HomeMy WebLinkAboutCity Council Ordinance 1997-22CITY OF PLYMOUTH ORDINANCE NO. 97-22 AN ORDINANCE AMENDING CHAPTER 21 OF THE CITY CODE TO CLASSIFY CERTAIN LANDS LOCATED SOUTHEAST OF THE INTERSECTION OF HIGHWAY 55 AND COUNTY ROAD 24 (96193) THE CITY OF PLYMOUTH ORDAINS: Section 1. Amendment of City Code. Chapter 21 of the City Code of the City of Plymouth, Minnesota, adopted December 18, 1996 as amended, is hereby amended by changing the classification on the City of Plymouth Zoning Map from FRD (Future Restricted Development) to PUD (Planned Unit Development) with respect to the hereinafter described property: That part of State Highway No. 55 as dedicated in said plat of DUNKIRK MEADOWS lying southerly of Line "A" as described and shown on the plat of DUNKIRK, MEADOWS, Hennepin County, Minnesota and lying westerly of the west line of Outlot A and its northerly extension, as platted in said DUNKIRK MEADOWS. Those parts of the Northeast Quarter and the Northwest Quarter of Section 20, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Commencing on the West line of said Northeast Quarter distant 1535.79 feet South from the Northwest corner thereof, said West line is assumed to bear South 01 degrees 03 minutes 19 seconds East; thence North 88 degrees 56 minutes 41 seconds East at a right angle 33.00 feet to the East line of Dunkirk Lane as dedicated in the plat of Dunkirk meadows being the point of beginning of the tract to be described; thence continuing North 88 degrees 56 minutes 41 seconds East on the same line extended easterly a distance of 296.12 feet; thence North 12 degrees 08 minutes 44 seconds East a distance of 763.16 feet to the Southwesterly line of State Highway 55 as platted in Dunkirk Meadows, said southwesterly line is also known as Line "A: on said plat; thence northwesterly along said southwesterly line of Highway 55 and said Line "A: to a point 100 feet southeasterly of its intersection with a line running parallel with and distant 33 feet East of said West line of the Northeast Quarter of Section 20, and 33 feet being measured at right angles to said West line of the Northeast Quarter; thence southwesterly along the southwesterly line of Highway 55 as platted in Dunkirk Meadows to the East line of county Road No. 24, Hennepin County Highway Plat No. 4, according tot he recorded plat thereof; thence Southerly and Southwesterly along said East line to its intersection with the Northeasterly line of said County Road No. 24, Hennepin County Highway plat No. 4; thence Southeasterly and Southerly along said Northeasterly line and along the East line of Dunkirk Lane as platted in Dunkirk Meadows to the point of beginning, according to the United States Government Survey thereof and situate in Hennepin County, Minnesota; except Outlot D, Dunkirk meadows, according to the plat thereof on file or of record in the office of the Registrar of Title sin and for said County. Together with those parts of vacated County Road No. 24 per Document No. 6755196, and Doc. No. 6819686, and vacated Dunkirk Lane per Document No. 6755195 and Doc. No. 6819686 accruing to said property. Outlot D, Dunkirk Meadows, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. That part of vacated Dunkirk Lane and vacated County Hwy. No. 24, as dedicated in the plat Dunkirk Meadows, adjoining Outlot D in said plat and embraced within Hennepin County Highway Plat No. 4, document number 969123, files of the Registrar of Titles. That part of vacated Dunkirk Lane, as dedicated in Dunkirk Meadows, not included in Hennepin County Highway Plat No. 4, Document No. 969123, files of the Registrar of Titles, which lies northerly of the easterly extension of the south line of Lot 1, Block 6, Seven Ponds Second Addition. Section 2. Amendment of City Code. Chapter 21 of the City Code of the City of Plymouth, Minnesota, adopted December 18, 1996 as amended, is hereby amended to add Section 21655.16 for PUD 91-1 (Plymouth Station), as follows: 21655.16 PUD 91-1 (PLYMOUTH STATION FOR LOT 1, BLOCK 1 AND OUTLOT A PLYMOUTH STATION ADDITION Subd. 1. Legal Description. The property affected by the PUD Amendment is legally described as: Outlot G, SEVEN PONDS SECOND ADDITION, Hennepin