February 6, 1974
A regular meeting of the Planning Commission was called to order
by Chairman Kroskin at 7:45 p.m- in the Council Chambers of the
Public Works Building, 12900 23rd Avenue North..
MEMBERS PRESENT: Chairman Kroskin Commissioners Harden, Threi'nen ,
Johnson, and Stewart
MEMBERS ASSENT: Commissioners Erickson; and ,hajka

Site Plan Review
Milt Dale' explained the request of Jim Hay for a Conditional Use
site plan review, Conditionaloval Use Permit and Permit
variance for the construction of a Butler metal
building approximately 40 x 125 x 14' high on a
0.58 acre site to be used af. a service station. The
petitioner plans to remove the existing building and
replace with a proposed eight -stall garage to employ
a maximum of eight mechanics
Petitioner Hay elaborated on his: future growth plans and
variances requested including a 35' front yard building
setback, 70' sides yard parking setback, 1 parking space
and no front yard parking setback due to the number of
feet required for 'County Road 18,
Commissioner Stewart requested landscaping on the north side
of the site become a part of the petitioner's site plan
Commissioner Threinen expressed concern over a maximum of
19 parking spaces in view of the fact there could possibly
be several vehicles parked awaiting service in addition to
those driven by employees alone.
Planner Overhiser stated that a detailed sign proposal was
not submitted with the site plan. He stated in his opinion
the most critical item in question is the metal construction

of the .building which the Building Inspector felt xwould
have to be sprinkled to moet the State Building Code.
The petitioner should also give some consideration to
reducing the size of the, building.
Commissioner Threinen requestedthe City Engineer evaluate
traffic flow at this particular intersection before possible
traffic congestion might be created thru expansion of this
facility;
MOTION was made by Commissioner Stewart, supported by Commissioner
Threinen that action be deferred until petitioner revise his
site plan to include the following.
1)` Redesign building to meet all Zoning Ordinance Require-
ments, State Building Code Requirements, and use more
permanent construction materials such as block and
brick rather than metal building.
2) That a more detailed plan. for signing be submitted.
3) That a much more detailed landscaping plan including
landscaping materials be shown on the north side of
the site
4) That no variances: be allowed for building or parking
setbacks or for signs.

Progress Report
Planner Overhi ser ;^ead from the last paragraph of the
staff report dated January 30, 1974 regarding the proposed
shopping center located at Co. Rd. 10 & 494 at the border
ofMaple .Grove and Plymouth. The staff would not recommend
consideri nit this matter again until such time as the Maple
Grove traffic consultant has submitted his review; Maple
Grove, the County and P,ymouth staffs arrive at a proposed
location for Co. Rd, 61. and until the extent of the area
to be possibly served by Maple Grove with utilities is
studied. The Staff will continue to work on these items
and will report back to the Planning Commission and
Council as additional progress is made.

Zoning Ordinance to Permit PUD in All Districts Except R-O(AG-I Dl
Planner Overhiser handed outt a revised draft and explained
the changes made as a result of Planni:ng Commission discus-
sion and City Attorney review.
Attorney Lefler felt that some of the facilities listed such
as churches would not primarily serve residents of the PUD,
This has been; rewritter, to say, in effect, that only the
office or commercial uses must be intended to serve primarilytheresidentsofthePUD.
Under Paragraph 6, Item, h was added to 'require bonding.
In conversation prior to this meeting Commissioner Erickson
had conveyed his general agreement with thea purpose and intent
of the proposed ordinance changes, but does recommend changingtheword 'informal' neighborhood meeting to 'informationall
neighborhood meeting.
Commissioner Hagen stated he felt the requirement for bondingforallproposedimprovementspriortoallowingadeveloperto
begin even grading would wori; a. hardship on the developer.
Frequently after a project is approved, it take some time
to come up with bonding to be set. During this time, possibly90days, a developer may want to construct his models, and
this would have to be at his own risk. Also, the requirement
of bonding, Item 6 c. is normally covered in the Development
Contract. Councilman Neils reported there have been a number
of cases where grading permits have been issued for land
preparation prior to Building Permits, as the code does permit
the issuance of grading permits.
Roger Fazendin stated he believes the ordinance as written
to require bonding would create considerable. problems for
many people, including staff, as to review and 'watth-dogging' .
MQTION was made by Commissioner Hagen, supported by Commissioner
Kroskin that Page 49., Section 6, Paragraph (c) and (h) of the
draft be eliminated because they should be a part of the
development contract (Item b).
Motion carried 5-0 MOTION CARRIED
Planner Overhiser stated that the outcome of the Shoreview
case testing the legality of the required membership in ahomeownerl $
association of succeeding parties beyond the
fl),st sale will be learned before the Council considers the
amendment.

