EMBERS PRESENT: Chairman Virgil Schneider, Commissioners llasiliou, Threinen Wire and Stei gerwal d. MEMBERS ABSENT: Commissioners Drank Barron and Lawrence Larson. STAFF PRESENT; Community Development Director Blair Tremere, Community Development Coordinator Marvin Ray, Planning Secretary Barbara Anderson. Georgianne Bursch (.A-7873 51 Conditional Use Permit Renewal This item was introduced by staff who reviewed the November 8, 1979 Staff Report. The petitioner seeks renewal of a conditional use permit to operate a beauty salon in her home at 1315 Dunkirk Lane in Plymouth. This request was approved by the City Council in August 1978. No. complaints have been recorded against this use or property. MOTION by Commissioner faire, seconded by Commissioner Steigerwald to recommend approval of the conditional use permit renewal subject to the following conditions I. The permit is issued to the applicant as operator of the facility and shall be non -transferable. 2. The permit shall be subject to all applicablecodes, regulations (including state licensing requirements) and ordinances and violation thereof shall be subject to grounds for revocation. 3, A current copy of the state operator's license shall be kept on file with the City, 4. Off-street parking not to exceed two vehicles at any given time related to the given use, shall be provided and maintained as approved by the City. 5, Hours of o%eration shall be between 9:00 A.M. and 5:00 P.M. Monday through Saturday. 6. No signs shall be allowed on the property advertising the use. 7. There shall be no increase in the curb cut width at the street line. MOTILIN CARRIED 5-0--0 All in Favor J PLANNING COMMISSION MINUTES -2- November 14, 1979 Fi ommers for On -Be aIn-.*, 7907 Similar Use Determination/ Conditional Use Permit This item was introduced by Staff who reviewed the November 8 1979 staff report. The petitioner proposes to have an adolescent chemical dependency treatment renter on the site of the St. Mary's of the w'Ae Church at 115 Forestview Lane. Chairman Schneider recognized Mr. Hill Sommers who spoke representing On -Belay, Inc. Mr. Sommers stated that the proposed facility was not a detox center, and the clients would be there because they wanted help, not because they had to be there. He stated that they had held a neighborhood meeting on October 23, 1979 which was; attended by approximately 25 people, who were notified of this public hearing along with property owners within 500 feet of the property. He stated that the clients would be approximately 13-18 years in age and there would not be a client admitted over the age of 18. Older family members who needed treatment would be referred elsewhere. Chai Man Schneider opened the public hearing.. Mr. Ron Jacobson of 11605 - 3rd Avenue North was present and spoke as a concerned neighbor regarding the outside activities of the clients and effect upon the Neigh- borhood. He inquired as to whether they were planning on fencing in the area, and what, if any, recreational facilities would be provided. Mr. Don Anderson of Wayzata High School representing the petitioner responded Indicating that there would be some field trips, and some outdoor recreational activities planned. However, the clients will be closely supervised at all times, and they do not anticipate any problems in this area. -Commissioner Steigerwald stated that if Mr. Jacobson has any prof-Iems with the use or the treatment Facility that he should notify staff and they would review the conditional use permit if sufficient grounds were given. Chairman Schneider commented that whereas this was a laege site, other smaller and similarly zoned sites in the City could be problematical in terms of accommodating such uses. Corryniissioner Threinen observed that: such uses require a conditional use permit and t;ius each would be evaluated on its merits, as in this case. Chairman Schneider closed the public hearing. MOTION by Commissioner Wire, seconded by Commissioner Steigerwald to act on this petition this evening. LOTION CARRIED 5-0-0 All in Favor MOTION by Commissioner Vasiliou, seconded by Commissioner Steigerwald to recommend approval ofthis conditional use permit subject to the following conditions: 1. Permit is subject to all applicable codes, ordinances and regulations, violation of which shall be grounds for revocation. 2. A copy of the current state license for the facility shall be on file with the City. 3. A maximum number of residents of the facility shall be frfteen (15). MOTION CARRIED5-0--0 All in Favor Vole Construction Company 79U7 Site PIan and Conditionai Use Permit This item was introduced by staff who reviewed the November 9, 1979 staff report. The petitioner proposes to construct an office/warehouse to accomodate the office, sales and warehouse uses of the owner, Pan -O -Cold Holsum Baking Company. Staff explained a conditional use permit is required for the proposed retail outlet for bakery products on the north end, Chairman Schneider recognized Mr. Glen Burnett who was present representing the petitioner. Mr. Burnett stated that if the retail sales of "day old" bakery goods did not prove to be a profitable venture, then the owners would remove it to a diff=erent location, while retainin;j the space for warehouse and office uses. Chairman