HomeMy WebLinkAboutPlanning Commission Minutes 05-03-1978PLANNING COMMISSION: CITY" OF PLYMOUTH, MINNESOTA May 3,,1978 A regular meeting of the Plymouth Planning Commission was called to order by Chairman Davenport at 7:30 p.m:. in the Council; Chambers of the Public Works Building, 14900 23rd Avenue North. MEMBERS PRESENT: Chairman Davenport;; Commissioners Erickson, Schneider, Threinen and Vasiliou (arrived at 8:30 p.m.) MEMBERS ABSENT. Commissioners Barton an(.. Stewart STAFF PRESENT; Charles E. Dil'lerud and Kate Marx A-338: Mission Partnership RPUD 76-1 A-33.8 Revised Preliminary Plat/Plan Staff presented the request of the Mission Partnership for revised preliminary plat/plan approval for the Mission RPUD 76-1, located north of 36th Avenue North., west of Zachary Lane and south of County Road 9. The internal circulation changes, structure type changes and adjusted spot densities as proposed were explained in detail. Staff observations and recommendations were presented per the Staff report of April 27, 1978. Commissioner Threinen questioned why the cul-de-sac had been created at the southerly end of the 1,iestern most roadway serving the multiple units, just west of Mission Ridge .and Mission Ridge 2nd Addition. Staffexplained that the re-routing did not reflect so much on a need for greater circulation flexibility within the plat as to the request of the homeowners in Mission Ridge and Mission Ridge 2nd' Addition for not having the roadway so close to their homes. Commissioner asked if this would not be creating an unsafe situation with respect to the "dead-end" in effect being so long. Staff indicated that the routing of the road to intersect with 36th Avenue North was not essential to circulation. Commissioner Schneider asked how long this cul-de-sac dead-end would be. Staff stated that it would be approximately 800 'Feet servicing 48 units. Commissioner Threinen questioned whether all areas labelled "G" wherein previously four story structures existed, had been replaced with three story structures. Roger Clemence, representing the Mission Partnership, stated that this wa. true. Mr. Clemence explained the architectural design differences between the two types of structures. Commis,sionerSchnei.derasked petitioners why they felt the overall changes were necessary, Mr. Clemence explained that the Partnership felt that this 1978 plan wasI more responsive to the direction given the Partnership when it first began the projectin1974., i:e, the greater density should be to the .north and west of the property. Further, it was the feeling of members of the Partnership that it was impossible at the start of the project to predict market conditions for the years to come It was their opinion that this proposal was more responsive to the present and future market Planning Commission Meeting Minutes -2 May 3, 1978 conditions that the original proposals were. Commissioner Schneider questioned whether petitioners would again find it necessaryatsomepointinthefuturetoreturnwithanamendedplan, again responsive to changing market conditions,. He'stated that the elimination of the high density was not the intent of the RPUD ordinance and added that he did: not feel the bunching" of the density further north and west each time was responsive to the ordinance nor to the original approvals granted this RPUO. irman Davenport questioned whether the purchasers of lots within Miswion Ridge and Mission Ridge 2nd Addition were informed of the ;potential road planned to the west of their lots. Mr. Clemente stated that they were informed before the purchase. Tom Parish, 11515 - 38th Avenue North, suggested alternate xoutings for the westerly most roadway intersecting 36th Avenue North. He stated that he felt it was important that Evergreen Lane residents nGt bear the burden of the multiple traffic.. Bill McCowan, 11605 - 37th Avenue North, stated that it was his. understanding that 36th Avenue_ Borth would become a dead-end street. He asked if the main access to the future Hennepin County Park would be via 36th Avenue North. Staff explained that during deliberations for the park in 1975, that it was made clear that 36th Avenue North was not to be used as an access point to the park, that the park would only be accessed via a public, County -built road intersecting at County Road 9. Mari l n _Thompson, 3650 Forestview Laine, stated that she had been informed of the future plans for the area. She questioned the eventual use