HomeMy WebLinkAboutCity Council Ordinance 2000-04CITY OF PLYMOUTH HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 2000-04 AN INTERIM ORDINANCE TEMPORARILY PROHIBITING THE ISSUANCE OF SUBDIVISION APPROVAL AND ZONING APPROVALS IN A DESIGNATED AREA LOCATED NORTH OF BASS LAKE ROAD AND WEST OF NORTHWEST BOULEVARD SECTION 1. DEFINITIONS: The following terms when used in this ordinance shall mean: OFFICIAL Ordinances and regulations which control physical development, CONTROLS: including ordinances establishing zoning, subdivision controls, site plan regulations, sanitary codes, building codes, and official maps. STUDY AREA: The area located west of the future extension of Northwest Blvd. (Co. Rd. 61), north of Bass Lake Road (Co. Rd. 10), and east of Quinwood Lane as designated on the attached map dated January 25, 2000, which is incorporated herein by this reference. SUBDIVISION: The separation of an area, parcel, or tract of land under single ownership into two or more parcels, tracts, lots, or long-term leasehold interests where the creation of the leasehold interest necessitates the creation of streets, roads, or alleys, for residential, commercial, industrial, or other use or any combination thereof, except those separations: A. Where all the resulting parcels, tracts, lots or interests will be 20 acres or larger in size and 500 feet in width for residential uses and five acres or larger in size for commercial and industrial uses; B. Creating cemetery lots; C. Resulting from court orders or the adjustment of a lot line by the relocation of a common boundary. ZONING Rezoning, land use guide plan changes, conditional use permits, interim APPROVALS: use permits, variances, site plan approval, planned unit development approval and building permits. SECTION 2. INTENT: It is the intent of this ordinance to allow the City of Plymouth time to complete an in-depth study concerning adoption of a comprehensive revision to the City's Comprehensive Plan for the study area and official controls implementing the comprehensive plan, and in the interim to protect the planning process and the health, safety, and welfare of the citizens of the community. SECTION 3. TEMPORARY PROHIBITION: Pending the completion of the above reference study and the adoption of appropriate official controls, no building permits, sketch plan reviews, subdivisions or zoning approvals shall be processed or approved and no application for such approvals shall be accepted for property in the study area. SECTION 4. EXEMPTIONS: This ordinance shall not apply to final plat approval of a subdivision that has been given preliminary approval prior to the effective date of this ordinance. SECTION 5. EFFECTIVE DATE: This ordinance shall take effect immediately upon its approval and shall remain in effect until the date of the adoption of the comprehensive plan amendment and official controls contemplated hereunder or July 31, 2000.
