COMMISSION VILLAGE OF PLYMOUTH, MINNESOTA March 7, 1973 A regular meeting of the Planning Commission was called to order at 7:39 by Vice Chairman Kroskin in the Council Chambers of the Public Works Building on Wedttesd'ay, March 7, 1973. MEMBERS PRESFN'T.- Vice Chairman K;oskin, Commissioners Johnson, Hagen,, and Erickson IEMBERS ABSE;NT Chairman Wahl, Commissioners Threinen and, Chapman STAFF PRES:NT Martin Overhiser, Georgia Rebbein Aw45 Tri-State Auction Company TRI-STATE AUCTION' Planner Overhiser introduced the petition, indicating Site Plan that the site plan teing presented for an auto cxuction Review center includes the site south of Medicine Lake, zoned I--1 and a portion of land now zoned R-4. He added that the proposed Guide Plan retains this area as industrial and multi yrle west of the Creek and pointed out the area of the parcel cave, ed by the Bassett Creep flood Plain. He i ndi ca t-d that the petitioner has retained soil engineers and a hydrologist to desi gp. the Center and nas met with the Bassett Creek Flood Control Commissin`r staff Barr Engineering) to discuss the proposal, Planner Overhiser added that Barr Engineering does not believe any problems exist with the plan as presented, Pl annet# Overhiser indicated that all information ha -1 been routed to the Bassett Creek Watershed for review, and any conditions they might specify would be add d to the conditions for Village approval. Village Staff has recommended approval of this site plan subject to five conditions: 1) A Performance Bond be established for the executing of the proposed. landscaping and drainage plan; 2) Final drainage plans be subject to the Village Engineer's approval Required sXr,aet right of way be provided along the east side of the property; 4) Fire hydrant locations be subject to the Village Fire Chief ' s approval 9) That. Bassett Creek Watershed conditions be met. Commissioner Hagen questioned if there would be any outside storage of 'junkers' Uruve Pankon n, Site Planner for Tri-State, indicated there would not be and added that Tri-State would contract ,pith auto dealers to recondition and resell cars six months to one year old. As for the chain link fence surrounding the area, Mr. 'Panko.nn stated guidance Blas necessary as there would be no view of the site from north or south. Commissioner Erickson questioned how _'soon the access to the site would be upgraded. Planner Overhiser answered that until Nathan Lane is extended to 13th Avenue, the access will be prom 10th Aven,-, with Nathan Lane eventually being extended as a local thoroughfare Planning commission Minutes March 7, 1973, Mr. Pankonin indicated he would be willing to initiate a petition to have Nathan Lane extended,, Planner Overhiser stated a petition had been initiated, but the work had not been ordered., COMR,'-ssioner Erickson questioned if the parking should be set back further on the site plan as presented. Planner Overhiser answered that an 8G foot right of way was 'required, but some easements have been obta.in.edby the Village Attorney which the Engineering Department will coordinate. He indicated that final analysis, will probably Call for a 40 toot right of way on the Tri-tate site, with an additional 50 foot setback from that point.` Commisslo,,-er Erickson stressed that the fence would not adequately scrQen the parking area and stated that an additional berm or solid fence should be provided on the north side., He added that the 0XIsting tree cover along the north property line adjacent to the tracks could be retained. G. Sunde, hydrologist representing Tri- State,, explained that this area is a storage area for flood waters and any amount of fill into the Creek must be minimized because it has to be, replaced with 'replacement storage on the project. Mr. Sunde added that the railroad bed, a good 4 to 5 feet higher than the Tri -Sl ' ate property, would provide an effective visual buffer fot, the site. Vice Chairman Kroskin wondered whether any plans exist for the remainder of the parcel, Mr. Johnson, Tri-State President, indicated that at some future date he would perhaps develop the, R-4 area on the other end of the P.#APcel, but at this time the auto auction center is the only development planned. MOTION was made by Commissioner Hagen, seconded by Commissioner MOTION' TO Johnson, to recommeqJ approval of the site plan. far Tri-State RECGMMEND Auction Company svbject to the five conditions outlined by APPROVAL/ Staff. Motion carried, four ayes. CARRIED The _Narrowtla L NARROW WAY Planner Overhiser explained that the petitioner wishes Conditional to use a residence previously used as an office in a Use Permit B-1 zone for a counseling service. He indicated that the business will be offering for sale certain items from the facility, and the Zoning Ordinance requires that a conditictia.1 use permit be granted for any merchandising In- a B-1 District. Fred Rodman, Director of the facility, indicated that