Commissioner Plufka inquired about the dedicated area for PRELIMIWY, Pte/

Planning & Engineeringt representing the application. Mr.
Koprschke explained the location of Swan Lake and other ,
developments inthe a `e . He explained that :the land was
used agriculturally and that their topographic* grading and
drainage plans have, preserved the natural tee*rain andvege-
tation. He discussed the access and -road .layout, he noted
that Dutlot B is planned for parkland and Outlot A is desig-
nated for private open space; he explained that part of this
land is in the CUSA (City urban ServiceArea/Staged Growth
Area);, and,: that they are demonstrating gray, Ly flow sewer.

Mr. Xopischke stated that in reference to Condition Flo. 1
concerning lot coverage,,. they are proposing the PUD with
measures to preserve the natural features of the site and
ar requesting Z5% lot coverage for those smaller lots
located at the center of the development and at the south-
east corner. These lots were reviewed on a plan haat had
bon color ``coded. Regarding Condition ilo. 14t relative to
signage, they are proposing an "entry feature" rather than
an Area identification Sign defined b the Ordinance.
They feel the variance request is appropriate because of the
landscaping features proposed around the sign, and that ' it
will consist of brick construction for footings and il-
tars. It is their feeling that measurements should be only
for the sign lettering rather than the total structure which
yill exceed the Ordinance standards.
Commissioner Magnus inquired about the berming and screening
for Lot 11 and frontages for those lets that are above Larch
Lane. He Inquired if %arch Lane would be a major collector
with heavy traffic. City Engineer 'Goldberg stated t#tat
Larch Lane is a minor collector. Commissioner Magnus stated
tits concern that larch lane traffic may impact,these lots $o
that more than adequate screening should be provided. Mfr.

questing the variance and stated that other developments
have attractive entrance' signage which meets the Ordinance
standards, he Is concerned that this Variance request is for
three times what the Ordinance allows.
Chairman Steiqerwald opened the Public Hearing.
Chairman eigerwald introduced Mr. Ed McConville, 310 Larch
Mace. Mr. McConvillenville inqu red who would be assessed for
the improvements to this property. Charman Steigerwald
explained that the Planning Commission does not deal with
a se $Sment 1 and this is a question that should be offered
to the City Council. City Engineer Goldberg confirmed that
the i mprovemants will he the d vc.l.o er' responsibility.
Mr. McConville' rioted that the homeowner of the adjoining
corner lot may be impacted by the roadway design and may
have to change his driveway.

Commissioner Plufka inquired about the proO sions for storm
water runoff. City Engineer Goldberg confirmed that this
would be reviewed and any ,problems resolved when final, grad-

Chairman Steiqerwald stated that the developer is required
to submit grading and drainage plans that are reviewed, by
the Clay to see that there is compliance with and radherenoe
to erosion control and proper drainage. He stated that in
regard to concerns regarding lot size,, the developer is
given the design flexibility for a Planned Unit Development,
but the Planning Commission, and City Council Want to O:
that lot sizes are comparable to ad aoent and abutting

Development Concept Plan, Preliminary Plan/Plat, Rezonlngt

June 11, 1985.
Commissioner Plufka;, Chairman Steigerwald and Coordinator
McConn confirmed that the difference in the plan was only
the addition of the color coding,; (light green areas) $hvoly-
inc the smaller lot sizes and defining them from the periph-
ery lots.

Magnus, to amend Condit"ton No. 14 to, read. Variance from
the Ordinance standards for signage to install an :area
Identification Sign,of 64 sq. ft. (vs 32 sq. ft.) as calcu-
lated by the Ordinance provisions.

Commissioner Pauba stated Jt *is his opinion that the
developer should be provided: the options for additional lot
coverage succi as fU of 'the lots as has been, discussed and

Chairman Steigerwald stated that regarding Lots 2 through. 4
on Black 11 the U lot coverage should he retained.

Commissioner Wire ingu r d about the .increased selvage floe,
City Engineer Goldberg reviewed the sewage flow data noting
that there would be an zncr;ase for one sewer district
against a decrease in another sewer district balancing out
the capacity, andt that no trunk line extension is needed.

stated the Commission could direct that this be reflected on
the final graJing plans.

Chairman Steigerwald introduced Mr. Clifton Perkins who
stated he has read the staff report and will answer any
questions from the Commission. He re-emph,#si ed his request
for a sign.
Commissioner p`lufk« noted his concern with the Ordinance in
that it does not address location such as It this residence,
located on Highway 55. A sign here may be appropr dte,
whereas .at another location it would not be appropriate. He
stated, however, that to alloiv signage for this location

that proper planning for this area take Into consideration
that his property is now surrounded by development. H
wants to maintain his private and peaceful home site., lie=
requests that the staff recommendation which reflects the
City Council action be upheld. He stated that Mr. Myron has
not adequately addressed the issue except for the price he
wants for the property; and, that Mr. Myron should accept
the Council action or a fair and equitable amount for the
land.
Mr. Crathwr l stated that 1,e has not suggested that Mr. Myron
and fir, pribble are unreasonable people. The fact that
there is a private easement shows that an agreement is pos-
sible. However, at.this time, the City could approve aplat
which reflects the intent of right-of-way on the out3ot and
gives evidence of the City's intentions.
Chairman Steigerwald closed the Public Hearing.
Commission Wire rioted that generally there are no private
easements for access: to p heels that are landlocked by other
development. City Engineer Goldberg noted that generally Ir:
cases like this, there is no access at all so the: City must
provide they street.. Coordinator McConn confirmed that in
the case of a private easement the City has no ,right to use
it as a public roadway. Commissioner V*ire stated that as
Mr. Fribbl e has no immediate development plans, perhaps the
private., easement could always suffice such as in the case of
land near Black Oaks Lane.
Commissioner Plufka noted that there has been a Multitude of
meetings and much discussion, regarding this application,
however, this is a land planning matter and providing access
for all property is good planning. He stated that the staff
recommendation ,arced Council act'on should be upheld,:

