19,32 COUNCIL COMMMITY AGENDA SjuDy ITEMS
Chairwomanan 'asiliOU recognized the Commission's Council
Coordinatiiiq Representative, atm Threi nen, and she reviewed
the February 5, 1982 Staff Memorandum outlining the CityCouncil's priorities. he stated the Commission should
discuss the first two ltems5 regardinq the Hazardous Waste
FdCllity siting and the future role of the Adult
Correctional Facility and its impact on the City.
Extensive discussion'ensued regarding the Adult Correctional
Iracility and direction the Commission could take in
evaluating possible Ordinance Amendments. Counc.ilmember
Threiner reviewed previous discussions wherein one approach
to be considered could be the amendment of the ZoningOrdinanceotoestablishtheexistingfacilityas < a
non -conforming land use which wooed be thereby ` constrained
from further expansion and enlargement,
Additional discus 'on centered on a matter, of the
determinant sentencing, and proposed state legislation.
Counci.lr emb r Threinen commented that one basic question is
to what --extent the present facility is consistent and
compatible with the harm .'er of surrounding development and
the City today.
Staff u e ttu-d that the issue is a Community -wide matterutter
and not one exclusively focused on the concerns of immediate
neighborhoods. Chairwoman Vasilfou stated that earler
hearings and discussions with neighbors indicated there were
some mixed feelings and concerns about' the Workhouse-, ,some
persons were concerned that the facil ty should be
restricted from any further development ' and eventuallyphasedcut; whereas) other persons were primarily oriented
to effective regulation and ` control ' of the facilities
perations and in parttoualar, the type and number of
inmates. She stated that one view would be the facility hasexistedforanumberofyearsandpredatesmostifnotall

Farther discussion suggested that the character of the
faeili -had changed in terms of its pro4rdms and the scope
of its use, from-,-a 1i.te:rai workhouse and dairy farm,, t
formal medium security prison and detention facility.
Commissioner Plufkd stated trtlat bath the City and the
institution had changed in character and that perhaps an
approach would be to riot classify it as ` a non-conforming
use, but rather establish criteria in the Ordinance which
would )rovide d el arer definition and restrictions as to '
the op- ra t ion.
Staff suggested some eptitgns which could be considered a n
determininq the approp.ri,at.e approaches to be taken in
amending the Zoning Ordi,n,n es for purposes' of further
r uld.tion of the facility.
Otte option wou,l€t be to more specifically define current
Ordinance lancludge : regarding, *1n-tib tit inhs, and exe, iud e
penal 'MitRituti ns and detention favi" Iti.es, thereby
renderivq the existing facility as a non-oon°f rminq use.
Staff ;p,leined that the exclusion was significant since
pr vi.slo*t for such facilities in the list of allowable uses
Is to provide or them in at least one of the established
Zoning Districts,
Another option would be to more specifically define penal
institutions and correctional facilities in the Ord inanoe as
allowable conditional uses which could be further regulated
aecord.*Mg to established Ordinance criteria that would be
conditions of the Permits., With 'that approach, the existing
facility would riot be a tIOn-cQ11forming usebut would be a
type of use subject to special: criteria' and conditions which
could address matters such as size and type.
Commissioner pl of a stated that the Commission needs to
define the type of facility that is desired or not wanted.
Commissioner ei.gerwald agreed,, and sogges ed that if the
giOrdinancepreciselydefinedtheeAnlitwhich ' is
now subjects to various standards r.,)k reculatio s governing
Population density and 55taffing, ..his cv d represent a
ceiling' on the size and Intensity of the facility. Commissioner ' Wire stated} howevery that the standards and

A discussion ensued on that issue and it was, the consensus
Of ; the CQM issa.t n that btaff should prepare draft Ordinance
language establishing sit!ng criteria for d Hazardous Waste
Disposal fa llityt publish that larr ua e in a Public HearinqNotioetandscheduleaPublicHearingtheproposed
amendment. It was eono, luded the further public information
was not necessary on this Issue since community concerns
were well - established. Commissioner Pluf a observed
however, that i was necessary for staff to assemble the
appropriate siting criteria ,and to develop it into the
proper Ordinance Amendment format. ;
Commissioner St i e wald suggested, and the Commission
eoncurr d,, that a Public. It form tion, l Hearinq should be
scheduled for the February 24, 1962 meeting with notices
seat td the property owners noticed last year during the
review of the Correctional Facility's expansion plans, and
with PubllcdtiOn, Of a legal notice in. the official
newspaper, The purpose of bhe hearing w ul,d be to seek
information from the public and would not be for purposes of
providing information, or for considering a specific
Ordinance amer dmerrt The notice should indicate that the
om iss on Is cons icer ng the future of the Adult
Correctional Facility and possible Ordinantee language to
clarify, regulate, arid/or restrict the facility,
Staff noted that there were a number of other Zoning
Ordinance Amendments which tentatively were scheduled for
hearing on March 17$, 1982. It was the, concensus of the
Commission that those amendments should be scheduled for a
meet tnq not it oonfl, iet with the hearings on the
orreotional Facility or on the Hazardous Waste siting,.
It was suggested that the amendatory hearing I on the
Hazardous Waste siting issue be scheduled for arch 31,
Regarding the Aoolt Correctional Facility matter, the
Commission directed staff to consult with the City Attorney
and other resources to develop the foliowing-
