MEMBERS PRESENT: MEMBERS ABSENT: STAFF PRESENT: PLANNING COMMISSION CITY OF PLYMOUTH, ,MINNESOTA June 15, 1977 of the Plymouth Planning Commission was called to order by Chairman p.m. in the Council Chambers of the Public Works Building, 14900 -23rd Chairman Davenport, Commissioners Erickson, Hoyt, Schneider 18:30 p.m,) Stewart and Threinen Commissioner Hagen Charles Dillerud and Kate Marx. A-702 Prudential Ins<arance Company A-702 Site Plan and Rezoning Staff presented petit,ioner's request for site plan and rezoning from R -O (Open Resi- dential) to B-1 (Limited Business) for a 475,000 sq. ft. structure to be located between County Road 47, County Road 10 and Interstate Highway 494 within the City. A recommendation for approval was proposed by Staff subject to the conditions as listed in the Staff report of June 9, 1977. The Commission discussed the County Road 10 alignment with petitioner`s representative, John Lackens of The Architectural Alliance. Issues of concern included right-of-way dedication for the ultimate alignment of the roadway, design speed for the road, i41 ntersection of County Road 61 and Panty Road 10, the affect of the traffic to be generated from the ite on thorought other communities, i.e. Crystal and County Road 10 zs it is routed throug City. The Commission also discussed with Dick Wolsfeld, of Bather, Ringrose and Wolsfeld, Traffic Consulzants for petitioner, the affect of traffic on the various roads within the City routed to the site, i.e.. Zachary i.ane, County Road 9, Xenium Lane (County Road 61). Mr. Wolsfeld stated that all estimates made for the traffic analy%s report were made from the point of view of "extreme cases" or on a "worst situation" basis. Commissioner Erickson asked, petitioner if it would be possible to adjust the site for a 50 ft. encroachment of County Road 10 into the. Prudential site at the eastern most curve from I-494 without design changes of a major nature. Jr. Lackens stated that this would be possible. No was present in the :audience from the surrounding neighborhood to ask questions or to comment. MOTION was made by Commissioner Erickson, supported by Commissioner Hoyt that the Planning Commission take action on this item at this meeting. MOTION CARRIED (5-0-0) (All it favor) MOTION CARRIED PLANNING COMMISSION MEETING 0INUTES -2- June 15, 1977 Coinnissioner Schneider arrived at 8;30 P.M. A-739 i tuber Creek A-7 Preliminary Plat Staff presented petitioner's request for p,eliminary plat approval of the Timber Creek plat: of Saratoga Development and Wayne Jopp, a plat for 25 single family residential lots located at Pilgrim Lave and 29th Avenue; North (extended). Of major concern was a lack of provision for the Pilgrim Lane alignment per the Thoroughfare Guide Plan for the site. Petitioner stated that he was not aware of the Thoroughfare Guide Plan alignment of Pilgrim Lane through the plat as per the Thoroughfare Guide Plar of the City, Chairman Davenport opened the public hearing to members of the audience., Allen J. Stenserud, 3051 Quaker Lane, stated that he objected to any thoroughfare being built in the neighborhood at all. He stated that he felt there was no need for a thoroughfare, nor did he feel there would be for quite some time. Carol Peterson, 10135 -29th Avenue North, Audrey Prues, 2925 Quaker Lane:, and Mrs.Darre N ynes, 28th Avenue North, all state 7 ject7on to any thoroughfare Being built in the neighborhood, also. Chairman Davenport close{ the public hearing at MO p.m., MOTION TO DEFER, was made by Commissioner Threinen,, supported by Commissioner Stewart until petitioner was able to 1) familiarize himself with: the City's. Thoroughfare Guide Plan so as to incorporate same into his plat; 2) properly designate Outlots A, B and C, Outlot C to be designated `or trail purposes; and 3) redesign the lots of the plat as per the Staff report of June 7 1977. MOTION TO DEFER CARRIED (6-0-0) eAll in %vor) XMION TO DEFER CARRIED A-723 Medicine Lake Estates A-723 Preliminary Plat and Rezon'i n Staff presented petitioner's request for preliminary plat and rezoning from R -O (Open Residential) to R-1 '(Single Family Residential.) for "Medicine Lake Estates", a plat for 46 single family dwelling lots to be located at the northwest corner of I West Medicine take Drive and 28th Place,. Staff indicated that viva telephone con- versation with the Hennepin County Staff, after the Staff report had been published_, a major concern for the alignment of 29th Avenue North had been expressed due to the topography and; alignment of West Medicine LakeDrive in the area and poor sight dis- tance. A recoliviendation for approval was proposed by Staff subject to the conditions as listed in the Staff report of June $, 1977, I L PLANNING 'COMMISSION MEETING MINUTES -3_ June 15, 1977 Ron Bast r, petitioner`s engineer, sated that the location of the road 'had beet desgne , with considerations of sight distance, and he felt that the alignment as proposed would provide adequate sight distance for the intersection. There was no one present to offer comments or questions from the surrounding neighbor- hood. i MOTION was made by Commissioner Erickson, supported by Commissioner Stewart, that the Planning Commission take action on this item at this meeting. MOTION CARRIED (6-0-0) (All in favor) MOTION CARRIED A-702 Prudential Insurance