Schneider declared the public hearing open. Commissioner Threinen noted that there was no sign plan submitted with the petition, and inquired as to what type of signage they intended to have. fir. Burnett responded that they had made no determination regarding signage as of this time, but' would submit sign plans Eater for approval, Chairman Schneider noted the large glass windows which face Highway 55, and he said that in all the "day old" bakery stores he had seen they put up large paper banners to advertise daily specials, and since the ordinance does not cover signage inside a building, the Holsum people could do the same thing in this case, an s signage was deemed aesthetically proper for this area. Chairman Schneider closed the public hearing_. MOTION by Commissioner Threinen, seconded by Commissioner Wire to act on this petition this evening. MOTILIN CARRIED 5-0w0 All in Favor Substantial discussion ensued relative to the retail sales operation and its appropriateness given the Ordinance standards for such uses in the T-1 Zone and given conCcrns relative to signage of a retail nature. Mr. Burnett stated thf• project was viable without the retail facility which could be located in a properly zoned location off site. MOTION by Commissioner Threinen, seconded by Commissioner 'Wi're to recommend: approval of the site plan only subject to the following conditicns; I. C)mpliance`with the City Engineer's Memorandum. 2 Payrent of park dedication fees in lieu of dedication in a) amount deter- mined according to verified acreage and according to the dedication policy in effect at the time of building permit issuance. Appropriate easements be provided for trail purposes per City Corridor Use bane, and construction of the designated trail per City specifications and plans approved by the City Engineer. 4 All waste and l;aste containers shall be stared within the structure, 5. No outside storage of materials or products. 6 8612 concrete curb shall be installed around all driving, and parking areas, per City Policy Resolution No. 79-73. 7. Location of fire hydrants and Fire lanes per City Code. 8. Site performance financial guarantee: shall be termed for 24 months, and all evergreen trees shall be a minimum of 6 feet high. 9.. All signs shall conform with the City Ordinance standards and be subject to the Commission review. 10. Compliance with City Policy Resolution No. 79-80 regarding development containing storm water holding facilities, MOTION CARRIED 5-0-0 All in Favor MOTION by Commissioner Threinen, seconded by Commissioner Wire to recommend denial of the request for a conditional use permit to have a retail outlet for bakery goods for the reasons of the difficulty in controlling signage, and the use is not deemed essential to or compatible with the I -M District. The petitioner is requesting permission to use a portion of a permitted construc- tion trailer at the southeast corner of Fernbrook Lane and 39th Avenue North for a sales offl, --. until such time as they have completed their model home which is to be them At:tablished "temporary sales office" until 80 percent of the project is sold. Chairman Schneider declared t!e public hearing oven, Chairman Schneider recognizes! Mr. Terry Mahoney, who was present representing the petitioner. Mr. Mahoney stated their position of wanting to use the permitted construction trailer° as a sales office since they already had a demand for their houses and this ena,)les prospective customers to view the site. He stated that they would be will.,ng to pave the parking ares of the "permanent sales office and that the site would be landscaped, ,her the recommendation of staff. PLANNING COMMISSION MINUTES -5= November 14, 1919 Chal man 'Schneider recognized =sir. Gerald Schmidt of 3810 Fernbrook lane North. Mr. Schnidt stated that "e loves in one of three homes directly adjacent to the trailer, and he feels than it makes their property look bad to have the trailer sitting so far out from the rest of the houses,, .ie wanted to know if the Planning Cotmission was going to require them to conform to some sort of setback requirements, -even though it is understood that -t is a "temporary" situation. Mr. Mahoney responded that they plan to move the trailer as soon as the sewer is installed on 39th Avenue North and they can get their vehciles in there to do it. Chairman Schneider recognized Mrs. Donna Maus of 14130 - 40th Avenue North. tars. Maus, informed the Planning Commission that this construction trailer was being used as a sales office right now, with prospective :buyers meeting sales personnel on the site. She also stated that there was no off-street parking in the vicinity of this trailer, and customers were parking on Fernbrook Lane. She also stated that they had signs advertising the sale of the homes located on the site next to the trailer, Community Development Coordinator Marvin Ray showed slides of the site. Mr. Mahoney stated that they h tii beer meeting people on the site and have sold three or four homes already. He stated that they have moved no sales materials or aids into the trailer; they have just used it as a meeting place for prospec- tive customers. Mrs. Maus continued, stating that they were running ads in the papers giving out a telephone number and directions on how to