HomeMy WebLinkAboutCity Council Resolution 2015-117 CP ITY OF LYMOUTH RN.2015-117 ESOLUTION O RACUPAV ESOLUTION PPROVING A ONDITIONAL SE ERMIT AND MENDMENTS TO ARIANCES FOR PL12755SH55(2015020) ROPERTY OCATED AT TATE IGHWAY WHEREAS, Fredrikson and Byron, P.A., on behalf of the property owner, requested approval of a conditional use permit and for amendments to variances for the site legally described as: Parcel 1: Lot 1, Block 6, Minneapolis Industrial Park, except that part of said Lot 1 that lies northerly of the following described line: Beginning at a point on the northwesterly line of said Lot 1, distant 40 feet southwesterly of the most northerly corner thereof; thence run easterly to a point on the northeasterly line of said Lot 1, distant 20 feet southeasterly of the most northerly corner thereof and there terminating; also except vacated 16th Avenue North, according to the recorded plat thereof, and situate in Hennepin County, Minnesota. Parcel 2: That part of 16th Avenue North (Old County Road 6), Minneapolis Industrial Park, according to the recorded plat thereof, lying northerly of the easterly prolongation to the east line of Section 27, of the most southerly line of Lot 1, Block 6, said Minneapolis Industrial Park. Parcel 3: Lot 3, Block 6, Minneapolis Industrial Park, according to the recorded plat thereof, and situate in Hennepin County, Minnesota. WHEREAS, the City Council approved resolutions 87-141 with conditions that imply that the office uses and parking lot are temporary improvements; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Fredrikson and Byron, P.A., on behalf of the property owner, for a conditional use permit and amendments to variances for the property located at 12755 State Highway 55, subject to the following conditions: 1.A conditional use permit is hereby approved to allow 100 percent of the building to be used for office purposes, in accordance with the application and plans received by the city on March 13 and 17, 2015, except as may be amended by this resolution, based on the finding that the applicable conditional use permit standards are met. 2.Condition 4 of resolution 87-141 is hereby amended to approve variances as follows: 1) the provision for parking on Lot 3, Block 1, Minneapolis Industrial Park benefitting Lot 1, Block 6, Minneapolis Industrial Park and 2) the provision of accessory parking without a principal use, in accordance with the application and plans received by the city on March 13 and 17, 2015, except as may be amended by this resolution, based on the finding that the applicable variance standards are met. Resolution 2015-117 (2015117) Page 2 3.Subsequent development of Lot 3 shall not be permitted unless the property owner demonstrates that the required parking for all the existing and proposed uses on both Lots 1 and 3, Block 6, Minneapolis Industrial Park may be accommodated on the properties. 4.Conditions 3, 5 and 6 of resolution 87-141 are hereby rescinded. 5.Subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions.
