April 18, 1073
A regular meeting of the Planning Commission ias called ro order by
Chairman Wahl at 7:30 p.m. in the Council Chambers of the Public Works
Building, on Wednesday, April 18, 1978.

Planner Overhi ser introduced the proposal. nasi c Si ce Plan Review
discussion involved question, on park dedication, RLS
density, minimum square foo ige of elderly housing, PUBLIC HEARING
and potential future street..
Chairman Wahl asked the petitioner's representative if
there was any objection to the park dedication proposed by
Staff. He answered that he could not concur as the Church
Board will have to okay the requcst. -
MOTILIN was made by Commissioner Threine,i, supported by MOTION TO
Commissioner Hagen to act at, the present meeting. Motion ACT
carried, 5-0-1, with Commissioner Chapman voting nay.
MOTION was made by CoTmissioller Hagen, supported by Commissioner MOTION TO
Johnson, to defer action to allow for more time in negotiating DEFER/'
with the petitioner on the condi t-. ons . pecl f i ed in the Staff
report. Motion carried unanimously. CARRIED
AOTION was made by Commissioner Erickson, supported by Commissioner MOT10 O
Threinen to defer action on the Registered Land Survey for the DEFER/
property on which the existing Bible College and Seminary is located. CARRIED
Motion carried unanimously.
MGTION was made by Commissicner Hagen, supported by Commissioner MOTION TO
Erickson, to defer action on the site plan for the Associ ati oii of DEFER/ `
Free Lutheran Congregations. Motion carriedunanimously. CARRIED

Planner Overhi ser explained that Staff 15 recommending
Subdivision
that the subdivision requested by Ronald L. and Vern C.
Dotseth be recommended to the Council for approval subject

to dedication of 27 feet along the rest s;d e of the existing
parcel for right of way purposes on Vicksburg Lane, a Village
thoroughfare.
Vern Ootseth, the petitioner, indicated that he and. his brother
o`b7 ect to _ the 27 -foot dedication because the parcel is only 1/2
acre short of the necessary ten acres, and the 27 -foot dedication
would include sixty 100 -foot trees on the northern half of the
parcel which he dues not wish to give away,
Chairman Wahl explained that upon, the adoption of the Thoroughfare
Guide Plan it became Village Council policy to require .any necessary
right of ray at Oe tnie of any change in band use, Commissioner
Erickson added that 27 feet would eventually be required regardless of
the size of the parcel.
Planner Overhiser pointed out that this request is as subject to
the requirements of the Platting Ordinance as if the Dotseths had
come in with a formal plat with lots and blocks drawn out. Therefore,
dedication of either street right of way or utility easements --whichever
is needed: --is required by Village Ordinance, in this case, Vicksburgha- been called out as a major thoroughfare requiring 120 feet of
right of way.
MOTION was made by Commissioner Threinen, supporter` by Commissioner MOTION TO
Er'ckson, to recommend approval of this subdivision to the Village RECOMMEND
Council subject to the dedication of 27 feet on the gest side of APPROVAL/
the parcel for right of way on Vicksburg. Motion carried CARRIED
ur 1mously.
FT -TRO - Paul Kroehnert PAUL KROE'HNERT
Planner Overhiser explained th-t essentially the Subd;vision
petitioner is requesting to move his north line two
feet to the north, necessitated by a 2' error on the
original survey of his property,
LOTION was made by Commissioner Threinen, seconded by MOTION TC
Commissioner Johnson, to recommend approval of the request, RECOMMEND
Motion carried unanimously, APPROVAL;/

Planner Overh ser introduced the propcsal and explained Site Plan Review
that Staff recommends that the site plan as proposed by
the petitioner be recommended for Council approval subject
to the following conditions:
1) Drainage plans be approved by the Village Engineer
prior to issuance of a Building Permit;
2) That the proposed caretaker's apartment not be
constructed as a living quarters until such time
as a rewriting of the existing zoning; were to
permit such use;

10 3) That petitioner's proposed sign design be submitted
to Staff 'for their approval prl or to issuance of a
Building Permit;
4) That four fire hydrants be placed, as; directed by
the Village Eire Chief, to serve the site,
Commissioner Erickson pointed out that this site plan has asphalt
all the way up to the property line (side yards) and. cited
Subdivision 8, Paragraph 2a of the Performance Standards in an I-1
District: "a, landscaping. ,,, required yards shall either be open
landscaped: and green areas or je left in a natural state...." With
regard to the landscaping on the northern and southern boundaries,
Commissioner Erickson questionedthe petitioner if it would be
possible to design the access so that the outside portion is a drive
andcould have a lands. aped strip.. Mr., Hubbard answered that it was
impossible to fit in landscaping and have all the buildings because'
they are double -sided,
Planner Overhiser stated that the Ordinance provides for driving in
the required yard areas, but prohibits parking or storage and specifies
that yard areas are not to be left undeveloped but are to be covered
with something. Commissioner Erickson indicated that there should be
something other than asphalt covering the yard area, and that some type
of screening should be provided.
Chairman Wahl pointed out that the Ordinance requirement .of 25 foot
side yards between buildings was not being met on this site plan.
Planner Overhiser stated that the side yards,in his opinion, at
located on the sides of the property, and added that each building
should not be treated as a separate parcel.
Mr. Hubbard stated: that the intent of his proposal is to handle
residential and small commercial storage needs cons-,stirq basically
of furniture and other non-flammable ory goods. He indicated that
the buildings would be concrete with steel doors and intetAior steel.

