HomeMy WebLinkAboutCity Council Ordinance 1998-39ORDINANCE NO. 98-39 AN ORDINANCE RELATING TO PERMIT PROCEDURES AND FEES AND AMENDING SECTIONS 1010.01, 1010.04,1015.11,1015.13,1015.17,1015.21, AND 1015.23 OF THE PLYMOUTH CITY CODE THE CITY COUNCIL OF THE CITY OF PLYMOUTH ORDAINS: Sec. 1. The Plymouth City Code, Section 1010.01 is amended to read: 1010.01. Fees. Subdivision 1. Fees Set. The fees for the various licenses required by this Code are set forth in this subsection under the headings listed for subdivisions 2 through 8. Type of License Subd. 2. Commercial Lawn Fertilizer Applicator License. (a) $100.00, which includes the use of one vehicle (b) $25.00 for each vehicle used in the application of Fertilizer in the City of Plymouth in excess of first vehicle. (Ord. 95-46, 09/05/95) Sec. 2. The Plymouth City Code, Section 1010.04 is amended to read: Res. 98-39 Page 4 1010.04 Penalty for Late Payment. Subdivision 2. Every person whose licensed trade, business, profession, activity or privilege is licensed by the City, other than one who has been closed down or who has not operated such activity in the City after the expiration of the licensing year, shall pay to the City Clerk the regular license fee and in addition thereto the following penalty for late application for a renewal license. (a) One to 14 days late, a ten percent penalty, but not less than U $10. (b) 15 to 30 days late, a 25 percent penalty, but not less than $4.4 $15. (c) After expiration of 30 days from the due date, the activity for which a license is required shall cease and no new license or permit for such activity shall be considered until the owner of the business personally appears before the City Council. If the new license or permit is approved, the fee shall consist of the amount set forth for new licenses and permits, plus the late penalty fee that was not paid for the old license. Subd. 3. Late Payment of the License Fee with Penalty no Bar to Prosecution for Operating Without a License. The late payment of the license fee together with the penalty set forth herein is no bar to a prosecution by the City for operating any licensed trade, business, profession, activity, or privilege within the City without a license therefor. Sec. 3. The Plymouth City Code, Section 1015.11 is amended to read: 1015.11. General Rule. Subdivision 1. Building Permits and Plan Review Fees. Building permit and plan review are those set forth in Subdivision 2. Subd.2. Fees. (a) Plan Review Fees. Plan review fees required by this Section shall be: Single family detached and attached dwellings - 65% of the building permit fee, provided that for attached dwelling plans the plan review fee shall be reduced 75% for a repeat plan which is substantially similar to a master plan previously fled with the building official by the same applicant within twelve months of the date of the application. The building official shall determine whether the plan is substantially similar to the master plan. Plumbing permit procedures and fees are as follows. It shall be unlawful for any person to perform work subject to the Building Code for which a permit is required without first obtaining a permit therefor from the City; such permits shall be issued by the City only to persons licensed as plumbers by the State and registered as such with the City or to persons making application to do any such work wholly within a residence owned and occupied by the applicant to whom the permit is to be issued and who shall be charged the following as permit fees: (a) Base minimum permit fee $11 Residential (In addition to other fees set $16 Commercial forth in (b) to (e) below (b) Each fixture $8 (c) Septic system $2-3 $35 (d) Yard sprinkler $ $20 (e) Each permit for alteration or repair of $8 for the first $100 or fraction thereof existing plumbing and for other plumbing in estimated cost; $3 for each additional work not included above $100 in estimated cost or fraction thereof (Ord. 98-7, 03/18/97) Sec. 5. The Plymouth City Code, Section 1015.17 is amended to read: 1015.17. Heating, Air Conditioning, Ventilation, and Refrigeration Fees. (a) For the installation of any central heating and/or air conditioning system, the fee shall be I% of the estimated cost. The minimum fee shall be = $80 for any such central system. (b) For additional alterations or repairs to any central system, the permit fee shall be 1% of the estimated cost. The minimum permit fee shall be $24 $25. (c) For each appliance or piece of equipment regulated by the Code, but not classed in other appliance categories or for which no other fee is listed in this Code, the fee shall be 1% of the estimated cost. The Plymouth City Code, Section 1015.23 is amended to read: 1015.23. Zoning and Subdivision Fees: Special Provisions. Subdivision 1. Scope and Application. This Subsection applies to applications for the platting or replatting of land and variances from platting regulations made pursuant to Section 500 of this Code, and to applications for zoning district changes, zoning code text amendments, conditional use permits, and variances, made pursuant to the Zoning Code (Appendix I of this Code). Subd. 2. Fees. Reduced Site Plan Review Fees. The fee for Site Plan review shall be 50% of the Site Plan review fee provided in Subdivision 2 under the following circumstances: (a) When plans are submitted after the City Council approval has either expired or has been extended but where no substantive changes have been made to the plans other than required by this Code or Ordinance, in accordance with the Plymouth Zoning Ordinance. (b) When plans have been submitted proposing minor structural and/or minor site expansions or modifications as provided by the Plymouth Zoning Ordinance. Subd. 4. Proposed Development and Land Use Action Announcement Sign Fees. A base fee of $165 will be charged for the installation and removal by the City of signs announcing" folloming proposed developments and land use actions as required by Section 21022.01 of the Res. 98-39 Page 9 Zoning Ordinance; .Tthis fee shall be in addition to the established planning application fee set forth in Subd. 2. The base fee will cover the cost of the installation of one development sign. For each additional sign required , an additional $50 fee shall be paid: Sec. 8 All license and permit that are made ready for issuance or before December 31, 1998 shall be charged according to the fee schedule in place on that date. License and permits that are made ready for issuance on January 1, 1999, and thereafter, shall be charged according to the fee schedule in place on that date. Sec. 9.
