HomeMy WebLinkAboutCity Council Resolution 2015-115 CP ITY OF LYMOUTH RN.2015-115 ESOLUTION O RAPUDAWP#6,LLC ESOLUTION PPROVING A MENDMENT FOR ILLOW ROPERTIES FOR 2600CD(2015011) PROPERTY LOCATED AT AMPUS RIVE WHEREAS, Willow Properties #6, LLC has requested approval of a planned unit development (PUD) amendment to allow revisions to the approved PUD general plan for the site located at 2600 Campus Drive; and WHEREAS, the subject property is legally described as Lot 1, Block 1, Northwest Business Campus th 8 Addition, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Willow Properties #6, LLC for a PUD amendment to allow revisions to the approved PUD general plan, subject to the following conditions: 1.The PUD amendment is hereby approved, in accordance with the application materials received by the City on February 6, 2015, and additional information on March 20, 2015 except as may be amended by this resolution. 2.All conditions of previous resolutions approving the Northwest Business Campus PUD general plan th and any amendments relating to Northwest Business Campus 8 Addition shall remain in full force, except as specifically amended by this resolution. 3.Prior to implementation of this PUD amendment, the applicant shall apply for, and receive city approval of a PUD final plan for the revisions. 4.This PUD amendment hereby allows: 1) a gymnastics and fitness club; 2) parking lot revisions to provide 124 parking spaces verses the 143 required by the zoning ordinance; and 3) a portion of the roof on the existing building to be raised provided all conditions of this resolution are complied with. If parking shortages occur, the applicant shall provide an additional 19 spaces and expand the infiltration/bio-swale on the site to treat the additional impervious surface within the shoreland overlay district for Plymouth Creek. Any parking expansion shall be reviewed by a separate application and all parking dimensions, setbacks, curb and gutter and other related requirements shall apply. Resolution 2015-115 (2015011) Page 2 5.Hours of operation for any commercial use shall be limited to 7:00 am to 10:00 pm. 24-hour fitness clubs are not permitted. 6.There are 124 on-site parking spaces shown where 143 parking spaces are required by the zoning ordinance. If parking shortages occur or if the needs of the property owner change, the applicant shall expand parking and the infiltration/bio-swale on the site to treat the additional impervious surface within the shoreland overlay district for Plymouth Creek. Any parking expansion shall be reviewed by a separate application and all parking dimensions, setbacks, curb and gutter and other related requirements shall apply. 7.Existing trees that are removed in conjunction with the parking lot revisions shall be relocated or replaced on site. 8.A separate building permit is required prior to the commencement of the project. 9.Prior to the issuance of a building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a.Receive City approval of final construction plans. b.Submit a revised grading plan showing an on-site infiltration area designed to the capacity to treat the additional impervious surface in the Plymouth Creek Shoreland Overlay District. c.Provide drainage calculations and an executed maintenance agreement for the infiltration basin. d.Complete a site improvement performance agreement and submit a financial guarantee pursuant to section 21045.10 of the zoning ordinance. e.Submit approved fire protection plan showing locations of all fire lanes and fire lane signage, associated turn-arounds and dead ends (including turning radius calculations), hydrants, post indicator valves, and fire department connections, and any below ground storage tanks.