Commissioner Wire} stated that he would like assurance that 85

Chairman Stelflerwald introduced lir. Don Jordan, representing
Trammell Crow Company. Hr. Gordan stated that the origindi
concep reflected a hotel/restaurant use for the property;
however, they Are requesting; the am(n n dent to continue the
uses now constructed (ffive sho'Wroom/warehous facilities)
within the Plymouth Business Center. He noted they are
sensitive to the concerns of the adjacent nolghborhdods and
want to continue the goad relationship,, He feels they have
constructed well designed buildings which they will carry
through into this phase of their development.
Coordinator McCona suggested that the regui,ding.and rezoning
should be oonditionali ed with the execution of the Develop-
ment Contract and filing, the Final Plot, such as with the
recent-appli.c:a*,i,on made for congree ate housing.
Commissioner Wire stated he is concernvd _ about transition

that he is in favor of the sane typo of buildings, but he i
concerned about transition to the residential neighbor-
hoods. Coordinator McCann explained the phased review for
PUD's noting the next phase will be for Preliminary Plat and
Conditional Use Permit which have more detailed plans ; re-
gardiiiq landscaping and transition. She advised that the
property owners will be notified of this meeting date.
f4s. Donna haus, 14130 40th Avenue North, stated that the
neighborhood agrees they would prefer a similar development
and would be opposed to a hotel site. She _ inquired if there*
would be a written tipula.inn that it would be developed as
proposed. She also is concerned that 40th avenue remain as
a cul-de-sac and that proper buffering and screening cue
installed at the end of 40th Avenue.

Chairman Steigerwald introduced the Ordinance Amendments ORDINANCE AWNUMENTS

Mr. David Akradi, 4601 West, 81st Street, stated that as rep-
resentata.vp for Nautilus Fitness Centers, Inc.,_ he had been
looking at property In Plymouth that has -1 Zoning. They
were interested an making application to construct a2 -story
building that would contain a Nautilus Fitness Center and
offices) however, the fitness center would neat be for just
the tenants of , that building. fie is roncern d that this
could not be allowed in Plymouth, where in other areas this
would be allowed by Conditional Use permit.
Comoissioner lire stated fie doesn't feel that Plymouth is
much different from surrounding communities; and, Coordin-

majority of communities of stoilar size and development
would not allow sports and fitness clubs in areas zoned for
office; use. Some communities, did allow the sports and fit-
ness centers In free standing buildings in the retail dis-
tricts by Conditional lyse Permit; and, some saw merit In
allowing this use in ether commercial districts rather than
pure office uses. However, it was rioted that most intended
this use for retail and service distracts $uoh as the B-
and B-3. She noted some allow the sports 4nd fitness
centers by, conditional use permit an the industrial zone $o

Mr. Arida reiterated that she sports and fatness club
should be allowed in the -1 District as it would be pri-
marily used by business people an the district.
Coordinator McCann reviewed the definition of the B-1Dis-
trict and the proposed definition which includes the para-
meters for a sports and fitness center, haat would be used
by the tenants and employees of the facility only, and would
not be marketed by membership 'to the public. She noted the
facilities' provided by Honeywell: and prudential that are
examples of Sports: and fitness facilities available to
employees only,

Mr. Akradi maintained that this Is not the sa e s as the -,e

that the clubs cater to businessmen haat that they do not
necessarily all come from the s*erne building.
Chairman t i.ge waled stated that their development of Ordin-
ance language comes From the fact that , these sports and fit-
ness, centers have become so popular. lie stated; they do not
look at Jost one particular development but the overall
planning and lend use. He stated that it is theCommis-
sion's feeing that this use would riot fit into the -1
classification as noted by the definition of the B-1 Zoning
District. €fie furtherr stated that fir. A rads had not given
adequate reasons why Plymouth should consider this b, Ines -
as appropriate for the -i District. fir. A rad! stated #1e
doesn't thine the City knows what they are eliminating, and
he doesn't see where the Nautilus Fitness Center as proposed
would not be appropriate for the -1 Zoning ` District.
Commissioner Magnus requested # an overviaw of Mr. A radi'
ba sin s. lir. Akrddl explained that the Nautilus is differ-
ent from RdCgar t and Tennis ` labs* that it is part of an
office building with workout equipment, pool, and analysis
of the proper type of fitness program for those visiting the
facility. He noted they do not sell products, but do pro-
vide analyses that include nutrition and exercise programs,,
Commissioner Plufka inquired if they were restricted' on
hours of operation, 14r. Akradi stated they operate 24
hours, 7 days a week, and noted that each person would visit
approximately two hours.
Commissioner Pluftca noted that the use as explained by Mr,,
Akradi is a retail use and would be more approprie -ly
located in the B -Z and B Zoning, Districts.
