HomeMy WebLinkAboutPlanning Commission Minutes 05-18-1977PLANNING COMMISSION CITY OF PLYMOUTH, MI,NNESO` May 18, 1977 A regular meeting of the Plymouth Planning Commission was called to order by Chairman Davenpor*t at 7:30 p.m., in the Council Chambers of the Public Works Building, 14900 -23rd' Avenue North MEMBERS PRESENT: Chairman Davenport, Commissioners Hagen, Hoyt, Erickson, Schneider, Stet, t and `brei nen MEMBERS ABSENT: None STAFF PRESENT: Charles Dillerud and Kate Marx OTHERS PRESENT: Kris Grangaard, YAAC Representative A- 99 Carlson Properties A-199 Preliminary Plat (3) Conditional Use Permit. for Subdivision: Unit Project, Rezoning and General Development Plan Staff presented petitioner's requests for preliminary plat, rezoning and a conditional use permit for a Subdivision Unit Project for Plymouth Creekview Addition, preliminary plat and rezoning approval ofPlymouth Creekview 2nd Addition and preliminary plat, rezoning and general development plats approval of Minneapolis` Industrial Park 3rd Addition. Total units involved included 42 single family residential lots (Plymouth Creekview Addition), 4 duplex lots (Plymouth Creekview 2nd Addition) and 8 industrial lots (Minneapolis Industrial Park 3rd Addition) located north of Highway 55 and west of Oakview Lane. Staff recommended approval of the residential plats subject to the conditions contained in the 'taff report of May 13, 1977. As to tho industrial, proposal, Staff indicated that the change in guiding from LA -3 (high medium density residential) to IP (planned industrial) would be required Staff indicated that the main consideration for the I Planning Conn7ssion would be the propriety and feasibility ofthe Land Use Guide Plan change proposed by petitioner. I)ick Knutson, petitioner's engineer, stated that he had communicated with the State. Department of Transportation .regarding the accesslegress,, stacking distance and general' design of the project in relation to State Highway 55. Rick Sathre, petitioner's engineer, discussed the traffic relationships of the project as proposed at IP guiding .and conpared'the traffic to LA= -3 type uses, The IP traffic PLANNING COMMISSION MEETING. MINUTES ..2 May 18 1977 of the project as proposed, would be less than the LA -3 traffic by about one-third. Commissioner Hagen asked petitioner what the benefits to the comminity would be should the guiding be changed from LA -3 to IP. Mr. Sathre responded that 1) visually, in terms of height of the buildings and screening of them, 2) the "passivJactivel" times of the industrial development compared to the residential development (industrial being done with their work, days at 4:30 and not working on weekends, residential being continually active) and 3) the proximity to the neighboring industrial area to the south and the State Hgihway made the property conducive to industrial development. Commissioner Erickson pointed out that in terms of traffic, the projections made by the engineers for the project had been based on the plan before the Commission at this time. He stated that the site, at full potential (50% coverage of lots, addi- tional parking to absorb expansion of facilities, etc.), would :e at least twice as great aswhatwas proposed by the petitioner, and, therefore, tate impact of the industrial upon tete area would be increased oy at least twice. James,Kuzmi(, 2217 Oakvlew Lane, representing the homeowners in the area, presented a statement f'om the property owners listing those conditions which the citizens in the area would like met should the industrial portion be approvtgd. The basic concept. of industrial was not objectionable subject to the conditions of the statement. Clayton Ziebarth, President of the Creekwood Heights Citizens, 2715 Sycamore .ane, spoke to the trafifi'c increase that would be faced by the residences existing, on 26th Avenue North. He stated; that it was the feeling of the grorn -that the additional 42 single family dwellings acrd the 4 duplex units would increase t,,t& traffic situation tremendously: Norm Torrison, 12910 -27th Avenue North, stated that he felt a neighborhood park should be provided within this project. Bud Smith, i2610 -24th Avenue North, stated that the present status of 24th and 25th Avenues Nortn was poor.. He added that he felt these two roads could not withstand any additional impact of traffic from the proposed project. He also asked if it would be possible for the developer to utilize a watering system that would prevent a great amount of dust to be introduced into the neighboring residences as the construction woula. be in progress. Delores Sundin 2001 Oakview Lane, asked if there was any way o bind the developer to -t e presentation off the project as stated. Commissioner Threinen asked John Sebold, Director of Reil Estate for Carlson Properties, what the intent of the petitioner was in terms of the building size, etc. Mr, Sebold eespondedthat their