of the outlot adjacent to her lot, however, if the new plan was to be approved. Staff explained that it was the intent of the City that this outlot be available for the neighborhood to access Medicine Lake Regional Park once it was built by Hennepin County. Rich Holter, 3640 Forestview Lane, stated that he felt the alignment of the westerly most public roadway to intersect with 36th Avenue North would create an "alley" for the existing homes. He added that he felt this would be a very undesirable situation. Dave Cavanaugh, 3645 Forestview Lane, stated that he was. aware of the future plans Tor the area as they were available in the model, However, he acded "hat it was only after moving into the neighborbood and living there for awhile that they could see how much traffic 36th Avenue North would carry. He stated that he favored the cul--de-sac for 36th Avenue 'North which would end approximately 800 feet north of 36th Avenue North. Mr. Clemence spoke to the proposed alignment changes of the area citizens, Most of the changes proposed involved cutting a hill or building very steeply graded roads, beyond City -accepted standards, Evelyn Lan e, 11720 - 38th Avenue North, asked what would happen to the trail panhandles_" near her lot if the: new plan was approved, Staff indicated that under similar conditions, the City split the property evenly between the adjacent propertyowners. It would be up to the City Council to decide the answer to that question at the time of review of the entire project.. Bob Sorenson, 11520 - 38th Avenue North, stated that the salesman had told him that the wester y most roadway running north -south would be located below the hill and that .Evergreen Lane would be a dead-end and not intersect County Road 9. Lane, stated that he was as concerned as the residents neat 36th Avenue North that his portion of the neighborhood noir be adversely affectedbythetrafficcirculation. He stated that be preferred Evergreen Lane to be a cul- de-sac as recently proposed and that he did not feel it was necessary that the multiple traffic be routed through the single family neighbo-hood Bob Donley, 11740 „ 38th Avenue North, stated that he was concerned that 36th AvenueNorthwouldbecomea "race track" for the high school students and that, should the westerly most roadway intersect 36th Avenue North as originally planned, much of this traffic from the high school would be routing through both the single family and multiple -family residential neighborhoods Anna, Lundquist, 11730 - 38th Avenue North, stated concern that car lights would be flashing into her windows if the multiple traffic were rotated through her neighborhood, Commissioner Threinen asked petitioner if it would be possible to build all the roadways: proposed prior to any ,additional purchases of property in the are,. Peter Pflaim, one .of the Mission Partners, stated that it 4vould not be possible tocoiiviit _ oinq so, Commissioner Threinen stated that he did not feel it was appropriate to change what was considered a good design on a referendum basis just because; people had beguntoliveintheneighborhood, Mr. Parish asked if the grade of Evergreen Lane was not greater that City standards would' allow. Staff stated that it was greater --City standard dictated 6% EvergreenLanewascloseto8% --but that there were very few options available to the routingoftheroadwayinthatcases Larry Gulden, 3820 Forestview Lane, stated that, from a security standpoint, he was not comfortable with a street being located so close to his home from the rear, He stated that he preferred the cul -de -ac that would dead. -,end the street 800 feet north of 36th Avenue North, R. J. ConMissioner Threinen questioned what the distance was fyorr, Highway 101 right-of-waytothenearestunits. Mr Knutson responded that the closest unit was 40 feet from Highway 1G1 right -of -sway, interior setbacks from the public right-of-way were '2S feet, Dale Meeks, 654 Harmony Circle asked if signalization of Highway 101 would be consideredinvofthetraffictobeintroducedasaresultofthisproject. Staff explainedthesystemforobtainingsignalsatintersectionsonStateHighways, Mr, Weeks asked, what the distance was from the closest unit to the school property (at the northwest portion of the project). Mr, Knutson indicated that this, too, was 40 feet,. Frank Conner, 671 Harmony Circle, stated that he fOl t the traffic situation, withvehiclesfrom112unitshavingonlyoneingress/egress, would be quite