MOTION was made by Commissioner Hagen,, supported by
Commissioner Stewart that the Planning Commission
recommend the ,adoption of the Revised. Draft of the
PUD Amendment to the Zoning Ordinance, Subdivision 1,
Section ZU., subject to the noted changes:

Planner Overhi,ser referred to correspondence from
this group dated 2/6/74 and letter of sane date from
him to Pastor Snipstea:d. The Association of Free
Lutheran Congregations has written thattheycan't
approve of the proposed rezoning. The letter' from Planner
Overhiser explained the City of Plymouth was not seeking their
approval in this matter, but merely advising them of the action
proposed by the City.
A public hearing was held Deo;ember 5, 1975, and the Staff
v recommended that the property be rezonea from R-4 to R-1
and a Conditional Use Permit be approved for the operation
of the Bible College.
MOTION was made by Commissioner Hagen and supported by
Commissioner Stewart that the rezoning of Tract A
Registered Land Survey #606 from R-4 to R -i be recommended
f)r Council approval and that a conditional use permit be
granted to the Association of Free Lutheran Congregations
to operate a Bible , ol'l ege and seminary with dormitory
facilities.,

MOTION was made by Commissioner Hagen, supported by
Commissioner Stewart that a Public Nearing be held
for March 6,. 1974 for an Amendment to the Land Use
Guide Plan for the Area Between Co. Rd, 9 and 49th
Ave. West of Co. Rd: 18.

Commissioner Hagen suggested something be done about the
misunderstanding of the: useage: of the term 'highway service', He suggested we delete all 'highway service' wording andreplacethistermwitha 'service business' designation, in the Land Use Guide Plan, as most persons believe this
to mean service stations or car dealerships.
Commissioner Threinen said the neighborhood concept is a
sound basis for the Comprehensive Land Use Guide Plan
and should be retained and not remove some undesi'reable
commercial uses from one driving neighborhaod and put, them
in another where the opposition is not so strong.
Commissioner Stewart reported it is his opinion the area
southof49th Ave. Flo, will be a residential neighborhood
unsuitable for highway, service, including, automobile sales
or anything listed under highway service, in spite of
proposed buffering, Highway 18 and the service roads.
In view of the types of site plans we have approved, suchasNorthwesternBell, Rockford Ponds, which is to be a
neighborhood shopping center, this existing and proposed
neighborhood should not include highway service,
Planner Overhiser explained that during discussion of the
Draft Zoning Ordinance this matter of terminology came up. B:-1 was to be Office Limited. Business, B-2 was titled HighwayServiceBusiness. It was decided to strike the word highwayandcallitServiceBusiness. Highway Service should also
be changed to Service Business on the Guide Plan to prevent
undue citizen concern that these uses would be all service
stations and car dealerships.
Chairman Kroskin read from the present Zoning Ordinance that,
the 8-3 Service Business District Is designed to: furnish
the areas served by other retail business districts with a
wide range of services and goods which might otherwise be
incompatible with uses permitted in the retail businessdistrict. This district is intended as a business district
which may be located in separate areas adjacent to shopping
centers and thus help keep the basic retail areas compact
and convenient."
Councilman Neils reported that the existing B-3 Districts
have almost always constituted a problem district once
zoned B-3, i.e... the Snyders Lake area, Ki1irer Lane,
55 & Dunkirk, have been less than desirable proposals for
the use of the districts. The Northwestern Bell site will
be one of the better looking developments in Plymouth, and;
that was one of the reasons the Council did not want B-3

type uses there. Also, the City Attorney advises that the
burden of denial to a petitioner for a conditional use
permit rests with the City to prove +61-+ under the current
Zoning Ordinance the proposal would `._ `inconsistent. It
is also important to list locational r" iteria for some of
the conditional use permits when you are dealing with
conditional uses under the ordinances,
140TION was made by Commissioner Threinen supported by
Commissioner Johnson that the map dated 1/16/74 showing'
tho highway service area on the north side of Co. Rd: 9
adjoining Rockford Ponds be the map proposed at the public
hearing.
AnAn amendment to the previous motion was rade by Commissioner
Stewart, supported by Commissioner Threinen that the map
submittedfor public hearing in relation to Co, Rd, 18 and
9 is predicated on the basis of the proposed Draft Zoning
Ordinance,
Motion was carried 4-1 with Commissioner Hagen voting: nay,

