HomeMy WebLinkAboutPlanning Commission Minutes 04-19-1978PLANNING COMMISSION CITY OF PLYMOUTH, MINNESOTA April 19, 1978- A regular meeting of the Plymouth Planning Commission was called 'to order by Chairman Davenport at 7:30 p.m. in. the Council Chambers of the Public Works Building,_ 14900 - 23rd Avenue North.. MEMBERS: PRESENT: Chairman Davenport, Commissioners arron, Erickson arrived at 10:00 p.m.) Schneider, Threinen, and Vasiliou and Stewart STAFF PRESENT: Charles Dillerud and Kate Marx 86 C oven Investment A-1 86 Pref"iminary Plat Staff presented petitioner's request for preliminary plat approval. of the Little Peninsula" of Medicine Lake. Proposed was the platting of 30+ acres into three primary lots (one for each structure) and two outlots (to contain common roads/facilities and a storm water holdinzl pond). Recommendations and observations of Staff were presented per the Staff 'report of April 12, 1978.. In addition, Staff pointed out that proceedings viere currently in progress concerning the residents of the area and an objection to the negative declaration of the City -prepared Environmental Assessment Worksheet. Commissioner Thre-inen questioned whether it would be possible for the outlots, if so platted, to become tax forfeit parcels. Staff indicated that it would be possible but that these matters should be controlled within the context of the covenant for the plat. Commissioner` Threinen asked what the purpose of the division of the land was; Staff indicated that it was not unique to this project to divide buildings of an apartment project into separate land areas for each. It was pointed out that Sagamore, located at the northwest corner of County Road 9 and County Road 18 had platted the land of that project in a similar manner. Don Maxwell, 2630 E. Medicine Lake Boulevard, presented the Commission with a letter from the local homeowner's association, AMLAC, which shall become an official part of the record of this proposal. In summary, the letter requested that no action be taken on this proposal until the Environmental Quality Board (EQB) matter was complete; in that the residents felt that this action could have an effect upon the outcome of the proceedings. Mr. Maxwell stated that he had recently spoken with the Hearing Examiner in the matter and.had been told that he would listen to matters involving the base of the peninsula as it involved the development of the tip of the peninsula. Mr. Maxwell; questioned whether the separation of the two projects by platting would not inter= fere with the EQB procedures on that basis. Mr. Maxwell added that he felt it would: be the burden of the petitioner to prove PLANNING COMMISSION MEETING, MINUTES April 19, 1978 to the City that it was necessary for certain reasons to plat this property at thistime, Chairman Davenport asked Mr. Maxwell fiis opinions as to the platting of outlots as proposed. Mr,. MaxwTell responded that he did not feel it would be appropriate that the outlots be allowed to be separated, from the lots with structures, but that they should be tied in some manner to the structures: which they would benefit. Lud Rippe, Manor Apartments, .stated that he had purchased a condominum from the owner of the located at the base of the peninsula and had never been told that there would be development on the tip of the peninsula. Petitioner was not present to respond to the questions of the Commission or audience. Chairman Davenport closed th.e public hearing at 8.107 p.m. MOTION TO DEFER was made by Commissioner Schneider supported by Chairman Davenport further action on the proposed nreliiminary plat of the "Little Peninsula" untilsuch time as petitioner would be prest,,,t to represent his request, Commissioner Th'reinen stated that he was bothered by the fact that this action could potentially frustrate the current Environmental Quality Board proceddings MOTION TO DEFER CARRIED (4-1-1} (Commissioner Threinen against, Commissioner Barron abstained) The Commission discussed the fact that the public hearing had been closed but that at such time as the developer would be present; perhaps the members of the audience would have questions that the developer could answer, MOTION TO RECONSIDER the previous motion was made by Commissioner Schneider'suppol=ted by Commissioner Stewart dealing with deferral of action on: the proposed preliminary plat of the. MOTION TO ;RECONSIDER CARRIED (5-0-0) (.All in favor) SUBSTITUTE MOTION was made by Commissioner Schneider supported by Commissioner Barron that the public hearing dealing with the proposed preliminary plat of the "Little Peninsula's` of Medicine Lake be Continued until such time as the developer could be present to represent his request. SUBSTITUTE MOTION CARRIED {4_1-1) (Commissioner Threinen against, Commissioner Barron abstained) Criterion Homes,Inc..