get to the trailer as a means of getting customers to the site. Mr. Mahoney responded that the telephone number was to their Eder Prarire Office and that the directions were so that people would be able to drive by the site and see where they would be located. Chairman Schneider recognized Mrs. Marion Zbikowski of 3816 Fernbrook Lane. She stated that she was opposed to the construction trailer being there at all. The traffic is parking down in front of her home causing problems in access and egress for her. The construction people have to park on FernbroQk Lane and their vehicles block traffic, and cause problems for her. She would like to see the trailer moved out. Mr. Thomas Leverenz of 14005 County Road 9, stated concerns about the content of the sign messages in light of various FHA regulations. Chairman Schneider declared the public hearing closed.- MOTION losed.. MO "ION by Coi missioner %tire, seconded by Commissioner Threinen to act on this petition this evening. Setback of the construction trailer shall be per ordinance standards. 2 Xf-street parking from 39th Avenue North shall be provided as soon as the street right-of-way has been improved so to be in a passable condition. PLANNING COMMISSION MINUTES -6- November 14, 1979 3. The off-street parking area for the model home/sales office shall be paved and shall be located in accordance with City standards. 4. A perfomance guarantee shall be submitted to assure restoration of the Lot 1, Block 1 model home site when the use of the temporary sales office is terminated. Commissioner Aire recommended the addition of a fifth condition as follows. 5. Use of the construction trailer for sales office purposes shall be terminat- ed on or before March 1; 1980 and to have the trailer moved off the property by June 1, 1980, and Lot 1, Block I restored to good condition. Commissioner Threinen spoke statfig that he was opposed to using the trailer as a sales office, and he felt that it should be denied. He did not feel it was appropriate to use a construction trailer as a sales office to sell homes MOTION failed for lack of a second. MOTION by Commissioner Threinen, seconded by Commissioner dire to recommenddenial' of the request for conditional use permit to use the construction trailer as a safes office for the reasons that it is difficult to enforce regulations that apply to permanent homes. MOI ON CARRIED 5-0-0 All in Favor MOTION by Commissioner Threinen, seconded by Commissioner Vasiliou to recommend approval of the conditional use permit to use a model home to be built on the northeast corner of 39th Avenue North and ,ernbrook Lane as a sales office subje^.t to the following conditions; I. Off-street parking from 39th Avenue north shall be provided as soon as the street right-of-way has been improved so to he in a passable condition. 2. The off-street parking area for the, model hAme/sales office shall be paved and shall be located in accordance with C'ty standards_. 3. A performance guarantee shall be submitted to assure restoration of the Lot 2, Block 1 model' home site when the use Of the temporary sales office is terminated; MOTION CARRIED 5-04 All in Favor Chairman Schneider recommended to the petitioner to cease all sales activities out of the construction trailer immediately, as they are illegal. The meeting recessed at 9:.30 P.M. and resumed at 9»40 P.M. Larry Lau a ssociates Re2uuiding and RPUD Concept Plan Review This item was introduced by staff no reviewed the November 9, 1979 staff report, noting that petitioner proposed a requid ng of a portion of the site, at the northwest quadrant of County Roads 10 and 18, from CL to LA -2 and that this was necessary to the proposed MPUD concept. PLANNING COMMISSION 14INUTES -7- November 14, 1979 Chairman Schneider recognized Mr. Peter Jarvis from the firm of Bather, Ringrose,. Wolsfeld,, Jarvis, Gardner, Inc. Mr. Jarvis had a presentation which outlined the concept of the planned unit development and showed graphics illustrating the land, natural features, axd the prospective development for each area to be included in the planned unit development, He also noted the area to be reguided as well es the "exception" parcels on the south and north. Mr. Jarvis stated according to their calculations about 28 acres of 54 acres sould be reguided to LA -2 and that the petitioner owned about 16.6 acres of the remaining 26 acres guided CL. Mr. Jarvis commented on the negotiations with the Hennepin County Park Preserve District and indicated design changes made in the northwest portion of the site relative to a double loaded street. He stated the county and petitioner are discussing the transfer of about 9.6 acres for Regional Park Preserve. Chairman Schneider noted the graphic shown for the northwest area differed from the one in the concept plan booklet, he advised the petitioner to revise the hooks prior to Council review. Commissioner T'hreinen generated discussion relative to the street layout and length of the cul-de-sac into the Condominium area on the east. There also was discussion regarding possible street connections with Maple Grove. Relative to density, Mr. Jarvis presented a handout containing calculations that excluded wetland areas, and tie wommercial area. Relative to possible bonus points" per ordinance, he stated