Chambers of the Public Corks Building, 14900 -23rd Avenue North, MELEES PRESENT. A-674 Site Plan and Conditional Use Permit Staff presented petitioner's request for a condition6i use permit and site plan approval for a 30,000 sq. ft. building to be located at the northeast corner of Niagara Lane and 21st Avenue Forth.: The building would be used for office, shop and warehouse purpuses by petitioner. Petitioner was proposing an 8 ft. high fence to surround the outdoor storage on the site. Staff noted that tl.is fence would be considered a structure if allowed to be higher than 6 ft. and would, therefore, require a setback variance. Staff recommended approval subject to the five conditions listed in the Staff report of dune 4, 1976 and a setback variance for the fence frror 25 ft. and 30 ft. required to 16 ft... as proposed. Chairman Xroskin asked petitioner wilat types of equipment would be stored within the outdoor storage area. Mr._ James I'aufman, President of Minnesot Toga, Inc. stated that the storage would include trax.lers,, tractors, prepackaged equipment and some irrigation pipe. 140TION was made by Commissioner Davenport ;Ajupported by Commissioner Hagen that the Planning Commission mace the .following recommendation to the City Council: Thant the request of Minnesota Thro, Inc. for a, conditional use permit and sato plan approval fo-,, a 30,0(10 sq. ft. building for office, shop and ware- housing purposes to be located at the northeast corner of Niagara sane and 21st Avenue. Petitioner pay a Park Dedication 'Fee equal to X500 per, acre 0500 per acre X 4 a(:ms = $2,000) payable -to the City of Plyrouth. 3. Engineering recommendations be incorporated into the site, as per the City Engineer. 4. Incorporation of an additional fire hydrant as recowended by the City Fire Chief. S. Outside storage be restricted: to designated paved area.. Waste receptacle b, restricted to the interior of the building 6. Petitioner would use the building proper for storage of all rental equipment except trucks and trailers. the -trucks and trailers would be stored to the north and west of the building within a 6 ft. high fence Staff recommended approval of the request subject to 'the conditions as listed in the Staff report of June 4, 1976. aiairman_ Kroskin asked petitioner what types of equipment he would be storing on the site. Mr, Wra. Jasper, petivioner, responded that ,at would be a. wide variety of yard and garsen equ1.pment as well as trucks and trailers, front-end Loaders, cement mixers srM11 tractors, Cc Commissioner Schneider asked petitioner if the equipment would be outside during the day. Petitioner responded that it would be but that it would be placed, within the fenced in area. Commissioner Stewart asked Staff about the timing of the landscape band to be required of petitioner. Staff responded that the bond would have to be in the hands of the City prior to the conditional use permit being issued to petitioner. 14DTION was made by Commissioner Stewart, sul . orted by Commissioner Hagen that the Planning Commission mike the following re -, andation to the City Council: That the request of Blue Jay Rental Faiterprises for a conditional use permit for a rental business to be located at the northwest corner of South Shore Drive and, Highway 55 be approved subject to the following conditions 1. No outside storage of waste, materials or equipment other than trucks and treilers 2, A total of eight parking spaces be delineated to comply with Ordinance requimre is (6 spaces for the first 1,000 sq. ft. of floor area and one space for each 500 sq. fig. over 1,000) S. landscapes of the fenced iia area behind the building to insure screening of all trucks and trailers in the area. the fencing material shall be of a stockade style. landscape plans to be: approved by the Director of Planning and Comaunity- Developmant prior to conditional use permit issuance, Chairman Kroskin asked petitioner if he would be willing to have the equipment all inside the fence, day or night, except for loading and unloading of the equipment; Petitioner stated that this was his intention, PLANNING COVAMISSION MEETING MI NVM -4- June 9, 1976 MOTION TO AMEND was made by Commissioner Hagen supported by Commissioner Schneider that the following condition #4 be added to read.