HomeMy WebLinkAboutCity Council Ordinance 1998-10CITY OF PLYMOUTH HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 98-10 AN ORDINANCE AMENDING THE PLYMOUTH CITY CODE, BY AMENDING CHAPER 21, C-2 (NEIGHBORHOOD COMMERCIAL) ZONING DISTRICT (98012) THE CITY OF PLYMOUTH ORDAINS: Section 1. Section 21460 of the Plymouth City Code (C-2, Neighborhood Commercial District) is hereby amended to read as follows: 21460.09. INTERIM USES: Subject to the applicable provisions of this Section, the following are interim uses on the C-2 District and are governed by Section 21020 of this Chapter. Subd. 1. All interim uses as allowed in a C-1 District. Subd.2. Seasonal Farmer's Market and Produce Sales, provided such products are sold directly to the consumer, subject to the following: (a) Products shall be limited to produce, vegetables, flowers, plants, and similar items. (b) Sales activities may be conducted within a required yard provided the area is paved and the activity does not interfere with parking, traffic circulation or emergency vehicle access. Temporary sales on unpaved landscaped areas are prohibited. (c) Tents, stands, and other similar temporary structures may be utilized, provided they are clearly identified on the submitted plan and provided that it is determined by the City Council that they will not impair the parking capacity, Ordinance 98-10 Page 2 emergency access, or the safe and efficient movement of pedestrian and vehicular traffic on or off the site. (d) The submitted plan shall clearly demonstrate that adequate off-street parking for the proposed event can and will be provided for the duration of the event. Determination of compliance with this requirement shall include an analysis of the nature of the event and the applicable parking requirements of Section 21135. Consideration shall be given to the parking needs and requirements of other occupants in the case of multi -tenant buildings. Parking on public right-of- way and streets is prohibited; except that parking on local streets may be allowed on Saturday and Sunday only, provided that the petitioner arranges for traffic control by authorized enforcement officers, as approved in writing by the Director of Public Safety, at the petitioner's expense. (e) Signage related to the event shall be in compliance with the temporary sign standards of Section 21155 and shall be allowed for the duration of the event. Special signage for purposes of traffic direction and control may be authorized by the Zoning Administrator; the erection and removal of such signage shall be the responsibility of the applicant. (f) The maximum time for sales activities shall be the period specified in the interim use permit and, in no case, shall exceed eight (8) months per calendar year per property. (g) All stands, equipment, signs, and other structures shall be removed on the last day of the sales event. (h) The approved permit shall be displayed on the premises for the duration of the event. (i) The submittal requirements of Section 21025 Subd. 2. shall be provided with the interim use permit application. Section 2. Section 21465 of the Plymouth City Code (C-3, Highway Commercial District) is hereby amended to read as follows: 21465.09. INTERIM USES: Subject to applicable provisions of this Chapter, the following are interim uses in the C-3 District and are governed by Section 21020 of this Chapter. Subd.1. All interim uses as allowed in a C-2 District, except seasonal farmer's market and produce sales. FA Ordinance 98-10 Page 3 Section 3. This Ordinance shall be effective immediately upon its passage.
