Chairman Davenport, Commiss-,'. ers Erickson, Hagen (9.15 p.m.), Hoyt., Schneider and Steuart MEMBERS ABSENT: Commissioner Threinen STAFF PRESENT Charles E. Dillerud, Kate Marx IOTHERS PRESENT:: Councilman Gerry Neils, Council Representative to Commission A-501 Test Tonka Estates A-501 Preliminary 'Plat I Staff presented pet boner's, request for preliminary plat approval of an 8.9 acre I parcel of land located int orthwest quadrant of Niagara Lane and County Road 1.5. A recommendation for approval N;,as proposed subject to the conditions as listed in the Staff report of March 31 1977, Chairman Davenport opened the public hearing to members of the audience, Mr.. John O. Jackson, 315 Orchid Lane, stated he did not feel any variances should be I granted for the lots. He also expressed concern for the added problems this project may bring to the .already poor storm water, drainage in the area. Mr. Willy Budnick, 16031 -18th Place, also expressed concern with the potential r1rainage problems additional construction may present. Staff explained that the City's Storm Mater Drainage Plan, adopted in 1973, was deci-gned to take care of the problems of drainage. The drainage of this plat would not affect the property to the north, the Iland to the north drains into this parcel. Dan Buses, 320 Quantico Lane, also expressed concern for the drainage in the over- al ver alIarea. In addition, he tated he did not feel the variances should be granted, for the area, that the developer should be made to meet the full requirements of the Ordi- nance. Mr. Me' ti(rolstad, 340 Ranchvi ew Lane, stated that during any good rain, the entire neig•borhond would be under water. He asked that the City look into the drainage jlrobler; prior to development of the West Tonka Estates plata Mr, Pat Sheehy, M Ranchview Lane, asked what recourse the poeple in the neighborhood had when their basements filled with water, Staff stated that the citizens should cuntact the City Public Works Department to notify the City Engineer of the drainage problems of the area. Staff also indicated that they would endeavor to notify the City Engineer of the problem in the area because of the great concern noted at this meeti ng.. Mr.. Robert Meyers, 16830 -12th Avenge North, addressed the Commission as to the structure and purpose of the Zoning Ordinance in these matters. Staff responded as to how, the various documents were used to review proposed plats. Chairman Davenport closed the public hearing at 8:30 p.m. MOTION was made by Commissioner Stewart supported by Commissioner Erickson that the Planning Commission take ac -tion on this item at this meeting., MOTION CARRIED (5-0-0) (All in favor) MOTION CARRIED Commissioner Schneider asked if the ponding provided on site would be sufficient to tritigate the problems with storm water drainage in the area.; Staff responded that the problem may be alleviated, however, it sounded as though the problems related to property grades being below the catch basins rather than lack of system capacity. Commissioner Schneider suggested that the Planning Commission make a formal recommenda- tion to the City Council regarding the investigation of the storm sewer problem for too .area„ tiu`ION was made by Commissioner Stewart supported by Commissioner Erickson that the, Planning Commission make the following recommendation to the City Council: That the request of Floyd B. Olson for preliminary plat approval oi= "West Tonka Estates" located in the northwest quadrant of Niagara Lane and Cout,ty Road 15, consisting of 10 lots for single family detached dwellings, be approved subject to the following conditions-. 1. Elimination of proposed trail easement along lots 5 and 6 and plat redesign to accomplish equal lot frontages for the 'lots fronting 3rd Avenue North 94 ft. -1) and lots fronting Co,,t ty Road_ 15 (96 ft.. ±) . 2. Elimination of the trail and walkway easement along 3rd Avenue North. 3 Dedication of 7 ft, of road right-of-way along the entire County Road 15 frontage. Construction by the owner, at his sole expense, of storm water drainage pond PL-' corsistent with requirements of the Storm Water Drainage Plan including all necessary appurtenances for connection to the existing storm sewer system. The Commission asked petitioner's engineer for his comments rAgard'ng the pond to be located on the property. Mr. Dick Knutson stated that the ponding would definitely help the area. He concurred with Staff that the pond would not tota' y correct the situation, however. MOTION CARRIED (5•-0-0) (All in favor) MOTION CARRIED MOTION was mace, by Commissioner Stewart supported by Commissioner Schneider that the Planning Commission make the followiN recommendation to the City Council: Thac the Council consider the drainage problems of the immediate area based or the comments and testimony of the public hearing regardicig "West Tonka Lstates". hUTION CARRIED (5-0-0) (,All in favor) MOTION CARRIED Chairman Davenport declared a five-minute recess at 9:05 p.m. The meeting was recon- vened at 9-:10 p.m. Commissioner Hagen arrived at 9:15 p.m. A-196 Cimarron Ponds West A--196 Concept Plan RPUD 77-2 Staff presented petitioner's request for concept plan approval of RPUD 77-2, Cimarron PLANNING COMMISSION MEETIPTG. MINUTES -4- April 6, 