- A-814 MPUD 78 -1 -Concept Plan Staff presented:petitioner''s request for concept plan approval of MPUD 78.1 Mixed Planned Unit L,,kielopment) including 110 lots for single family detached dwellings, 9.4 acres.ofservice commercial use and 2.7.3 acres for planned industrial PLANNING COMMISSION MEEI`ING MINUTES -3- April 19, 1978 use. Staff made recommendations and observations regarding the project per theStaffreportofApril13, 1978, Commissioner Threinen stated that he felt the efforts of petitioner to buffer theOaknell. Addition were adequate,, but he questioned why similar treatment ,had notbeenaffordedthepropertyownerbyAxelJ. Erickson to the south. Commissioner Threinen stated that it did not appear as though the developer had provided sufficient screening from the proposed motel for the existing singlefamilydetachedresidentstothesouthandwest. The Commission also questioned what depth would be allowed for the single familydetachedLotsatthenorthwestportionoftheproject. Petitioner responded that the proposed depth for those lots would be 150 feet. It was pointed out that 150feetwouldexceedthedepthofthelotsoftheexistinghomes. In addition, petitioner was proposing that the "backyards" be bermed (20-30 feet in width) and plantings be supplied for additional buffering ni` the existing residentialareafromthesinglefamilyfroposedbythisproject. Staff reminded the Commission that the lots currently fronting County Road 9 wouldtotbeallowedtodosointhefuture --that they would be accessing somehow to the south, when County Road 9 would be upgraded to its final width. Commissioner Threinen questioned petitioner as to whether Mr. Axel Erickson hadbeencontactedregardingtheproposal. Mr. Dor. Hess, Landplan, Inc., representingpetitioner, stated that they had not personally contacted Mr. Erickson. Commissioner asked petitioner how the phasing of the project. was planned for con- struction. Mr. Hess responded that Phase I would be including the extreme north and extreme south ends of the pro;;ect--the commercial to the north and the single industrial' structure to the south, Building F', plus the entire service road fromnorthtosouth. Commissioner Schneider asked why petitioner did not consider a permanent road to Building P at this time as opposed to having to build two roadways. Petitioned stated that this, would be a possibility, Their intent had been to separate thetraffictypes --residential verse industrial --from each other. The Commission questioned whether petitioner had had direct contact with Robert Berthiume regarding the proposed project. Mr. Hess stated that they had not, Commissioner Vas l i ou_ askedpetitioner what the price range of the homes would be, Mr. don Nelson, Criterion Homes, stated that the improved single family lots withFdmeswouldbeapproximately $73,000. Coniissioner Threinen questioned whether the motel could be moved further east_. Mr. gess indicated that this would not be possible due to the powerl.ine easement ofNSPinthatarca Staff presented the Commission with a letter from the property owner most affected by the proposed development within the Oaknell Addition, James Olson, owner ofOutlot1, Mr. Olson's letter indicated no major problems with the proposed developmeatalongwithminorsuggestionsastoadjustmentstobenefitbothparties. PLANNING COMMISSION MEETING MINUTES -4 April 19, 1,978 Gonna Maus, 14130 - 40th Avenue North, indicated that near the north end: of the proa` r` ec'-- t, that right -of-way had been ret aside for the access of those who lived on County Road 9 to eventually access Fernbrook Lane via another route.. She added that she was concerned that more traffic would, be routed past her home by people considering the right-of-way intended for the residents facing County Road 9 as a "short-cut" to Fernbrook Lane, Ms. Maus stated that she did not feel it would be at all appropriate to allow the traffic from the commercial structures to route through the adjacent residential neighborhood. Commissioner Threinen stated that the "tail" of right-of-way asked of the petitioner was one that would allow, further options for access for the existing residential