HomeMy WebLinkAboutPlanning Commission Minutes 12-21-1977PLANNING COMMISSION CITY OF PLYMOUTH, MINNESOTA December 21, 1977 A regular meeting of the Plymouth Planning Commission was called to order by Chairman Davenport at 7:30 p.m, in the Council Chambers Avenue North, of the Public Works Building, 74900 -23rd MEMBERS PRESENT; Chairman Davenport, Commissioners Erickson, Hoyt, Schneider, Threinen and Vasilou MEMBERS ABSENT: Commissioner Stewart STAFF PRESENT: Charles Dillerud and Kate Marx A-784 Parklands Development A-784 Preliminary Plat and Conditional Use Permit ft.'r Subdivision Unit Project and ,Rezoning Staff presented petitioner's request for preliminary plat, conditional use permit for a Subdivision Unit Project and Rezoning from R -O (Open Residential) to R-1 (Single Family Residential) for "Deerwood Meadows," a 79.4 -acre project proposed for 173 single family detached lots located between Schmidt Lake, Zachary Lane and approximately between 44th and 47th Avenues North. Staff proposed a recommendation for approval sub!act to the conditions as listed in the Staff report of December 16, 1977. Referencing the City Engineer's report on this project, Connissioner Threinen questioned whether temporary cul-de-sacs would be created at the ends of Cottonwood and Balsam Lanes. Petitioner's representative, Fran Hagen, stated that there would be no objection to this type of situation. Commissioner Threinen asked if the dead-end of 45th Avenue North would not also have to be dealt with in a similar manner. Staff indicated that this would.. be true. Commissioner Threinen, again referencing the Engineer's report, asked if there were any alternatives available for the petitioner other than building storm sewer for the pro- ject to control the storm water run --off from the property. Mr. Hagen stated that they had already planned to install storm sewer to alleviate this problem. He indicated that petiti-oner's were well aware of the consequences of such a project. Mr. Hagen added that this was the only alternative he was aware of to control the storm water rune -off to the adjacent undevelopedproperties. Mr. Hagen also stated that with respect to the Trail System Plan inconsistencies withiin the plat, there would be no problem effecting adjustment to accommodate the proper alignment for the trails. PLANNING COMMISSION MEETIWU MINUTES -2 December 21, 1977 Commissioner Hoyt asked petitionerif there had been any attempts to at, -tion parcel located at the northwest corner of the proposal. Mr. Hagen indi had been attempted:, however.-, they had not succeeded in doing so to date. that the same was true for the -exception parcel to the southeast of the project. Fred` Haas, representing Marvin H. Anderson Construction, developers of the property north of the proposed Deerwood Meadows, stated that with respect to the problem of coordinating street alignments between the two plats, that his firm would be most willing to work with the Parklands firm to eliminate any inconsistencies. Mr. Hagen indicated: that the petitioner, too, was most willing to coordinate with Mr. Haas' firmonthismatter. Staff stated that a phone call had been received from Dean Johnson, a homeowner in the area,, whereby he had indicated concern that 45th A+enue North reTain`a cul-de- sac in .order to prevent any peripheral road being created for Schmidt Cake. Mr. Hagen, stated that this could be adjusted to the satisfaction of the City, Chairman Davenport closed. the public hearing at 8:25 p.m MOTION was made by Commissioner Thre,nen supported Com,ssioner Hoyt that the Planning Commission take action on this proposal at this meting. MOTION CARRIED (5--0-1) (Commissioner Vasil! ou abstaihed) MOTION CARRIED A-552 Magney Construction A-552 Site Plan and Preliminary Plat i Staff presented petitioner's request for preliminary plat and site plan review of property localted at the nortoeast corner of Vicksburg Lane and 28th Avenue North. Proposed was the platting of seven industrial lots on ten acres and; site plans for seven buildings for the lots, Staff made recommendations regarding the requests per the Staff report of December 16, 1977, Commissioner Threinen quest>oned wnetbor the right-of-way for_Ranchview Lane from the north edge of 28th Avenue,North to the north border,of the proposed plat was necessary. He stated that the future platting sof the lands north coulc provide their own street access and potentially avoid the routing of any additional industrial traffic past the residential area of Shenandoah. Regarding the landscape plan, the Commission concurred