A regular meeting of the Plymouth Planning Commission was called to order by Chairman
Xvoskin at 7:30 p.m. in the Council Chambers of the Public Works Building,
14900 -23rd Avenue: North.

Staff present&! petitioner's request for final plat of five lots located at the
southeast corner of Wedgewood Lane and Vine aood Jane. Staff proposed a recommendation
of approval subject to the conditions and variances us listed in the Staff report of
September 14, 1976.

Planning Commission make the following recommendation to the City Council:
That the request of Ann Farnam for final plat of "Addie's Wedgewood Acres,"
a plat of five lots, Located at the southeast corner of Wedgewood bane and
Vinewood lane be approved subject to the following;
1. Petitioner pay a Park Bedication fees -in -lieu of $750.00 ($150 X 5 lots)
2. All additional se merand water stubs to be at owner's expense.

Staff presented petitioner's rerquest for a. conditional use permit for a home occupation
to operate an upholsten* business in her home. Staff proposed a recommendation for
approval of the request subject to the cuT.dK tions as listed in the October 21, 1976
Staff report.

Commis Toner Stewart asked petitioner what arrangements she 1,:,nned for delivery and
pick-up of the items, she would be reupholstering. 'Mrs. Gilvin. stated that she would
have 1101 customers pick-up and deliver the items to her.
Conussioner Davenport asked.petitioner if she intended employing anyone in addition
to herself by the operation of this business. Petitioner stated that she did not.
NI)TION was made by Commissioner Schneider supported by Coiimdssioner Stewart that the
Planning Commission make the following recommendation to the City Council:
That the request of Margaret Cilvin for a conditiona! use permit for a home
occupation to operate an upholstery business in her homp, at 10140 -28th Avenue
North be approved subject to the following conditions:
1< Permit be for one year.
2. No exterior signs or structural alterations be allowed.
S. Application for building permit for any basement alterations.

Commissioner Threinen stated that he abstained because of the inconsistencies he felt
existed between the ordinance as stated and the manner in which the City is administering
the ordinance. fie stated that he felt he could only properly abstain until the
inconsistencies were corrected which would be done in the new ordinance as proposed.
X-_694 Victor Sorenson A-6-97 Conditional Use Permit
Staff presented petitioner's request for a conditional use permit to operate a business
to sell salvage lumber and fire wood at his -residence near the northeast comer of
Urbandale Court and State Highway #55.
The Planning Commission discussed how this use would fit as a conditional use permit
in a B-4 Zoning District or as a home, occupation. Petitioner was not present to
represent his request.
WTT(N TO DEFER was made by Commissioner Davenport supported by Commissioner Stewart
the request of Victor Sorensonfor a conditional use permit to operate a business for
the sale of salvage lumber and fire wood from his residence at the northeast comer of
Urbandale Court and State Highway #55.

Commissioner Threinen stated he was against because he did not feel the usa fit under
the definition of home occupation and, therefore, should be denied.

Revised Landscape Ilan
Staff presented petitioner's request for a revised landscape plan for his site located
at the northeast cornier of Kilmer bane and 35th Avenue North. Petitioner was
requesting an amended site plan reflecting the substitution ofasphalt for landscaping
consistent with what presently existed on the site. It was also pointed out that the
sign presently on the site was not the one appy —ed along with the site plan previously,
although it was a "legal." :sign and a permit for .t had been issued.
The Commissioners discussed petitioner's request with him at length as to the reason
for his request.
In particular, it was noted that the frontage on Filmer Lane was not landscaped as
previously approved.. The curb cut had been substantially widened. The consensus of
the Commission teas that the curb cut be narrowed by a Landscaped island..
Coimaaissioner Threinen statQd that he felt the petitioner was in violation of the
Ordinance by having constructed the site other than as approved by Council earlier this
year. fie further stated that he.felt the situation had become a matter of enforcement,
not planning, and that an enforcement agency ought to be mitigating the situation,.
not the planning agency of the City.
MOTION TO DEW was made by Commissioner Threinen supported by Commissioner Stewart the
petition of William Gadtke for a revised landscape plan.
Commissioner Threinen s4.ated that he felt the original plan was adequately discussed
and that petitioner had presented no additional hardship in support of a revised
landscape plan.

The Commissioners against the motion stated that they felt it would be more constructive
to give the petitioner directions as to what type of alterations would be necessary
in order that the landscape plan may be revised.
MOTION TO DEFER was made by Commissioiler Davenport supported by Commissioner Hagen
until petitioner could return with another plan for the site which would take into
account all, the concerns of the Commission.

