Chairwoman Vasiliou commented that it is not clear that the
Criteria for granting this variance have not been met, that is,
verifying a wiliqueness ind bardship.
Mr. Wheeler stated that putting the restaurant on the large
existing parcel would not be ,justified, the parcel being
too large for this use only, and putting in another
restaurant wool d be counterproductive to the proposed
planning. fir. Lupu added that they want another use on a
separate :ar, such as art` office building.
Mr. Jack Lynchli, 2829 University Avenue, of BRW stated they,
have updated altrafficanalysis, (acus for `this site in 1978.
This study was dine over a o 4 days period this month
whore they took actual traffic cons to compare with the
1978 analysis. On the ' assumption that there will bea, ros
taurant and office/warehouse constructed, the daily trips will
nc,r ase by 200 over 1978. Tutor observations taken relative t
the problems of traffic congestiou at the Judy's r !iad rant

and that'vehicles were moving freely, so their report hows

Mr. Lupu stated they understand that warehouse facilities
are.not permitted., and the approval for an office building and
restaurant use is understood* Mr. Lupu stated that Shakey's is
a family restaurant and, will tend to get more people in fewer

Chairwoman Vasiliou expla ned that Mayor Davenport had asked to tweet with the
Coramission to discuss a nuaber of matters regardinq Community Development and
Arming Goals. The Mayor stated he was preparing a "State of the City" rrressa e
with the intention of proposing programs and City,leqislation in 1982, and h
asked for input from the Planning Cimmission. He asked the Commissioners to
collectively, or Individually,, provide hien with their thoughts as to direction
for the City to take, ;he asked that this be provided to,him by arid -December.
Extensive discussion ensued. she Mayor also reported to the Commission the results
of a' meeting held by the City Council earlier in the week with the Chief Judge
of the Hennepin County District Courts Su'perintendent of the County Adult Corrections
Kaci l i and the y< s t erne n County Commissioner reqarding the 'operation
and future planning for the Adult Corrections facility. The Mayor stated that
It was a productive meeting, but the main conclusion was resolution of concerns

Chairwoman Vasiliou stated concern , that trtePlanning Commission 'rad not been
aware of the meeting, and she understood Lahr Use matters were also discussed.
She also stated that representatives of the surrounding n ighborbood had been
incited to the meeting and had participated in the discussion, and thus,
in anticipation of future public hearings before the `planning" Commission,,
the Co=issioners world net be as well as informed as the residents.
The Mayor stated that the thrust of the discussion with the County officials
was not land use, but that at the conclusion of the meeting, there had bbeeh
discuWn and directitsn to staff regarding evaluation of the Ordinance
pr vi si (,! :' for correctional facilities. e stated it was not ' intended to
exclude Planning Commissioners from the meeting, but the meeting had been
scheduled in anticipation of discussing ratters of an onerational and policy
nature
Commissioner Stei geral d stated that he believed it would be helpful for the
City Managers to periodically issue an °`alerts° to advisory Commissioners, a
wellas Cite Council regarding issues such as this, as well as scheduled
greetings and hearings. Heu y ped that such a memo could briefly outline the
subjects, with an indication of staff members who could elaborate upon and
explain the issues In detail for L-immission rs who are interested. The Mayer
welcomed the idea, and directed staff to convey this to the Citi Manager.
In farther discussion,, Chairwoman Vasiliou stated c- cern with attendance by -
appointed members at the Boarl of Zoning Adjustments and appeals meetings, where
there has been frequent diff (,Rile in getting a quorum. Extansive discussion
ensued regarding the role of t k. ;card of Zoning Adjustments and Appeals, and
Chairwoman Vasiliou and. the Mayo,,-, directed staff to research the statutory
proves ins for Appeals Boards, and t1=x develop a report for the Commission ar:,d
Councill as possible alternatives.
In athc-r business, Commissioner Barron stated that he had been required by his
businoss to be regularly absent fr -j the city. for past several months, and
he anticipated that he would be absent even more during the coming year. He
stated that his term expires at the end of tori s year. and he requested that he
not be considered for reappointment. He thanked the Commissioners for their
cooperation and dedication, and stated that he Ead found the time served on the
Planning Commission gas challenging and fruitful.
Chairwoman Vasiliou thanked Commissioner Barron for his service to the Commission
and she noted to the Ra or that there were apparently a lame;rrumber of qualified
applicants who had expressed interest in serving on the Planning Commission.
She asked staff if there were ether expiring terms, and staff stated that the two
terms were those of Commissioner Barran and Commissioner Steigerwald.
