HomeMy WebLinkAboutPlanning Commission Minutes 09-22-1976PLANNING COMMISSION CITY OF PLYMOUTH, MINNESOTA September 22, 1976 A regular meeting of the Plymouth Planning Commission was called to order by Chairman Kroskin at 7.,30 p,m. in the Council Chambers of the Public Works Building, 14900 -23rd; Avenue Borth. MEMBERS PRESENT. Chairman Kroskin, Commissioners Davenport, Erickson, Hagen, Schneider and Threinen MEMBERS ABSENT Commissioner Stewart STA1= F° PRESENT".: Charles Dill eruct, Milt Dale and Kate Marx A-680 J. Brooks Hauser A--680 Lot Division Staff pre,,,mted petitioner's request for a lot division of his property located at the scutheaat corner of Bass Lake Road and Jonquil Lane. Staff recommended approval subject to several conditions. It was pointed out,that petitioner presently accesses the lot via County Road 10 (Bass Lake Road) and that petitioner would prefer to maintain said access. Staff stated that the City's adopted Goals, Objectives and Criteria recommended against such access on major thoroughfares within the City, and tat it would be preferred that Mr. Hauser access via JonquilLane. it gas also noted that the present proposal was for both Parcel A, and Parcel 8 to share a driveway accessing County Road 10. Chaiman; Kroskin asked petitioner if it would be desirable to have Parcel B access through Parcel A. Petitioner responded that his intention was not to sell the parcel, his main purpose was to build another home for the use of his family. City Subdivision Regulations require that only one house be on one 'lot, therefore, he was requesting the lot division.. Commissioner Schneider asked petitioner if iic: would be willing to remove the old house after the new one was built. Petitioner stated that he would prefer not to raze the old home. Commissioner Threinen stated that he felt the lot had potential for divisions beyond that proposed by the present owner on the 3,5 parcel. If divided as proposed, the future owner of Parcel B, the mithorly pm: , wos.-ld have no guarantee of proper access to County Road 1O. Petitioner stated he had no intention of sellingeither parcel of land or of dividing the acreage further in 'the future. PLANNING COMMISSION MEETING MINUTES -2 September 22, 1576 The Commission discussed: the V ft right-of-way necessa: y for CountyRoad "1: , Petitioner stated he did not feel it would be necessary at this time. Further, he indicated he had extensively landscapedthe area and would object to removal of this landscape treatment. Staff explained the procedure for right-of-way tacking on major thoroughfares to petitioner indicating it was standard procedure,; Commissioner Threin.en stated he would not favor a division whereby the southerly parcel would access County Road 10 or Jonquil Lane by crossing the northerly parcel via easement. Chairman Kroskin concurred. Mr.. Bill Soth, peti'tioner's attorney, reiterated petitioner's point of view and regjest suggesting various methods of an agreement such as City approval prior to either parcel being sola. Commissioner Threine: painted out that the City would be creating, in effect, a land- locked parcel. This is against the City's Goals, Objectives and Criteria. MOTION was made by Commissioner Threinen supported by Commissioner Schneider that the Planning; Commission make the following recommendation to the City Council; That the request of J. Brooks Hauser for division of his property located at the southeast corner of County Road 10 and Jonquil Lane be approved subject to the following conditions: 1. The northwest property line of Parcel B be adjusted to allow future direct access to Jonquil Lane for said Parcel B. 2. The dedication of 27' ft. of additional right-of-way along County Road 10. 3. A Park Dedication Fee of $150 for Parcel B. 4, No building permit to be issued unless the house is connected to public sewer and water. r 5. Sewer, water and storm drainage easements as required by the City Engineer. Commissioner Threinen started that he felt this would aid in avoiding any pieco-meal planning for the parcel, MOTION CARRIED (6-0-0) (All' in favor) MOTION CARRIED A-682 Johnson/Yngve A-682 Site Plan Stare presented petitioner's request for site plan approval of two industrial ware- houses located at the southwest corner of Nathan Lane and 10th Avenue North. Staff explained the parking si'Uaw on for the site, noting the space reserved for future parking as well as the two methods for calculating the necessary number of parking spaces. Also, it was pointed out that Bassett Creek Watershed Commission would be forwarding their comments on the proposal in the near future, PLANNING COMMISSION MEETING MINUTES -3 September 22, 1976 Commissioner Hagen questioned the status of loth Avenue North. Commissioner Schneider stated that he did not feel the landscaping proposed was adequate. Petitioner stated that it was his intent to further landscape the building and that the landscape plan before the Commission was merely a preliminary showing. Staff stated that it would be necessary to obtain the approval of the Director of Planning and Community Development of the new landscaping plan prior to building permitissuance, MOTION was made by Commissioner Hagen supported by Commissioner Threinen that the Planning Commissionmakethe following recommendation o the City Council: That the request of Johnson/Yngve for site plan approval of two industrial buildings located at the southwest corner of Nathan Lane and 10th Avenue. North be approved subject to the following conditions I. No outdoor storage ;of waste, materials or garbage, 2. Posting of a 150%, 18 -month landscape and drainage bond prior to issuance of building permits 3. Petitioner pay a Park Dedication flee of $9,800 based on $500/acre X 19.76 acres 4. Engineering recommendations of the City Engineer be incorporated as per Staff memorandum of September 14, 1976. 