Cominissioner Threinen stated: that he felt the original, site plan shou'd remain as it was.

Staff explained petitioner's request for a site plan and conditional use permit for
an office/showroom operation for manufacturers representatives of lighting fixtures..
Staff proposed a recommendati,,n for approval subject to the conditions as listed in
the Staff report of October 21, 1976.

Petitioner stated that the type of lighting fixtures would be strictly for commercial
uses, Further, there would be no retail, sales from the site at all.

That the request of the site plan of Ronald Roelofs for a 1,730 sq. ft. struc"Ure

fixtures and located at the southeast corner of Nathan Lane and 10th Avenue North
be approved subject to the following conditions:
1, Incorporation of the provisions of the City Engineer's memorandum of
October 22, 1976 with respect, to this project,
2. Signs shall be limited to those consistent with Code only.
3.. 1 ayment of a fees -in -lieu Park Dedication Ree in the amount of $400.00..
4 All waste and waste containers shall be stored indoors.
5, Petitioner post a performance bond with the City to be termed for 18 months
at 150% of the cost of the i.mprovements,to the site, prior to building permit
issuance.

MOTION was made by Commissioner Threinen supported by Commissioner Stewart that the
Planning Commission make the following recommendation to the City Council.:
That the request of Ronald Roelofs for a conditional, use permit for an office/
shoirroom for manufacturers representatives in lighting fixtures on Lot 30,
Plymouth Gardens, be approved subject to the following condition.
Issuance of a Certificate of Occupancy to the new 1,730 sq. ft. structure on:
said parcel.
FURTHER, that the following variances be granted.
1,. A front -yard setbac, variance of 18 ft., i.e. from 50 ft to 32 ft.
2. A side -yard variance of 6 ft., i.e. from 25 ft. to 19 f:.
3. An off-street parking variance cf one (1) space.

Staff presented petitioner's request for a site plan and conditional use permit for
a box manufacturing facility to be located at the southwest corner of Niagara Lane
and 28th Avenue North. A recommendation for approval was proposed subject to the
conditions as listed, in the October 20, 1976 Staff report.

building as proposed.. It had been suggested by Staffthat the driveway be located
adjacent to the south property line in order t, facilitate a single curb cut for the
use of the future tenant to the south and pe, Aoner to Niagara Lane.. (Niagara Lane
is classified as a thoroughfare within the (...cy's Thoroughfare Guide plan.)
Co mAssioner Hagen asked petitioner if this moving of the driveway would pose any
special problems for him. Petitioner responded that it would not.
WrION was made by Commissioner pavenpert supported by Cowmi.ssioner Stewart that the
Planning Commission make the following recommendation to the City Councils
haat the petition of the Rauenhorst Corporation for subdivision variance to
divide :Lot 9, Block 2, Circle Star Business Center 2nd Addition as petitioned
be approved subject to the following conditions:
1. Provision of "a 6 ft. utility and drainage easement along the south line
of Parcel B and the north line of Parcel A as proposed.
2. Access to Parcels A and B to Niagara Lane shall be only by a single, shared
curb cut at the property line. I

Planning Coumussion make the fallowing recommendation to the City Council:
That the request of A.B.C. Box Company dated September '4, 1976 for a site plan
to construct a 7,500 sq.. ft building on the northerly —36.128 ft, of Lot 9,
Block 2, Circle Star Business Center 2nd Addition be approved subject to the
following conditions:
1. Compliance with the provisions of the City Engineer's Memorandum regarding
this project of October 22, 1976.
2-. Dr,, -—.,ay adjustment to provide for combined access -to Niagara Lane with the
parcel immediately to the south thereof.
3. Payment of fees-in-1,11'eu Dark Dedication prior to building permit
issuance.
4. No outside storage of waste.

6. A two year term bond in the amount of 150% of the cost of all site improvem nts

A-697 Dura Proprties A-697 Site Plan
Staff presented petitions .Cs request for site plan approval of two business/professional
office buildings, 2,560 sq. ft. each, to be ;located at the southwest corner of Highway
M and Comtyy Road #15. A recommendation of approval was proposed subject to the
conditions as listed in the Staff report of October 20, 1976.
The Commission discussed t1e variances necessary to the site and it was general consensus
that the shape of th,.= pa.rcel, contributed to the need for the. variances.

