MEMBERS PRESENT: Vice Chairman Hagen, Commissioners Hoyt., Erickson, Schneider and Threinen MEMBERS ABSENTt Chairman Davenport (Reserves) and Commissioner Stewart STAB -F PRESENT= Charles Dillerud and Kate Marx A-714 Jahn R. Pauls%n71 4 Rezoning Staff presented petitioner's request for rezoning of a parcel of land located at the northeast corner of 22nd Avenue North and Kilmer Lane from R-1 (Single Eam)ly Resi- dential) to R-2 (Two Family Residential). A recommendation for approval was proposed subject to the conditions as listed in the Staff report of March 4, 1977. Mr. David Bother, builder, stated that he did not feel the Londition requiring access to be via the County Road 18 service road was appropriate due 'to the cost of creating such an access for the parcel, safety in backing cnto such a read in terms of a hill quite close to the site at which visibility is quite difficult and the speed allowed for vehicles on the road. Staff pointed out that Kilmer Lane and 22nd Avenue North were, not able to handle much more traffic,if any,due to the present state of the roads. It would be preferred to access the County Road 18 service road to prevent any further deterioration of the roads in the area due to increased traffic. Vice Chairman Hagen opened the public hearing to questions and comments from 'the members of the audience, MrV F. Peterson, Route 1, Hamel, owner f th- property to the south of the proposal, stated that he felt it would be better for petitioner to access 22nd Avenue North or Kilmer Lane as opposed to the County 'Road 18 service roaddue to the traffic hazard of the service road. Mr. John Holmes, 2120 E. Medicine Lake Boulevard, representing all property owners fronting the parcel from Kilmer Lane, stated that they were against the building of a duplex on the lot because the area surrounding the parcel was all developed in a single family residential .nature. Mr. Bob Scribner, 2015 Lancaster Lane, stated he was against the rezoning because the area was already high in density with the single family residential development, traffic was already a problem in terms of bad roads and hazardous travel on County Road 18 service road and the area could not withstand, if this rezoning were approved,. additional PLANNING COMMISSION MEETING MINUTES - March 9, 1977 duplexes to be built. Vice Chairman Hagen closed the public hearing at 8:07 p.m. MOTION was made by Commissioner Threinen supported by Commissioner Erickson that the Planning Commission take action on this nein at this meeting. MOTION CARRIED (5-0-0) (All in favor) MOTION CARRIEi A-7 17 Westmfniseer 77 Rezoning, Preliminary PUt and Conditional Use Permit for SubdivisionUnit Prom Staff presented petitioner's request for rezoning, preliminary plat and conditional use permit for a Subdivision Unit Project for property located west of We:;,t Medicine Take Drive at 34th Avenue North. Of importance in review of the plat were considera- tions of flcodway and floodplain areas as now delineated by the National Flood Insurance Administration. Staff` explained how this affected the plat. A recon* latior for approval was proposed subject to the conditions as listed in the Staff report of March 3, 1977, Commissioner Hoyt pointed out that the only ingress/egress for the proposed 57 unit project woc: ,,' t— West Mediofne Lake Drive unless petitioner would propose 1to extend Pineview Lane southerly to eventually connect with the plat to the south. Staff stated that the properties both north ;,nd south would probably he platted soon and under development alleviating this problem. Mr. Cal Hedlund,; engineer for petiti-oner stated that he had met with the City Engineer and had discussed with him the problems with, floodways and floodplains. A satisfactory agreement had been reached which would be reflected in a revised engineering memorandum on the project, Vice Chairman Hagen closed the public hearing at 8:45 p.m. MOTION was made ;by Commissioner Threinen supported by Commissioner Hoyt that the Planning Commission take action on this item at this: meeting, MOTION CARRIED (5-0-0) (All in favor) MOTION CARRIED A-718 Mi ddl:emi st 3rd Addition-A-4-1-8- Prefiminark Plat and ReiLn n Staf=f presented petiti'oner's request for preliminary plat and rezoning approval for property located: at the southeast corner of Zachary Lane and County Road 9. A recom- mendation for approval was proposed subject to the conditions as listed in the Staff report of March 3, 1977. PLANNING COMMISSION MEETING MINUTES -3. March 9, 1977 Mr. Cal Hedlund, petitioner's engineer, stated objection to the Staff proposed condi Mdealingto street realignment and access to Cou,ty Road g. Mr. Hedlund pre- sented a sketch drawing of an alternative routing which responded. to Staff concertns with the street alignment. Vice Chairman Hagen opened the public hearing to members of the audience, Mr, John lei hcht , 10330 -40th Avenue