Representative Chairman: Kroski n opened the Public Hearing at 7:30 p.m. and explained the procedure that was to be followed in revive this item., A744-5 14ELYIN G. ASTLEFORD h-449 Rezoning from R-0 to I-2 to E-1 for ".Bass Lake Plaza" Staff presentee; the request,; outline., the hi=}dory of this site with the aid of a map with overlays and recapped the proposed General Development Plan. Problems outlined in a letter of October 22, 1974 to the petitioner's engineering consultant were also .recapped for, the Comnissioners. Staff reviewed the revised plan and noted some of the objections In their report, leading to the Staff's recommendation to the Planning Commission for denial of the request for rezoning^, for the three reasons stated in their report, Mr Frank Berg, of Consulting Engineers Diversified, Inc.,7708 Lakeland Avenue North, Osseo, Mn., represented the petitioner, Melvin Astleford, and recapped; the history of the proposed develorment beginning with January of this year, at which time they had submitted a fina Ilei; for ppprovai.. He admitted the uses they had proposed did not necessarily re close shown in. the Land Use Guide Plan. He outlined the considerations they jave xfo the topography of the land and also the concerns of transition from industrial to medium/high density residential, out- lining th,:ir reasons for the feasibility of the proposed plat as being an appropriate use as a ineans of transition between the two uses. The advantage to the City, if approval was granted,, he stated woLid La an increase in the tax base, sMe buildingcouldbestarted, others would have to wait until utilities are put in but the over- all plan of development for this area would be established. Considerable discussion centered on the compatibility of the uses as proposed with each other in the plat and with surrounding areas and its advantages for deviations from the projected plan outlined in the adopted Land Use Guide Plan as opposed to remaining with the Guide Plan, which was adopted after many months of study.. Also consideration was given to the effect approval would; have on the installation of utilities, which are not scheduled until 1979 under the C.7,P. PLANNINQ COMMISSION MEETING MINUTES - 2 -, November 20, 1974 Bob Baldwin, represented Baldwin Chevrolet, expressed his reasons; for wanting tolocate, 'int s area. Harlan Peterson, 9912 Bass La;k-a Road, owner of 80 acres directly north of the proposed site;, expressed approval of the development of this land for tax purposes. Public Hearing was closed at 8.05 p.m Mr, Frank Berg requested that the pf—tition be shelved or tabled to allow them more time to work with the Staff and possib;y come up with a plat which might be more acceptable in view of the comments expressed .by the Planning Commissioners, especially in the southwest corner of the proposed plain MOTION was made. by Commissioner Threinen supported. by Commissioner Hagen that the request of Melvin G. Astleford for the rezoning -of Bass Lake Plaza from R -O (OpenResidential) and 1-2 (General Industrial) to Br -1 (limited Business) based on a General Development Plan submitted October 25, 1974 be postponed until such time as petitioner presents a revised. plan in accordance with the Land: Use Guide Plan. Commissioner Threinen felt that if some of the other problems could be worked out and the only hang uo was the matter of lack of water and sewer available, at least the petitioner would know exactly what the problem was. MOTION CARRIED (4-Z-0) (Commissioners Hagen and Davenport opposing) CARRIED A-601 RADISSON HOTEL CORP. A-601 Conditional Use Permit Staff outlined this request for a Conditional Use Permit for an offsale liquor store to be located in an 1-1 District on land adjacent to Uncle John's on 26th Avenue North. The petitioner has presented a proposed site plan for informational purposes only at this time; the sife plan was not presented for official consider- ation. The various points in the Staff Report were briefly outlined as well as the reasons for the; Staff's suggestions as given in their report, John Sebold, and Dick Enroth, both of Carlson CompaniesInc.,, representing M,I.P, and the petitioner were present. The Radisson Hotel Corp. would be the owners; and operators of the offsale liquor store. They stated that after studying theStaff's report and further discussions, they concurred with -the Staff's suggested second approach of deferring action and waiting until action had been taken on the request to rezone this land to be consistent wits, the Land Use Guide Pian. They were in agreement with the proposal to rezone this land to 8-1 (Limited Business) as the use of the liquor store would possibly be more from general public than industrial park personnelper se. He stated they were thinking a possible use for the balance of the parcel (approximately 4 acres) would be anofficebuilding complex, Comments were expressed relating the advantages and disadvantages of having the liquor store in or near a motel and comparative situations were presented, Mr. PLANNING COMMISSION MEETING MINUTES 3 Mover;ober 20, 1974 r^nroth ralayed the results of a market study they had made on this, with Mr. Sebold prefacing this with projected aspects and proposals for M-1{P>',s further expansion. MOTION teas made by Commissioner Threinen supported by Commissioner Davenport that the Planning Commission hold a public hearing on December 1.5, 1974, on its request to rezone this area bounded by :Annapolis Lane, 26th Avenue extended,, Xenium Lane and Highway 65 from I-1 (Planned Industrial) to D--1 (Limited Business) consistent with the adopted Land Use Guide Plan. MOTION CARRIED All in favor CARRIED MOTION was made by Commissioner Threinen supported by Commissioner Stewart that the request of the Radisson Hotel Corporation for a Conditional Use Permit for a liquor store be postponed until after the public hearing for the requested reotling of this area is held on December 18 1974 MOTION CARRIED All in ba.vor CARRIED This concluded New Business at 8:50 p.m. OldBusiness. None Reports of Officers, Boards and Committees. MAIP/1NIPA November Chapter Meeting Meeting is to be held on Saturday, November 23, 1974, from 9:30 a.m. to 12:30 p.m, at the University of Minnesota. A movie of Phoenix, Arizona plan wDuld be presented. Members were urged to attend Ietropai tan Counci Regional Park Proposal The Metropolitan Council is going to have a hearing on November 26th, 1974 con- cerning regional parks, This report has to be ready for the Legislature by thefirstofthe-year. The regional park in. Plymouth is north of Medicine Lake. They are proposing the Hennepin County Park Reserve be the c,,cting agency to administer this park plan. Staff noted that a more complete repea-t on this issuia would be presented at a subsequent meeting.