difficult, He added that )e felt the potential traffic problems for this area warranted Cityreviewinterme, of requiring another access or immediate signalization of the intern secAtion.; Chairman Davenport closed the public hearing at 9:25 .mp9p MOTION was me,,de by Commissioner Schneider supported by Commissioner Erickson that the Planning Commission take action on this item at this meeting, MOTION CARRIF (5-0-0) (Alli in favor) A:529 Mendci A-52$ Preliminary Plat .and Rezoning from RRO to B-2 and Site Plan Staff presented petitioner's request for pmliminary plat review of Maple Grove Center 2nd Addition as well as rezoning from R -O Residential Subdivision) to B-2 Shopping Center Business District) and site plan review for a portion of a shoppingcenterproposedtobelocatedwithinthecorporatelimitsofbothMapleGroteand Plymouth with the majority located within Maple Grove, Staff made observations and recommendations regarding the site per the Staff report of April 28, 1978, In addition, Staff pointed out that the City of Maple Grove had granted approvals for the preliminary plat, rezoning and site plan requests of the developer at this time, Mr. R,an, Rvl,n Construction, representing petitioner, outlined that portion of the proposed shopping center which would be located within the corporate limits of theCityofPlymouth. In effect, the City of Plymouth would have a portion of the parkinglotwithinitsboundariesatthistime --no structures. Commissioner Vasiliou asked what uses had been proposed for the center; Mr, Ryan responded that a grocery store, drug store and hardware store, and various specialtyslopsWouldbeincludedforthecenter. a PLANNING COMMISSION MEETING MINUTES -5- May 3, 1978 Commissioner Schneider asked what the direction of drainage would be from the parking; lot. Mr. Ryan responded that the drainage would be ,o the north. Commissioner Schneider pointed out that he felt pians for the remaining property should be considered carefully in view of the fact that, portions of the project would be quite close to LA -1 guided areas of the City. He added that more stringent means of buffering should be considered for those portions of the project close to the LA -1 areas of the City, Chairman Davenport questioned whether it would be possible to place;a berm along the County Road 10 frontage of the project in order to provide greater screeing of the structures. Staff pointed out that a berm at the southeast corner of the project would require the elimination of some of the trees in that area. Gary Welk,,5010 Kirkwood Lane, representing the -Shorewood Homeowners Association, statethat the Association had two concerns with respect to the project: 1) traffic flow and control --he questioned what plans the City would have for the control of traffic in terms of signalization and access for pedestrians, and 2) adequate buffering from both site and noise that would be introduced by the center --parking lot would be located quite close, within 80-90 feet, to the homes in Bass Lake Shorewood Hills. Mr. :Ryan responded that the height of the berm would be 5 feet which would aide in the screening of vehicles/parking lot from the residents south of County Road 10. Headlights would not shine into the homes with a berm of this height.. Staff stated that the noise would be better buffered by trees than by the berming of the entire frontage of the project. Mr, Welk asked if it would be possible to guarantee that the trees in existence would not be touched in order to preserve the noise buffering qualities that were there. Staff responded that this type of condition may be handled via the development contract. Mr. Welk asked if traffic signals would be added to County Road 10 in order to slow the traffic on the road, particularly in view of the fact that the shopping center would draw more traffic into the area.. Staff explained the system by which traffic signals could be installed at intersections. It was pointed out that by the time Prudential would be ready for occupancy, the traffic situation would be one warranting the installation of the signals in that area,. Melvyn Magree, 5925 Magnolia Lane, suggested that bicycle. and pedestrian access to the project be given more consideration, not only from residential areas, but from the eventual business developments in the vicinity as well. Chairman Davenport closed the public hearing at 10:05 p.m. MOTION was made by Commissioner Vasiliou supported by Commissioner Erickson that