intent was to try to meet all the conditions proposed by the adia tent property owners and to do so contractually, ifpossible and desired. Chairman. Davenport closed the public hearing at 9:15 p.m: MOTION TO CONTINUE was made by Commissioner Threinen supported by Commissioner Stewart until such time as the developer would 4ncorporate into the project in contractual form the petitioned conditions of the adjacent property owners including a building height limitation of 25 ft. for Lots 7 and 8 and 30 ft. for the remaining Lots 1-6, PLANNING COMMISSION MEETING MINUTES .,3 May 18, 1977 together with the recommended Staff actions provided per the Staff report of May 13, 1977, all said contractual documents to be subject to the approval and acceptance of the City attorney and based upon the proposed development as presentedby petitioner dated April 28, 1977. The Commission discussed the motion in detail, including the discrepancy in lot sizes on 26th Avenue North between lots on the north and proposed lits for the south side of the road. In addition, the buffering proposed for the north and east existing residential areas was discussed. The Commission then voted on the main motion, MOTION TO CONTINUE CARRIED (6-1-0) (Commissioner Erici:son against) MOTIONTOCONTINUE CARRIED Commissioner Erickson stated he was against the motion and the proposed project as he did not feel the change in the Land Use Guide Plan from LA -3 to IP would be proper in that it would .be jumping a buffer (T.N. 55) for additional industrial development, and, also, would eliminate a transitional area from the residential existing in the area to the industrial development to the east and south. Chairman Davenport stepped down from the table for consideration of the following item A-232 Seven Ponds East A-232 Preliminary Plat, Rezoning and 'Conditional Use Permit for Subdivision Unit Project Staff presented petitioner's requests for a conditional use pe mit for a Subdivision Unit Project, rezoning and preliminary plat review of Seven Ponds East consisting of 2.9 single family dwelling units located west of Dunkirk Cane at 32nd Avenue North. Staff recommended approval subject to the conditions as listed in the Stafh= report i of May 13, 1977. Staff indicated that the parcel to the north of the proposed project (approximately 8 acres) was not under the ownership of the petitioners involved in the Seven Ponds East project; however, the current proposal would not prohibit a well-planned develop- ment to the north: Come ssioner Threinen questioned the availability of sewer and water to the project as to location at the present time. Staff indicated that sanitary sewer was planned to be located in the Shiloh 2nd Addition adjacent to the southwest corner of the proposed Seven Ponds East project. It was planeed; to be in place during this construction season. Vice Cha rman Hagen opened the pubic hearing to questions and comments from the audience. PLANNING COMMISSION MEETING 'TNUTES r4- May 18, 1977 Staff stated that they had heard by phone from Doug Haft, the property owner immediately to the west of the priposed project who was unable to attend the public thearing on the project. He requested that the heating be postponed until he would be able to attend, the meeting. Roger A, D„aen, 17000 -32nd Avenue North, questioned how traffic would be handled for project if 32nd Avenue North would be continued westerly as proposed by the project. He stated that he felt the alignment was too direct to County Road 24. Stan Alexander, 17200 -32nd Avenue forth, suggested that the plat should access only via Dunkirk Lane to avoid a thru-street use of 32nd Avenue North from Dunkirk to County Road 24. The Commission discussed the possibility of a "T" shaped street pattern and; a "horse- shoe" shaped street pattern. MOTION was made by Commissioner Stewartsupportedby Commissioner- Erickson that the Planning Coirmission take action on this item at this meeting. MOT"104 CARRIED (6-0-0) (All in favor) MOTION CARRIED MOTION was made by CoMmission3r Stewart supported by Commissioner Threinen that the Planning Commission make the following: recommendation to the City Council: That the request of the Rolling Acres Partnership for preliminary plat, rezoningfrow, R -O (Open Resi'dontial) to R-1 (Single Family Residential) and a conditional use permit for a Subdivision Unit Project for Seven Ponds East per plans dated May 2, 1977 be app:^%ved subject to the following conditions lo Compliance with provisions of the City Engineer's memorandum regarding this project including the timing and availability of sanitary sewer. 