that the landscape plan was ritical -to the site in that the industrial uses would be abutting a residential neighborhood:. Dick Anderson, attorney, and Rick Pierce, representing Magney Construction, were present to answer questions from the Commission. Mr. Pierce stated that the intent was that the buildings not be "spec" buildings for multi -tenant rental, but that they be owiner occupant with respect to the parking spdce deficiencies noted for the seven sites per the Staffr report. PLANNING COMMISSION MEETING MINUTES -3- December 21, 1977 Comm ssioner Hoyt questioned whether it would be possible to double -load the driveways in order to have fewer access points to 28th Avenue North. Mr.. Pierce stated that this had ,been considered at one time, but that due to the added drainagecapabilities of additional .blacktop to route the drainage to the street, Magney had decided upon the proposed' number of driveways. Roberta Klienmentz, a resident of Shenandoah, stated that she objected to so many entrances onto 28th Avenue North. She added that 28th Avenue North was currently used for parking fo vehicles owned by the residents of Shenandoah and that the additional traffic would only add to the problem. Chairman Davenport pointed' out that the elimination of the number of driveways would not reduce the amount of traffic. Chairman Davenport closed the 'public hearing at 8:55 p.m, MOTION was made by Commissioner Schneider supported by Commissioner Threinen that the Planning Commission take action on this item at this meeting. MOTION CARRIED (5-0-1) (Commissioner Vasiliou abstained) MOTION CARRIED A-774 Ridgecrest Addition A-774 Preliti-nary Plat and Conditional Use Permit for Subdivision Unit Project Staff presented the revised preliminary plat for Ridgecrest Addition including the property owned by Alan Stensrud to the northwest. Staff indicated that the revised plat was responsi,to the Commission's direction at their previous meeting and recommended approval per the sport of December 16, 1977, Commissioner Threinen questioned whether the cul-de-sac was adequate in width to allow for snow --plowing, etc. by the City.. Staff stated that it was. The Commission questioned whether Lot 10, Block 1 could be squared off to effect a smoother design for the lot. Mr. Hill, representative of Mr. Nick Losche;der, stated teat there; would be no objectlon to this. Harwood B. Heggen, 5027 Sheridan Avenue North, asked if :31st Avenue North would become. a thoroughfare,. Staff stated that it would not be a thoroughfare through his property. Claes Svensson, 2935 Quaker Lane, stated that he felt by the design presented this time that Quaker Lane, had the rotential to become a thoroughfare type street with people using it to a'much greater degree with the direct north -south alignment proposed. He questioned how the drainage would work: for this property as now designed. Staff explained the drainage to Mr. Svensson. Mr. Svensson stated that this would create for him an open drainage trench both on his north and west property lines and that he did not feel. this. was a particularly safe way to design the drainage considering the children in the area. PLANNING COMMISSION MEETING MINUTES -4- December 21, 1977 l Charles and Carol Peterson, 10135 -29th Avenue North, questioned how the assessments would be paid for the public improvements that wool'd be required for the. area. Staff explained the hearing process involved with asses rents to the Petersons. Chairman Davenport closed the public hearing at 9:25 p.m. MOTION was made by Commissioner Erickson, supported by Commissioner Schneider that the. Planning Commission take action on this item at this meeting, MOTION CARRIED ,5-0-1) (Commissione.- Vasiliou abstained) MOTION CARRIED Community Development Revenue Sharing Funds, Year IV MOTION TO DEFER was made by Commissioner Schneider supported by Commissioner Voyt any discussion of this item until after new business. MOTION TO DEFER CARRIED (5-0-2) (Commissioner Vasiliou abstained) +LOTION TO DEFER CARRIED 784 Parklands Development A-784 Preliminary Plat and Conditional Use Permit for Subdivision Unit Project and Rezoning MOTION was made by Commissioner Threinen supported by Commissioner Erickson that the Planning Commission make the following recommendation to the City Council: That the requEst of Parklands Development for preliminary plat and a conditional use permit for a Subdivision Unit Project for "Deervood Meadows," located between Schmidt Labe and Zacaary Lane and approximately between 44th and 47th Avenues North., consisting of 173 