Char man Schneider called the meeting -to order at 7:35 PM.
Richard Lindell (79049) Site Plan Approval
Staff reviewed the report of July 6 regardinga proposed 9,500 sq, ft. office
building on a .gl acre lot at the northwest corner of Kilmer Lane and 34th Ave.
N. and noted concerns about the setback and parking variances.,
Jerry `Nalmurest, i-nresenting the petitioner, presented pictures of the
proposal.
During discussion of various alternatives regarding setbacks and the number
ofparking spaces, Commissioner Barron stated it would be advisable to keep as
much parking as possible.. Commissioner Wire noted concern with the size of
the building.
Commissioner Schneider commented that this area was one of the most congested
traffic and parking areas in the City and an effort to "clean up" this corner
was being implemented.
Mr. Nalmurest indicated he was not in,a position to make final decisions
regarding the variances but suggested moving the building forward 3 feet,
take 5 feel: off the back and keep the 37 parking stalls. This would result
in a reduction of 288 sq, ft. bringing the total size of the building to
9,212 sq,_ ft.
Commissioner Schneider inquired as to the timing of the proposal 'indicating
that the landscaping shown was fess than what the Commission would like to
see. His main concern: was with the number of trees,
After considerable discussion regarding additional landscaping, a MOTION was
made by Commissiener hire and seconded by Commissioner Barron to make the
following recommendation to the City Council
That the site plan for Richard Lindell for an office building at
the: northwest corner of Kilmer Lane and 34Th Ave. N. be approved
sQbj ect to the following conditions:
1. Compliance with the City Engineer's memorandum.
2. Provision for fire hydrants and fire land as recommended'
by the Fire Chief per City Code:
3. Payment of park dedication fees in lieu rr dedication in
accordance with City Park Dedication Po'icy in effect at
the -time of building permit issuance,

4, Reviii:on of the landscape plan to provide for minimum
two -and one-half inch diameter trees with additional
plantings along the west side of the building, additional
berming and plantings along the south and east sides of
the site to, screen the parking lot, and addition of

on the east side 6' high between the maple and ash,
15 dense medium size shrub on the west side and a
evergreens 6' high on the southwest corner;
5. Outside trash enclosure to be of the same material as
the main building and covered with no outside storage;
6. Variance from the ordinance setback standar) to allow
for a 20 fort setback on the west side with a
corresponding reduction in the size of the building,
to 9,212 sq. ft. and 37 parking stalls as shown.
7. Submission of ordinance -required site performance
financial guarantee termed for 24 months.
8. Consolidation of the two lots into one parcel in
accordance with City Code requirements prior to the
issuance of building permit;
MOTION by Commissioner Schneider, seconded by Commissioner Barron. to amend
by adding a 9th condition: the planters be decreased to 2 feet wide so the
walkway on the east side would be wider.

MOTION by Commissioner Barron, seconded by Commissioner Wire to amend by
adding a 10th condition that a variance be approved of 5 feet for the parking
stall at the southwest corner of the building.

Gar Irene (79039)Variance
Staff reviewed the report of July 6 regarding a variance to allow four
building permits on approximately 20 acres of hand west of the Plymouth Gun
Club, east of Peony .Lane and north of the Soo Line Railroad tracks and
explained the history behind the creation of these four lots, by statutory
division, which are outside the Metro Urban Service Area,

