A regular meeting of the Ply youth Planning Commission was called to order by Chairman
Kroskin at 7:30 p.m. in the Council Chambers of the,City Public Workz Garage, 14900-
23rd Avenue North,

Conditional Use Permit for
Subdivision Unit Project

Staff presented petitioner's proposal, for development of 32 acres located at the
southeast corner ofWest Medicine Dake Drive and 28th Avenue North into 57 single
family lots. It was poiW-ed out that the previous proposals for the property had
presented several problems„ most of which seemed to have been dealt with by the current
petitioner, i.e. single Runily development as opposed to multiple development, purchase
of the "Bolduc Property" to be included in the plat, intersection of Evergreen with West
Medicine Lake Drive, tiail corridor location; and other more minor aspects.
Staff proposed a reconunendation for approval subject to the conditions as listed in the
November 12, 1976 Staff report.
The Commission discussed the trees located on the site. It was pointed out that a
substantial portion, although not a. majority, were elms.
The Commission asked petitioner exactly where trees on, the site would be disturbed as
a. result of roadways and homes. Back Knutson, petitioner's engineer, presented a
graphic indicating the location an event`o`? trees to be disturbed or requiringremovalfromthesite.
Chairman Kroskin opened the public heaxving to members of the audience.
Mr, John Mullan, 1.1845 -28th Avenue North, stated that he was concerned about the
envir6nmental7istt.trbance this plan would, cause. Fle stated that he felt this plan
would be the most detrimental to the environment of all the proposals to date. He
further stated that he was opposed to the Evergreen Lane alignment which allowed access
to hest Medicine Lake Drive.

Mr. Larry Frekin , 11805 -28th Avenue North., asked if the assessments for the new roads
would `t a current residents. Staff stated that they would not.
Coodssioner Schneider asked petitioner's engineer, Mr* Knutson, if this proposal would
involve more or Less removal of trees as :ompared with previous proposals.. Mr. Knutson
stated that, more trees would have to be vemoved as a result of the current plan.
Commissioner Schneider further inquired if, in the opinion of the petitioner's engineer,
less trees would have to be sacrificed if an 8¢ grade would be allowed on the streets.
Petitioner's engineer, Mr. Knutson, stated that this would definitely help the situation{
Commissioner Davenport asked if, in the opinion of the petitioner's engineer, less
trees would have to be sacrificed if narrower streets could be built for the plat,.
Mr. Knutson responded that this, too, would make a difference. Be added that if the
road could be built so as to be off -set within the right-of-way of the street as opposed
to centered within the nigh; -of -way, the petitioner would also be able to save more
trees.
Chairman Kroskin closed the public hearing at 8;15 p.m.
A)TION was made by Commissioner Threinen supported by Commissioner Stewart that the
Planning Commission take action on this item at this meeting.

MOTION was made by Commissioner Threinen supported by Commissioner Erickson that the
Planning Commission make the following recommendation to the City Council.
That the request of Lundgren Bros, Construction, Inc. for preliminary plat
approval: and a conditional use permit for a Subdivision Unit Project for
Chippewa Trails" a plat of 57 lots on 32 acres at the southeast corner of
28th Avenue North and West Medicine sake Drive be approved subject to the
fallowing conditions,
1. Compliance with provisions of the City F,ngineer's memorandum.of November 12
1976 regarding; this project
No private driveway access to 'West, Medicine Lake Drive be allowed.
3. Compliance with Subdivision Unit Project open space requirements by Dedication
of Outlot A (0.14 acres'), Outlot B (0.38 acres) and Outlot C (0.07 acres)
together with payment of ;fees -in -lieu in the amount of $8,550 (57 bots X'
150.00 per lot).
4. Compliance with subdivision public open space requirements by payment of
ees-in}lieu in the amount of $8,550 (57 lots X $1.50.00 per lot).
S. Inclusion of the free-standing parcel, along 28th Avenue North with adjoining
lots~
G. Where possible, it is recommended street alignment be allowed to vary withintheright-of-way in order to preserve existing trees within the plat and
enhance the environmental aspects of the site. Also, that streets be allowed
to be built at a 7% grade.

The Commission discussed the variance :From the allowable 6% grade to 7% grade as
petitioned and reconnended for approval to the Council. The Commission agreed that
such a variance would be allowable only in special circumstances and that the burden
of proof of need for such a variance would be upon the developer.
The Commission also discussed, with respect tothisparticular project, allowing an
0 grade for the streets where it would save more trees. stated that the issue
would best be discussed at the time of final plat when petitioner would have more exact
detail in this regard,

Site Flan and Conditional

Staff explained petitioner's request for site plan approval and a conditional use permit
for a 48,194 sq. ft. structure with a 4,25.3 sq, ft.. office, the balance divided between
manufacturing .and warebousing. A recommendation :For approval was proposed subject to
the conditions as listed in the Staff report of November 10, 1976.
The Commission discussed the landscaping plan of petitioner, particularly with respect
to the outside storage area for waste and waste containers.
MO'T'ION was made by Commissioner Stewart supported by Commissioner Hagen that, the Planning
Commission make the following recommendation to the City Council
That the request of INYico Stamping for site plan approval of a 48,194 sq. ft,
structure for office, manufacturing and warehousing to be located on the west
side of Niagara Lane at 27th Avenue ;North be approved subject to the following
conditions:
1 Storage of waste and a,;te containers only as depicted on the site plan
with said: area to be completely screened,
2. All site surfaces disturbed by construction shall be seeded or sodded,
3. Fire lane shall be dust -free -- either asphalt or equally dust -free alternate.
4. Yard sign shall be set hack 20 ft. from the property line.
S. Payment of Park Dedication fees -in -Lieu of $3,250 (6.5 acres X $500/acre).
6. Performance security for site improvements to equal. 1500 of said improvements
for a two-year term.
7. Incorporation of those features specified by the City Engineer's memorandum
of November 10, 1976 regarding this project