the Planning Commission take action on this item at this meeting. MOTION CARRIED (5-0-0) (All in favor) PLANNING COMMISSION MEETING MINUTES May 3, 1978 I* A-745 Lard LaUkka A-745 Concept Plan for RPUD 78-3 Staff presented petitioner's request for Concept Plan approval for RPUD -8-3,proposed to be located in the northeast quadrant of Larch Lane and County Road 9.' Of the 102acres, 96 units were proposed as single family residential, 168 units as quadraminiumsand100-120 apartment units. Additional observations and recommendations of StaffwerepresentedpertheStaffreportofApril27, 1978` Commissioner Threinen questioned whether the construction of County Road 9 as alignedthroughthisplatvasaconsiderationoftheCouncilatthistime. Staff indicatedthatitwasnot. Commissioner Erickson asked if the final alignment of Larch Lane had been determinedandhowitwouldaffectthisproject. Staff indicated that it had been proposed for realignment in three different manners and explained how each would affect the property. Commissioner Threinen asked if the proposed trail was actually to be aligned on the north side :of County Road 9. Staff stated that this was true. Dan Hess, Land Man, Inc., representing the developer, indicated that it would not be a probl ein to relocate the trail to be in compliance with the Trail System Plan. James Bjorgan, 12135 County Road 9, asked if the drainage for the property would betothesouth. Staff explained that the drainage would flow to the south and that the developer would be required to build the project in such a manner as to maintaintheflowinthequantity, quality, and direction it was currently taking. Mr. B,jorgan added that he felt it would be quite important to determine the final alignment of County Road: 9 both for the developer and the surrounding property owners. Commissioner Threinen stated his reasons for the recommendation as folloik s the proposed lower profile of the three„ -story condominiums was preferrable to the four- story/stacked duplex units of the previous plan; the new circulation patterns for traffic were an improvement over the previous plan in separating multiple/singlefamilytraffic; the arguments of the;;exisLing neighborhoodresidents were pursuasive in terms of the elimination of an intersection with 36th Avenue North for the most southwesterly multiple units; and since the Mission Partners are responding to achangeinmarketconditionsfortheproposeddensitytransfertothe 'west, Commissioner Threinen stated that he did not feel it would be appropriate to transfer density toareaJIsimplyasareactiontoachangei'n the market, He added that he did not. feel that any neighborhood should have such an influence on a proposal as to negatethesoundplanninganddesignreasonsforaproject, that the City should not be planned on a referendum basis. Chairman Davenport questioned why a. roadway aligned from 36th Avenue North, north to access the condominiums was not proposed. Commissioner Threinen stated that he felt the grades were too steep for such a roadway and: that the roadway would onlybemisused, It was better eliminated altogether, MOTION CARRIED (5-0-0) (All in favor) A:759 _e_Mrion Company A-759 Preliminary Plat/Plan RPUD 77-3 MOTION was made by Commissioner Threinen supported by Commissioner Schneider that the Planning Commission make the following recommendation to the City Council: That the request of Centurion Company for preliminary plat/plan approval for RPUD 77.3, King5mood Farm, located in the southeast quadrant of the Luce Line Trail and Highway 101, consisting of 112 single family detached units, be approved, per plans dated,Aprial' 28, 1978 and subject to the following conditions.- I. onditions: 1. Structure setback for the units from Highway 101 be 50 feet minimum at the southwest property line. 2 Compliance with the provisions of th.; City Engineer's memorandum, PLANNING COMMISSION MEETING MINUTES -8 May 3, 1978 3. A-528 Preliminary Plat, Rezoning from R-0 to B-2 and Site Plan MOTION was made by Commissioner Schneider supported by Commissioner Erickson that the Planning Commission make the following recommendation to the, City Cou,nci?:' That the request of Mendota, Inc. for preliminary plat approval for Maple Grove Center 2nd Addition, proposed to be located north of County Road 10 and east of Highwray 494, per plans Staff-dated April 26, 1978, be approved subject to the following conditions; 1= Written concurrence from Hennepin County as to right-of-way width and location for County Road 10. 