2. Prohibition of all private access to Dunkirk Lane. 3 Fees -in -lieu payment for Public Open Space of 1.76 acres. Further, that the following variances be granted; From Section 7, Subdivision 7,, paragraph 2a, to allow variance from the 20 -acre minimum requirement for this 16 -acre Subdivision Unit Project, and from Section 7, Subdivision 7, paragraph 2e to allow payment cif fees -in -lieu for 16 acres of Subdivision Unit Project 'Open Space requirements. MOTION TO AMEND was made by Commissioner Threinen supported by Commmissioner Stewart to add the following as condition #4 Redesign of the street pattern for the pkat to form a traffic: loop accessing and tigress ng Dunkirk Lane. MOTION TO DEFER CARRIED (6-0-0) (All in favor) MOTION TO DEFER CARRIED Chairman 'Davenport returned to the table, A-555 Wayzata Evangelical Free Church A-gv,-' Conditional Use Permit Staff presented peti`tioniar's request for a conditional use permit extension of three years for a temporary buiNding to be located on the site for the educat onak purposes for the church. Richard A. Berreth, representing the church, stated the church was in the process of collecting funds for the necessary educational addition to the church building at this time.. Tice Commission discussed the possibility of extending the permit for a lesser 'period of time to enable the City to check on the progress of the church building plans. MOTION was made by Commissioner Erickson supported :by Commissio ler Stewart that the Planning Commission crake the following recommendation to the City Council: That the 'request of Wayzata Evangelical Free Church for a conditional use permit extension for a. temporary building located on the site of the church at 705 Highway 101 used for educational purposes be granted fora period of two years after which time, the progress of the church in construction of a permanent addition to the church for educational purposes will be checked and any addi - tional extensions of the conditional use permit considered. MOTION CARRIED (7-Q-0) (Ali in favor) MOTION CARRIED A-126 Columbus Home Association A-126 Conditional Use Permit Staff presented petitioner's request for a conditional use permit to allow a fraternal lodge in a B -B zoning district. MOTION was made by Gommissioner Threinen supportedby Cok,iissioner Erickson that the proposed: fraternal lodge be acceptable as a, use by conditiunal use permit in a B-3 zoning district as similar in nature to those uses permitted in a B-3 zoning district as per Section 13, Subdivision 3, paragraph 13, MOTION CARRIED (7-0-0) (All in favor) MOTION CARRIED staff stated that the proposal for the specific site which petitioner requested to use was, at this time, incomplete. Petitioner would have to supply Staff with addi- tional information prior to Planning Commission review of the specific site. A-381 Schmidt Lake Wood 'RPi1D 76-4 A-fiBi Final Plat Staff presented petitic-ner`s request for final plat approval of Schmidt Lake Woods Addition located at the southwest quadrant of Zachary Lane and the Soo Line. Tracks and towzisting.of 59 single falrily dwelling units A recommendation for approval was proposed sub,lect to the conditions as listed in the Staff .report of May 13, 1977. MOTION was made by Commissioner Erickson supported by Commissioner Hagen that the Planning Commission make the following recommendation to the City Council. That the request of Enterprise Properties for final plat aprpoval of "Schmidt Lake Woods" addition located at the southwest quadrant of Zachary 'Lane and the Soo Line Tracks and consisting of 59 single family dwelling units, be approved subject to the following conditions. 1.. No private curb cut access to 49th Avenue North be permitted. 2. Compliance with provisions of City Engineer's memorandum regarding this project. 3. A settling pond be established at the northeast corner of the plat by the developer. 4. Dedication to the City by fee title of Outlot A (for trail purposes) and Outlot B (for neighborhood: park purposes), MOTION CARRIED (7-0-0) (All in favor) MOTION CARRIED PLANNING COMNISS10N MEETING MINUTES -7- May 18, 1,977 A-501 West Tonka Estates. A-501 Final Plat Staff presented petitioner's request for final plat aprpoval of West Tonka Estates,, a plat consisting of 10 single family dwelling units located in the northwest quadrant of Niagara Lane and County Road 15. A recommendation for approval was proposed by Staff subject to the conditions listed in the Staff report of May 13, 1977. MOTION was made by Commissioner Schneider supported by Commissioner Stewart that the Planning Commission make the following recommendation to the City Council.; That the request of Floyd Olson for final plat approval of West Tonka Estates a residential plat consisting of 10 single family dwelling units located in the northwest quadrant of Niagara. Lane and County Road 15 be approved subject to the following conditions; 1. Construction by the owner, at his sole expense, of storm water drainage pond: PL -P4 consistent with the regvirements of the Storm Water Drainage Plan including all necessary appurtenances for connection to the existing storm sewer system. Plans for grading work shall reflect preservation of as much natural vegetation as feasible. Payment of Park Dedication fees -in -lieu of $1,200 ($150 X 8 lots). 