neighborhood once the County Road 9 access would be closed for individual drive- ways. He stated that. it would be prudent than as, many options as possible be maintained. Ted Zbikowski, 3816 Fernbrook Lane, asked 1) about the, eventua. disposition of the Olson riveway north of his lot, 2) density proposed for the project. Staff stated that Mr. Olson''s driveway would cease to exist as it currently does. As to density, the proposed density ;was at three units per acre, the top end of the LA -1 allowable density.and the: bottom end of LA -2 range of density. Staff pointed out that a portion of the site would even allow 5-10 units per acre in density. Mr. Zbikowski stated that he did not feel the quarter -nacre lots were appropriate for this area. He stated that the City standards had always been for half -acre lots at least. He added that he did not feel the 70 foot lot widths in the, area were at all appropriate, that the area would be too highly used. Mr. Zbikowski questioned whether those living on cul--de-sacs and smaller lots within this development, would be assessed in the same manner, as: he would be assessed. Staff stated that manner of assessment would be the same. Mr. Zbikowski stated that iie was against the density as proposed within the LA -2 and LA -3 areas, Tom Leverenz, 14005 Ccuoty Road 9, asked what the plans for County Road 9 were for the future. Staff indicated that the County planned to widen the road but ad not committed to when or how. Mr. Leverenz stated that he was concerned with traffic control and tie.grade of the land in the area with respect to County Road 9. Mr. Leverenz stated that he would have no ,objection to townhouses but felt that the industrial area was too large in comparison. He added that he did not feel it was necessary to have two fast-food and a motel and a convenience store, rather one or more of these commercial uses. could by eliminated. Ron Holden, 4115 Fernbrook Lane, stated that he did not understand why the right-of- way for future County Road 9 would be required at 120 feet. Staff explained the usage of the right -of" -way. He further commented that he felt the buffer area between the developed lots to the west of the project, the existing four lots (not built upon at this time) also to the west kind the model should be greater. Mr. Holden added that he felt the; lot sizes for the proposed single family area were too small. Commissioner Vasiliou asked Mr. Holder what his opinion would be it townhouses were developed in the area as an alternative. Mr. Holden stated that he wouldnot object to townhouses, PWINTNG COMMISSION MEETING t4INUTES; -5, April 19,, 197$ S Petitioner was asked by the Commission if the owner of the exception parcel located between the subject parcel and Interstate 494 was 'notified of the meeting. Mr. Hess responded that he had obtained the list ,of adjacent property ownersfromHennepinCounty, but that he would check into the matter to determine who the party was and tl insure notification of the upcoming meeting. Roger Strom, 14010 -40th Avenue North, asked what the location of the motel in the area would do to the value of his home: He asked. if the trail could not be placed between the existing residents and to the west side of the road: between the motel and the existing developed area. Sharon Holden, 4115 Fernbrook Lane, asked if it would be possible to move the walkwayfurthertateeastandifthecommercialstructurescouldbelimitedtothreein number. Tony Anderson, 141190 - 40th Avenue North, asked what the proposed date of starting the development was planned to be. Mr. NejSon responded that there were still marketing -studies taking place at this time that would determine the starting datesforthecommercialandindustriallots. He added that the residential could possibly be developed within three years Chairman Davenport closed the public informational meeting at 9;40 p.m. MOTION was made by Commissioner Schneider supported by Commissioner Vasiliou that the Planning Commission take action on this proposal at this mee,irg. MOTION CARRIED (6-0-0) (All in favor) I Commissioner Erickson arrived at 10:00 p,m. 813 B -T Land Company A-813 RPUD 78-2 Concept Plan Staff presented petitioner -Is request for Concept Plan approval of "Cedar Ridge" RPUD 78-2 located at the southwest corner of County Road 9 and Fernbrook Lane, proposed for 108 single family dwelling and 22 townhouse (duplex style structures) units for the property. Staff mads, recommendations and observations