County, Minnesota together with that part of vacated County Road No. 24 per Doc. No. 6755196 accruing to said property and together with That part of the North Half of the 66 foot wide vacated Medina Road per Doc. No. 2550687 as originally platted in SEVEN PONDS SECOND ADDITION, Hennepin County, Minnesota lying easterly of a line described as beginning at the most easterly corner of Outlot H, said SEVEN PONDS SECOND ADDITION; thence southerly perpendicular with the south line of said Outlot H to the center line of Medina Road and there terminating and lying westerly of the southwesterly continuation of the southeasterly line of Outlot G said SEVEN PONDS SECOND ADDITION. Outlot B, Seven Ponds Second Addition, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. That part of the South half of vacated Medina Road, as dedicated in the plat of Seven Ponds Second Addition and delineated within a strip 66 feet in width adjoining Outlots B and G, in said plat, which lies between the Southwesterly continuation of the Southeasterly line of Outlot G, in said plat and a line drawn Northeasterly perpendicular to the Northeasterly line of Block 5 in said plat, from the most Easterly corner of said Block 5. That part of vacated County Road No. 24, as dedicated in the plat of SEVEN PONDS SECOND ADDITION adjoining the southeasterly line of Outlot B, in said plat and lying northwesterly of the Survey Line as delineated on Hennepin County Highway Plat No. 4. Document number 969123, files of the Registrar of Titles, which lies between a line drawn southerly at right angles to the most southerly segment of the southeasterly line of Block 5, in said plat and passing through the most southerly corner of said Outlot B, and a line described as beginning at the most easterly corner of said Outlot B; thence southeasterly along the southeasterly extension of the northeasterly line of said Outlot B a distance of 85.74 feet, more or less, to a point of curvature on the southerly right-of-way line of Medina Road, as delineated on said plat; thence southeasterly along a tangential curve to the right having a radius of 377.23 feet to the Southwesterly continuation of the Easterly line of Outlot G. in said plot; thence Northeasterly along said Southwesterly continuation to the Westerly continuation of the Northerly line of Dunkirk Lane, as dedicated in said plat; thence Easterly along said Westerly continuation tosaid Survey Line and there terminating. Lot 1, Block 6. Seven Ponds Second Addition, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. That part of vacated Dunkirk Lane, as dedicated in the plat SEVEN PONDS SECOND ADDITION embraced within Hennepin County Highway Plat No.4, document number 969123, files of the Registrar of Titles lying southeasterly of the Survey Line as delineated on said Hennepin County Highway Plat No. 4, together with that part of vacated County Road No. 24, as dedicated in said plat of SEVEN PONDS SECOND ADDITION adjoining the north westerly line of Block 6, in said plat lying southeasterly of said Survey Line, which lies northeasterly of the northerly right-of-way line of Medina Road, as delineated on said plat of SEVCEN PONDS SECOND ADDITION between the most southerly corner of Block 5, in said plat and the most westerly corner of said Block 6. That part of vacated Dunkirk Lane, as dedicated in Seven Ponds Second Addition, not included in Hennepin County Highway Plat No. 4, document number 939123 files of the Registrar of Titles, which lies northerly of the easterly extension of the south line of Lot 1, Block 6, in said addition. Minnesota Highway No. 55 as platted in SEVEN PONDS SECOND ADDITION, Hennepin County, Minnesota, together with that part of vacated County Road No. 24 per Document No. 6755196 accruing to said property. That part of State Highway No. 55 as dedicated in said plat of DUNKIRK MEADOWS lying southerly of Line "A" as described and shown on the plat of DUNKIRK, MEADOWS, Hennepin County, Minnesota and lying westerly of the west line of Outlot A and its northerly extension, as platted in said DUNKIRK MEADOWS. Together with those parts of vacated County Road No. 24 per Document No. 6755196, and Doc. No. 6819686, and