Mr. Irene, the petitioner, indicated that the ;Hardship was that he started
developing this land prior +o Ordinance adoption. He noted that if his
variance were approved, any further development of the lots was doubtful
because of the topography and creek.
Commissioner Barron askedthe ptttitioner if he was ,prepared to comply with the
Engineer's memo regarding the construction of a 9/10 mile 7 ton road to
serve these lots. Petitioner responded negatively.
Commissioner Vasiliou. arrived.
Staff const tinted on the City Engineer's memo regarding the equivalency of a
public road and that would go all the way to the end of the pavement on
I olly Lane.
Petitioner stated he had planned on putting a class 5 limestone road in,
commissioner Dire ing0red if any of the lots were sold to which he received
a negative response.
140TION by Commissioner Barron, seconded by Commissioner Wire to make the
following recotwendation to the City Council:
That the variance for Gary Irene to allow 4 building permits
to be issued on approximately 20 acres west of the Plymouth
Gun Club; east of Peony Lane, and north of the Soo Dine
Railroad tracks be denied for the following reasons J
I. Building permits are issued only to lots which abut
a public street,
Petitioner is not wil'l'ing to comply with the condition'
of the City Engineer's memo relative to a private road
of equivalent public road design.
Staff commented that the action taken should be relevant to the variance and
not solely as to compliance with the City Engineer's memo.
Commissioner Barron noted that had the petitioner been willing to comply,
he would have been in favor of -the variance.
Commissioner Schneider indicated' that the direction the Council wanted the
Commission to take was to discourage this type of development by requiring
abutment to a public street..
A brief discussion ensued regarding action the Council took on previous
similar petitions as noted in the staff report.

Robert Ameriks (A-829) Final Plat Approval
Staff revievied the July 6 report regarding the final plat approval of 12
single family lots at the southwest corner of 28th. Ave. N. and Orleans Lane.
Staff notedthat since the preliminary plat was approved two changes have
occurred; 1. a small portion of Lot 7 would be need to complete the QuakerLakecul-de-sac, and 2. 27th Ave. N. could be vacated,
Mr. Ameriks stated his concerns about fees for the assessments, and the
Commission directed him to take up that matter with the Council..
MOTION by Commissioner Wire, seconded by Commissioner Barron to make the
following recommendation to the City Council.:
That the final: plat for Robert Ameriks consisting of 12 single
family lots at the southwest corner of 28th Ave. N. and
Orleans Lane be approved subject to the conditions listed.
1. Compliance with the Engineer's memorandum For this
project. j
2. Dedication of necessary right-of-way for the Quaker
Lane cul-de-sac from proposed Lot 7 as approved
by the City Engineer.

Staff reviewed the report of July 6 regarding final' plat approval of four
industrial lots in the northwest quadrant of Niagara Lane and 28th Ave. N:,
Staff noted one change in the final plat from that of the preliminary platregardingthedesignofproposedLot2.

Mr. Don Anderson. representing the petitioner, -indicated that registration of
the land had been caken care of and explained the design of Loi 1 to Lot 2.
The rear lot line of Lot 1had been changed along with an adjustment in the
sewer easement,
Commissioner Schneider noted concern about density for the building.
MOTION by Commissioner Barron,. seconded by Corrmissioner Vasiliou to make the
following recommendation to the City Councils
That the ficial plat for Volp Construction Company consisting of
four industrial lots located in the northwest quadrant of Niagara;
Lane and 28th Ave. N. be approved subject to the following conditions;
I. Compliance with the provisions of the City Engineer's
memorandum for this project.
2. Design of that portion of Pond BC -9 within this plat
shall be specifically approved by the City Engineer.
3. Development contract shall' limit private curb cut access
to Niagara Lane to one for .proposed Lots l and 2,

Block 1.
s 4. Development contract shall reflect measures to implement
construction of the proposed new Medina Road/28th Avenue
North/Niagara Lane intersection.
5. All dead diseased trees on the site shall be removed
at the owner's expense,
6. Compliance' with City Council Policy Resolution No. 79-80
regarding minimum floor elevations in subdivisions enol
sites which abut or contain storm water drainage facilities,

Creeksi e Parlk and Parkbrooke 79018 RPUD 79-1
Staff reviewed the staff report of July 6, '1979, regarding the construction
of 128 quadra niniums and 10 townhouses in Outlot G of Plymouth Hills Addition.
Staff further noted the various discrepancies regarding these 'two plats, in
light of the Council Concept Plan/Preliminary Plat approval'.
Commissioner Vasiliou inquired as to why the Commission was seeing this now
if the proposal was not complete.
Staff responded that with the present volume of work, the apparent deficiencies
were best judged by the Commission, so the item could be given direction and
passed' upon or deferred.