regarding the proposal per the Staff report of April 13, 1978, Petitioner's engineer, Mr. Fran Hagen, stated that with respect to that area indicated to be inundated at -the time of the 100 -year flood, it had been determined by the developer to be better to not 'bLjild within the area, but to have the land divided amongst the adjoining lots. During soiltesting of the site, it was found that the area of Inundation was mostly peat and difficult to build on regardless of the flooding considerations. The lots eliminated were lots 14-24 of the west center cul-de-sac of the proposal. Mr. Hagen added -that. this made the density per acre calculation of approximately 2'.8 units per acre. PLANNING COMMISSION MEETING MINUTES -6 Ap.ri1. 19 1978' aRickMurray. 6-T Land Company, stated that it was also the intention of the firm to re ocate the southerly most townhouse structure to the area of the project fronting County Road 9, replacing the unit w,th a single family detached. dwelling. Ted Zl.ikowski, 3816 Fernbrook Lane, asked what type of unit would be directly across Fernbrook from his ;tome, Mr. Hagen poi 1.,ted out that there would iia a single family dwelling located in that position. Rory Holden, 4115 fernbrook. Lane, asked if the total right-of-way width for Fernbrook Lane had yet bern determined. Staff explained that it would be determined to be between 80 and 120 feet. The, final determination would be available upon completion of an. engineering study taking place at this time for the road. It was pointed out that a potential 7 additional feet would be needed from the property owners on the east side of Fernbrook Lane, Mrs. Zbikowski, 3816 Fernbrook Lane, stated that she understood the Central Park or the pity was planned i this area. Staff explained that the proposed Central Park was adjacent to this property to the south and west, but that it had never included any portion of this property. Tony Andreson, 14100 -40th Avenue North., asked what the price range of the homes would be. Mr. Murray responded .that they would be between $90-100,000 in price Mr. Strom, 14010 -40th Avenue North, stated that he felt it was necessary that a park be available in this neighborhood instead of the children having to travel to New Hope for any recreation programs,, MOTION was 'made by Commissioner Vasil;iou supported by Commissioner Barron that the Planning Commission take action on this proposal at this meeting. Inc. for Concept Plan approval for MPUD 78-1, consisting of 1.10 lots; for single family detached dwelling development, 9.4 acres for commercial development and 27.3 acres for industrial development, located at the southeast corner of County Road 9 and Fernbrook Lane, be approved subject to the follcA ng conditions: 1. Written consent of the owner of Plat 43722 Parcel 4115, as to the design for the proposal as it affects his property at the southwest portion of the proposal'. 2 Maximum affirmative, design efforts toward oo site transition, of the commercial and motel uses to the homes and lots of the Berthiume Addition. 3. Affirmative design efforts to buffering the trailfrom the single family detached dwellings by a combination of distance and plantings. One of the commercial structures located at the northeast corner of the proposal be eliminated (either the motel, a fastfood use or the corvenience store) MOTION TO AMEND was made by Commissione)* Threinen supported by Commissiner Schneider, to add the following language to condition #a: "Further, that the minimum depth of the lots abutting the existing single family lots, be 145 feet to allow for plantings and bermincd as was proposed as a buffer by petitioner," VDTION TO AMEND CARRIED (6-0-1) (Commissioner Erickson abstained) Commissioner Threinen expressed concern that the iccess road to the project from County Road 9 be at least 1.,000 feet: west of the diagonal of Highway 494, but that it still be as far east as possible to allow for geater distance between the new roadway and the e;istng residential area. MOTION TO AMEND was made by Commissioner Threinen supported by Commissioner Vasillou to addthe following as condition #10: "At the next stage of development, contact the owner of the property located at the southwest portion of the site, Plat 43715, Parcel' 850, as to his reaction to the proposal and as to possible inclusion in the overall project," WTION TO AMEND CARRIED (6-0-1) kCommissioner Erickson abstained) The Commission thC-n voted on the main motion as twice