HomeMy WebLinkAboutPlanning Commission Minutes 06-01-1977PLANNING COMMISSION CITY OF PLYMOUTH, MINNESOTA June 1 1977 A regular meeting of the Plymouth Planning Commission was called to order by Chairman Davenport at 7,30 p,.m., in the Council Chambers of the Public Works Building, 14900 - 3rd Avenue North. MEMBERS PRESENT: Chairman Davenport, Commissioners Erickson, Hagen, Hoyt, Schneider and Threinen MEMBERS ABSENT: Commissioner Stewart STAFPPRESENT: Charles Dillerud and Kate Marx Commissioner Hagen stepped down from the table for discussion of the following i'. -em. 733 Parklands Developments 733 Concept Plan for RPUD Staff presented petitioner's request for concept plan approval of an RPUD to consist of 147 single family dwelling units to be located west of Larch Lane and south of the Soo Line Tracks. Staff proposed a recommendation for approvalof the proposed concept plan as per the Staff report of May 26, 1977. Commissioner Threinen questioned the realignment of Pineview Lane through the p1-,; as Pineview Lane is classed as a collector street on the City's Thoroughfare Guide Plan. Petitioner was proposing a direct north -south alignment as opposed t,,. the northwest= southeast alignment of the current .right-of-way. Staff indicated' that in terms of safety, the proposed alignment of the road was perhaps better as realigned than the presently existing right-of-way. Comrissioner Schneider asked if the drainage way would be open, or underground;. Staff stated that the conveyance was an open drainage ditch. Chairman Davenport questioned petitioner as to why they felt the property should be developed as an RPUD. Don Hess, representing the petitioner, stated their reasons for proposing > the project as an RPUD. He added that the type of home to be 'built would be in the $40,000-$60,000 range. Commissioner Erickson asked petitioner if the acreage of the site as stated included the current right-of-way for Pineview Lane. petitioner responded that it did not. Chairman Davenport opened' the public informational meeting to continents and questions from members of the audience. PLANNING COMMISSION MEETING MINUTES -2- June 1 1977 Ruth Rosendahl, 5205 Pineview Lane, stated that she fell; the proposed realignmentofPineviwanewasagoodideainthatthepresentalignmenthasbeenthesource of several accidents when people have missed the sharp turn in the road: Chairman DaVenport closed the public informational meeting at 8:20 p.m. MOTION was made, by Commissioner Threiner supported by Commissioner Schneiuer that the Planning Commission take action on this item at this meeting. MOTION CARRIED (5-0-0) (All in favor) MOTION CARRIED MOTION was made by Commissioner Threineo supported by Commissioner Erickson that the Planning Conmlission make the following recommendation to the City Council That the request of Parklands 'Developments for Concept Plan approval of RPUD 77-1PineviewEstates", a residential plat consisting of single family dwelling unitslccatedwestofLatchLaneandsouthoftheSooLineTracks, be app,owed subjecttothefollowingconditions - 1. Density to be 2.2 units per gross acre for the project. 2-. The proposed realignment of Pineview Lane be approved and the entire dedication of right-of-way for the'realignme,lt of Pineview Lane be dedicated from the proposed plat Commissioner Schneider ques';oned whether there was adequate transition of lot sizebetweentheproposedplatasldtheplattotheeast, Palmer Creek Estates. A-199 Carlson Pro_perMs A-199 Preliminary Plat, Condi- tional Use Permit for Subdivision Unit Project, Rezoning and General I Development Plan i Staff reviewed the previous Planning Commission: action from the May 18, 1977 meeting PLANNING COMMISSION MEETING MINUTES -3_ June 1, 1977 Postponing until petitioner would comply with certain requests of the PlanningCommission.. These requests included written agreement including the concerns of the surrounding neighborhood., together with the recommended Staff actions provided per the Staff report of May 1,3, 1977, Said documents were to be reviewed by the City's attorney. Dick Knutson, petitioner's engineer, stated that the State Department of Transporta tr4 o FlaT stated that, contrary to the Staff recommended 300 ft. of vehicle storage between the south curb of the service road and, the north pavement edge of the west _bound lane of Highway 55, that 150 ft of vehicle storage would be sufficient. Staff confirmed that the State had not requested more than tta 150 ft. and stated that the reconnendation of the May 13, 1977 Staff re,rt could be altered to reflect the State Department of Transportation recommendation for condition 5. The Commission asked petitioner what affect the 300 ft. vehicle storage area between the south curb of the service road and the north pavement edge of the west bound lane of Highway 55 would have on the project. John Sebold, Carlson Properties, iro erties stated that it would be major enough to cause the project to be redesigned entirely in that area, Commissioner Schneider stated that he could see potential: for conflict in deciding upon a proper landscape plan for the project as proposed by the petitioner and the homeowners in the area. A committee of four citizens and the developer may result in many problems wherein the City would become the