Mr. .Dick Knutson of McCombs Knutson, representing the petitioner, indicated
that he felt the intent of Resolution 79-203 was met. Regarding condition
1, the cross sectional view was corrected.
Chairman Schneider noted he thought the quadraminium units were to be
buffered from the single family area to the north.
Comm ssioner Barron made reference to previous Planning Commission minutes
stating that the Goffnission wanted a view of the terming from the north.
Mr. Knutson further pointed out details regarding the terming and reviewed
each berm with respect to height and the saving of existing oak trees.
Chairman Schneider stated he was not as concerned with plantings on the
interior as he was with ones on lthe exterior.
An extensive discussion enused concerning the landscaping along County
Road 9
Til Igo, petitioner, reflected the berminq Siong County Road 9 by explaining
there would be screening on both sides *Jt the bFrm filling in the gaps. He
further explained this would be done all along County Road 9,
Commissioner Wire expressed concern regarding the landscaping per the
grading plan.
Commissioner Schneider indicated there should perhaps be a backup for the
Russian Olives since tnepre were a relatively short-lived tree.
Regarding the Flood Plain Ordinance, Mr. Knutson indicated he perceived the
Ordinance as stating no specific action was needed at this time because no
unit would be in the Flood 'Plain area; however, they would.comply if need be.
Staff stated Section 6 of the Ordinance clearly required a CUP because
the subdivision did involve the General Flood Plain district.
Concerning the trailways, Mr. Knutson indicated they might add a trail along
County Road 9 in which case they would come back to the Commission with a
modification. He further stated they would grade the Plymouth Creek trail
if the sewer contractor would not, thereby leaving it in its finished stage
prior to the City completing it. He noted that Parkbrooke would not have any
trail -ways because of its size
Regarding the Environmental Assessment Worksheet, this has been done, and
plans would be certified as complying with the Area EAW.
Regarding park dedication, this will be taken care of per policy.

Concerning condition #7, the City Engineer was concerned with how the road
comes into the property to the east. Mr. Knutson showed a slide of the area
road circulation. Commissioner Schneider suggested that the road be
curvalinear prior to connecting to the property line, so "deeper" lots could'
be assured south of the road on the adjacent land to the east:

followingrecommendation to the City Council
That the final pkat for "Garrison's Greekside Park" RPUD 79-1
consisting of 64 quadraminium dwelling units and 2 outlots
in Outlot G of Plymouth Hills Addition be approved subject
to the following conditions=
l.. Compliance with the City Engineer's memorandum for
this project;
2. Payment of Park dedication fees in lieu of dedication
based upon 64 dwelliig units and :n accordance with
City Park Dedication Policy in ef;ect at the time of
filing of final plat.
3. Designation and dedication of riglst-of-way for proposed
38th Avenue North per design approved by the City
Engineer north of Outlot B.
4. Compliance with the requiremenits of Section 9 of the
Zoning Ordinance with respect to homeowners association
agreement to be reviewed and approved by the City
Attorney as to form and content, including provision
for maintenance of common facilities by the City, if
necessary, with the cost to be assessed agnst the
homeowners as 5ociation.
5. Certification that the development grading, drainage
and ponding sh,11 be consistent with the guidelines
set forth in the Related Area Environmental Assessment
Worksheet for Plymouth Hills Addition.;
6. Compliance with the provisions of Section 6 of the
Zoning Ordinance relative to flood plain development'
prior to filing of final plat.
7. Submission of plans showing extension of proposed
streets to the east.
8. Submission of detailed plans showing the grading
and design of internal trail linkages with the
public trail corridor.