5: Recommendations of the DNR and Bassett Creek Flood Control Commission be a part of this recommendation. 6 Provision for three fire hydrants and fire lanes as per Fire Chief recom- mendations, 7. An area be reserved for parking 349 additional cars on the site to be blacktopped at the time of the need for the spaces. 8:. Additional right-of-way along Nathan Lane, i.e. 32.5 ft. Developer to petition the City for public improvements along Nathan Lane kind 10th Avenue North. 9. More detailed landscaping plan be submitted to the Director of Planning and Community Development for approval prior to building permit issuance. MOTION TO AMEND was made by Commissioner Davenport supported by Commissioner Schneider that the Planning Commission add the following as condition #10: ,"No sign variances be permitted", MOTION TO AMEND CARRIED (6-0-0) (All in favor) MOTION TO MEND CARRIED MOTION TO AMEND was made. by Commissioner EriLkson supported by Chairman Krc;skin that the Commission add the following as condition ##11: "Parking setback along 10th AvenueNorthbe50ft.". PLANNING COMMISSION MEETING MINUTES -4 September 22, 1976 Commissioner Threinen pointed out that ;his would eliminate at leant 75 parking spaces if the setback would be changed to 50 ft. on the 10th Avenue North side of tile site. A-683 bietram Properties A-683 Site Plan Staffpresented petitioner's request for site plan approval of a shopping center to be located at the southwest corner of County Road 9 and County Road 18 and also explained the lengthy history of the site. A recommendation for approval was proposed by Staff subaect to the conditions of the Staff report of September 16, 1916. Commissioner Threinen asked petitioner what intentions he had for the two "future sites" Mr. R. L. Pape, architect for petitioner, stated there prC-iently were no plans for the "future sites", Commissioner Erickson asked petitioner what hardship he felt was present in that he requested a variance to the parking setback on the east. Petitioner stated that he felt the parking requirements of the City were too strict as far as number of spaces required -,therefore, to meet the City's requirements, petitioner felt it was necessary to request a variance in this location. Mr. Pope cited studies done by several firms such as Dayton --Hudson whereb„v lesser numbers of ;narking spaces per gross retail space were considered necessary for shopping cent,:rs of various sizes Commissioner Hagen stated' that he felt the futur, sives should be incorporated into the present site as para of the building structure ff structures were to be built or become part of the parking lot if more parking spaces are deemed necessary. Commissioner Threinen concurred. Mr. Toni Berg, president of the Middle East Homeowners Association, stated that the Kimeowners had several concerns with the proposed plan; 1} traffic from the center that may come into the residential neighborhood; 2) lightitig and signage for the center, 3) noise produced by the center; 4) landscaping for buffering purposes, including within the parking lot; and 5) drainage from the low lying land onwhich the center PLANNING CUMINISSIONMEETING MINUTES -5- September 22, 1976 is to .be located, Mr. V. A itO.Menson, 4040 Pilgrim Lane, stated that he was pre->ently adjoining thesog_t__11'i'jture site" and would ask that as much buffering via landscaping aspossible1 v° ne in that area, Mr. Loren Pac-, 4050 Nathax" Lane, stated that he felt no amount of landscaping would be sufficient to buffer the site from the surrounding residents since the site was at such a lower elevation than the surrounding residential neighborhood'. Mr. John Wire,. 4130 Quaker Lane, stated that he felt the traffic on the south side of Lancaster Lane should be buffe ;A by landscaping from the residential neighborhood. Proposed plant, indicated buffering only on the north side of Lancaster Lane. Commissioner Hagen pointed out that there was inadequate space available for land- scaping to survive o,7 the south side of Lancaster Lane. MOTION TO DEFER was made by Commissioner Threinen supported by Commissioner Hagen until such time as the following concerns could be addressed.: 1) Use of the "future sites""; 2) soil conditions are checked for parking lots 3) sinage be addressed 4) the seven conditions of the Staff report of September 16, 1976 be addressed, i..e. 1. Inorporation of the "future sites depicted into the: shopping center design to overcome most of the parting deficiency. 