link fence, with all ingress and egress occurring at the main gate
for purposes of security,
Drainage was discussed, with Commission -pr ttagen maintaining that cn

buildings He indicated, this runoff would cause problems even in a
five-year rainfall and wonaered how the drainage co;Al d be handled
without placing pipes underground. He added that no storm sewer ex,sts
near the site, The petitioner stated that this would' be provided tor
by the swages in the dri?es between the buildings,
Commissioner Hagen pointed out that there would be no provisions for
driveway if loading was to occur off the 25 -foot aisle, Mr. Hubbard'
indicated that there would be only parallel park loading. Commissioner
Hagen stated that loading ttias bound to occur with eight foot doors
every ten feet, as that is. h,y the doors existed:

Erickson, to recommend denial of the site plan on the basis. RECOMMEND
that it does not meet the side yard requirements of the DENIAL.ICARRIED j

iIt was agreed by the Commission that the use was a good one, but
that the petitioner should provide a site plan which does not
make such intense use of the land.
Commissioner Hagen stated that the eralier proposal fog* the MIP
Mini Park be re-examined With respect to interpretation of side
yard requirements with more than one building on cne parcel.
Planner Overhiser indicated this would be done.,

Planner Overhiser reported that the Minnescta Request Withdrawal
Highway Department had withdrawn their request
because they were unable to acquire additional
parking for their proposed facility,

MOTION was made by Commissioner Threinen, supported Final Plat
by Commissioner Johnson, to authorize the Chairman to MOTION TO
sign the Final Plat of the Williams Woods development. AUTHORIZE

Zoning Ordinance Report - Flood Plain Districts
ZONING
Planner Overhiser stated that Staff is presently foimulatinq ORDINANCE/'
a revised Zoning Ordinance. He explained in detail the FLOODPLAIN`
Floodplain Districts, adding that a Natural Resources
Analysis would be required to identify all natural features
of the site involved, including an analysis of the effect of the
proposed use on natural conditions.
Trail; Hike
Plarner Overhiser announced that the Council, Planning Commission, TRAIL
Trail Committee, and Parks and Recreation Advisory Commis=sion will HIKE
meet at 8:30 a.m. on Saturday, April 28 at the Country Kitchen for
a bus tour and three trail: hikes
Trail Committee Report
Del Erickson, Commission representative on the Trail Committee, TRAIL
reported that the Trail Committee had endorsed a letter from COMMITTEE
member John Sl avi cs addressing the problem of motorized vehicles REPORT
on private property and proposed public trails. John Slavics
recommended that the Council draft an ordinance requiring that the
users of trail bikes .and other like motorized vehi cl es, excl udi rtg
snowmobiles, be required to have in their possession a, letter from

the owner of the property through which they are pasSxng granting
permission to use his pronlerty.,
The Trail Committee recommended to the Park and Recreation Commission
that a system of transportation trails for moving children to and
from schools and playgrounds and for the use of adults in commuting
to work be studied' The major arterials that present the greatest
problem at this time are County Road: 6 from Ferndale Road toVicksburgLaneandStateT.H. 101 from County Road 24 to the Wayzata V4llage
Limits.
Metro Appliance Company
Planner Overhise-r indicated that a meeting had been held with. Mr.
Martin of Metro Appliance and the site had been visited by Staff.
He added that a letter had been sent to the County with regard to INFORMATION
the signing of the business, and the Building Department had done
an inspection .of the building which resulted in several directives,
to Metro Appliance.
Medici-ne Lake Bus Com an
Planner Overhiser distributed correspondence between the. Building
Department and the Medicine Lake Bus Company with regard to INFORMATION'
excess of vehicles on the site. They answered with an explanation
that they were in the process of moving several buses to a new
location.

Commissioner Chapman indicated that precautions maist be taken in BO. OF
platting land in order, that enough room for setbacks is allowed ZNNI
for all lots; he added that many existing corner lots are creating; DJUS NEflT_
a real problem with regard to the necessity for, and approval of REPORT
variance requests.
NOTION was made by Commissioner Hagen, seconded by Commissioner 3--21-73
Johnson, to approve the March ?1,, 1973 Minutes as printed. Minutes
Motion carried: unanimously.
