HomeMy WebLinkAboutPlanning Commission Minutes 10-05-1977I PLANNING COMMISSION CITY OF PLYMOUTHI N SMN_ E OTA October 5, 1977 A regular meeting of the Plymouth Planning Commission was called to roder by Chairman Davenport at 7:30 p.m. in the Council Chambers of the Public Works Building, 14900 -23rd Avenue North._ MEMBERS PRESENT; Chairman Davenport, Commissioners Hoyt, roltneider, Stewart and Threi nen- MEMBERS ABSENT! Commissioner Erickson STAFF PRESENT;: Charles :Oillerud and Kate Marx A-735 Robert E, Middlemist A--735 Preliminary Plat Staffpresented petitioner's request for preliminary plat approval of Middlemist 4th Addition, a six -lot residential plat proposed for single family .detached dwellings located east of Ximines Lane at 41st Avenue North. A recommendation for approval was proposed by Staff subject to the conditions as listed in the Staff report of September 30, 1977. Commissioner Threinen questioned why this plat had not been presented as a joint venture with the property owner to the east, thereby eliminating the remnant parcel's to the east of the project fronting on the lake which would result from the platting of the property to the east as a separate venture. Staff indicated that the two parties had been unable to come to terms on the land, and, therefore, each had separate development plaits. Chairman Davenport opened the meeting to questions and comments from the audience, Gary Walters, 3945 Lancaster Lane, owner of the property to the east, stated that he had no objection to the alignment of the road thorugh the Middlemist 4th Addition project in that he felt it would be conducive to future platting of his own parcel. Howard Fistere, 10$15 -40th Avenue North, stated that the developer had already begun a project 'to the west of this proposal, Mddlemist 3rd Addition, which was causing problems for the neighborhood. For example, the 40th Avenue North piece of road was built for a 3 -ton limit and trucks of iituch greater weight were travelling the road; entry of construction vehicles was une'verstood to be allowed only from County Road 9, yet petitioner was continually using the residential street; due to the use of the PLANNING COMMISSION MEETING MINUTES -2- October 5, 1977 road by the construction vehicles, the road was deteriorating substantially:-ind much of the dirt and mud was washing into the lake, Staff indicated that they were in the process of requiring the developer to correct the situations of the road,. Judy Williams, 41.20 Ximines Lane, stated that she, too, was concerned with the condi- tion of the road. She added that she felt the neighborhood had received no cooperaticn from Mr., Middlemist in making the area as livable as possible during the course of his development. Bob Sidare, 10810 -40th Avenue North, reiterated the concerns of his neighbors regarding the developer of the Middlemist 3rd Addition. Chairman Davenport closed the public hearing at 8:25 p.m. MOTION was made by Commissioner Threinen, supported by Commissioner Stewart that the Planning Commission act on this item at this meeting, MOTION CARRIED (5-0-0) (All in favor) MOTION CARRIED A 766 Minneapolis Workhouse Property A-766 Concept Plan It was pointed out by Staff that an error had been found in the public notice to the surrounding property owners resulting in no notification being :sent to a large number of residents. A recommendation to continue the meeting to another date was suggested by Staff, MOTION was made by Commissioner Threi.nen supported by Commissioner Schneider that consideration. of the Minneapolis Workhouse Property Concept Plan be continued to the Planning Commission meeting of October 19, 1977 pending proper notification of all surrounding property owners. MOTION CARRIED (5-0-0) (All in favor) MOTION CARRIED A-735 Middlemist 4th Addition X-735 Preliminary Plat Commissioner Threinen stated that he was concerned about the potential for creating the remnant parcels at the southeast portion of the proposed plat on the adjacent property owner's land. He added that he did not feel this was effective use of the I and,t The Commission made it clear to Mr,. Walters, owner of the property to the east of the proposal, that, should he and Mr. Middlemist not be able to find a solution to their differences, the Commission would be reluctant to grant :any variances to him when he brought his own property before the Commission for review, HLANNING COMMISSION MEETING MINUTES "3- October 5, 1977 MOTION TO CONTINUE was made by Commissioner Schneider supported by Commissioner i:oyt consideration of the Middlemist 4th Addition preliminary plat until such time as the petitioner and the owner of the property to the east could resolve their differences in, order to make the best possible use of the land, particularly to eliminate the remnant parcels which would result oM the shore of Lost lake. MOTION TO CONTINUE CARRIED (5-0`-0) (All in favor) MOTION TO CONTINUE CARRIED The Commission directed Staff to carry forward to the Council the complaints of the. neighborhood regarding the roadway problems, .etc. as mentioned regarding the develop- ment taking place in the neighborhood. Chairman Davenport stepped down from the table for .discussion of this item; Commissioner Threinen assumed the chair. A-752 Maurice McCaffery A-752 Site Plan, General Develop- ment eveiopmentPlanandRezoningfrom R-1 to R-3 As directed by the Planning Commission at its meeting of September 21, 1977, petitioner was presenting his site plan for Lot 5, Gleason North, along with a request for rezoning from R-1 (Single Family Residential) to R-3 (Multiple Family Residential) fir said Lot 5 for review at this time.. Staff presented the report for the project and recommended approval subject to several conditi oris :is listed i1 the Staff report of September 30, 1977, MOTION was made by Commissioner Schneider supported by Commissioner Stewart that the Planning Commission make the following recommendation to the City Council: That the requests of Maurice McCaffery for site plan, general development plan and rezoning from R-1 (Single 'family Residential) to R-3 (Multiple 'Family Resi- dential) approvals be granted subject to the following conditions: 1. Approval and execution of the final plat and development contract for the Gleason North addition. 