North, representing eight of the surrounding property owners in the area stated that they were against any access to Zachary Lane from the plat. They also were questioning how drainage was going to be directed to Lost Lake, how many trees would be host as a result of the development and the availa- bility of water to the site. Staff stated that drainage for the plat would be directed to Medicine Lake) not Lost Lake for this plat and that water was available in Zachary Lane for the project. Mr. Hedlund responded that the petitioner would be saving as many trees as possible for the project, Mr. Don Olson, 10825 -•40th. Avenue North, stated lie, too, was against any access to Zachary lane from the plat: Mr. Tom ,4annous 4015 Trenton Lane, stated that perhaps 41st Avenue worth would be best aligned to intersect at Zachary Lane to avoid traffic site -seeing arssthe lake. Staff pointed out that the intersection of 41st Avenue Noy^th would b; ..a close to County Road 9 to be allowed. Vice Chairman Hagen closed the public hearing at 9:40 p.m, NOTION was made by Commissioner Schneider supported by Commissioner Erickson that the Planning Commission take action on this item at this meeting. Paulson A-714 Rezoning MOTION was made by Commissioner Threinen supported by Commissioner Schneider that the Planning Commission make the following recommendation to the City Council:: That the request of John R. That the request of Philip Feldman for rezoning from R -Q (Open Residential) to R-1 (Single Fancily Residential), preliminary plat and a conditional use permit for a Subdivision Unit Project for Westminister, located west of West Medicine Lake Drive at 30th Avenue North and consisting of 57 lots be approved subject to the following conditions 1. Redraft of Lots 1-7, Block 2 and 30th Avenue North to preclude all fill activity within the floodway per Exhibit 19 of the DHUD Floodway Boundary Map dated September, 1976 There shall be no variances for gross lot area inasmuch as the extension of Pinevieu Lane will dispense with one lot and, with lot rearraggewents, all lots would meet the 18,500 sq. ft. lot area requirements of the ?oning Ordinance, 2. All fill activity proposed in the floodplain (existing elevation 930 ft. or below) but outside of the floodway shall be compensated for on a cubic foot for cubic foot basis below elevation 926 by pond excavation in proposed Outlot B Lot lines of dots abutting the resulting pond shall extend into the excavated pond area so as to preclude dry land area within the outlot. MOTION was made by Commissioner Threl!,;.%:,, by Vice Chairman Hagen that the Planning Commission make the following v,---comatandation to the City Council., That the request of Rolf Erickson for a conditional use permit to allow height limitations of the R-1 district to be exceeded for the construction of a 60 ft. high wind generator (Section 17, Subdivision 4, Paragraph 1c) be approved subject to the condition that the permit be for a period of three years for purposes of review and control should the tower cease to be operative, become unsafe, unfeasible, etc. When and if the -,jwer is required to be removed, it shall be at the owner's expense. MOTION FAILED (2-3-0) (Commissioners Erickson, Ho,, ind Schneider against) MOTION FAILED MOTION was made by Commissioner Erickson supported by Cummissioner Schneider that the Planning Commission make the following recommendation to the City Council: That the request of Rolf Erickson for a conditional use permit LG allow height limitations of the R-1 district to be exceeded for the construction of a_60 ft. h1,9h wind generator be denied based upon the following: 1. The site is not of adequate size to accommodate the tower. 2. The tower would place building constraints on the adjacent vacant parcel, 3- The tower would place constraints on the neighborhood. MOTION CARRIED (3-2-0) (Vice Chairman Hagen and Commissioner Threinen against) MOTION CARRIED Vice Chairman Hagen and Commissioner Threinen stated they were against the motion to deny as they did not feel the constraints as stated in the motion were realistic concerns. It was stated that the City of Maple Grove, City of Plymouth and Hennepin County had recently held a meeting to discuss this project. The Planning Commission discussed the various intersections with. County Road 10 that were planned in Plymouth. Of significance were the County Road 61 and Hemlock Lane intersect ons. The Commission directed ,Staff to write a letter to Hennepin County rzoarding their concerns with County Road 10 as follows 1. -Hemlock Lane intersertior 2. County Road 61 intersection 3. Curve, in align,.rent east of the L.ibby's superette 4. Taking of right-of-way to ,he north as much as possible Further, prior to any recommenjation being made to the Council, the Commission asked to havo the input of Prudential Insurance with respect td their site plan fronting on County Road 10.