2. Further development actions, except for platting as unbuildable outlots shall be withheld for Lot 2, Block 1 and Block 3 until City Council approval of plans to extend public utilities to serve these sites. 3. Compliance with the City Engineer's memorandum, 4. Approval of the City of Maple Grove for the plat of Maple Grove Center lst Addition. S. Retention of the existing trees along' the east and southeast portions of the parking lot. Should it become necessary, due to construction, to remove any of the:rees, each one removed shall be replaced by one evergreen tree, 8-10 feet in height. Staff, prior to. grading of the site, shall determine the number of existing trees of 3" calipher or greater. FURTHER, that Council Policy Resolution #75-664, dealing with development of the unsewered areas of the City, be waived , b,. ,waived based g suponthefollowingfzndnpg 1. The development of this property is not considered "leap -frogging" in that development is taking. place directly south of County Road 10. 3. Very little. of a true developmental nature is entailed in the petitioned action. A part of a parking lot that is best located within the City of Plymouth, as opposed to the City of Maple Grove, is the main consideration at this time, acid will not, in itself, require the extension of City services.. Commissioner Vasiliou stated that she felt the provisions of condition #5 were too stringent. MOTION CARRIED (4-1-0) (Commissioner Vasiliou against) MOTION was made: by Commissioner ,hneider supported by Commissioner Erickson that the Planning Commission make the follotr,R,q recommendation to the City Council: That the request. of Mendota, Inc. for site plan (as General Development Plan) and rezoning from R-0 (Restricted Residential Subdivision) to a-2 (Shopping Center Business), of Lot 1, Block 1 of the preliminary plat of Maple Grove Center 4 2nd Addition, per plans Staff -dated April 26, 1978, be approved subject to the following conditions: 1. Compliance with design related conditions of the preliminary plat. 2. Approval of a final plat and development 2, :-t covering the subject site as well as dedication of and improver,:o s to Sycamore and Quinwood Lanes; and County Road 1.0. 3. Approval of the City of Maple Grove of all necessary plats, site plans, and building-.ermits for the Maple Grove Center. 4. Provision of site plan improvements security per the Zoning Ordinance requirements with the City of Maple Grove to act as escrow agent on behalf of the City of Plymouth. 5. Payment of nark Dedication fees -in -lieu of $1,350. 6. Retention of the existing trees along the east and southeast portions of the parking lot. Should it become necessary, due to construction, to remove any of the existing trees, each one removed shall be replaced by one evergreen tree, 8--10 feet in height. Staff, prior to the grading of the site, shall determine the number of existing trees on the site of 3" calipher or greater. 7. All trees which are part of the landscape plan and are located within the City of Plymouth corporate limits, shall be 4-6 feet in height. Commissioner Vasiliou stated that she felt conditions #6 and. 7 were too stringent for compliance by the developer. PLANNING COMMISSION MEETING MINUTES -10 May 3, 1978 MOTION CARRIED (4-1-0) (Commissioner Vasiliou against A--. 45Larry Laukka A-745 Concept Plan for RPUD 78-3' MOTION was made by Commissioner Erickson supported by Commissioner Threinen that the Planning Commission make the following recommendation to the City Council That the request of Larry Laukka for Concept Plan approval for 'RPUD 78-3, located in the northeast quadrant of Larch; Lane and County Road 9, proposed for 9e single family detached units, 168 quadraminiums, and 100-120 apartment j units be denied basad upon the following findings: 1. Density for the project as proposed exceeds that allowed within the LA -1 guided areas of the City of 2-3 units port acre. 2. Blilk of the property should contain single family detached and transition should take place on the property to the west within the LA -3 guided land. The unit type proposed in inadequate for the guiding of the: property. MOTION TO AMEND was made by Commissioner Schneider supported by Commissioner Vasiliou to substitute the following for condition #2 of the previous motion; "The area at th, routhwest.portion of the property should be single family detached as opposed to the apartment units proposed and the