9. Completion of the necessary replatting as approved by the
City Engineer relative to former 37th: Avenue North cul--de-,sac
and proposed 38th Avenue North,
10., Removal of all dead or diseased trees feom :he site at the
owner's expense.
Mr. Knutson stated concern with the items No. 3 and No. S, because the petitioner
had drawn deeds with the owner based upon the proposed plat with no road. Staff
stated road dedication was essential and should be part of this overall plat,
and not part of the anticipated plat of Outl of B. Mr. Knutson ,suggestedan
easement for the ri Chit of way could be dedicated. Chairman Schneider stated
the Council' should determine that.
Chairman Schneider, noted the land to the east is guided LA --2 and probably would
consist of RPUD's in the future.

Discussion than ensued regarding the site plan for Creeks-' and especially
the landscaping and internal trails.
MOTION: by Commissioner Wire, seconded by 'Commissioner Eagleton to make the
following recEairmendation to the City Council
That the site plan for Garrison's Creekside Park, RPUO 79-1 be
approved subject to the following conditions;
1. No building permits to be issued until the final plat for
Garrison's Creeksi de Park Addition is filed with the
County.
2. Submission of financial guarantee termed for 24 months to
assure completion of ai.proved site improvements.
3. Submis ion of detailed sign plans before the issuance
of :;ign permits.
4. Compliance with Policy Resolution No. 79-74 and with City
Code regarding fire lanes and fire hydrants.
5. installation of concrete curb and gutter around all
driving and parking areas in accordance with Policy
Resolution No. 79•-73,
6. Compliance with Council Policy Resolution No. 79-80
regarding minimum floor elevations for new structures
on sites adjacent to or containing open storm water
drainage facilities, construction also to be in
compliance with any adjustments mandated by the
findings of the General. Flood Plan Use Permit per
Section 6 of the Zoning Ordinance.

7. Provision for additional buffering including plantings
and berming. along County Road 9 and that the landscape
plan show the berming as indicated on the grading plan.
Building setbacks to be as indicated on approved plan.

main motion by adding a 9t1i condition: that the landscaping along County
Road 9 in the second phase be completed at the same time the first phase
is completed,

Parkbrooke Final Plat/Plan RPUD 79-1'
Staff reviewed the report dated duly 6, 1979 notin ;his was an amendment of
10 townhouses instead of 12 quads:
Commissioner Barron inquired if there would be two separate homeowner's
associations to which Mr. Knutson replied in the affirmative. He further
inquired as to the price of the townhouses.
Mr. Frank Larson:, petitioner, stated the price would be in the range of
110-130,000. He further explained the exterior construction of the
houses.
Commissioner Vasiliou inquired what the owner relationship was between the
two proposals.
MOTION by Commissioner Barron, seconded by Commissioner Vasiliou to make the
following recommendation to theCity Council:
That the final plat for "Parkbrooke" RPUD 79-1 consisting of 10
townhouses on Outlot B of Garrison's Creekside Park be approved
subject to the-follQwing conditions:
1. Compliance with: the City Engineer's memorandum for
this project.
2. Payment of park dedication fees v, 1 i eu of dedication
based upon 10 dwelling units and in accordance with
City Park Dedication Policy in effect at the time of
final platting
8. Right-of-Fway dedication for 38th Avenue North shall
be part of the Garrison Creekside Park plat and
therefore deleted.; adjustments to be made to this

That the site plan for "Parkbrooke” RPUD 79-1 be approved subject
to the following conditions:
1. No building permits to be issued unt*l the "Parkbrooke"
plat is filed with Hennepin County and until full street
access has been provided to this site from the west,
2. Building setbacks and yard setbacks from the public
street shall be as indicated on approved plans, and in
the case of adjustment of the alignment of 38th
Avenue North, shall be no less than that indicated on
the approved. plans
3. Submission of financial guarantee termed for 24
months to assure completion of approved site improvements,
4. Submission of detailed si°jn plans before the issuance
of sign permits,