1977 Ponds West, located at the southeast corner of County Road 6 and Dunkirk Lane. The proposal. included 86 attached and 9 detached single family dwelling units with a 10 -acre portion of the parcel to be dedicated to the Minnesota Department of Natural Resources for park purposes.. Staff proposed a recommendation for approval based on findings and conditions of the Staff reports of April 1 and April 6, 1977. Commissioner Erickson questioned the staging dement of the project. Staff pointed out that petitioner intended to complete Cimarron Ponds Addition, Cimarron Ponds 2nd and then: begin the Cimarron Ponds West project. This would mean approximately 1979 for construction. Commissioner Schneider stated that he felt the transition was adequate 'to the: east, but that the transition to the north, west and south was not adequate as shown on the proposal He adder! that he did not feel that the land to the south intended to be sold to ONR should be included in any density c hculations for the proposal, Chairman :Davenport opened the public informational meeting to q(Aestions and comments from members of the audience, Mr. D. W. Johnson, 1225 Dunkirk Lane, stated there was a creek running through the ply at the present time. He stated that he felt this should be taken into considera- tion during the development oi, the project. Mr.. Ron Prekker, 1.405 Zanzibar Laney questioned whether the proposed single family detached units to the northeast would be a sufficient number to buffer the residents from the remainder of the project.. Kathi Olson, 1310 Archer Lane, stated that the project wojlC be creating a pocket of singze family detached dwellings in the area surrounded by multiple residential uses. ChOsea Woods to the north, Cimarron Ponds to the south and now this porposal of Cimarron Ponds West would Close in Lie single family detached area already existing. Mr. Brian Knox, 16805-1%th Avenue North, stated that he did. not feel the density pl^oposee to the southwest would be adequate transition for the property owners already living in the area. )heir homes, located on one -acre lots, would be abutting the higher density of the proposedattached single family dwel'ings. He added that he felt the project: could at least provide: buffering on the Dunkirk Lane frontage to provide a better transition between the existing and proposed neighborhood, Mr. Tom Rose, 16925 -13th Avenue North, asked about the procedure for the RPUD review over the coming month.. Staff explained the process to Mr. Rose, indicating that all meetingr would be public meetings and that, following this meeting, at least five additional maetings would be necessary should petitioner cb.00se to continue with the project. Mr. W. H. Hogenson, 16815 -12th Avenin North, asked if the er ek would be left in natural stake and how, if the developer intended to fill the ,area, storm sewer wout. be handled. Staff explained that the petitioner would be required to meet the City's specifications with respect to providing for adequate storm sewer in the area.: As to the creek, if the developer chose to fill in the area, the storage and flow of water would have to be provided elsewhere. Mrs. Ruth,fiembre, 16740 -14th Avenue North, submitted a. petition signed by the children in the neighborhood asking that the natural area not be destroyed in that much wildlife would be destroyed or forced. away from the are?, should it be developed. The Commission accepted the petition on behalf of the children and mate it a permanent part of the record. i i Mary Hale, 16705 -12th Avenue North, expressed her concern for the natural area being destroyed. She added that she did not feel the transition was adequate for the exist- ing neighborhood, nor, was the housing type appropriate for the neighborhood. She concluded that she felt the project should be required to adhere to the 'guide plan strictly in terms of LA -1 density for the majority of type acreage. Anna Hale, 16705 -12th Avenue North, stated she had no objection to the area being' eveelopedas single family home sites, however, she did not feel the patio homes would be appropriate, particularly since no buffer was being provided for the surround ing existing neighborhood, Mr. Philip Eraser, 16730 -12th Avenue North stated he felt this would be a terrific blow to the ecology of the area. commissioner Hagen stated that this would be deter- mined via an Environmental Assessment, which would be mandatory for a project this size, during coming stages of consideration on the. 