Chairman hroskin stepped down for discussion of this item.
Saff presented petitioner's request for site plan approval and a conditional use
permit for a 1.30,000 sq. ft. b;iildi.ng to be Located between 1-494 and Fernbrook Lane
at 17th Avenue North to be used for manufacturing, warehousing and related office
space.:. Staff explained, also, the lengthy history behind proposed access and traffic
circulation for the site. A recommendation for approval was proposed subject to the
conditions as Listed in the Staff report of November 10, 1976.
Tho Commission discussed the various methods of access and traffic circulation proposed
both in the past and presently with respect to the site and neighboring properties and,
zoning districts including Cheshire Lane, Fernbrook ,Lane, 17th Avenue North and 21st
Avenue North,
MOTION was made by Commissioner Threinen supported by Corrunissioner Steivart that the
Planning Commission,, nuke the following recommendation to the City Council:
That the request of leaguer-Spraytech for site plan approval, dated November 1,,
1976 for a 130,000 sq. ft. structure to be used for manufacturing, warehousing
and related office space and to be :Located between 1-494 and: Fernbrook Lane at
17th Avenue North be approved subject to the following conditions;
1, Compliance with provisions of the City Engineer's memorandum of november 10,
1976 regarding this proposal
2. Encircling of 'the sti-azture with a 12 ft, wide, 5 ton fire lane and water
main loop with hydrants at 300 ft. intervals,
3. Public Roadway dedication as follows;
a. 30 ft. Wide from. Fernbrook Lane easterly along the south property lame
to terminate at the east property line with a cul-de-sac right -of -Way
with a 50ft. radius centered on the southeast property corner.
b. 7 ft. Wide additional along the full, Fernbrook Lane frontage.
4. Deletion of the proposed private access to Fernbrook Lane,and dedication on
17th Avenue north such that a curb cut could be made for a private road and
for a truck drive which Would ,enable access to the next plat aria the same
curb cut.
S. Reduction of the east elevation wall sign area to 400 sq;. ft. maximzun.
6. All waste and waste containers shall be stored within the structure.
7. All site improvements shall h.e guaranteed by a security instrument in favor
of the City for 2 years at 15-'3, of the cost of the improvements.

Staff presented petitioner's request for a conditional use permit for exceeding height
limitations for a wind generator to be used for providing; electrical power to a home
and to be located at the northwest corner of 12th Avenue North and Harbor Lane
The Commission discussed the matter with petitioner and his representative, Cob Burandt
in detail. Ofmost interest to the Commission was the height of the tower, safety
for the neighboring residents and location of the necessary battery housing:

until such time as petitioner could provide the Commission with more detailed
information regarding the proposed battery housing building, screening, of the structure
and safety information for the protection of the neighboring residents.

that the residents within 300 ft be notified of this tower and of the upcoming meetingontheproject.

Staff presented petitioner's request for 4a conditional use permit for a home occupation
to sell salvage lumber and firewood from .2Is residence at the northeast corner of

The Comenissicra discussed the situation with petitioner with respect to screening the
use, extent of the storage and nature of the use vis-a-vis the Zoning Ordinance.
Petitioner stated that lie did not feel he would be able to afford screening the
stored'iumber and firewood by a fence.
MOTION was -rude by Commissioner Schneider supported by Commissioner Threinen that
the Planning Commission make the following recommendation to the City Council:
That thoe request of Victor Sorenson for a conditional use per -lit for a home
occupation to sell salvage lumber and firewood at his residence Located at
the northeast corner of Urbandale Court and State Highway #55 be denied based
upon the following;
1.. The proposed use is inconsistent with B-4 zoning of the parcel.
Z A conditional use permit to create or extend land use in the unsewered
area of the City taould be inconsistent with the policy of City Council
Resolution #75-664.
3. Petitioner has stated that he would be tenable to screen the outside storage
of lumber,

Commissioners Stewart and Erickson stated that they felt the situation could have
been worked out in some manner; therefore, they abstained.
MOTION was ;Wade'by Commissioner Threinen supported by Commissioner Schneider that the
Planning Commission make `he following recommendation to the City Council.,
That Victor Sorenson be given 90 days from the date of the Council Resolution
denying conditional use permit as petitioned by Mr. Sorenson for a home
occupation to sell salvage lumber and firewood at his residence, 18240 State
T:i.ghway P55, to clear said property of all salvage lumber and firewood and to
cease the sale of salvage lumber and firewood.

Petitioner stated that he felt this would be ample gime to remove the wood from his
property.
REPORT'S OF OFFICERS, BOARDS AND CW, II.SSIONS
Planner Dillerud indicated to the Commissioners that the Metropolitan Council would
be sponsoring a workshop on the new Land Planning Act -recently passed by the State
Legislature Thursday, December Z 1976 at 8:00 p.m, at Medina Ballroom. He encouraged
the members of the Commission to attend if they could,
Commissioner Threinen stated that, as part of his review of the Proposed Zoning;
Ordinance, he felt it necessary that an Industrial PUD section be added and that the
Commission should begin: work on such an ordinance as soon as possible.

RESIGNATIGN OF CH IRMAIIT MOSKIN
Chairman Kroskin stated that he would be resigning from the Commission effective
November 30, 1976.,He added that Mayor Hi.lde had appointed David, Davenport to the
position of Chairman effective December 1, 1976.
The Commission thanked Reg Kroskin for the many years of fine work on the Commission
and for the enormous contribution he had made in racking the Commission one of the best
the City had ever had. The Commissioners wished him well in his future endeavors.
