HomeMy WebLinkAboutPlanning Commission Minutes 11-06-1974PLANNING COMMISSION CITY OF PLYMOUTH-, MINNESOTA November 6, 1974 A regular meeting of the Plymouth Planning Commission was called to order byChairmanKroskinat7;30 p.m, in the Council Chambers of the Public Works: Building, 14900 23rd Avenue North, MEMBERS PRESENT' Chairman Kroskin, Commissioners Erickson, Schneider, 'Davenport, Hagen, Stewart and Threinen, MEMBERS ABSENT-, None. STAFF PRESENT, Charles E. Dillerud, Muton Dale and: Agatha Mortenson OTHERS PRESENT: Connie Genung, Y.A.A.C, Representative A-2'59 JEROME P. BECK`! A-2 5 Conditional Use Permit Renewal Staff briefly outlined the history of this operation, which Hennepin County andMinnesotaPollutionControlAgenciesweremonitoring. Staff had been at the site earlier this date and had taken pictures of the area for the benefit of the commissioners. While, Hennepin County anticipates the winding up and closing: of this operation in the near future, they do recommend renewal of the: Conditional jUsePermitbegrantedtoallowtheoperationtobecompletedaspertheirdirection. l All agencies felt the operation was being conducted in a satisfactory manner, l Staff recommends the approval of the Conditional Use Permit, with an expiration date of June 30, 1,975, at which time a determination of the progress being madeinclosinguptheoperationcanbemade, Jerome Begin, 12615 County Road 9, was present in the audience to answer any concerns of the Commissioners. MOTION was made by Commissioner Hagen supported by Commissioner Stewart that, the Planning Commission make the following recommendation to the City Council; That the request of Jerome Begin for a Conditional Use Permit to Operate a Sani- tary Landfill at the southeast corner of interstate 494 and County Road 9 be approved:, subject to the following conditions: 1) No garbage. 2) No burni . 3) Attendant during open hours. 4)" Nightly covering with six inches of appropriate sail. 5) No toxic wastes or solvents. 5` Permit application approval by the Minnesota Pollution Control Agency and the Hennepin County Public Works Department, Environmental Division. November 5, 1974 7') That enforceiaent procedures be implemented by the City, County, and P.C.A. to insure that the conditions specified and the operation procedures called out in the engineering report are not violated. 8) This permit is to expire June 30, 1975, MOTION CARRIED All in favor CARRIED A-590 PARKERS LAKE BAPTIST CHURCH/PERSONAL DYNAMICS A-590 Conditional Use Permit Staff briefly outlined the background': this facility and its present problems, Also presented was a brief explanation o, the firm that would occupy the facilities, Personal Nnamics, their intended operation at this facility. Several serious cons i4,.,r 1,ons were pointed out to the Comnissioners, i.e, the appropriate,/inappropriate use of this building for the function proposed; the educatioN aspect for monetary pr -'-it in a residential district vs. a business oparat on in ar, R-1 pone, allowable or not, and the definition for the words institution" and "education" as it relates to the Zoning Ordinance and. the proposed us2 Leo A. Hauser, III, Presi,dertt, Personal Dynamics, stated they have been in bus- iness for five years, they are a Minnesota corporation, incorporated in 1969, he is currently the president, they are presently located on the 4th floor of the IDS Center, they do. operate for a profit, Jim Lutzweiler, 8725 W. 35th Street, '',er of Parkers Lake Baptist Church and also t,e rea estate agent that was handling the sale of the property, read a prepared statement of the church body, reiterating the problem of disposing of the property for use that would not bring undesirable conditions to the neighborhood and would be acceptable to the City Offices, outlining some they had turned down. Advantages of this proposed use were also outlined; i.e. the use would be during 8100 'to 5:00 weekday hours; prospective buyer would have no more than six cars per weekday vs, the church's 170 per week when they operated the facility; the use is compatible with the residential neighborhood and of such nature that would be allowed if the church body itself opirated this function; and they were of the opinion the use definitely fell within the definition of a "school" As the room was filled with people, Chairman Kro&kin reminded the audience that this was not ,a public hearing. No one acknowledged they were there in opposition to this request. Almost everyone in the audience acknowledged they were members of Parkers Lake Baptist Church, but only a few dere residents of Plymouth. Kira Hauser then explained the operation of Personal Dynamics in some depth, the history which led to the founding of this organization, its purposes and goals, the background .of the officers. In response to a question of the Commission, it was stated that Personal Dynamics has been working directly with the school and does have a contract thru HUD to work with the disturbed and underachievers I PLANNING COMMISSION ,is ETINQ KINUTES - 3 M November 6, 1074 in the public schools in an attempt to motivate them to better learning. They would be using the church building as their headquarters, where they would be creating new material, developing new programs and disseminating the material from the building, and organizing the classes which are held elsewhere. The printing of the material is done by another firm, No classes would be held at this location unless they were instructed to do so to meet the requirements of a "school". A soundproof room in the basement would be ideal for use as a re- cording studio to produce the tapes used in their programs. They felt the nature and structure of the building lends itself to the atmosphere for creativity, which is why they were interested, in this site; and as such, they would not be alteringthestructureatallbeyondtheremovalofthechurchpeers. They plan on buyingthebuilding, not leasing it, if the City grants them the Conditional Use Permit. He stated they understood they could not alter or expand the building even if their business grew beyond the capacity of the building, believing it was large enough to accommodate their needs for some time. Presently they have three fulltime employ- ees and one parttime. They had not anticipated purchasing the adjacent lot for parking but were willing to do so if needed to meet the parking requirements. The building contains 2500 square feet. Commissioners explained the Ordinance require- ments and restrictions pertaining to off-street parking for employees and the City'spolicywhichallowedthechurchtoparkinthesetback. area. Robert Ford,, 1730 Ithaca Lane, representing the Northeast Parkers Lake Home- onersssociation, was present, stated he had no comments or questions concern- ing this request for a_Conditional Use Permit. He introduced Max Smith, 14912 County Road 6, representing the homeowners in the area. Mr. Smith acknowledged that he was a member of the Parkers Lake H?pfist Church, he had no comments or questions to make or questions at this time, but stated the Association had not met on this issue and therefore he was not We to report their stand on the matter,. Discussion then centered around the concerns Of the Commissioners pertaining to the following. 