Chairwoman Vasillou inquired of the Petitioner whether mar-
keting studies had been done for the Proposed hotel site.
Mr. James 3ohnston, 'representing Charlton Comnanl s stated
they have had,a, consultant prepare a study because it was
their opinion that the. next trsurg 'c of qrowth will be In ' the
north"est. rn Suburbs, and they feel that alonq with their
proposal for the regional headquarters faei;li.ty., it would he
an excellent site for a quallty hotel- he added there is a
second study underway at this time. Mr. Johnston introdtioed 1CepGepeErnst, Ernst and Associates. and qtr. Jim Fillippi,
their consulting -civil ' engi`neer r. 3ohnston ` farther
stated that Charlton Companies wants to create a Oliallty
project for the company and for the City of Plymouth at till'
qatewdy location.
Mr. Ernst pointed ouL the lunation 'of the site, and exp lain-
ed the "CMPUS Concept" 'with the existing corporate hul.ld-
inq. stated their Plans will reduce the amount of

Chairwoman ' a i.l.,lou inquired about the changes to the inter-
section at Hlqaway 55. Stoff stated that the Cit;v is

upgrading that Intersection.

Mr. Johnston stated they anticipate Completlnq a traff=ic

3HarryCarlson, stated his business is located on CountyRoad
1A and he Is interested, because from the plan, it looks as
though the hotel is proposed to go on his property.
Staff stated it Is Important for the v titloner to show the
pirate possible uses whichinclude the blanni,nct for the
area and the hotel4, but; specific site alanni.nq for adjacentnt
sites will take'; place after other land is 'reouided, zoned,
and proposed for actual development. Only .land now owned
by the petitioner is proposed for rectoi inn at this time.
Commissioner Pauba stated his concern;' that the sewer oap„
achy is a sionificaht problem, Staff stated that stud d
analysis of. sewer capacities will be completed before so ca_
if icy development clans take shape and the decision will be
made whether there should be any "trimming" of tt t prDoosed
plans and whetherthe dev to m ni as pronos d is feasible..
Comr issloner Wire inquired wheth r the "'finger of land"
described in the- staff report as the adjacent industrial
properties, is Included in those plans.
Staff stated it is not included in the retiuidlno proposal at
this time, but staff recommends hearings to determine
whether those properties,should also be re ufided
Mr. Johnston stated they are aware of the seer capacity
problem and th it engineer believes :the City's analysis
gives a conservative estimate regarding the increase in
flow. fie' expal fined the development will be constructed
over a period of ten years and they will. work with the City
regarding the determination of seer capacity problems.
Chairwoman VasIllou asked about the staging process for the
project and Mr. 3ohnston stated they are now planning for
completing the municipal procedures for the requidino and
concept plane approval this year, and will also be taking

market" which exists: now. There is also the Issue of the,
adjacent properties and this wi it all have to be resolved
before any final plans are submitted,.
Mir. Harry Carlso , stated his neighbor, _lir. Dick Borden owns
the Circuit; Science B il,dinq on County Road Iii and they

Mr. Carlson was advised by the Commission to contact the

Mr. 3ames Johnston stated that he is concerned that the
amendment to the motion may be rtstrictive to both the
petitioner and the City EnqIneer In analyzinq the estimated
sewer, flow from the project._ He does riot feel the
increase estimated by the City Consultant should be ,least in
Bement" and that it rs his feelinq that this nercentaqe
will be found to t much less.
Commissioner Wire stated that the project should meet the
current requirements and not exceed the sewer capacity
established fo- this area. 5t of f st ated the s will be
studied by the Enqineering, Department.

County Adult Correction Facility. Staff reviewed the March RENNET% COUNTY
9 memorandum. ADULT CORRECTIONAL
Commissioner Stulberq stated it is his cpl.nl.nn that the

facility should be considered a non-conforminq use.
Staff cited than the City Attorney's letter in response t
Commission questions stated that classifyinq the facility as
a non -con orminq use was not an effective aoproach. It Is
likely that the'County could challenge that in court: and it
is probable tViit the court would uphold the County. The

porated-in the Zoning Ordinance.
Staff advised that if the facility is classified a non-
conforming use, -.1t can. -lot be expanded on, nor enlarged, and
variances cannot be granted..
The Commission stated this is their Intention. Commissionen,
Wire stated that It should be added as another Subdivision
in .Section 12, of the Zoning Ordinance to spell. ow; "cor-
rectional Institutions" as discussed, providing that there
shallbe no Increase of operations) or expansion to the
facility which 'Will In turn control and .unit the number of
inmates In the facility.
Commissioner St l,herq stated that from a planninq standpoint
this facility should he considered a non-conforminq use,
The Commission dlscuised that further refining of the ianq_
ua e should be attuned to the fact that they do not grant to
affect the regulations set out for such treatment facilities
as detoxifieation,, drug rehabilitation., and facilities for
battered women.

After further discussion the Co-gaK, rss'Lon addressed the two
Points of direction from the City Council., and concurred
that they have covered both ,points, that they are recoma
mending that the Hennepin County Correctional. Facility be
established as a non-conformi nn use*, ar d facility
does have a major impact on the City wvh,ich as the reason for
their recommendation. n. Further, these facilities should not
be illowed in, ani zoninaIdistrict. ct.
Itt was the concensus that staff should draft an ordinance
amendment per the discussion, and< Commissioner Wire's sug -
pestlon for the Section 12 placement.
Chairwoman Vasillou ripened , discussions ' reviewinq the DESIGN REVIEW
Hazardous Waste Disposal Facilities. She advised the CRITERIA FOR
Commission that the Aqllte Site has been w1thdrawn but that HAZARDOUS WASTE
the citizen's committee Cl4 Atli position is not to let this DISPOSAL FACILJTJES
drop, but to continue developing regulations to be enforced
by the Ci t v .
Staff reviewed the March 19, 191i2 memorandum and the Cltv
Council direction. Extensive discussion ensued.
Commissioner Wire stated the City should rake a clear stand
on tht. slt*nq criteria and have something written which will
have the appropriate restrictions - to keel) these facilitiesles
out of the Cit,,
Commissioner Magnus stated someth.rnq needs to be 11p.at oz, the
books" to repulat. these facilities, but that, -t7 City
needs to reco ni e that future energy resources may depen
on these types of facilities and theCity needs to reccq i e
this as regulations are formulated.
Staff reminded the Commission that the City Council has
directed them to come up with criteria and .standards so that
If a Plymouth site Is designated for hazardous taste dis-
posal, there will be regulations and tight controls.
Staff noted the provisions of the State Statutes on this
ratter.
Commissioner Stulberg stated h,rs opinion that they, should be
totally prohibited, and that If criteria were met, the City
could have such a facility whether wanted or not.
Commissioner Wire concurred and stated that, between the
Issues of prohibiting such facliti es or adopting criteria
for their development, he supports prohibition.