single family residential lots be approved subject to the following conditions:; I. Re.iesign to provide north-sout, street continuity per the considerations of the Plymouth Staff report of December 16, 1977, specifically relating to possible cul -de -,sacs on Lot 8, Block 5 and Lot 1 Block 6 at the north end of Cottonwood Lane and specifically relating to Lot 45, Block 2 and Lot 1, Block 8 at the end of 45th Avenue North extended westerly. In addition, that right-of-way be included for possible extension of 45th Avenue North through Lot 6 Block 2 Further, in said redesign, that petitioner and Marvin H. Anderson Construction redesign in a cooperative venture the alignments of Cottonwood and Balsam Lanes for possible connections north south in order to avoid possible double intersections. NB -P1 site shall retain 9.0 acre feet of storm ;Outer storage per the specifications of the Storm Water Drainage Plan. 4: Subdivision Unit Project Open Space and Public Open Space`requi)ements shall be recalculated uporx redesign, but shall be fees -in --lieu for that portion remaining after credit for storm water drainage and the trial corridor. 5. Any private curb cut access to Zachary Lane shall be prohibited. 6. All peripheral lots shall maintain an area of 15,300 sq. ft.. or greater. 7. Compliance with the provisions of the City Engineer's memorandum. It was pointed out that the engineer's report should be changed to include three temporary cul -de -sass rat) -^r than two to include 45th Avenue North. MOTION TO AMEND was made by Chairman Davenport supported by Commissioner Threinen that the Engineer's report be changed to include installation of storm sewer pipe as the answer to storm water drainage from the plat, Chairman Davenport stated that since petitioner agreed that this would be how the situation would be handled, that it should become of record, MOTION TO AMEND CARRIED (5-0-1) (Commissioner Vasiliou abstained) MOTION TO AMEND CARRIED MOTION TO AMEND was made by Commissioner Schneider supported by Commissioner Erickson that the front yard structure setback for lots along 45th Avenue North be the same on the west (petitioner's property) as exist on the east side of the street (within Shorewood Acres), not to exceed 50 ft., specifically Block 4, Lots 1-6,. MOTION TO AMEND CARRIED (5-0-1) (Commissioner Vasiliou abstained) MOTION TO AMEND CARRIED The Commission then voted on the main motion as twice amended, MOTION CARRIED (5--0-1) (Commissioner Vasiliou abstained.) MOTION CARRIED MOTION was made by Commissioner Threinen supported by Commissioner Erickson that the Planning Commission make the following recommendation to the City Council: That the request of Parklands Development for rezoning of Deerwood Meadows" from R-0 (Open Residential) to R-1 (Single Family Residential) be approved. MOTION CARRIED (5-0-1) (`Commissioner Vasiliou abstained;) MOTION CARRIED PLANNING COMMISSION MEETING MINUTES -6- December 21, 1977 W-_5 Maguey Construction A-552 Preliminary Plat and Site Pl an MOTION TO DEIrER was made by Commissioner Hoyt supported by Commissioner Schneider the request of Maguey Construction for preliminary plat and site plan approval of Metro Industrial Park 2nd Addition, a ten-acre plat proposed for seven industrial lots located at the northeast corner of Vicksburg Lane and 28tfh Avenue North and the site plans therefor per the following design considerations and concerns; 1. Redesign to eliminate two curb cuts to 28th Avenue North, 2. Submission of a detailed landscape plan for the sites reflecting the concerns of the Planning Commission regarding the sites in proximity to the adjacent residential neighborhood, i.e. berming, plantings to buffer the residential neighborhood from the industrial development to the north. 3. Parking per the Ordinance requirements be shown, even if not: to be built at this time. The Commission expressed particular concern that the landscape plan, be an adequate buffer for the residential neighborhood from the industrial proposal. MOTION CARRIED (5-4-1) (Commissioner Vasiliou abstained) MOTION CARRIED A--774 Ridgecrest Addition A--774 Preliminary Plat and Conditional Use Permit for Subdivision Unit Project MOTION was made by Commissioner Schneider supported by Commissioner Hoyt that the Planning Commission make the following recommendation to the City Council% That the request of Nick Loscheider and Alan. Stensrud for preliminary plat and conditional use permit approvalfor a Subdivisi:on Unit Project for the "Ridge- crest Addition" located in the northeast quadrant of Quaker Lane and 29th Avenue North for single family residential development per plans dated December 12,, 1977 be approved subject to the following conditions: 1. Compliance with the provisions of the City Engineer's memorandum, 2, Compliance with DNR/Corps of Engineers wetlands definitions and any resulting permit processes. 