imended MOT10N CARRIED (Commissioner Erickson abstained) PLANNING C%1MISSION;M5ETING MINUTES -8- April 19, 1978 X -8113,B7 Lan Gompany A-8 3' RPUD 78.2 Conpept Plan MOTION was made by Commissioner Threinen supported by Commissioner Schneider that the Planning Commission make the following recommendation to the City Council: That the request of B -T Land Company for Concept Plan approval of RPUD 78--2, Cedar ridge," located, at thetsouthwest corner of Fernbrook Lane and County Road 9 proposed for 108 single family 'detached units and 22 two -unit townhouse structures,; be approved subject to the following conditions: 1. Preliminary plat/plan shall include specific plans with respect to the area of the plan designated for inundation by the Plymouth: Storm Water Drainage Plan,, in particular the intent of the developer not to build within the "inundation" area. 2. Completion of the Environmental Assessment Worksheet process, if required 3: The walkway at the south portion of the property be landscaped with evergreen trees of 2 feet in height on 15 foot centers along the boundary lines of the walkway on both sides of the easement for purposes of screening the adjacent lots from the grail users. 4. Per, the developer, the townhouse structure located at the southeast corner of the property shall be relocated to the northwest portion of the project. along County Road 9. MOTION TO AMEND was made by Commissioner Barron supported by Commissioner Vasiliou that the following be added as condition 5: "The two -unit townhouse structure located at the southwest corner of 40th Avenue North and Fernbrook Lane shall be relocated to the northwest portion of the project along County Road9. MOTION TO AMEND CARRIED ` (6-0-1') (Commissioner Erickson abstainer) Commissioner Schneider asked if having the access to the proposed Central Part: area of the future would be prudent at this time. Staff explained that tie negotiations for the purchase of the land by the City were nearing completion at -this: time and that final status of the property would be know by the time of final plat of this project, The Commission then voted on the main motion as amended. MOTION CARRIED (6-0-1) (Commissioner Erickson absta ned) A-126, Co ua us Home ssociation- 26 Lot .[division Staff presented the request of petitioner for lot division/consolidation of unplatted property located at the northwest quadrant of South Shore Drive and Highway 55. By previous Council action,; petitioner was granter use permits for two tenants of the multi -tenant structure of the site with one of the conditions of approval 'being PLANNING COMMISSION MEETING MINUTES -g- April 19, 1978 division/consolidation actions to reflect appropriate property ownership. MOTION was made by Commissioner Schneider supported by Commissioner Vasiliou that the Planning Commission make the rollowing recon,,endation to the City Council, That the request:. of the Columbus home Association for lot division/consolidation of their property located in the northwest quadrant of South Shore Drive and Highway 55; involving Plat 43736, Parcels 9210, 9234, 9245, and 925Q be approved,, MOTION CARRIED (7-0-0) (All in favor) ymout tate SaR V -M Site Plan and Conditional Use Permit Staff presented petitioner's request for site plan and conditional use permit approvals for an 8,800 square foot structure to house a general offi,e area. of 3,000: square ft?et (to be rented) and peti.tion.or (5,800 square feet) proposed to be located north of Highway 55 at industrial Park Boulevard, withil the Minneapolis Industrial Park Srd. Addition. Staff pointed out that per the Zoning Ordinance, the structure proposed by the aetitioner had only minor alterations: necessary to meet i.ode requirements.. However, the proposed conditional use permit for the use of the bank within this zoning district, I-1 (Planned IOM istrial), was a matter of compatibility consideration t;ar the City. Additional observations and recommendations of the Staff were presented, per the Staff report of April- 14 1978. Robert Lexvold, President of the Plymouth: State Bank, stated that it was the desire Mt-Te__Tank to relocate to the proposed site for several reasons:: l) It would; be near where the bank had been located for the past five years; a) The area is actually the "edge" of the industrial park, not the center; 3) A great deal of the customers are the industries and worker's therefor of the industrial park; 4) Conpetitionawithin the financial field was