vacated Dunkirk Lane per Document No. 6755195 and Doc. No. 6819686 accruing to said property. And that Robbins Partnership, a Minnesota General Partnership, fee owner of the following described property situated in the State of Minnesota, County of Hennepin, to wit: Lot 1, Block 5, Seven Ponds Second Addition, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. That part of the South half of vacated Medina Road, as dedicated in the plat of Seven Ponds Second Addition, adjoining the Northeasterly line of Block 5, in said plat, which lies between the northeasterly continuation of the Northwesterly line of said Block 5 and a line drawn Northeasterly perpendicular to said Northeasterly line, from the most Easterly corner of said Block 5. That part of vacated County Road No. 24, as dedicated in the plat of SEVEN PONDS SECOND ADDITION adjoining the Southeasterly line of Block 5, in said plat and lying Northwesterly of the Survey Line as delineated on Hennepin County Highway Plat No. 4, Document No. 969123, files of the Registrar of Titles, which lies between the Northerly right-of-way line of Medina Road, as delineated on said plat of SEVEN PONDS SECOND ADDITION between the most Southerly corner of Block 5 and the most Westerly corner of Block 6, and a line drawn Southerly at right angles to the most Southerly segment of said Southeasterly line of Block 5 and passing through the most Southerly corner of Outlot B, all in said plat. Outlot H, SEVEN PONDS SECOND ADDITION, Hennepin County, Minnesota together with That part of the north Half of the 66 foot wide vacated Medina Road per Doc. No. 2550687 as originally platted in SEVEN PONDS SECOND ADDITION, Hennepin County, Minnesota lying easterly of the southwesterly extension of the northwesterly line of Outlot H, SEVEN PONDS SECOND ADDITION and lying westerly of a line described as beginning at the most easterly corner of said Outlot H; thence southerly perpendicular with the south line of said Outlot H to said center line of Medina Road and there terminating. And that the City of Plymouth, a Minnesota Municipal Corporation, fee owner of the following described property situated in the State of Minnesota, County of Hennepin, to wit: Outlot D, Dunkirk Meadows, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. That part of vacated Dunkirk Lane and vacated County Hwy. No. 24, as dedicated in the plat Dunkirk Meadows, adjoining Outlot D in said plat and embraced within Hennepin County Highway Plat No. 4, document number 969123, files of the Registrar of Titles. That part of vacated Dunkirk Lane, as dedicated in Dunkirk Meadows, not included in Hennepin County Highway Plat No. 4, Document No. 969123, files of the Registrar of Titles, which lies northerly of the easterly extension of the south line of Lot 1, Block 6, Seven Ponds Second Addition. Subd. 2: Incorporated herein by reference are the Plymouth Station plans received by the City on August 1, 1997 and August 5, 1997, except as amended by City Council Resolution 97-, on file in the Office of the Zoning Administrator under File 96193. Subd. 3. Allowable Uses. The allowable uses are any permitted, accessory, conditional or interim uses allowed in the C-1 and C-2 Zoning Districts and a grocery superstore not exceeding 65,000 square feet. In addition, the following uses shall be permitted in the PUD provided they do not exceed 10,000 square feet in building area on an individual basis: 1) appliance and electronic stores; 2) auto repair -minor; 3) book, office supply, and stationary stores; 4) car wash accessory to a convenience grocery market with motor fuel sales; 5) convenience restaurant with drive-through service; 6) fabric/notions stores; 7) free-standing restaurant with liquor service; 8) jewelry stores; 9) music stores and 10) toy stores. All the uses listed above shall be considered as "permitted" uses in the PUD, provided they comply with all development standards and conditions for such uses under the most restrictive corresponding conventional zoning district. Subd. 4: Development Standards. Minimum development standards shall be as indicated on the approved PUD General Plan Amendment as cited in Subd. 2 above. Section 3. Effective Date.