transition area from the LA -1 of this property to the. LA -3 of the property adjacent to the west be on the property to the west, not part of this proposal. The burden of transition should be on the property that is .guided for `,-he higher, use, MOTION TO AMEND CARRIED (3-2-0) (Commissioners Erickson & Threinen against) The Commission then voted on the main motion as amended. A-792 Final Plat/Plan for RPUD 78.1 Staff presented petitioner's request for final plat/plan approval of RPUD 78-1, Burl Oaks, located at the vest end of 9th Avenue North, east of State Highway 101, proposed for 21 dwelling units. Recowendfations and observations of Staff were presented per the Staff report of April 25, 1978, MOTION was made by Cowirissioner Schneider supported by Commissioner Threinen that the Planning Commission make the following recommendation to the City Council: That the request of Lundgren Bros.. Construction, Inca for final' plat/plan approval for :RPUD 78-1, Burl oaks, located at the west end of 9th Avenue North, east of State Highway 101, proposed for 21 single family dwelling units per plans Staff -dated PLANNING COMMI$SION MEETING MINUTES -11 May 3, 1978 April 25, 1978, be approved, subject to the following conditions: I. All diseased trees be removed from the site at owner's expense. 2. Completion of the Environmental Assessment Worksheet process. 3. Structure setbacks along Highway 101 be 50 feet; structure: setbacks on the internal streets of the project shall be 35 feet for front yard and 10 feet for side yard. 4. Compliance with the provisions of the City Engineer's memorandum. 5. Park dedication shall consist of Outlots A and B. 6. There shall be a 9th Avenue North access for temporary purposes located to the east of V e project. The period of time for use shall be specified in the development contract with the termination date of approximately September 1979. 7. Lot B, Block. 1 be granted a variance for 25 feet front yard setback to preserve the pond on the north portion of the lot. 8. Rear setback on Lots 4, 5, 7, and 8, Block 1 shall be ninimum of 100 feet. 9. Park dedication shall consist of the following: A. Commissioner Schneider questioned the status of the peninsula in Gleason Rake as to the reaction of the Minnesota Department of Natural Resources to purchasing the parcel. Peter-Pflaum, Lundgren Bros, Construction Inc., stated that DNR was, definitely interested. in purchasing the parcel, and added that it would take approximately 5 months for them to acquire the property. The Commission discussed the proposed access to the parking lot of the church and the parsonage lot with Dick Berreth, representative of the: church. It was suggested by the Commission, and agreed to by Mr. Berreth, that the church parking lot not be accessible via the cul-de-sac to be built. An insurmountable curbing was suggested as a method of conteolling this situation. MOTION was rade by Commissioner Erickson supp rted by Commissioner Threinen that the Planning Commission make the following recommendation to the City Council; That the request. of the Wayzata Evangelical Free Church for site plan expansion and a conditional use permit for the church located west of Highway 101 at approximately 7th Avenue North, per plans Staff -dated April 27 1978, be approved subject to the following conditions 1. Adjustment of the site pla: to eliminate all off-street parking setback variances. 2. Provision of an 1.8 -month performance bond to guarantee all landscape and paving, including improvement of the Narcissus Lane cul-de-sac to a standard 7ton City cross-section. 3. Removal of all temporary site structures upon occupancy of the building addition, or upon expiration of the conditional use permit (Council' Resolution #77.264), whichever occurs first. 4. Design of the cul' -de --sac be in such a manner as to eliminate any access to the church parking lot from. Narcissus Lane, and that bermi'ng be added to insure the access be eliminated. The Commission concurred that the design of the cul-de-sac to eliminate access to the church parking l-ot would accomplish several things: 1) it would help to protect the residential neighborhood to the south from more traffic being introduced when the church would be in use, 2} it would stop the use of Narcissus Lane as an informal access to the church from Highway 101. Mr. Berreth also indicated, on behalf of the church, that this would be a better situation for their purposes as well.