1) Appropriateness of this proposed use for this building and for this area, 2) The intent and the meaning of the word "education" as related in the Ordinance, 31) The need for a site plan to indicate adequate parking. 4) If the permit is granted, what implications might result or precedents set if the business outgrows the building and the structure is again up for sale. After considerable discussion, Commissioners requested that the Minutes reflect that they were considering this request on the basis of it being an educational facility+ MOTION was made by Commissioner Threinen supported by Commissioner Stewart that the Planning Commission make the following recommendation to the City Council; PLANOINC COIMIMISSION MEETING MINUTES 4 - November 6, 19,74 That the request of Parkers Lake Baptist Church for a Conditional Use Permit to Operate art Attitudinal Education Service be approved, subject to the follow- ing conditions 1) Adequate parking be provided according to the Zoning Ordinance specifica- tions. 2) The acquisition of the adjacent lot to the west presently owned by theCityof,MinneapCis, 3) A site plan be submitted for approval. Commissioner ;hreinen`s reasons for this proposal was that he felt the proposedusedoesfitthistypeofstructureandtheuseisaborderlinecase. MOTION was made to AMEND the Motion by Commissioner Davenport, supported byCommissionerSchneidertoaddthefollowingconditions 4) No clasaes be conducted on the premises. 5)Conditional Use Permit to be renewed on an annual basis. Commissioner Davenport expressed the opinion that this would help: with the traffic and parking problem and would give the City control over the situation in the event a problem did appear. MOTION to AMEND FAILED (3-4-0) (Chairman Kroskin, Commissioners Erickson , Hagen and Threinen opposing) FAILED MOTION was made to AMEND the Motion by Commissioner Hagen supported by CommissionerThreinentoaddthefollowingcondition; 4) The proposed use is an educational one. Further discussion was held as to what is ao "educational use" and the need for specifically listing it as such as a guide fo-1 any future requests for this site. MOTION' to A141END CARRIED (4-3-0) (Chairman Kroskin, Commissioners Erickson and Stewart opposing) CARRIED MOTION was made to AMEND the Moti c'' by Commissioner Davenport supported by Commissioner Stewart that the following condition be added 5) No classes be conducted on the property. N NC6 - I Dn Flood Plain Zoning - Section 6 Staff presented a memo, flow chart and rough draft of a proposed Section 5 Flood Main Zoning, covering a new approach to this subject in the light of D.N.R. requirements, On Page 4, Subdivision 6, #1 - Commissioners asked that the last sentence of this paragraph be deleted as they felt the wording could mean that the permit applications couldby-pass the Planning Commission and they were de-.irous of looking into the matter before going to the Council for approval, They did request that the first sentence be left in the paragraph, On Page 9, #2 Conditional Use, #A n Commissioners requested that the kords "as provided by Subdivision 9, 4V be added to, the last sentence at the end of the paragraph, On Page 7, #2, #I - the correct Subdivision should be referenced. On Page 13, Subdivision 2, #A - Commissioners asked for examples of what variances the Board of Adjustment would be handling ender this section. Example situations were explained by Staff, Reference was made to provisions given on Page 3, Subdivision 5, #2 - Conditional Use, Mr. Dil erud informed' the Commissioners that Randy Thorsen, a student at St. Cloud State College will be working with us. He is a student of Environmental Impact. He will be assigned to research and develop the Conservancy :Section of the proposed new Zoning Ordinance.. If he does not get this done before the Zoning Ordinance is ready, this section will be left out and added, later as an amendment, Commissioner Hagen. requested that a copy of the proposed New Zoning Ordinance be submitted to Bassetts Creep Watershed District for their approval, as they do have quite a bit to say about this phase of development. Commissioners expressed a concensus in favor of going on with the Zoning Ordin- ance and adding the special districts later, working towards public hearings to be held in January. All: Commissioners expressed by vote the opinion that the City Council should be made aware of this Proposed Section 6 before it is submitted to D.N.R. for its approval Old Business was concluded at 9:55 p.m. PLANNING COMMISSION MEETING MINUTES - ,6 - November 6, 1974 Re ortsr N H14CS RID .R RAMS STUDY -- Mr. Dter. Dillerud asked for a Commissioner to volunteer or be appointed to represent Northeast Plymouth at these: meetings. Commissioner Stewart volunteered to represent Plymouth. SCHOOL DISTRICT X284 Mr. Dillerud asked for a Commissioner to volunteer or be appointed to represent Plymouth at these meetings. Co0missioner Davenport stated he would be willingtodosoashelivesinthisdistrict. The minutes ofthe Planning; Commission Meeting of October 16, 1974 were presented for approval. MOTION was made by Commissioner Hagen supported by Commissioner Davenport that the minutes of the Planning Commission Meeting of October 16, 1974 be approved as presented, MOTION CARRIED (6..0-1' (Commissioner Erickson abstaining) CARRIED Commissioner Schneider mentioned that he thought they were taking a great deal of trees as a result of the construction of tke water tower on Zachary Lane. Mr. Dillerud reported that -the City Council approved the Preliminary Plat of Greentree West" basically as was approved by the Planning Commissid:l MOTION was made by Commissioner Threinen supported by Commissioner Hagen that the meeting be adjourned,.