'project. M,ary_Hahn,, 16820 -13th Avenue North, stated that Thee, too, did; not feel the transi- tion area to the west and south would be adequate in terms of building attached patio homes adjacent to an established neighborhood of 20 years. A buffer of some type should be provided at the least, Mrs. D. W. Johnson, 1225 Dunkirk lane, stated that she felt the area already hadsnoughmultipleresidentialdevelopment, and that the proposal would be too much of a burden on the neighborhood. She added that she did not feel the traffic which would be generated by the project could be adequately handled by County Road 6_ Chairmain Davenport closed the public informational meeting at 10:10 p.m. Comm?ssioner Erickson stated that the density proposed for the site was beyond that allowed by the Land Use Guide Plan for the majority of the area. The C(,,imission continued to discuss the project in terms of densit, and the proposal's qualifications as a Residential Planned Unit Development. MOTION was made by Commissioner Hagen supported by Commissioner Schneider that the Planning Commission make the following recommendation to the City Louncil; Tbat the City Councilmake the following findings with respect to the property located at the southeast corner of Dunkirk Lane and County Road 6 a) Unusual features of the property itself and the: surrounding neighborhood ark such that development under the standard provisions, of the normal District would not be appropriate in order to conserve a feature of importar,ue to the heigh orhood and community. The Commission. established the range of density for the area to be between 55 and 95 units for gyne entire parcel according to the Land Use Guide Plan. MOTION was made by Commissionet.:rickson supported by CommissionerHagenthat the Planning Commission make the following recommendation to the City Council: That the density for the parcel located at the southeast corner of Dunkirk Lane and Co;::qty Road.6 be estalished at the low end of the density allowable for the area based on the City's Land Us^ Guide Plan arn. chat transition areas be establisled for the existing neighborhoods to the north, east and west. Further. the highest density for the project shall be establi'hed at the southeast: area of the parcel adjacent to the Cimarron Ponds plat to the southeast. MOTION TO AMEND was made by Commissioner' Erickson supported by Commissioner Stewart to add the following: The density allowable for the project sr.zll be established at a maximum of 65 units for the entire parcel. Said density shall be based on developing 15 acres at a density according to the Land Use Guide Plan of LA-1, average range of 2.5 units per acre or 37 units and 5 acres at a density according to the Land Use Guide Plan of LA-3, lower range of 5 units per acre or 25-28 units to include spatial relationships as presenntect by the developer for the LA-3 guided area, MOTION TO AMEND CARRIED (6-0-0) (All in favor) MOTION TO AMEND CARRIED Commissioner Schneider asked petitioner's engineer, Dick Knutson, if a settling pond could be made a feature of the plat in order to filter the water before it entered Gleason Lake. Mr. Knutson started that this would be possible. PLANNING 'COMMISSION MEETING MINUTES -7- April 6, 1977 A--33& Mission 111-1--s--P ark 3rd Addition A-33$ Final Plat Staff presented petitioner's request for final plat approval of Mission Hills Parr 3rd Addition located at 39th Avenue North west of Zachary Lane, and consisting of Z4 single family detached dwelling units Staff proposed a recommendation of approval subject to the conditions of the Staff report of .March 31, 1977, MOTION was made by Commissioner Schneider supported by Commissioner Erickson that the ,planning Commission make the following recommendation to the City Council: That the request of Mission West Development Corporatiot,:for final plat approval c" Mission Hills Park 3rd Addition located at 39th Avenue North west of Zachary Latae, consisting of 24 single family detached dwelling units, be approved subject to the following conditions; 1. Cut -hots A B and C shall be dedicated to the City for park and trail purposes following grading and seeding/sodding by the developer, 2 Compliance with provisions of tate City Engineer's report regarding thi pro- ject, 3 Soil erosion mitigation consistent with the provisions of Council Resolution 77- 163. 4. Both cul -de --sacs shall be named Balsam Lane. Staff proposed a recommendation for approval subject to the conditions as listed ift the Staff report of March 31, 1977: MOTION was made by Commissioner Hagen supported by Commisstoner Stewart that, the Planning Commission make the following recommendation to the City Council: That the requestof Hillsborough Manor, Inc. for final plat approvalof Arrcwood" a single family residential plat consisting of 16 lots located at the southwest cornier of Zachary Lane and 53rd: Avenue North be granted subject to the following conditions.: I. Also noted was the Council direction of the February 28, 1977 Council meeting asking the Commission, in particular, to consider the Kilmer Lane frontage of the parcel The Commission discussed the revised landscape plan with fir, Gadtke, MOTION was made by Commissioner Stewart supported by Commissioner Hoyt that the Planning Commission make the following recommendation to the City Council. That the revised landscape planfor the car wash located at the corner of 35th Avenue North and Kilmer Lane for Mr. William Gadtte be approved subject to the following conditons 1. Deletion of the boulevard arecn space in front of the "!-lair, Etc. building. 2. Provision of four ash trees, three to the south property boulevard; and one for the Kilmer Lane boulevard frontage, to be 2-21k inch diameter trees balled and burlaped. MOTION CARRIED (6-0-0) (All in favor) MQTION. CARRIED REPORTS OF OFFICERS, BOARDS AND COMMISSIONS The Cottmission asked; Staff to have the following site;, inspected for compliance with Zoning Ordinance regulations. Plyoco Gas Statcrt, Walt's 66 Gas Station.
