A regular meeting of the Plymouth Plannin,7 Commission was calZed o ord-v by

staff reviewed the report dated April 2?, Z979, regarding the proposal to rezone
a tract of Zand at the noovthw, est corner of 1-494 and County Rd. 9 from R-U (re-
stricted residential subdivision) to B-1 (office Limited business). Staff noted
that because of the: physical constraints on the property the Planning Commios,.on
had earlier deterrnined that light commercial guiding was better than industrial.
Staff further noted concern about the read intersection with County Rd. 9, right-
of-way needs fo County Rd. J and pedestrian circulation. Utilities to the site
should be available this year.
A brief dssaussion ensued concerning the placement of the trail corridor, the
orzginax guiding of the properly G,i access to the residential area to the nort%
Greg Dumonceaux, architect representing, the petitioner, explained the size of
structs.-es that probably wculd be constructed and the types of uses that would W
utiGized including one Freestanding Class Z restauranv. Fie further noted the
t i.nimum lot size was one acre. Regarding a e'uestion concet-ning the community
trails and sidewalks, he stated they vouldbe open to suggeations concerning this.
Chairman Davenport opened the tbZic hearing.
Ctrs. IlaroZd liytian of 1030 .Kirkwood Tare indicated she owns land to the north and
east. She seated presently it was guided LA-3 but was not in 4959 when she pur-
chased the land. .She was opposed +o the residential g°riding because of the impact
of the freeway and stated it would - Metter guided commercial or industrial.
Chairman Davenport explained that her land was not being considered at this h -ing.
Mr. Dale Berthiaume of 13905 Co. Rd. 9 questioned why the residential development
proposed several years ago was not undertaken. Ile expressed concern about the
boundaries, the number of stories of the buildings, number of restaurants going
in, landfill that is being proposed, the road alignment and trail corridor
location.
Racy Schlosser of 4150 Fernbrook Lane questioned the ava-.Labizity of sewer to
the area and wondered if it was contingent on the Criterion RPUD doveZopment to
the south.

Staff reviewed the report dated April 27, 7979, regarding the proposal to con-
struct 323 singte family detached homes on l75 acres north of County Rd. 9, east of
Turtle Lake, oest of Fernbrook ,Lane and south of approximately 45th Ave. N. Staff
addressed the relationship of the project to surrounding neig?zborhoods, its com-
pliance with City ordsl;xnces and the Comprehensive Plan and recommended action
which included referring the plan to FRAC.
Mr, 5nerm (Wdberg, engineer for Lundgren Bros., addressed the four RPUD attvibute,
of the Ordinance, He father indicated that when sewer is available to a site,
the site is ready for development,
Mr. Dice Knutson of McCombs -Knutson gave a cost comparison summary between 04'
it would cost for 2.3 units/acre in a RPD'D -nd Z,7 units/acre in straight platting.

or traits within this site. Fie noted efforts ti preserve the marsh and ponding
areas and a possible paz•K site on Pernbrook Lane,
Chairman Davenporr opened the rtformationaZ hearinq.
Air. Richard Davideit of 4420 Vicksburg Lane noted concern with the environmental
impact of Turtle Lake. Ile wondered if there was any control over the amount of
filt and grading. He further noted the Zack of park space in light- of the number
of, children possible in the area.,

would go orce the natural dru,snage area was replaced with houses,
Adr. r. father Gilson of 4235 Fennbrook .bane questioned the availability of sewer

of this deveZopment wouyd have on it He stated h- and the adjacent owner would
prefer to vacate it; staff explained the procedure.
Mr. Coldnerg then: responded to the various c»onments aznd quer .ions posed 'g the
citizens regarding filling, cost of hom,:s, timing oy deveZopment and storm drainage.
He stated :he required Environment l Assessment Worksheet would be prepared and
submitted at the time of preliminary platting

Commissioner Threinen stated the G`riterzon RPUP approved street intersection on
the south of County Rd. 9 is offset to the Wiest of the west boundary of th.-. Rem-
brandt site, and efforts should be made to contact the owner of the land to the
west as to future right-of-way needs. He also stated that the trail corridor
should be as indicated on the City Plan, but the crossing at County fid. 9 was a
problem which should be reviewed farefulZy,, with input from MO., for both this
te and for . the Criterion site..

That the request by Rembrandt:} Inc. to reguide the land at the nortnwest corner
of X-494 and County Rd. 9 from IP to CL consistent with t!ye December, 7,978, Com-
mission recommendation based upon the Barton Aschman Physic.°a” Constraints Analysis
and in consideration of the access and buffer,ng characteristics of the site be approved.

Extensive discussion ensued regarding the criteria for granting variances which staff
read at the Cha:xman request.

lztaff recownended mixt the Planning Commission meeting schedule be changed from the
Zst and 3rd Wednesdays to the 2nd and 4th Wednesdays to alleviate congestion in
preparing two agendas in the same week for both the Planning Commission and City
Council,

the Planning Commasion meeting schedule as the 2nd and 4th Wadnesdays effective
with the June meeting.
