Coordinator McConn stated that comments from the Department of Natural 'Resources: (ONIR) were received after publication of the reports, their response stated- the proposal complied with the Shoreland regulations.- Chairman Steiqerwald introduced Cary Gabriel., DeMars-Gabriel Surveyors, representing the petitioner. Larry, Kaa , 3'M Xenlum tune, inquired about :the rcadway and the City's regulation regarding the distance of right- of-way from his residence. He was concernedthat it was the required distance from his property line* Pyr., Gabriel stated that the road right-of-way was existent with the original owner of the land and the 30 ft, right-of- way was maintained for future roadway.When Petr. Cates pur- chased the land he sold two and one-half acres and retained the, 30 ft. roadway easement which is filed with Hennepin County. Coordinator McConn confirmed for Chairman teigerwald the right-of-way width and dist .-ce to the curb, furthi.cj she reviewed the yard setbacks for the R-2 Zoning District. Mr< aatz inquired about the elevation stating his house is on,I 1irstl and the property next to hitt is much lower. He if there would be a retaining wall on his side, Chairman t iger4ald explained that the retaining wall would be built to the City's specif oatinns and the City's Engine- ering Department vwoul,d work with the developer to see that the work is done according to regulations,, the retaining wall is to pe within the road right-of-way. Mr. Gabriel stated they would' follow existing grades with a t. reta.i:nino gall,' on both sides of the roadway. Mr. Gabriel confirmed that the wall would be approximately 1 ft. from the side of the residence, Mr. Kaatz stated that .his neighbors were also concerned about the grading oaf, Lots 17 - `19, and inquired about the drainage. fir. Gabriel stated that all ' grading would be accomplished 50 to 60 ft. south of the north Plat boundary. Chairman Steigerwald closed the Public Hearing. Chairman Steigerivald inquired about the soils report and stated` his concern about the condition of the soil.. Bill Engelhardt, consultant to the petitioner, stated that at ,the time of issuing building pere lts, the builder should be re- quired to submit a foundation design that would cover ar'y f)robl,ems. Howe -ver, t this time, he is not aware of the specific construction details. Commissioner lire inquired if the engineers would look at the soil conditiond In more detail at the time of construe - tion. City Engineer Goldberg stated that before the build Ing permit is issued, the builder would have to submit foundation designs prepared by a registered engineer page 1I°. City Eqqlneer Goldberg stated that -with the review of deed ;d pians, It may be necessary to do more soil borings and building "footprints" wl1 be reviewed by the Engineering Department. Coordinator l c onn confirmed that the City has asked for this type of Information With building permit applications for other development such as if), the case of the construction of the bank across from City Center where areis of poor soils requiredadditional soil testing. Coordinator McConn oonf,l.rmec,' for ' Commissioner Plufka that the rear yard setback is ,15 ft. in the R-2 Zoning District. Cowissioner p.lufka inquired about Lot 1 acid the square footage for a residence to be built.; Mr. Gabriel stated that the hom, would be approximately 1200 sq. ft. 'Including the g.!r,.. o. Commissloner, lofka, noted that the size 01the footprint will limit the style of the home. Commissioner Wire Inquired about the selection of lots for the sola borings, he stated he had visited the $Ate and wondered why borings, were taken only from the Lots on the reek. Mr. Zeuthen provided the background for the applications and explained that this dev- elopment Is part of a teary effort to provide a development that Nvi ll not stress the site.. Lane and they will service the Williams Addition with utili.tles. He stated that they may tape the option of the City construct - Ing Olive Lane and assessing the developer. He, noted they have tried to meet with the principals= of "Red l" but they were unavailable. They feel Red Owl should be assessed for their portion of the roadway. Chairman Stei ,r old stated that the City Council woui,d address this at the -Lime they consider the application. Mr. LeRoy Polley, 17720 13th Avenue North, stated he under- stands this area will be developed, but he wants the devel- oper to pcvad buffering and screening for the evo, stent.. Mr' Zedthen:stated they will have plantings rather than h rmi ng— that they do not want to di. tur!) the natural terrain but wilt clean out the scrub brush. fid stated they would grade out 50 ft. from the building, but would not dis- turb the natural vegetation beyond that point. There ;was further discussion on just how much natural vege- tation would remain' and it was estimateded that approximately 90 ft. would be retained on the south boundary Mr. Polley noted that when he, and his wife visit friends in ars apartment complex with recreational amenities, they hear, excessive noise from the pool and tennis court iirea. He inquired whether the City would regulate the hours that people could use these facilities. Chairman Steigerwald confirmed there would be no lighting of the pool or tennis court which would tend to curtail .late evening use. Mr. Polley staged that the meniti.e he spoke of had no lighting either, but this did not seem to cuter people From using the facilities late :into the evening. She noted that the luminalre plan shows no light spilling out beyond the pool and tennis; courts. Chairman Steigerwald suggested that they could add a condition to limit the hours. Mr. Bill Williams, 1325 penny .ane$ stated he had met with 3ack Schuett and that Mr. Schuett understands the concerts of these who live In the mature residential nirghborhoocs that abut this property. He stated that the construction Of tennis -courts would be an invasion of their privacy. Mr. Williams suggested the developer plant pine trees on that side to give more permanent screen- ing all year long. He noted that the pool is 57 feet from his property lire and he is concerned about the n lz% e and his loss of privacy* Commissioner Plufka stated his concern about the area close to the pond which could give access to the tenants of the development, who may be unaware that they are trespassing pato private property. ter. lilliams stated he agrees with this