3. Public Open. Space requirements shall be satisfied by fees-in-lieu equal to the value of 2.51 acres, not to exceed $150 per lot less credit for storm water drainage as applicable. l PLANNING COMMISSION 4EETING MINUTES -7- December 21, 1977 4, Lot 10, Block 1 shall be redesigned to square off the corner of the lot and the cul-de-sac, MOTION CARRIED (5-0-1) (Commissioner V'asiliou abstained) MOTION CARRIED A-441 Ronald Russ A-441 Conditional Use Permit Staff presented petitioner's request for a conditional use permit to allow an office use in the railroad car of the fox Meadows Office Complex located on the north side of Harbor Lane: It was the understanding of Staff that one office would be in operation within the rail road car, Mr. Russ explained how the operation worked with respect to the attached building used as a handball court and the .remainder of the car being used as a conference room. In addition, seven parking stalls were available for the handball/railroad car use. The Commission discussed the nature of the operation in further detail with petitioner. MOTION was made by Commissioner Erickson supported by Chairman Davenport that the Planning Commission make the following recommendation tothe City Council, That the request of Donal Russ for a conditional use permit for an office use in the railroad car of the Fox Meadows Office Complex, located on the north side of Harbor Lane be approved subject to the following conditions: I. Office be limited to three employees 2. Seven parking spaces be designated for the use, Commissioner Threinen stated that he was concerned with the manner in which this situa- tion, had been created; by the previous owner/developer of the Fox Meadows Complex. MOTION TO AMEND was made by Chairman Davenport supported by Commissioner Erickson to add the following conditions 3. The office use be limited to an architect, real estate office ;or an insurance office. 4. Permit shall be for one year. 5, Permit not be granted until it is determined that a lot division has been approved creating the subject parcel as a separate of from the remainder of the Fox Meadows Complex. 6, A site plata be presented by the time of the lot division consideration indicating the new lot lines, parking spaces, etc. C PLANNING COMMISSION MEETING MINUTES -8- December 21, 1977 C MVION TO AMEND. MOTION CARRIED (4-0-2) (Commissioners Threinen and Vasiliou abstained) MOTION CARRIED A-785 Jerome P77ffeginfS Lot Divsion,of Unplatted Property Staff presented petitioner's request for, division of an existing parcel of 18 acres into a. homestead parcel of one acre and a vacant parcel of17 acres. Access to the, one --acre parcel was proposed by easement since the parcel would be otherwise land- locked., Scaff pointed out that the request ofpetitioner was contrary to the intent of Council Resolution #75-664 dealing with platting or replatting of land in the unsewered areas of the City. Commissioner Erickson asked Mr. Begin why he was not proposing a five -acre parcel. Mr. Begin stated that he did not see that this was necessary. Also, he indicated that there were already several parcels in the area that were one acre i, size and that he felt that he was not making an unusual request. Tl,e Commission explained the nature of Resolution #f75-664 to Mr. Begin, MOTION was made by Commissioner Threinen supported by Commissioner Schne`1der that the Planning Comrtiission make the following recommendation to the City Council That the request of Jerome P. Begin for lot division of unplatted property located at the southeast corner of Zachary Lane and 49th Avenue North be denied due to inconsistency with Council Policy Resolution #75-664 dealing with the development of any nature in the unsewerea areas of the City. Further, that should. the Council grant an exception to said policy resolution; that the future design of the parcel be again reviewed by the Planning Commission in terms of access for the one -acre parcel, MOTION CARRIED (4-0-2) (Commissioners Hoyt and Vasil;ou abstained) MOTION CARRIED PLANNING COMMISSION MEETING MINUTES -9-- December 21, 1977 Aw781 Vanage Companies A-781 Amended Site Plan Staff presented petitioner's revised site plan for Commission review. The new proposal responded to the intent of the