mediator. Petitioner and the citizens' representative, Jim Kuzmic, stated that they felt this would not happen in this situa- tion. Bob Sundin, 2001 Oakview Lane, stated he was in total opposition to the proposal of the Car son Pcoperties. He would prefer residential to industrial on the property.. He stated that access to Oakview Lane was already limited and in bad shape and that the project would only increase: the 'problem; the proposed buildings would be too close to his property as well as his neighbors, the drainage in the area would be affected by the project and could possibly affect the residential neighborhood by causing flooding of basements and back yards; and further, the natural areas of the site would be destroyed by this development. He sta" ti at there was a terrific speed problem at present and he was concerned that without some signalization at the intersection, the traffic would only become worse, Chairman Davenport closed 4 -he public hearing at 9:20 p.m. MOTION was made by Colinissioner Erickson supported by Commissioner Threinen that the Planning Commission act on this item at this meeting. PLANNING COMMISSIONMEETING MINUTES •4, June 1, 1977 A-232 Roll'lPartnership A-232 Preliminary Plat and Conditional Use Permit for Subdivision Unit Project Staff reviewed with the Planning Commission the previous action taken at the May 18, 1977 Planning Commission meeting regarding this project. Petitioner had now responded to Planning Commission direction to reroute the street alignment for the project to allow both ingress and egress from Dunkirk Lane as opposed to routing 32nd Avenue North through the Seven Ponds project. Doug Nara, 16926 County Road 24, stated he felt the lots should be significantly larger to match those of the surrounding neighborhood. He added that he felt open areas should also be dedicated within the plat and that he felt 32nd Avenue North should not be allowed to connect the two projects (;Seven Ponds and Seven Ponds East) at any time, now or in the future: Stanley Alexander, 17200 -32nd Avenue North, stated that; he, too, felt 32nd Avenue North should not be, built at this time, if at all between the two plats,, Roger 0a en, 17000 -32nd Avenue North, also stated opposition to the extension of 32nd AvenueNort and its connection to the Seven Ponds plat. MOTION was made by Commissioner Schneider, supported by Commissioner Hoyt that the Planning Commission act on thi's item at this meeting. MOTION CARRIED (5-0-0) ('All in favor) MOTION CARRIED Vice. Chairman Hagen declared a five-minute recess at 9:55 p.m.; the meeting was reconvened at 10::00 p.m, MOTION was made by Commissioner Erickson supported by Commissioner Threinen that the Planning Commission' make the following recommendation to the City Council That the request of Rolling Acres Partnership for the Preliminary Plat, rezoning from R -O (Open Residential) to R-1 (Single Family Residential and a conditional use permit for a Subdivision Unit Project fo., Seven Ponds East per plans dated May 2., 1977 subject to the -following conditions: 1. Compliance with provisions of the City Engineer's memorandum regarding this project including the timing and availability of sanitary sewer.. 2. Prohibition of all private access to Dunkirk Lane, 3. Fees -in -lieu payment for Public Open Space of 1.76 acres, FURTHER, that the following variances be granted: From Section 7,_Subdivision 7, para- graph 2a, to allow variance from the 20 -acre minimumrequirement for this 16 -acre Subdivision Unit Project; and from Section 7, Subdivision 7, paragraph 2e to allow payment of fees -in -Lieu for 1.6 acres of Subdivision Unit Project Open Space require- ments. Incorporation of provisions for protective covenants as is mutually acceptably to Carlson Companies and the adjoining property owners including lot coverage as is currently established in the Minneapolis Industrial Park south of Highway 55. Comiiss.itRner Erickson stated he would not vote in favor of the motion as he felt the proposed 1-1 zoning would constitute spot zoning in that the industrial district would jump a buffer (Highway 55) and was not consistent with the Land Use Guiding for the site, i.e. 'A-3 (High Medium Density Residential).. Further, he stated that he felt the intensity of the industrial development proposed would be greater than would be found with the LA -3 type area. In addition, Commissioner Erickson stated that he felt the 75 ft. buffer for the residential area to the east would not be adequate. Cotmti.ssioner Hoyt stated that sf:e, too, was concerned about the jumping of the buffer area. by the industrial proposal and that the LA --3 guiding was more -appropriate as a use for the property. Family Resi- dential) and a conditional use permit for a SubdivisionUnitProject be approved subject to the following conditions 1. Compliance with the provisions of the City Engineer's memorandum regarding this project, 2 Dedication of 0utlot A to the City of Plymouth by fee title in satisfaction of Subdivision Unit Project Open Space requirements. 3. Einar plat provisions for Public Open Space requirements to be fees -in - lieu. Compliance with the provisions of the, City Engineer's memorandum regarding this project. 2. Prohibition of private drive access to 26th Avenue North. 