the loan/moderate income criterion would not apply; otherwise, petitioner asked consideration for 8 bonus points. Chairman Schneider declared the public hearing open. Chairman Schneider recognized Mr. Bob Derus of 17813 Weaver Lake Road who was present representing adjacent property owners, Mr. Don Graves who owns property at the north end and Mr. Gauvittes, who owns property at the south end of the proposed development. He stated that Mr.. Graves would prefer that the guiding not be changed on his land as the present guiding is more consistent with what he had in mind for the business that he is operating out of his home now. The traffic on Bass Lake Road (County Road 10) was discussed and tNe future Hennepin County priorities. Mr. Derus expressed a fear that this development would simply make the traffic situation worse, since with new homes being built and more people moving in, he could forsee a serious traffic hazard. He also stated Mr. Craves did not support the plan proposal for half of 'the right--of-way of the street from County Road 10 to come from his land. Chairman Schneider declared the public hearing closed. MOTION by Commissioner Threinen, seconded by Commissioner Steigerwald to act on this peition this evening. MOTION CARRIED 5-0-0 All in Favor PLANNING COMMISSION 141NUTES -8- November 14, 1979 Staff commented on possible area discrepancies in the area of It -he CL guided portion; petitioners calculations were acceptable. Staff also recommended inclusing the three "exception" parcels in a conceptual layout to assure future viable use and access. Chairman Schneider expressed concern about minimal open space in the northeast area, notwithstanding all of the developnents classified as PUD's. Commissioners Vasiliou and Threinen commented that excessive cpen space requirements resulted in generally higheo housing costs. Chairman Schneider requested staff to review the "Bonus Point" criteria in the ordinance. fie stated the proposed Regional Park acreage should not be included in the density calculatiQn--unless the City Council accepted a dedication of that land for Regional Park purposes; he noted that did nog, appear to be probable from the petitioner's perspective. 0 0 Staff noted that using petitioner's calculations, with the City Engineer's wetland figure, and excluding the Regional Park area (9.6 acres), the effective acreage for density calculation purposes is not 132.9 acres. He stated tfit given the proposed 488 dwelling units, V density would be 3.67 acres; and that if Bonus Points Were granted only fore project size (criterion A") the four points in LA -2 areas Would allow a den.,.ity of 3.8 units per acre; thus, the development density Was within the ordina,P,.,e guidelines, without additional points assigned. MOTION by Commissioner Threinen, seconded by Comwtssioner Vasiliou to recommend approval to the City Council subject to the -following conditions: 1, Maximum approved density shall be 4.2 units per acre, which includes 6 bonus points assigned per Section 9, Subdivision 2 of the Zoning Ordinance 4 for size; I for variety of housing types; and 1 for design efforts), exclusive of wetland areas and regional park land area as verified by the City Engineer. 2. The concept plan shall be modified to include the residentially guided exception areas at the south, West and north portions of the site to assure useability, utility access, and street acces-, completely on Petitioner's propety. 3. Phasing and development schedule shall be in accordance with the approved Capital Improvements Plan approved bythe'City. Council. 4, Public streets terminating -it property lines of the project shall be provided with c0 -de -sacs - 5i. Compliance with the City En6ineer's Memorandum. 6. Land dedication fir park and puolic open space purposes shall be in accordance with established City policy at the time of final platting. Consideration may be given to accepting land designated for regional park purposes, but until specifically approved by the City Council, such land shall not be used for density or park dedication credit purposes and FRAC by Council reference, should review public open space needs. 47. Concept plan shall be mod .fied to reflect possible effective uses of the area labeled '"condominium"" and the area labeled "office,comme-Mial". PLANNING COMMISSION MINUTES -9- November 14, 1979 8. Prior to preliminary platting, petitioner should ceordinati! with the Pork Department and the hark and Recreation Advisory Commission as to appropriate City trail corridor alignment and design. 9. Prior to final platting, petitioner- shall complete the reqs fried environmental assessment worksheet review process. 