concern. Mr. Zedthen stated they plan no access to the pond$ and he Is aware of what land is 'privately held. Coordinator McConn noted that the Site Plan is based on a survey current within six months so that all boundaries and elevations are as , exist today. She noted that the City's 100 -Fear High Water Elevation is 978 of this pond. Chairman Stelgerwald stated he concurs with Mr. Williams that the residents may not tresspass on purpose, but the corner could be used by those seeking access to the pond, Mr. Zeuthen stated that the plans do not create an invitation to the residents to trespass pato private land. He rioted that this area is very marshy and not attractive or inviting to anyonewishing to walk to the pond. Page I IOr Planning Commission Hinut s May , 1985 Mr. Williams stated that he had offered to buy this .hand s that It would not be used but was told It was not for sale. He stated that ttie homeowners around- the pond enjoy the wildlife, they toe skate In winter and swim to the sLpniller. However, the pond has deteriorated In the last ten years showinq Increased geed growth that has been caused by run- off. He is very concerned that: additional parking areas would drain into the pond, adding more chemicals and oil residue. Engineer Goldberg stated that a permit must be granted from the Watershed Distract and they would require that most of the runoff he directed to the storm serer and catch` isms. He stated there is a tributary to the pond and ,a filtration system will be needed tG trap the ci l and chemicals.CO- ordinator McConn explained that subsequent to _City Council consideration all necessary permits must be issued and made part of the record of this development.. Mr. Williams reiterated his concern about the viability of the pond and read a letter stating the concerns his nel: h- bors, ter. and Mrs. Noel Davis of Ranier Lane, and was made a part of these Minutes by reference. Mr. Dick Williams 1315 Peony LaneI stated he has the same icancerns and that the residents have had to deal witn broke-"- promises roken promises f om other developers. He stated that screening should be provided ;all the way to 15th Avenue, He stated the plan shows approximately 37 1/2 sq ft. of access to the pond and there should be no access to the, ,nand from this development. He is concerned about the density`, and stated that 143 a its would be preferable to the 153 propo ed. He is also concerned that tn, building exceeds the height regu- lation with the gabled roof design.. Mr. Zeuthen stated they have proposed a residential design for their building and that the roof 'form helps reduce the see, of the building. He stated that the flat roof is very institutional in appearance.. 1r. filen wainy 1 015 County Road t stated has concern about the quality of Pine Tree Pond, and that he and the residents are fighting to save It 4e built his home 30 years ago and has patched the pond go downhill He is con- cerned that the City has not offered to help. He told the Commission that he has a 1938 survey prepared when his father-in-law bought his property which does not show the pond on the subject land. Chair- man t igerwald advised that this should he made known to the City Counc:i.l, at the time they consider this development proposal. Mr. Kurt Hellberg, 1420 Ranier Lane, stat -, 14 his property is utfh of Mr. Mitchell (Mj.Swain's fatter -in-law) and across from the Williams. He stated his concern about the height of the building and the ; density* ,and, that the height variance should not be granted. Coordinator McP nn explain- ed that, in the RZoning District the height regulation is a maximum of 35 ft. or 3 -stories.. She stated tt:at the Building Divisionisi.on ha reviewed the proposed 1aui.ldi.ntl plans and that a height variance is net needed., Mr. Zeuthen stated he had sought a variance from the height restriction for the gables. Coordinator McCann reiterated that the proposed buil-din height s within the -story requirement.. Mr. Hellherg stated he is still concerned about the building height and would like .it reduced, he approves of the design if they would lover the roof. Pyr. poltey stated he has wormed in construction and that the gables could be lowered a pew feet. He stated that relative to the _ request for ` pine trees on the south side of the property he requests the tree line be extended to screen his property. RECESS Chairman Steigerwald stated 'that the Council previously granted approval for 213 units for this prope ;ty and this developer proposes 153 units. He suggested that those who are concerned about the density make it known to the Councit that they want to see fewer units. He stated that the points of concern are that tenants of ,this development may unknowingly trespass on private property to gain access to the pond; and, that there be adequate screening of the development. Commissioner Plufka gent on to say that he knows the teoh- nolo y exists today to solve these types of problems and that the Watershed District may require it. City Engineer Goldberg stated that this can be worked out with the Watershed Distrlet, and suggested the use of baffles. Commissioner Mellen noted that the requirement for chain lank fence may be detrimental to the church property. Com- missioner Magnus concurred stating that a 6 -ft. fence is tOO high and would be an eyesore, he could support a -ft. fence of different construction. MOTION by Commissioner Magnus, seconded by Commissioner Wire OTION TO AMEND to amend. Condition No. 10 to read -ft. fence, on the vest and snub sides of the property . Commissioner plufka asked for a, clarification and it was noted that the _ fence would be to the 978 elevation on the west side. Mr. Zeuthen started he had no problem with the amendment, except with the fencing, and inquired what the neighbors want ars, grad the property. Mr. Bill Williams stated that he would be concerned about a chain link fence which could restrict the movements of the wildlife in the area: He suq ested split rail or something showing the intent of delineating the boundary.. He also suggested that pine trees be implemented in this area. Mr. Polley reiterated haat he wants pine trees planted to shield his property; He concurred that fencing would restrict the movement of wildlife in the area and he would like, to see trees rather then fencing. Mr., Zeuthen also noted that the pane trees may not fit into the natural scheme of vegetation around the pond.