Company _-702 Site Plan and Rezor.'n MOTIONi was made by Commissioner Threinen supported by Commissioner Stewart that the Planning commission make the following recommendation to the City Council: That the request of Prudential Insurance Company for approval of rezoning of the 77 acre site bounded by County Road 10, County Road 47 and I-494 from R-0 (Open Residential) to B-1 (Limited Business) based on a Gereral Develop'lent Plan consisting of a site plan dated May 27, 1977, be approved. MOTION CARRIED (5-0-1) (Commissioner Schneider abstained) MOTIONCARRIED MOTION was made by Commissioner Threinen supported by Commissioner Erickson that the Planning Commission make the following recommendation to the City Council prat the request of Prudential Insurance Company for site plan approval of a 475,000 sq. ft. structure to be located between County Road 10, County Road 47' and I-494 be approved subject to the following conditions. I. Dedication by easement of the 120 ft. right-of-way for future County Road Cl as depicted on said plans. 2 Dedication by easement of the 40 ft. trail paralleling future County Road 61 as depicted on said plans and payment of Park Dedication fees -in -lieu based on site area sans land dedicated for road right-of-way, less the assessor's fair market value of the aforementione4 trail easement as of the date of building permit issuance,_ 3. Provision of performance security for site improvements per Zoning Ordinance requirements for a period of two years, 4. Written easement dedication for 7 ft. additional road right-of-way for County Road 47 as it fronts the site and as aligned per the City's Thoroughfare Guide Plan. 5. MOTION CARRIED (5-0-1) (Commissioner Schneider abstained) MOTION CARRIED Cotmnissiorter.Schneider stated that his abstaining votes were due exclusively to his absence at the public hearing. A-'723 Medicine Lake Estates A-723 Preliminary Plat and Rezoning MOTION was made by Commissioner Erickson supported by Commissioner Threinen that the Planning Commission make the following recc mendation to the City Council: That the request of Medicine Lake Estates, Inc.. for preliminary plat and rezoning from R-0 (Open Residential) to R-1 (Single Family Residential) for "Medicine Lake Estates", a single family dwelling development for 46 units located at the northwest corner of West Medicine Lake Drive and 28th Pla, be approved subject to the following conditions 1.Dedication of a storm water drainage easement to the City for all plat area below elevation 930 ft. to satisfv Subdivision Unit Project and Public Open Space requirements. No abatement of area charges for .obis area shallbe considered: 2. Compliance with provisions of the City Engineer's memorandum regarding this project. 3. Compliance with comments of the: Bassett's Creek Watershed, Commission. 4, Prohibition of private curb cut access to County Road 154, S. Modification to provide 40 ft. right-of-way from centerline on County Road 154, 6. Agreement of Hennepin County in the propos,,„d alignment of 29th Avenue North and its intersection with West Mediciue Lake ,Drive or realignment as per the County to intersect West 'Medicine Lake Drive at the existing 28th Place for access/egress to West; Medicine Lake Drive. Davenport left the meeting at 10.10 p.m, Commissioner Threinen assumed the chair as Acting Chairman. i A-4740 Carni Peterson A-740 Conditional' Use Permit Staff presented peti.tioner's request for a conditional use permit for a home occupation of a secretarial service (IBM Word Processing Typing) in her home at 10135 -29th Avenue North. Staff proposed arecomnendation for approval subject to the conditions as listed in the Staff report of June 8, 1977. MOTION was made by-ommissioner Schneider supported by Commissioner Stewart that the Planning Commission make the following recommendation to the City Council'; That the requesi rr Carl Peterson for a, conditional use permit for a home occupa- tion to operat# a secretarial service (IBM Word Processing Typing) in her home at 1.0135 -29th Avenue North, be approved subject to the following conditions; I. Compliance with the terms of the definition of Nome Occupation found in in the Zoning Ordinance. 2. No exterior signs be permitted. 3. Permit be for one year, MOTION CARRIED (5-0-0) (A11 in favor) MOTION CARRIED A-126 Columbus Nome AssoFiation A- 26 Conditional Use Permit Staff presented petitioner's request for a conditional use permit to operate a fraternal' lodge in a B-3 zoning district, specifically located in the northwest quadrant of South Shore Drive and Highway 55. In addition, petitioner had submitted a revised site use plan which enhanced the available parking and landscaping of the building as it now exists. Parking was proposed to be increased and landscaping substantially improved by petitioner's' plan. Columbus Home Association for the following actions at 10904-10910 South Shore Drive be granted: 1. Conditional use permit for a fraternal lodge to occupy not more than 1,000 sq., ft. for a period of one year. 2. A conditional use permit for Aaron Electric for a period of one year. S. Lot division/consolidation of Parcels 9234, 9250, 9210 and 9245, Plat 43736 -to create the parcel depicted by plans dated May 30, 1977, Said actions shall be subject to the following conditions: 1. Improvement of the subject site consistent with plans dated May 30, 1971. 