10. Preliminary plans shall include a landscaping and buffering treatment for the residential lots abutting County Road 10 and the commercial area along future Pever e Lane. Commissioner Threinen commented the Ordinance ;Tonus Point provisions had been appropriately applies; Chairman Schneider stated concern that the allowed density woule permit more units than proposed, and he noted the ordinance required a specific number- of units to be set at this time. MOTION by Chairman Schneider, seconded by Commissioner Wire to amend Condition 1 to read that -the density be for 488 units as proposed by the petitioner allowing the 4 bonus points for size which makes it 3.8 density per acre:. Staff comented that the density of 3.8 units per acre for 1.32.9 acres would permit up to 505 dwelling units. Commissioner Vasiliou stated that she supported Commissioner Threinen. Commissioner Steigerwald commented that he would like to award the developer the bonus points for bringing in a plan which can provide housing in the $70,QQ0 range. He would like to see them given a chance to da this, even if more units were added. Mr.. Laukkin, was recognized and he stated he concurred with Commissioner Threinen's observations about applying warranted Bonus Points, notwithstanding proposed number of units. He stated, as a residentialdeveloper, that complex City Ordinances should be flexible by provision for Bonus Point assignment to allow more units when a project merits them. Mr. Jarvis stated the proposal meets the "spir'it" of the ordinance,, the site is adjacent to a large regional park; City plans do not call for a City park; and application of Bonus Points would not: affect open space since any addition- al units would he realized in the condominium area. Commissioners Threinen and VasiIiou stated concern about "chopping" density from viable projects. Chairman Schneider stated the intent was not to "chap" density, but rather, to set a maximum number of units based upon reviewed plans—not upon possible future plans with substantial additional units. Chairman Schneider called for a vote on the amendment to the main motion. MOTION FAILED 2-0-3 Commissioners Vasiliou, Threinen riil Stei gerwal d against. PLANNING COMMISSIOR MINUTES ]O- November 14, 2979 Chairman Schneider requested that the petitioner change the booklet that would go to the City Council so that they would see the same plans as the Planning Commiss- ion had acted upon. Chairman Schneider called for a vote on the main notion. MOTION CARRIED 5-0-0 All in Favor Miff Frazer for Kustom Die Company . 576 Conditional Use Permit Renewal, variance and Amended Site Plan Reading of .the november 9, 1979 staff report was waived at the request of Chair- man Schneider, since only the petitioner was present. Chairman Schneider, recognized Cliff Frazer who stated that this business has existed in this location since 1967 and they must expand to continue their business. he stated that it created a hardship pnottoexpand at this time, Chairman Schneider inquired as to why they did not proceed with the proposed expansion that was approved in 1976, and Mr. .Frazer responded that their financing fell through and they could not afford it until now. Chairman Schneider noted the new plan was substantially expanded from the 1976 plans. 01dirman Schneider recognized Mr. Roger Rice of 5545 Westbrook Road, who spoke regarding graphic art being a 5-3 use, versus an I--1 "manufacturing use". At the Chairman's request, staff reviewed the Ordinance statement of intent for the B-3 District. MOTION by Commissioner fhreinen, seconded by Commissioner Wire to recommend approval of the Kuston Die Graphic arts operation use as peemitted based on the finding that it is a service based operation. MOTION CARRIED 5-0--0 All in Favor Chairman Schneider noted that more variances were requested in this petition than the one presented in 1976. He stated that it appeared there was too much building for this site. Staff noted concerns with proposed curb cuts. Also there is a problem with parking lot dimensions and the number of parking stalls provided. Commissioner Threnen inquired as to whether the requestedvariances would improve the situation, and he felt that the variances and design alternatives should be further reviewed by staff a°nd the petitioner. Mr. Rice stated that the petitioner was anxious to proceed, but that certain design modifications, such as reduction of curbcuts, were possible MOTION by Commissioner Threinen, secot0ed by Commissioner Wire to defer consideration of the site plan to allow petitioner time to work with staff to minimize the number of variances required. to if necessary, reduction of building size. The petitioner is requesting a 7,500 square foot addition which would increase the ground coverage ratio to 12% total, and it appears it is within Ordinance setback requirements. Chairman Schneider recognized the petitioner, and a brief discussion ensued. MOTION by Commissioner Wire, seconded by Commissioner Steigerwald to recommend approval of the site plan amendment subject for Metroquip, Inc., subject to the following conditions: I. Compliance with the City Engineer's Memorandum. 2 Completion and compliance with the requirements of 'Resolution No.. 78-480, especially with respect to landscaping and outside storage. 3. The petitioner is requesting approval of a 64,300 square foot office/warehouse complex on approximately 4.23 acres to be located in the northwest quadrant of the intersection of 23rd Avenue North and Cheshire Lane. Staff recommended that berming along Fernbrook, Lane be provided. Chairman Schneider recognized the petitioner Leon Martin, and also Cary Eitel, who represented the adjoining property owner. Mr. Martin requested that he he allowed to leave the signage until the end of the process, and he will come back to the Planning Commission for approval of any signage when it is time to install it.
