He expects a response from the attorneys in the next few days. In reponse to Commissioner Plufka, Mr. Smith identified the location of the right-of-way to be Vacated on the proposed plat. Chairwoman Vasiliou opened and iulosed the Public Hearing as there was no one present to speak on the item. Commissioner Pauba confirmed that condition ;number 11 in the draft Resolution appropriately addressed the proposed right- of-way vacation. MOTION by Commissioner Pauba, seconded by Commissioner. Planning Commission Minutes August 22,, 1984 Chairwoman Vasi.liou introducot the request submitted by ROOMT MIDDLEMIST Robert Middlemist for Rezonir i, and Preliminary Plat forREZOHI"GAND property located northeast of Wiest Medicine Lake Drive and PRELIMINARY FLAT 4th Avenue North. She _;introduced Mr. Xiddlemistj,, who in 052 turn recognized Mr. Calvin Hedlund, consulting engineer. Mr. Hedlund provided the Commission with a summary of the application including the rezoning request ' from R-1A District to R-1B District.. He discussed the proposed loot sizes and compared them to the adjoining properties, Mr. Hedlund reviewed` a cross section diagramming the topography of the site. Commissioner Plrufka' confirmed that the crass section graphic was not drawn to scale. Chairwoman Vasi.li.ou opened the Public Hearing. Edward Ilhtyre 12615 <46th Avenue North, requested a response to several questions including why an access would not be provided to Hanel Road. Mr. McIntyre expressed con- cern., that creating additional lots for development may cause the area to develop at a dower p?)ue, If there ars: many ether parcels in the City whish are vacant. He stated his lot isa!tacent to the existing ponds and requested confirmation .hat there would not be a negative impact on his property. he questioned why the zoning of the property should he charged to achieve smaller lots, and requested: a cl,,,,)rlfication on the availability of utili.tie;°. Planning Dxk:e<tor Tremere responded with respect to the ac- cess to Ramal Road, rioting that the roadway is classified as a minor arterial which would have a higher inten sty of use. He also explained that 48th' Avenue North was `ale s intended to be extended, ,and that 49th Avenue North offers an alternative circulation route Assistant City Engineer Sweeney explained that a preliminary engineering report has been ordered, and is being prepared with respect to the ponding inthis overall area. He explained that until the study is completed, no further development; in this: area would be permitted. Reference was made to the ngioeer's Memorandum which states that no final plat shall'be processed until the engineering report is or}mpletcd Mr Aiddlemist explained that he was aware of the study, and requested that the city complete the engineering report expeditiously. Commissioner Pauha Inquired who would construct the homes. Mr. King provided a summary of the proposed application and noted that the intent is to consolidate the administrative functions into one facility, explaining that the Clifton E. French Regional Park was most ,centrally located, Chairwoman Vasiliou opened the Public Hearing recognizing Arlene'3ohnson, 3535, Rosewood Lane, who, expressed concern that she did not receive a Public Hearing Notice on the prow- po ed application. It was her opi ion, that someone g ad bungled tfie preparation of the Notice". She'stated that she bought her >home in this area considering the rural nature and location of the Regional Para. She expressed concern that new she lives near a four -lane highway and a proposed r offic cc mple c Ms. Johnson asked questions with respect ° to the overall development of the Regional Park. Community Development C .o dioator McConn, responded that lighting was eonsidered, but iteras not thought the parking lot lighting would have an impact on adjacent properties. Scott MoDonaldt architect, stated the lighting would be low key, and would not intrude on surrounding properties. Cori.sslone dire inquired if the Bark Reserveiii stri ct would make ' a commitment to no further expansion of this fa pity, as a cenditi.on of approval.. Mfr. Henry stated that the t.urrent program aloes not include any expansion, but he would have ` to confirm agreement to such a condition of ap roval, with the Board of Commissioners and Superintendent. Bon Xingo expressed concern with the recommended condi:taona of the Engineer's Memorandum, numbers 6 and 7, which require easements around the property lines, and for ponding purposes. Be questioned the purpose of the easements, and requested a waiver of the requirement. Assistant City Engineer, Sweeney enplaned that the easements were necessary, especially for the ponding areas, and along the roadway. This should be considered by the City Council.. Commissioner Stelgerwald commented that he strongly recommended the City Council 'consider determining that the development of the property should be contingent upon the completion of new County Road 9. Commissioner Wire and. Chairwoman Vasil i.ou concurred. MOTION by Commissioner Wire to Amend the Main Notion to add NOTIOO TO AHM condition number 9 to state, "`there shall not be any . further FAILED expansion of the facility". The Motion failed for lack of second. Chairwoman Vasiliou commented that she dial .not feel the proposed amendment was realistic. Co ,ism r*rner Plufka stated that he thought such landscaping wn-:lo be a gesture of good faith to the contiguous areas, in demonstratinrq a desire to, restore and reforest the wetland area. Commissioner Stulberg questioned whether that would apply to the specific proposal being considered. Commissioner Wire concurred with the amendment, in that the property appears to not belong to anyone, and installing laadscaping would assist in integrating it .into the park. Rol Call Vota. Cominissi,oner Steigerwald and Chairwoman Vasiliou concurred. The Planning Commission discussed the development of the property with respect to traffic on County Road. 9. Chairwoman Vasiliou introduced the request submitted by Mr. MICHAEL LEUER Michael Leuer for, a preliminary plat and final plat for PRELIMINARY FLAT Greentree West 2nd Addition. Mr. Marof"sky explained that when the petitioner purchased the property, he told the neighbors of his possible future intent to subdivide the property- The neighbors were not pleased with that possibility, and therefore, proposed to purchase a portion of the property.