2. Adjustment of the access road to reflect a 900 intersection with 13th Avenue North. 3. Construction by the developer of an 8 ft. asphalt trail beginning at the north end of Outlot B, Cimarron Ponds ist Addition and extending westerly along the north site periphery to a point 200 ft. west, 4. Approval by the City Attorney of all condominium association covenants and provisions for ownership/maintenance of common open space. PLANNING COMMISSION; MEETING MINUTES -4 October 5, 1977 5. Provision of site improvements security per Ordinance requirements for a period not to exceed: two years. 6. All waste and waste containers shall be stored within the structures, 7. A-739 Timber Creek A-739 Final Plat Staff presented petitioner's request for final plat approval of Timber Creek, a plat proposed for single family residential development consisting of 27 single family dwelling lots and trail dedications. A recommendation for approval. was proposed sub jest to the conditions as listed in the Staff report of September 30, 1977.: MOTION was made by Commissioner Stewart supported by Commissioner Schneider that the Planning Commission make the following recommendation to the City Council; That, the request of Saratoga Development for final nlat approval of Timber Creek, a residential plat consisting of 27 single family dwelling lots and trail dedications located at Pilgrim Lane and 29th Avenue North be approved subject to the following conditions; I. Compliance with the provisions of the City Engineer's memorandum regarding this project. 2,. Satisfaction of 1.7 Park Dedication requirement by dedication of Outlots A and B to the City for trail purposes,: 3. Removal of all: diseased elms solely at owner's expense. MOTION CARRIED (5-0-0) (All in favor) MOTION CARRIED PLANNING COMMISSION MEETING MINUTES October 5, 1977 ` A-753 Erlin Linder, A-753 Final9 _ `rn 1 Plat Staff presented petitioner's request for final plat approvalof the "Rolling Ridge Addition"', a plat proposed for single family residential development located at the northeast corner of Queensland Lane and 3rd Avenue North for six dwelling lots, A recommendation for approval was proposed subject to the conditions as listed in the Staff report of September 29, 1977. Compliance with ,` y nct Rl'es.A,plutlon 77-163 regarding Erosion and Siltation Control: MOTION CARRIED, (5-0-0) (All in favor) MOTION CARRIED A-564 Spraytech A-564 Site Plan Amendment Staff presented petitioner's request for relief from Condition #5 of Resolution #76-695 approving the site plan for the new Spruytech building and specifically, requiring no outside storage of waste container's, Proposed by petitioner on the original plan and still desired by them was a waste system that involved waste receiving wi'htin the structure to a permanent inside compaction device that would ,directly discharge to a large mobile container parked within their truck court on the south side of their building. The considerable size of the mobile container precludes a feasible interior location according to petitioner. Staff recommended approval of the request based on the unique characteristecs of the proposed waste collection/storage system, The Cormtission discussed the regvest and the screening of the equipment from the adjacent properties. Commissioner Schneider questioned whether the landscaping or the south of the, site was sufficient to screen the equipment from the adjacent pro- perty owner. Mr. Jerry Johnson, representing:Spraytech, stated that the firm toad been already as; ed bythe property owner on the south to increase the landscaping j RAW% COMMISSION MEETING MINUTES October 5, 1977 and that they would be willing to screed further if required, He added that he felt the screening on the south berm would be sufficient to screen the equipment from the property owner to the south. MOTION was made by Commissioner Schneider supported by Commissioner Stewart that. the Planning Commission make the following recommendation to the City Council: That the request of Spraytech for relief from Condition #5 of Resolution #75-695, i.e. approving the .site plan, and, specifically requiring prohibition of outside storage of waste and waste containers, be approved based on the unique nature of the operation as explained by petitioner, the location of the equipment to be used being so far removed and not visible from three sides of the building and subject to the fallowing condition: That the south green space be landscaped with evergreen trees 6-8 ft. in height at planting and on 20 ft.. centers. MOTION CARRIED (4-0-1) (Commissioner Threinen abstained) MOTION CARRIED Commissioner Threinen stated that he did not feel he could make a judgement as to the suitability of the operation as he did not have any idea how the operation worked or how it would appear in use. October 5, 1977 A-767 Piyrnouth Bible Chapel A-767 lot bivision Staff presented petitioner's request for lot division of unplatted pro;)arty located on the south side of 35th, Avenue North at Union Terrace Lane. A reconneodati'on for approval was proposed subject to the conditions as listed in the Staff i°eport of September 30, 1977. MOTION was made by Commissioner Schneider supported by Commissioner Ste lart that the rlanning Commission make the following recommendation to the City Council That the request of the Plymouth Bible Chapel for lot division of unplatted property located. on the south side of 36th Avenue North at Union Terrace lane, be approved subject to the following conditions; 1 Dedication by written easement of 7 ft. additional right-of-way (to a total of 40 ft. from centerline) along the 36th Avenue North frontage of both proposed parcels, 2. Payment of $150Park. Decdication fees -in -lieu, 3. Written easements for drainage and utilities 6 ft. either side of the new property line. 4,.
