Chairwoman Vase nay explained the request car La 'proposed addition to
duplexwithin an RPUD (residiential planned unit" development) which
is governed by the Homeowner Associatior, Bylaws and Covenants,, and that
approval has been given by the Cimarron Pones Archi tecturaI Controls
tll'ommittee.
Staff stated gest the petitioner is.also requesting a vacation of
portion of utility easement which will b heave by City Council at
their nest vleeting.
There were no questions or compents from the Commission or Nfrt, Atkin -
n, the petitioner.
Chairwoman Vasillou introduced Jean Graff, 1010 Xene Lana, wholl questioned
whether this proposed addition would extend over theproperty line an
encroach on he common area of the complex.

addition will encroach on t4e easement which necessitates the vacation a
request, and, that it is presumed there are no covenantor legal
constraints to prevent the construction of this add ions

who stated that there is no house directly oppositc his wn and that

objections. He stated he has discussed It with the Beard of Directors,

same materials and colors as the existing dwelling, and is similar

original developer.

Commissioner Wire stated that the addition is well p awned, the Home-
owner's Association and Architectural Controls Committeetee have approved
the proposed addition, and the unit is '"Internal", ' h minimal impact
toward neighbors or outside the development. He stated he also had
general concerns with precedent.

Chairwoman Vasiliou introduced the ns t item; reading of the M. L. JACOBS

subject; to the following conditions-

Mr. Uebele reported n the present proposal and the, future expansion
plans. He stated that they were complying withthe n i neer" s

Mr. Uebelle sated they have some concerns about the requirements

sewer and catch basin, and also, the requirp4-qetit for continuous

Staff stated Item, No. 20 had been reviewed i h the Engineer who had
approved proposed changes.
Mr, Dick Knutson spoke to tberequirement, that a private road be
constructed prior to occupancy of any building, ureic proposal is
that the construction of this 'road to the east and Plymouth blvd.,

approvedo. lie stated the road would be graded a ' this time.
Contuissioner Wire asked Mr. Uebeleabout their plans for seeding
the future expansion site.. Mr. Uebele stated that it is now an

Commissioner Stulberg stated that the petitioner should confirm and

be completed as part of the initial development. Future

problems that may be created by his development,, but that he

Chairwoman Vasiliou commented that reduction of lot size s something
the Cowmaission and City Council have discussed and smaller lots can
be well planned.. such as through proper zoningw