3. Final plat and development contract provisions to provide for park dedication payment of fees -in -lieu. 4. DNR approval of floodway/flood plain modifications required on Plymouth Creek to accommodate development of Lot 1. 5. The final plat shall relfect right-of-way dedication of the geometries required to accommodate a relocated 26th Avenue North per the Thoroughfare Guide Plan. MOTION TO DEFER CARRIED (6-0-0) (All in favor) MOTION TO DEFER CARRIED A7734 Prest Equipment Company A-734 Site Plan and Conditional Use Permit Staff presented petitioner's request for site planapprovalof a 10,000 sq, ft. structure for office/warehouse uses to be located at the northeast corner of Fernbrook Lane and 25th Avenue North. A recommendation for approval was proposed by Staff subject to the conditions as listed in the Staff report of May 27, 19,7. Petitioner,, John Prest, explained his business of industrial fork-lift sales and service to the Commission stating that he maintains an inventory of 40-50 lift trucks and t= other similar vehicles for customers. The remainder of the sapce is used for test- driving within the structure and office space. Servicing also is conducted from the PLANNING COMMISSIONMEETING 14INUTEB' 8- dune 7, 1977 structure. However, most of the serivice is dispatched to the site of the customers, very little is conducted on site bypet?tioner. MOTION was made by Commissioner Hagen supported by Comnisioner Schneider that the Planning Commission Make the following recommendation to the City Council: That 'the request of Prest Equipment Company for approval of a 10,000 sq. ft. structure for office/warehouse uses to be located at the northeast corner of Fernbrook Lane and 25th Avenue North per plans dated May 12 1,977 for the sales/ service of industrial lift trucks be approved subject to the following conditions: I. Dedicatin by easement of 7 ft, addittnnal right-of-way (to a total of 40 ft. from center line) along the ire Fernbrook Lane frontage. The proposed 50 ft. structure setback fi,,, Fernbrook Lane shall be maintained from the new right-of-way line, 2: Compliance with the provisions of the City Engineer's memorandum regarding this project, 1 3,; All street setback areas and portions of the site disturbed during construction shall be seeded or sodded (sod only for slopes exceeding 10%). 4. A recommendation for approval was proposed by Staff subject to the conditions as listed in the Staff report ofMay 27, 1977,. Robert lliddlemist stated that, as purchaser of the 3.0 .acre parcel, he did not feel the Staff recommended condition regarding dedication of an easement for roadway purposes across the parcel was necessary at this time. Staff proposed a recommendation for approval subject to the conditions as listed, in the Staff report of May 27, 1977 MOTION was made by Commissioner Erickson supported by Coffenissioner Hoyt that the Planning Cormi;ssion make the following recommendation to the City Counl:il That the request of Ronald Libby for a 3,000 sq., ft. addition to his building located in the, northeast quadrant of 8,ass lake Road and Hemlock Lane be approved subject to t'ie following conditions; 1, Dedication by written easement of 27 ft, additional right-of-way along the; entire County Road 10 frontage, 2. Compliance with provisions of the City Engineer's memorandum regarding this project. 3. P.rohibiti`on of outside storage of waste or waste containers. 4. Petitioner shall remove all diseased elm trees from the property. 6. As; per Commission request, representatives of Hertz were present at the. meeting to explain the nature of the operation. During discussion with petitioners, it was noted that most of the trucks that would tr PLAANING`COMMISSION MEETING MINUTES -11- June 1, 1977 be pa)iked on site would be replacement units for those already in service; that there would be equipment maintenance taking place at the facility --not major overhaul or major repair work on the vehicles customers would be leasing vehicles for hong periods of time„_6 months on an average as opposed to a weekend or an afternoon, gasoline would be stored on site for customer use to be delivered periodically, 5-10,000 ga. lops at a time. MOTION was made by Commissioner Threinen supporf-4 by Commissioner liugen that the Planning Commission make the following recotmtene.tion to the City Council That the request of Hertz for site plan and conditional use permit approval for a 9,000 sq. ft structure to be located at the southeast corner of Fernbrook Lane and Highway 55 for office/servicing of trucks be approved subject to the following; conditions.; 1. The conditional use permit shall be to allow truck storage (maximum 26 stored outdoors) and servicing only. Retail leasing operations involving pick-up and/or drop-off of vehicles at this location shall be prohibited 2. Dedication by easement of 7 ft. additional right-of-way along the Fernbrook Lane frontage, Front etback shall remain at 50 ft. 3. Compliance with the provisions of the City Engineer's memorandum of May 10, 1977 regarding this project. 4. Payment of Park: Dedication Fee of $1,235 prior to building permit issuance. S. Prohibition of outside storage of waste or waste containers. 6. Site plan performance security per Zoning Ordinance requirements for 18 months. 7.