2. Treatment of the strip between Lancaster Lane: and County Road 9 to include a berm constructed to the maximum height feasible. 3 Petitioner reconstruct a median on Lancaster Lane at thep Proagednorth entrance to the proje:t to provide a median cut and a left turn "lane of a design acceptable t.T 0, City Engineer. 4., Petitoiner submit specific plans for the proposed pylon sign for Planning CommissionCommission approval prior to building permit issuance, 5. F=acilities for fire protection be incorporated consistent with Code.. 6 No outside storage of waste, materials or containers, 7. Provisions for property exchange with the City, Lancaster Lane improvements, any required storm water holding pond improvements, utility and park dedication fees be incorporated in a Development Contract between the City and the project owner. Staff recommended approval subject to the conditions as listed in the Staff report of September 17, 1976, Mr, Jinn Hawks, representing petitioner, Centurion Company, stated that three; or four vehicles would be requested to be stored on the site as a function, of the operation,. Storage would consist of cabinets, furniture for model homes accessory to the: Centurion development of patio homes on the site,, etc. on the inside of the building. MOTION was made by Commissioner Schneider,. supported by Commissioner Threinen that the Planning Commission make the following recommendation to the City Council; That the request of Centurion Company for a conditional use permit to operate a storage facility within one of the bays of a commercial building located at 1123 Vicksburg Lane be approved subject to the folloiwng conditions 1. iso outside ovew-night storage of vehicles. 2. No signs other than presently constructed and in place. S. Permit be for one year, MOTION CARRIED (6-0-0) (All in favoi-) MOTION' CARRIED A-208 Centurion Company A-208 Conditional Use Permit Staff presented petitioner's request for a conditional use permit to operate a moving and storage business at 1121 Vicksburg Lane, to be run by Lake Moving and Storage, Inc. Staff recommended approval subject to the conditions as listed in the Staff report of September 15, 1976. MOTION was made by Ccmmissionor Erickson supported by Commissioner Davenport that the Planning Commission make the following recommendation to the City Council': That the: request of Centurion Company on behalf of Lake Moving and Storage, Inc. for a conditional use permit to operate a moving and storage lousiness at 1121 'Vicksburg Lane be approved. subject to the; following conditions. 1. No outside overnight storage of vehicles-. Z. Pio signs other than presently constructed and in place. MOTION TO AMEND was made by Commissioner Schneider supported by Commissioner Thrienen that the Planning Commission add the following as condition ##3; "Permit to be for one year." MOTION TO AMEND CARRIED (6-0-0) (Ali in favor) MOTION TO AMEND CARRIED Voting then took plaice on the main motion as amended. PLANNING COMMISSION MEETING MINUTES -7- September 22, 7976 MOTION CARRIED (6•-0-0) (All in favor) MOTION CARRIED Mr. Dim Hawks, representing Centuiron Comapny, stated that he found it unusual that there were no provisions within the: City for outside storage of vehicles. Staff pointed out that the provisions for outside stoarge of anything in the City was that this storage area be screened. A-374 Greenwood Baptist Church A-374 Conditional Cosy Permit Renewal Staff presented petitioner's request for renewal of a conditional use permit to operate a day care center. A recommendation for approval was proposed by Staff sub- ject to the conditions as listed in the Staff report of September 16, 1976. MOTION was made by Commissioner Erickson supported by Commissioner Threinen that the Planning Commission make the following recommendation to the City Council: That; the request of Greenwood Baptist Church for renewal of a conditional use permit to operate a day care center at the church be granted subject to the follow- ing conditions 1. All applicable fire codes be complied with. 2. Conditional on the approval and/or certificaticr of petitionar's operation by any, appropriate State and/or County ag,encie. MOTION CARRIED (6-0-0) (All in favor) MOTION CARRIED A-473 Ramal Stationery A-4 3 Site Plan Staff presented petitioner's request for site plan approval of a building addition to their prevent facility located at the northwest corner of Highway 55 and County Road 6. A recommendation for approval was proposed by Staff subject to the conditions as listed in the Staff report of September 16, 1976. MOTION was made by Commissioner Hagen supported by Commissioner Erickson that the Planning Commission make the following recommendation to the City CouNcil That the request of Royal Stationery for site plan appr)val of a building addi- tion dditiopttotheirpresentfaci1itylocatedatthenorthwestcornerofHighway55 and County Road 6 and dated September 13, 1976: be approved subject to the followinc conditions PLANNING COMMISSION; MEETING MINUTES -8- September 22, 1976 I.