3. Storm water drainage easements to the City for a site area at elevation 971 ft, and below after completion of site grading. 4. Maintenance of a 973 ft, minimum floor elevation for all homes to. be con- structed within the plat. 5. Compliance with provisions of the City Engineet,'s memorandum regarding this project with emphasis on design to aide in solving the serious drainage problem in the area. 6. Combined driveways on lot turn-arounds to serv;ce Lots 7 and 8 and Lots 9 and 10. 7. Compliance with the terms of Council Resolution #77-163 regarding erosion control during construction. MOTION CARRIED (7-0-0) A=730 Hertz A-730 All in favor) MOTION CARRIED Site Plan Staff presented petitioner's request for site plan approval of an office/service facility for truck leasing to be located at the soutehast corner of Highway 55 and Fernbrook Lane, structure size of 9,00 sq.. ft. with substantial vehicle storage on the remainder of the 107,700 sq. ft. site. PLANNING COMMISSION MEETING MINUTES -8- May 18, 1977 The Commission discussed the exact nature of the use proposed by petitioner with petitioner`s representative, Dick Anderson. Of basic concern to the Commission were the following: 1) final grade of the site parking and vehicle storage, and 2) whether truck depot maintenance was a major or minor type of maintenance to be operated from this strutLlure, MOTION TO DEFERwas°mad'e by Commissioner Stewart supported by Commissioner Threinen until such time as a representative from Hertz could be present before the Planning Commission to answer the concerns as stated.: 1. Gomplaince wtih the provisions of the City Engineers memorandum regarding this project 2 Park Dedication fees -in --lieu of $4,350 ($500 X 8.7 acres) be paid to the City prior to building permit issuance_. 3. ,Prohibition of outside storage of products, trash or trash containers. 4. Site plan performance security pew Code for 18 months to be provided to the City prior to building permit issuance, PLANNING OMISSION MEETING MINUTES May 18, 1977 5, Submission to and approval by the Director of Planning and Community Develop- ment of an amended site plan reflecting, removal of parking from the south setback and incorporation of earth berms of 6 ft. elevation within the frcn°t setback with variable height for office exposure, MOTION TO AMEND was made by commissioner Erickson supported by Commissioner Schneider that the following be added as #6: Landscape stock be increased to approximately three times the amount currently shown on the plats with the exception of the choke cherries, MOTION TO AMEND CARRIED (6-0-1) (Commissioner Stewart abstained) MOTION TO AMEND CARRIED The Commission tben voted on the main motion as amended. A recommendation for approval was proposed. by Staff subject to the conditions as listed f1i the Staff report of May 13, 1977. Mr. Dave Knodell, attorney for Mr. Begin, was present to explain the request in further detail, Commissioner Threinen asked if the Elm Creek Watershed District had been notified and askedto comment on the project. Staff responded that they had not. MOTION TO DEFER was made by Comissioner Threinen supported by Commissioner Erickson until such time as comments from the Elm Creek Watershed District regarding the project would be available for Planning Commission and Council review; MOTION TO DEFER CARRIED (7-0-0) (All in favor) MOTION. MOTION was made by Commis:,aioner Erickson supported by Commissioner Threinen that the Planning Commission make the following recommendatioii to the City Counci, That. the request of Dav,o Roofing and Sheet Metal for site plan approval of a 15,000 sq. ft. office/warehouse/sheet metal fabrication facility to be located in an 1-2 zoning district at the southwest corner of Ranchview Lane and 32nd Avenue North be approve- subject to teh following conditions; 1, Compliance with: the provisions of the City Engineer's memorandum regarding this project. 2. Dedication of easement for 10 ft. additional right-of-way on the 3.1s:c Avenue North frontages 3. Adjustment of storage area south limits to provide a 15 ft. setback from the new 31st Avenue North right-of-way line, 4. Construction of a landscape screen along the south and east` storage area limits to consist of 6 ft. balled and burlapped evergreen trees on 2.0 ft. centers, 5. Asphalt paving of the parking area labeled "Class 2" on the March 21, 1977 plan. 6. Payment of Park Dedication fees -in -lieu of $1,600 prior to building permit issuance. 7. Site plan performance security shall be per the zoning ordinance for a period of 18: months., Further, that a variance to Section 17, Subdivision 2, be granted to allow 17 off- street parking spaces where 19 would be required based on projected employment by an owner/'occupant and the availability of sufficient site area for additional parking if 1*ter required..