2 Adjustment of sign location to maintain 20 ft. setback. Said sign shall not exceed Z90 sq., ft. in surface area and 36 ft. in height or reduced in height such that aggregate sign area for the site does not exceed 290 sq. ft. S. All parking areas shall be asphalt paved. 4. All deciduous plantings shall, be of minimum 2-z'" calipher and all coniferous plantings shall be of a minimum 5 ft. height balled and but -lapped. 5. Site improvements shall be secured per the Zoning Ordinance ,and subject to the phasing plan provided based on a three-year term, phase one being completed;in one year, phase two being completed after two years, etc. 6. Compliance with the City :Engineer's memorandum regarding this project. FURTHER, that variance from Section 17, Subdivision 2, Paragraph 4d, side and rear park- ing setbacks, be granted based on the unusual shape of the parcel and petitioner's efforts to provide off-street parking well in excess of Zoning Ordinance requirements to meet future needs. MOTION CARRIED (5-0-0) (All in favor) MOTION CARRIED A-590 Nest Horizons A-590 Conditional Uses Permit j` ,Staff presented. petitioner's request for a condition l use permit to operate a day f care center in the old Parker's Lake Baptist church located at the northeast corner of Niagara lane and; County Road 6. It was pointed out that the basic problem was that of definition in terms of the Zoning Ordinance: Staff proposed a recommendatiorg for denial based on findings as listed in the Sta t i, -)ort of dune 8, 1977. PLANNING COMMISSION MEETING MINUTES June 15, 1977 William and. SueDunkle , representing New Horizons, made the following statementsinterms6Tdefinitionqualificationsa.s concerned the Zoning Ordinance and their operation at the Parker's Lake Baptist Church: 1) The State Departments of Education and Welfare consider the New Horizons operations as schools.. Such certification is based on various cr-tera required to be met .by the State of Minnesota. They ;are not a .day care operation in teras of babysitting only; 2) As to concern for the location.of the building near thoroughfares, it compares to the allowance. of day care centers in R-1 zoning districts per the Plyvmouth Zorting Ordinance. The 8-1 buildings are more likely to be located on thoroughfares than a residential zone, and yet day care centers are allowed in such zoning districts in Plymouth; and 3) The State of Minnesota is quite strict when dealing with day care centers. Generally speaking, their requirements are more stiff than any city zoning ordinance in terms of safety for children,sanitary surroundings, quality of education (if con sidered a school) and quality of care provided for the children. The State of Minnesota has approved the si e for this use by the New Horizons operation,. The Cotmtiscynn discussed pettioner's daily operations in detail with the Dunkleys. Threii)en supported by Commissioner Eri,.kson that. the Planning Comnissior,, make the following recommendation to the City Council: That the request of New 'Horizons for a conditional use permit to operate a day car - center in the old Parker's Lake Baptist Chruch, located at the nort;eest corner of Niagara Lane and County Road 6 be approved subject to the following conditions: 1, A site plan be submitted to the Planning Commission and City Council for review indieatina the use of the parking lot and the proposed drop-off area for children as well as other outdoor areas to be used by the opera- tion. 2, Permit be for a period of one year for purposes of reviewing the progress and operation of the use. Masters` T-741Site Plan Staff presented petitioner's request for site 'plan approval of a 2,500 sq. ft. addition to the existing 13,150 sq ft. st.ucture located in the southwest quadrant of County Road 10 and 18. Staff proposed a recommendation for approval subject to the conditions as listed in the Staff report of June 8, 1977. Begin A-725 Conditional Use Permit Staff reviewed the previous- actions on this proposal by Jerome Begin to operate a landfill at the south end of Mud Lake. To date, the petition had been deferred by the Commission awaiting input from the Elm Creek Conservation District.. The concerns of the Elm Creek Conservation District were contained in the Staff report of June 9, 1977 and recottmended for inclusion in the Commission recommendation to the Council on this item., MOTION was made by Commissioner Stewart supported by Acting Chairman Threinen that the Planning Commis;,vion make the following recommendation to the City Council: That the request of Jerome P. Begin for a conditional use permit to operate a landfill at the south, end of Mud Lake be granted subject to the following conditions: 1. Permit shall be for l20 days only with no extensions intended, Z. Fill material shall be limited to tees and clean cover material, not including diseased Flm trees. 3. Deposition in the landfill shall be exclusively by aod with equipment and: employees of the petitioner. 4.. Petitioner shall provide the City with security in the maount of $2,500 to guarantee compliance with the provisions fo this conditions use permit. 5. Concurrence of the State Department of Natural" Resources with respect to Shoveland'Zoning definitions.. 6. Substitution of an earthen dike for the proposed straw bale sedimentation control device.
