Director Tremere summarized the proposal Identifyina that

Director Tremere explained that the City Council has ao--

confirmed that. the "No !>ar%ingll signs had been installed.

neighborhood observation that the par i.na problem was due to

judgment until the proposed Site Flan Amendment and Vdriance
application was forwarded for their deliberation
Vice Chairman Stei erwold recocini en Mr. L.W. Samuelson,
Arehitept, and Dr. Hundor who stated they would answer
questions. Vice Chairman Stellaerwald explained that a
oral public hearing was not required for this Application,
but comments from the audience woUd be allowed.

being told that there would not he more than 5 or 6 ears at

did not have a personal problem with the proposal, but thero
might be one with other neighbors He urged the Pl?annin
Commission to carefully consider the land use.
Mr. Doini.nger stated them was some indication that :x dance

such a land use would he permitted in a professional
buildiinq. He expressed concern about the potential future
land uses which could locate in the stru.;+ur .

Mr. Samuelson explained that the propose$ addition was to -b

which could specifically be used for the employees so that
the existing Par ino area would, be assailable for the

room ,left on the site for future addition$*

would be provided from the entrancelexit to the general

Vice Chairman Steigerwal.d inquired as to the maximum number
of employees. Dr. Hunner responded there would he a maximum
of -15 employees.
Viol Chairman Steigerwald attempted to account for the
potential number of cars in the lot at one tim , estimatino
that approximately spaces could be utilized ddri:na normal
business hours.
Commissioner Wire inquired as to who could he utili.z na the
building early in the mornina and late in the ev ninct. Or.
iiuc der stated that a, lab technician arrives early in the
mornin 7 however, the general office hours start at :00
A, It would not he uncommon for employees to arrive at
approximately, :3 A.R.
Marian Deini ger 1100 Everqreen Lane,` explained that she
arriec, the petition for the "No, Par i.no" ;signs on the east
side of Evert ,reen lane. the explained that she could have
gotten more ' lan tures, however, it was too cold for her to

She was concerned about traffic circulation tryino to get
from Goldenrod lane to Highway 55 as they,utilized Fvercrccn
Late. The intersection of Evergreen Lane and Highway 55 has
been a point of mnoe tion. Sh,e expresser) that a visitor to
the nel9hbcrhu.)d might not be familiar with the traffic
circulation. -She stated that while she supports free
enterprisef it should not be provided to th- businessman at
the expense of the residents. ,.
Ms Deininger hoped that the elevation of the beret would not
change if the addition is, approved.. $he requested that the
people who live la the area on ,a -hour basis receive
strong consideration.' '.ice Chairman 5teigerwald;stated that
the City is also concerned about the overall' traffic.
Commissioner Paba requested that staff explain why the
first addition proposed in 1979 was denied, and why later
larger addition in 1979 was approved.,
Director Tremes explained that the initial proposed
addition in 1979 required consideration of several variances
in order to locate the :building addition in the eastern
portion of the site. The City' Council denied that proposal
and directed Dr* Hunder to redesl,on to eliminate the
variances. This was Noone,- and the Council then approved an
expansion.
Vise Chairman Steiqervitald inquired if the City has Qlve A any
consideration to improve the area. circulation. Director
r mere explained that if it is determined there are
problems in the area,:. they can b investioated throuch the
Minnesota Department of Transportat'con (Mnbot) and the
City.. He stated that he dial not think the clinic users are
solely responsible for traffic, giro lation through the
neighborhood.,

increased alot, especially in speed, and that. the traffic
which has missed the 'turn for Evergreen tune from Highway 5
turns onto Coldenrod and circulates back to, the clinic; She
stated she is opposed to the buildinq addition, and she
f$llls the neighbors have put ; u with this land use since

MOTION bynCommissioner pauba, seconded by Commissioner Wire MOTION TO DENY
to reoommianu denial of the proposed Site plan Amendment and
Variances based upon ` f1 3,n q, that compliance with the
Variance Criteria has not been demonstrated,. and the
petition is matter of mere, in onvenie. -e to the owner and
represents a potential for additional tenants.
CommIssioner p,lufka stated he; felt the rectuested variances
dig tint directly relate to the proposed tiz . The b ildina
setback request was the same as the ori final Isuildinc , and
the drive aisle width would' allow for additloaal park .nq
which is logical.
Commissioner Wii,e stated that the obJe-tion to the addition
YAS that in 1969 it was intended to allow a small clinic
which has now gone beyond than: description. He thought that.
in 1979 the > City drew :, line as tc any more addit.ioas.
Commissioner Ma us; stated he agreed with Commissioner
Plljfka, that the variances would not be detrimental., and
that a parking addition would be more beneficial in the lona
run.
Commissioner Pluf ka stated that he Felt there was benefit in
providing a solution to the off-street paarki.na situation,
that 'changes could be made in the lighti.ng direction, and
that some, of the circulation concerns could be ititproved.
Also, he stated that if the petitioner is serious about the
proposal, thought should be given to assurances with respect
to the hours of operation and employee para int... He
expressed concern about the need for a tura around at the
ion theasFt corner parking ara,4 He suggested deferring the
I tem with direction to the petitioner.
Commissioner Pemba stated that he felt, the internal space
problems could be eli.mi. aced if the accountant and dance
studio information storage were not in the building.
Vice Chairman -Stetgervald suqpested that denyincs the 200
sq ft. addition would not address the other concerns
expressed.
Commissioner Pauba reaffirmed his statement that he could
not support the proposal with variances.
