HomeMy WebLinkAboutCity Council Ordinance 1998-30CITY OF PLYMOUTH ORDINANCE NO. 98-30 AN ORDINANCE AMENDING THE PLYMOUTH CITY CODE, BY AMENDING CHAPER 21, PUD (PLANNED UNIT DEVELOPMENT) ZONING DISTRICT AND CLASSIFYING CERTAIN LANDS LOCATED NORTH OF BASS LAKE ROAD, WEST OF THE BASS LAKE COMMERCIAL CENTER AND EAST OF GOLDENROD LANE AS PUD (PLANNED UNIT DEVELOPMENT) (98108) THE CITY OF PLYMOUTH ORDAINS: Section 1. Amendment of City Code. Chapter 21 of the City Code of the City of Plymouth, Minnesota, adopted December 18, 1996 as amended, is hereby amended by changing the classification on the City of Plymouth Zoning Map from FRD (Future Restricted Development) to PUD (Planned Unit Development) with respect to the hereinafter described property: All that part of Government Lot 3, Section 2, Township 118, Range 22, described as follows: Commencing at the point or intersection of the center line of County Road No. 10 with a line drawn parallel to and 193.64 feet Southeasterly from the Easterly line of Lot 45, Morrison's Lake View Addition; thence Northerly along said parallel line to the point of its intersection with the Southerly line of Lot 42 of said addition; thence Southeasterly along the Southerly line of said Lot 42 and along an extension of said line a distance of 160.45 feet; thence Southwesterly on a line parallel to said Easterly line of Lot 45 of said Addition, which line coincides with and forms a part of the Westerly line of Lot 52 of said addition, to the center line of said road; thence Northwesterly along the center line of said road to the point of beginning, according to the United States government Survey; And That part of Lot 52, lying Southeasterly of a line running Northeasterly from the Southeast corner of Lot 42 to a point 450 feet North of the Northeast corner of Lot 51, Morrison's Lake View Addition; And That part of Government Lot 3, Section 2, Township 118, Range 22, described as follows: Commencing at an extension southwesterly of the center line of County Road No. 10 with an extension southwesterly of the southeasterly line of Lot 52 of Morrison's Lake View Addition; thence northeasterly along said extended line and along the southeasterly line of said Lot 52 to Ordinance 98-30 Page 2 the northeastern extremity of said line as shown upon the plat of said addition; thence at right angels southeasterly a distance of 200 feet; thence at right angles southwesterly on a line parallel to the line first above described to the point of its intersection with the center line of said road; thence northwesterly along the center line of said road to the point of beginning. Section 2. Amendment of City Code. Chapter 21 of the City Code of the City of Plymouth, Minnesota, adopted December 18, 1996 as amended, is hereby amended to add Section 21655.11 --Pike Lake Woods PUD, as follows: 21655.11 PIKE LAKE WOODS PUD: Subd. 1. Legal Description. The PUD is legally described as referenced in Resolution 97-573, on file in the Office of the Zoning Administrator under File 97079 and as referenced in Resolution 98-543, on file in the Office of the Zoning Administrator under File 981084QU 46 to 51 iaGl giyo 1 aUa v;o.,, ddi4io u@PA@pi; r,,.. Incorporated herein by reference are the Pike Lake Woods PUD plans received by the City on June 27, 1997, except as amended by City Council Resolution 97-573, on file in the Office of the Zoning Administrator under File 97079 and the Pike Lake Woods 2nd Addition and Pike Lake Woods Yd Addition plans received by the City on June 5, 1998, July 9, 1998 and July 31, 1998, except as amended by City Council Resolution 98-543, on file in the Office of the Zoning Administrator under File 98108. Subd. 3. Allowable Uses. (a) The permitted, accessory, conditional or interim uses allowed on the residential property in Pike Lake Woods PUD are any permitted, accessory, conditional or interim uses allowed in the RMF -1 (multiple Family 1) Zoning District. All allowable uses are subject to the standards and restrictions of the RMF -1 District, except as modified in Subd. 4 below. (b) The permitted, accessory, conditional or interim uses allowed on the commercial property in the Pike Lake Woods PUD are any permitted, accessory, conditional or interim uses allowed in the C-2 (Neighborhood Commercial) Zoning District. All allowable uses are subject to the standards and restrictions of the C-2 District, except as modified in Subd. 4. Below. Subd. 4. Development Standards. (a) Development standards for the residential property shall be as specified in the RMF -1 zoning district, except that the side yard setback shall be 6 feet (regardless of the location of the garage). Ordinance 98-30 Page 3 (b) Setback restrictions along the periphery of the commercial property are as follows: (1) Front yard setback of 75 feet (2) Side yard building setback of 75 feet (3) Rear yard building setback of 75 feet (c) Other development standards shall be as indicated on the approved PUD general plan as cited in Subd. 2 above.