Planning Commission directives, but used a different method to attain the additional parking spaces than had been suggested by the PlanningCommission. In ,particular, the Commission. asked that the structures be moved more to the west to allow more parking spaces on the site. However, peti- tioner had redesignedthe truck court area to supply the additional parking. Commissioner Schneider asked petitioner why the buildings had not been moved to the west, Tom Loftus, representing Vantage Companies, stated that the topography would not allow the moving of the structures as proposed b, o Commission. It was pointed out that should the parking spaces within the truck court be in use, maneuvering within the truck court would be difficult. The Planning Commission discussed rearrangement of the site plan in further detail with the petitioner with respect to provision of the additional parking spaces, MOTION TO DEFER was made by Commissioner Threinen supported by Commissioner Schneider the further consideration of the amended site plan proposal of Vantage Companies for for office warehouse structures to be located at the southwest corner of Water Tower Circle and'Xenium Lane subject to the following design alterations to the site; 1. Adjustment of site plan west to place drive area in 50 ft.. setback to Annapolis Lane. Additional parking to be added on the Xenium Lane side of the site in resultant extra space. 2. "Extra" parking per n2 above need not be constructed, but must appear on the redrawn site plan, S. At least 140-150 total' parking spaces are required on the new plan. It was pointed out to petitioner that should the building not be able to be moved to the west, that proof of such a problem be presented to the Commission: MOTION TO DEFER CARRIED (5-0-1) (Commissioner Vasi'liou abstained) MOTION TO DEFER' CARRIED A-259 Jerome P. Begin A-259 Conditinal Use Permit Staff presented petitioner's request for a'conditional use permit for a metal structure to house construction equipment on his site located at the southeast quadrant of County Road 9 and Interstate 494. Petitioner had indicated to Staff that the structure would be temporary to the extent whet once water and sewer would be available to the site, commercial zoning would bei possible and another use would likely replace the storage activity --including the structure PLANNING COMMISSION MEETING MINUTES x-10- December 21, 1977 Mr. Begin stated that he would not be willing to grant the 60 ft, easement for right- of-way from centerline for the future alignment of County Road 9 as proposed by Staff, Chairman Davenport explained that this was a practiced policy with the City whereby any proposal fronting a thoroughfare street was requiredto grant the remaining right- of-way needed to complete the street to its full status as a condition of approval of the request Gormvl ssioner Hoyt questioned why a conditional use permit would be required for this use. Staff stated that the temporary ofhpyynauetr the building was difficult to explain without a definition of "temporary." In addition,. the use for which the building was proposed was not allowable in an R-0 zoning district, therefore, the only way in which it could operate would be -through a conditional' use permit: The Commission discussed the existing oftemporary buildings in the'R-0 zone to - date noting that they were in use for various purposes throughout the City, MOTION was made by Commissioner Threinen supported by Commissioner Hoyt that the Planning Concission make the followi,rg recommendation to the City Council: That the request of Jerome P. Begin for a conditional use permit for a metal s-tructurr, to house Construction equipment at his sanitary landfill site located in the southeast quadrant of County road '9 and Interstate 494 be approved subject to the following conditions: 1 Written easement for right-of-way along the entire County Road 9 -Frontage to a total of 60 ft. from centerline. 2. Retention of the single curb cut to County Road 9 and existing berm. MOTION TO AMEND was made by Commissioner Schneider supported by Chairman Davenport to add a condition #3 as follows.. "Permit be for a period of three years." MOTION TO AMEND .CARRIED (5-0-1) (Commissioner Vasiliou abstained) MOTION TO hfwEND CARRIED The Commission then voted on the main motion as amended. It was pointed out by Staff that Federal rules and regulations were still in the process of being finalized at this time, and that a majority of the funding would be required to go toward low to moderate income families or planning activities.