MOTION was made by Commissioner Stewart, supported by
Commissioner Hagen to amend the present ordinance
regarding political signs to read as follows:
Political signs may be parmitted for a period of not
more than sixty (60) days before and ten (l O) days
after an election, Political signs may not exceed
360 sqi inches per lettered material, and a proper
disclaimer must be posted on the sign. Political
signs shall' conform to this ordinance with permit,
fee and setback requirements waived
Motion failed 12-3, Commissioners Stewart and Hagen writing in favor,

6, That the Development Contract establish the park timetable for
its development to be with the completion of Merrimac Lane,
264th Avenue and 27th Avenue North.
Dickman Knutson said he is confident the pond could be rearranged. so that the
park land could be considerably largur by moving the .pond to the east,
Commissioner Schneider stated there was considerable concern by residents to
the south in :Sunny Acres that the proposed plan to raise the land could create
a drainage into the back yards of existing homes and suggested some stipulation
be made concerning drainage back into the pond. Mr. Knutson stated that the
elevations on these lot, would be such that no drainage problem would occurs
MOTION was made. by Commissioner Erickson, supported by Connissioner
Stewart to amend (3) above by a(Ai, g the following:

Commissioner Threinen served as Acting Chairman.
NOTION was made by Commissioner Davenport, supported by Commissioner
Threinen that the request of Bel -Mar Builders for Preliminary Plat
Approval for "Belmar's Industrial Park dated January 23, 1974 be
approved subject to the following conditions
1) That 10 foot utility and drainage easements be shown along all
property lines on the final plat,:
2) That a temporary cul-de-sac easement be granted at the south
terminus of proposed Cheshire Lane. (See Staff Proposed Plat
Circulation Plan) and Cheshire Lane be paved south to serve
Lot 1, Block 11 or that the developer be required to post bond
for such improvements in the development contract.
3) That the recommendations of the: Park & Recreation Advisory
Commission (2-7•-74) to accept cash payment be consideredto
satisfy the park dedication requirements.

GENERAL DISCUSSIONS
Safety Valve"
Councilman Neil's stated that he and other Councilmen
believe that the Planning Commission should act as a "SafetyValve" between the Staff and the Council. When petitioners
are not following the advice and direction of the St,4ff as
to. City Ordinances and policies, the Planning Co missiolt
should act to reenforce the. Staff position if they agreewiththeStaff, In this type of a situation the Planning
Commission would direct tha petitioner to revise his reguesi
in line with appropriate City plans and policies. The first
item on the Planning Commi+;siva agenda at this meeting was
sited as an example.
Chairman Kroskin stated that he agreed but did not want this
procedure to become a general practice-. He believes that
with a full -,time sta`,f that the stiff should be doing all
of the detailed review and working with the petitioners to
bring their proposals in line with City policies. Before
Plymouth had a full-time, Planning Staff, the Planning
Commission spent too much time pawing over proposed plans
with the developer at the Planning Commission meetings.

Planner Overhiser questioned the Planning Commission as
to the current information being provided in the PlanningComr-Ossion Agenda Books. The comment iias been made that
the reduced maps in the agenda book are ,at times unrea.oable.
Following discussion it was agreed that the present practice
of reducing the maps in the book form and displaying the
large maps at the meetings should be continued, The Staff
was requested to make the maps as large and as readable as
possible within the Agenda Book. If any Planning Commission
member wants more detail than that contained in the Agenda
Book, they should contact the staff,
Joint Meeting With Council
Chairman, Kroski'n stated that the Mayor and Council want to
meet with the Planning Commission on February 25, he
listed some possible items which might be discussed and
asked for additional matters which might be placed on the
discussion outline for the meeting,