- "The overnight storage of trucks and trailers be wi:Iiin the fenced in area and that any other equipment, during hours of operation, -hat is outside of the building be placed within the fenced in area. 11 MOTION TO AMEND CARRIED (6-0-0) (All in favor) MOTION '10 AMEND CAP= MOTION TO AWD was made by Commissioner Schneider supported by Commissioner Davenport that the following condition #S be added to read: "The stockade fence be required to be 8 ft. in height." The Commission discussed diffeiences between the usual 6 ft. high fence and the $ ft. height now proposed. It was pointed out that the fence, at 8 ft., would be considered C -t "struotux-el' by Minnesota building codes and would, therefore, require a variance to the setbacks. Commissioners Threinen and Stewart stated that they felt the, 6 ft. height would be adequate. MOTION CARRIED (6-0-0) (All in favor) MOTION CARRIED K-52-7 LLMon Industries A-527 Site Plan Expansion and Lot Division/Consolidation Staff presented petitioner's request for site plan expansion and a lot division/consoli- dation for the Litton Industries site located at the southwest corner of County Road 6 and County Road 61 (Xenium; Lane). Staff recommended approval of the requests subject to the conditions as listed in the Staff report of June 4, 1976. Chairman Kroskin asked if the County Highway Department had been contacted wi-di respect to the accesses to County Roads 6 and 61. Staff responded that it had been contacted and that the County did not see any problems with -the proposed accesses. John Sebold, Carlson Properties, stated that the original intention was that Litton would expand to all three lots of the "Litton Addition" plat. However, at this time, they are contemplating use of only two. The County Road 6 access for the site may someday be the only access to Lot 3 of the "Litton Addition" plat. That the request of Litton Industries for a lot division/consolidation to complete the site plan expansion of Litton's plant at the southwest earner of County Road 6 and County Road 61 (Xenium Lane) be approved. MOTION CARRIED (6-0-0) (All in favor) MOTION CARRIED MOTION was rade by Commissioner Thr^einen supported by Commissioner Stewart that the Plash Ing Cormass ion make the following recom wndation to the City Council: That the ri,!(1uest of Litten. Industries for site plan expansion of their operations Located at the southwest corner of County Road 6 and County Road 61 (Xenium Lane) be approved subject to -die following conditions., 1. A landscape and paving bond be provided by Litton Industries for -the expansion plans. This bond should be for 150% of the cost of the improve- ments , teased for 18 months, 2. All storage of waste, garbage or other materials to be within the building. MOTION TO AMEND was made by Commissioner Davenport supported by Con dssioner Schneider that the following condition #3 be added:. MOTION CARRIED (6-0-0) (All in favor) MOTION CARRIED A-563 Gerald Provost A-563 Conditional Use Permit Staff presented petitioner's request for a conditional use permit renewal for a hone occupation for hydrostatic testing of scuba tanks. Staff recommended approval subject to four conditions as Listed in the June 4 1076 Staff report. MOTION was made. by Conmissioner Stewart supported by Commissioner Threi.nen that the Planning Conmission make the following recomnendation to the City Council.; That -the request of Gerald Provost for a renewal of his conditional use permitIforahomeoccupationforhydrostatictestingofscubatanksbeapprovedsubject to the following conditions: I. MOTION CARRIED (5-1-0) (Co—assioner Davenport against) MOTION CARRIED Commissioner Davenport stated that he did not feel this use fit the Zoning Ordinance definition for "hom occupation". A-429 Access to R.L.Z. #1344 A-429' Staff reviewed with. the Comission the background to this request and explained that it was back, to the Commission for either substitute recommendations to the Council or reaffirmation of the Commission recommendation to the Council of May 5, 1976. The Commission discussed the situation and various resolutions to it with r1r. O'Brien and Staff at length. It was the determination of the Commission that any so-Lution to the access problem should not force any hardship on the O'Briens. The Commission reoonmindation of May 5, 1.376 wits: respect to this issue, was reaffirmed and reco-rr&end?d for Council action. 645 Walter Strand A-645 Conditional Use Permit Staff presented petitioner's request for a conditional use pe'- "t to continue his accessory use of truck and trailer i.,ental at a service statim -jcatad at the north- west comer of Highway 101 and Count,,? Road 6. It was noted to the Commission: that petitioner had a revised site plan mflecting the changes requested by the Commission and I-taff at its February ;8, 1916 meting. Staff recommended approval of the request subject to the -three conditions as listed in the lure 4, 1976 Staff report.. The Coodssion discussed the number of vehicles to bu parked on the site at any titre. Petitioner stated that he would comply w;. -t;1 the 16 requested by the Commission as much as possible; however, there would be ties where -ptentially uore vehicles could be on his lot fror, clistoTnam leaving the units off on a one-way trip.