Staff reviewed the report dated July 6, 1979, regarding the proposedresidential
planned unit development consisting of 94 townhouse and quadraminium units.
north of County Road 9 and east of Trenton Lane;
Chairman Schneider inquired whether, the items that resulted in this petition's
deferral from the June 27 Planning Commission meeting had been complied with.
Staff noted they had with the exception of the access of one unit on Trenton
Lane;
Mr. Clack Knutson of McCombs-Knutswi representing the petitioner indicated that
the unit south of the collectyar street, east of Trenton could be shifted so
as to eliminate the exit onto the new collector street.
Staff indicated the Mengelkoch 'petition would be carried forward to the City
Council as indicated earlier.
Chairman Schneider noted the Commi;s*rtnn had little preference as to which
exit Mr. Mengelkoch used in lieu of the one to County Road 9,
MOTION by Connissioner Vasiliou second*d by Commissioner Eagleton to make
the following, recommendation to the City Council s
That the prel iminary plat/plan, rezoning and conditional use
permit. for, Norman Janes for RPUD 79-2 consisting of 94
townhouse and quadraminium units north of County Road 9 and east
of Trenton Lane be approved subject to the following conditions:

1.. Compliance with the Engineer's memorandum on this
project,
2. Specific engineering dnalys-is of the drainage and
ponding area at the north end of the site, per the
submitted CAW, to be incorporated into the final plat.
3, Dedication of right--of-way for County Roark 9 as
indicated; said dedication to be coordinated with the
approved dedication from the approved Menglekocn
property..
4, Coordination at the final platting with the proposed

division of the Menglekoch property to provide
driveway access rights to County Road 9 from that
exception parcel; to be dedicated to the City, with
driveway access fro the house on that parcel to be
moved to Trenton Lane:; and that public street access
to the easterly boundary of the exception parcel be
provided with necessary easements from the exception
parcel to allow for completion of a cul-de-sacs
5. Payment of park dedication fees in lieu of dedication
based upon City Park Dedication Policy in effect at the
time of filing of final plat.
6. Developer shall petition for a public improvement project
to provide a public street access to Nathan Lane prior to
final platting.
7. Substantial buffering consisting of berming, and/or
plantings to be provided along the east side as transition
to the commerical area.
8 Provision for,10 foot easements on either side of the east-
west astwestpublic; street for trail purposes,
9. Revision of proposed quadraminium units north of the public
street (23 through 26) to eliminate public street access
onto Trenton Lane.
MORION by Commissioner Schneiders seeondd by Commissioner Carron to amend
the 9th, condition to read as follows; Lots 1-4 either share their driveway
with the ones to the east, or come out onto Trenton Lane so there will be
less congestion; and 6riveways on the north bloc (Lots 23-26) be oriented
northerly onto Trenton Lane by acquisition of adjacent triangular property if
possible, or share access with units to the east

Staff reviewed the report of duly 5, 1979 concerning the request to divide a
existing platted lot into 2 Tats with less than Ordinance minimum widths west
of Orleans Lane between 28th and 29th Avenues North. Staff noted also that
the petitioner could not be veached.
Following a brief discussion there was a MOTION by Commissioner Wire, seconded
by Commissioner Eagleton to make the following recommendation to the City
Council
That the variance request for Charles Dressel to divide an existing
lot west of Orleans Lane between 28th and 29th Ave. N. be approved
subject to the following conditions:
I. Payment of park: dedication fee in lieu of dedication
for one lot in accordance with City Park Dedication
Policy in effect at the ti.rte of filing the division,
2. All new construction shall comply with the, Zoning
Ordinance as to setbacks
3. Any and all additional Residential Equivalent
Charges, area and/or lateral charges to be paid prior
to building permit issuance
4. Any neer sewer or water connections to be made at
owner`s expense.
5. Required utility and drainage easements, as approved
by the Gity Engineer, to be filed prior to filing
of the lot division.

Chairman Schneider recommended that Commissioner Vas lion be appointed
by the Mayor as Vice Chairman,
here being no further business to come before the Planniog Commission,,the
meeting was adjourned at 12:15 AM.
