Planninq Director Tremere stated that, if the petitioner
identifies 'which models will require the reduced setbacks,
and If the proposal is approved by to the Planning Commis-
sion and C#9unci.l, staff can more readily administer the set-
backs, as permits are ,issued. Also, Planning Director
Tremere discussed. the appropriate platting methods for the
private open space abutting Living Area C-'.

The Vicksburg West Property, subject to the conditions and
requirements as reflected in the ` draft Resolution, < noting
that the building setbacks 4hall be as proposed and,: that a
deck on models 220 and 3103 may encroach 3 ft., into the re-
quired 9 ft side yard setback in those cases where the deck
would be located opposite a substantial solid ,wall on the
neighboring house. Staff clarified that sign plans could
be reviewed with the final plat and conditions' of approval
would be the same as those for the Fox Rust signage. Vote. VOTE NOTION CARRIED
Ayes; MOTION carried.

Lloyd Muehlbauer, 13035 3$th Avenue North, inquired why Area
A should be rezoned From _1'8 to R-2. Planning Director
Tremer explained that the LA - Guide Plan Clssi iea ion,
does not include development of the N-18 District, but does
contemplate utilizat,ca of the Zoning District.

Chairwoman Vasilinu closed the public hearing.
MOTION by Com Assioner Pl f a, seconded by Commissioner
Steigerwald to take action on this petition. Vote 5 Ayes.
MOTION carried.
NOTION by Commissioner Plufka a seconded ; by Cotmissioner RECO DATION
Steigerwal.d to recd mend approval of the rezoning of Area A
from R-1B to R-2; and the rezoning of Area B from FRD to
R"I .. Vote 5 Ayes.. MOTION carried. VOTE - MOTION CARRIED