at a fierce stage at this point in time, necessitating the bank to move now if at all possible. Mr. Lexvold added by way of explanation that the tenant for the general office portion~:of the structure would ;be Associated Bankers. Dale. Kennedy, representing Carlson Properties, owners of the Minneapolis Industrial Parkrid-Addition, was. asked by Chairman Davenport how use was comparable to those that, were discussed at the time of platting with the neighborhood. Characteristics of the uses discussed at that time included little daily traffic, no weekend or evening traffic, uses compatible with the industrial zoning of the property. Mr. Kennedy responded: that he did not feel this use would be objectionable to the people living in the area. He added that he would be willing to call another meeting of the property owners,if so desired, Commissioner Threinen stated that the; bank, in its current location, was a non- conforming use, addin -tat non -conforming uses were not mellowed to expand and t hate r PLANNING COMMISSION MEETING MINUTES _10- April 19, 1978 this Use,,asosedoprp could be construed as an expanding non -conforming use, Commissioner Threinen further added that if the use were allowed it would, in effect, be spot zoning for a special interest in his opinion. The Commission discussed the use proposed in greater, detail as it related to therecentlyapprovedMcCombs --Knutson Associates structure and use. (A-800) adjacent tothesite. MOIION was made b, Commissioner Threinen supported by Commissioner Schneider that the Planning Commission make the following recommendation to the City Council; That the request of the Plymouth State Bank for a conditionaluse permit to operate a full bank within an I-1 (Planned Industrial] zoning district be den'`ad based' upon the following findings, 1. The use fails to meet the criteria set forth in Section 8, Subdivision 3 of the Zoning Ordinance dealing with conditional uses allowable in an I-1 Planned Industrial) zoning district, 2. The proposed use is incompatible, with the; industrial district in that the activities of the use entail traffic by the general public into the industrial district. 3. The proposed use is incompatible with the industrial district in that the hours of business of a bank will extend beyond those of most I-1 uses thereby intro- ducing traffic and the general public into the I-1 district during hours when said traffic and activity, should be minimized for security purposes. 4. Financial institutions are permitted' uses in B-1 and B-2 districts and permitted by conditional use permit in B-3 districts. Substantial platted and serviced acreage exists in the community with these zoning classifications upon which such a use is clearly contemplated by the Zoning Ordinance. 5. Approval of the petitioised conditional use permit would be contrary to Goal B, O",,;;ective 4, Criteria. 3 of the adopted Goals, Objectives andCriteria, with respect to grouping of commercial and industria uses. MOTION CARRIED (6-0-1) (Commissioner Vasiliou abstained) 4. 793' 'Johnson/strum r -MT Final Plat Staff presented petitioner's request for final plat approval of Schmidt Lake Hills, located at the northwest corner of Larch Lane and 45th Avenue North, proposed for 59 single family detached dwelling units. Staff made recommendations and observations regarding, the proposal per the Staff report of April 14, 1978. MOTION was made by Commissioner Barron supported by Commissioner Erickson that the Planning Commission make the following recommendation to the City Council: That the request of Johnson/Ostium for final plat approval of Schmidt Lake Hills, PLANNING COMMISSION 'iEETING MINUTES April 19, 1978 located at the northwest corner of Larch Lane and 45th Avenue '.North, proposed for 59 single family 4etached dwellings be approved, per plans Staff -dated April 13, 1978,, subject to the following conditions: I. Compliance with the provisions of the City Engineer's memorandum. 2, Provision of a 20 foot trail easement parallel to Larch Lane and payment of fees-in-,lie4 Park Dedication equal to the Assessor's average market value for 4.18 acres of the subject parcel 3. Private curb cut access to Larch Lane: shall be prohibited: 4. A7; existing structures on the site shall be removed. S. The setback on Larch Lane for structures shall be 35 feet plus the trail of 20 feet fora total of 55 feet from :street to structure. 6. Removal of all diseased trees from the site, solely at owner's expense. 7.