Planning Commission make the iollowing recommendation to the City Council;
Flat the request of Dura properties for a lot division/ consolidation for
Lots 11, 12, 13, 14 and 15 of Schiebe's Highland View Addition and the vacated
portion of Gaylord Avenue into Parcels A, B and C as petitioned, dated
October 15, 1976; fluid including a side yard parking variance from 20 fc. to
2 ft. on Parcel A, be approved.

Planning Commission make the following recommendation to the City Council;
That the request of Dura Properties for site plan approval of two buildings as
business/professional office structures of 2,560 sq. ft. each to be located on
Lots 12; ?3, 14 and 15 of Schiebes 'Highland View .Addition and the vacated port' -.on
of Gaylord Avenue dated October 15, 1976 be approved suuject to the following
conditions:
1. Execution of Uie division/consolidation of Lots 11, 12, 13, 14 and 15 of
SchiebeIs Highland. View Addition and the vacated portion of Gaylord Avenue
into Parcels A, P and C consistent with petitioner's October 15, 1976 plan
including a side yard parking variance from 20 ft. to 2 ft, for Parcel; A.

Staff pres'nted petitioner's request for site plan and conditional use permit approval
for ar. office/laboratory/warehouse totalling 65,024 sq. ft, to be located at the
southeast coimer of Niagara bane and 28th Avenue North. A recommendation for approval
was proposed subject to the conditions as listed in the Staff report of October 20, 1976.
MOTION' was made by Commissioner Steuart supported by Comm ussi.oner Schneider that the
Planning Commission Make the following recommendation to the City Council:
That the request of Steenberg Structures, Inc. for a site plan and condition;i
use permit for a 65,024 sq. ft. structure on Lots 2 and 3, Block 2, Circle Star
Business Center 2nd Addition dated October 13, 1976 be approved subject to
the following conditions
1. Legal combination of said Sots 2 and 3, prior to building permit issuance.
2. Incorporation of the features not d. in the City Engineer's Memorandum of
October 22, 1976 regarding this project,

to delete requirement number two of the City Engineer's memorandum of October 22 1976
regarding the number of driveways to be required for the site.
Commissioners concurred that the three drive entrances were not on a major thoroughfare
and, therefore, would not be considered hazardous oz, ire conflict with the City's
Thoroughfare Guide Plan.

a 19,000 sq ft. structure for of ice and assembly of construction equipment to be
located at the southeast corner of 23rd Avenue North and Niagara Lane, Staff proposed
a reco mendation for approval subjelrt to the conditions as listed in the Staff report
of October 20, 1976«
Comgmissi:cner Schneider questioned ohy the screening had not been carried over throughout
the plat., specifically on the east, Staff stated that the screening was not considered
to be as critical from the adjoin,, ig industrial use to the east, however the screening
could be increased at this pint,
Commissioner Hagen asked petitioner what type of equipment Mould be stored or, the site.
Petitioner, ?ick Anderson, described the vehicle as being a Mudcat used in dredging
operations. fie dict not have an example of the vehicles available for review,

Coft lssioner Hagen stated that he felt it was important that the Coxm#ti:ssion know what
type Of'Vehicle would be stared in order to judge whether the screening would be
adequate as proposed. e Other McMb,,M of the Commission concurred,
Commissioner Hagen stated that he would move to defer the item on that basis.
Petitioner, Dick Anderson,, stated that lie would prei,r the Commission to act to deny
rather than defer so that lie would be able to receive Council action as soon as possible.
MOTION7 was made by Commissioner Threinen supported by Commissioner Stewart that the
Planning Commission make the following recommendation to the City Council;
That the request of Steenberg Structures for site plan approval and a
conditional use permit for a 19,000 sq. ft. strpacture for office and
assembly of construction equipment be denied based on the following
1:. The parking variance as requested is not necessary as petitioner has
indicated no hardship for allowing said variance:,
2. Information available to the City is inadequate regarding type of
equipment to be stored outdoors, precluding a judgment being made
regarding the suitability of screening for said outdoor storage area..

to add the following.
3. Present site screening .is not available to screen the entire outside storage.

Commissioners Threinen and Erickson had attended the Elm Creek Watershed District
co;nference held October 13, 1976. Commissioner Threinen, stated that he was impressed
by the methods presented for drainage in the flood control areas with respect to
sanitary systems in the rural areas'. He stated, that lie felt the citizens of Plymouth
ought to be informed as to the availability of these systems and the methods of
maintenance now being used in these areas,