family and parental gu,ida.nce of an inter-denominatiaral nature would be provided, and that any items such as books or cassettes sold would be strictly in conjunction with. the co sling operation, as he has no interest in any walk-in business. Planning Commission Manutes -3 March 7, 1073 MOTION was made by Commi ss i or,., r Erickson seconded by [COTTON TO Commissioner Hagen,, to recommend approval of the requested RECOMMEND conditional use permit io Gell items incidental to the APPROVAL/ operation of the Narrow Way in a B-1 District. Minnesota Exteriors MINNESOTA EXTERIORSA-457 Planner Overhiser introduced the proposal, stating that Site Plan St. Paul Package Furniture Company had at one time prnposed and a facility on this parcel, He indicated that the current. Conditional proposal for an office/'display/storage business would Use Permit require site plan approval and a conditional use permit to operate in a 5-3 Service Business District. He added that Staff rerommends Plahning Commission approval subject to five cu,ditions-and variances, l) Petitioner grant the Village 27 additional feet of right of way along State Highway 101; (condition) 2) A front yard setback from Highway 101 of 35' be allowed, or 15 feet less than t iequi rel; (variance) 3) The storm drains be tied into the Village storm drainage system, with final plans subject to the Village Engineer's approval; (dondition) 4) A Performance forBond landscaping and drainage plan be executed and subject to Village Staff approval. wpecies and planting/mature sizes of trees and shrubs be indicated; (condition) 5) That, 14 parking spaces be provided or 9 less -thQn required. (variance) Commissioner Hagen questio=ed why a condition was being included that would require the petitioner to tie into the Village storm drainage system, whon policy on this matter remains unclear. Planner Overhiser indicated that in this case the storm sewer is available,, and with the proposed loading dock on the south side of the site, the petitioner desires to tie into the Village storm sewer; Martin Bennis, President of Minnesota Exteriors, indicated that his business would deal primarily in business exteriors or siding and that he was strictly a sub -contractor dealing with builders in the Twin City area, He added that the operation includes a swimming pool franchise which will be completed by 1974, but added that 1973 will be spent constructing -the building. He explained that this business would be an office and administrative building as business i_.t transacted primarily off-site at building locations. He stated that traffic generated is very slight, with approximately one semi a month delivering supplies. He assured the Commissioners that all storage would be inside. 0 Planning Commission Kinute _4, March T 197 Parkin .gas discussed with Planner ve;' r O rh ser explaining that. alth*ugh there is adequate room for additional parking spaces,. relocation of the parking area, wouldbe difficult because the building area is restricted by a power line easement over the west side of the property. He added that several parking alternatives had been considered, witr, the plan presented chosen as the most desirable. He added' further that a parking varianceof2-O" from the 751 setback from the residential area to the west of the property would be required to allnow for tho parking as presented. Commissioner Hagen pointed out that the driveway should be readjusted to provide a raoial entrance onto Merrimac thus allowing the driver a two -dray view. Mrs. Bruce Hag'eberg, resident to the west of subject property, questioned hours of business and whether there would be a buffer provided between the proposed use and the street. Mr. Bennis answered that hours would be from 7 a.m, to 5.30 p.m five- days per week, with possibly longer hours when the swimming pool operation reaches full-scale. He assured Mrs. Hageberg that traffic would not be increased as a result of the longer hours. Commissioner Hagen explained that a landscaping plan would be submitted to the Village which would provide adequate screening. Mrs, Edward Klein, residen.; of the property behind Hagebergs, wondered where traffic would exit. Planner Overhi'ser stated it would have to Merrimac, exit on as the Village will not allow any exit onto Highway 101., a major thoroughfare. MOTION was made by Commissioner Hagen, seconded by Commissioner MOTION TO Johnson, to recommend approval of the cond"tional use permit RECOMMEND to operate an office/display/storage business in a B-3 Service APPROVAL/ Buiness District and that the site plan be recommended for CARRIED approval subject to the five conditions outlined by Staff with two additions: 6) That a variance of ZO feet from the 75 foot setback on the west side of the property be granted to allow for the parking as indicated; (variance) 7) That the access be adjusted at the point where Merrimac bends toprovide a radial rather than an angular entrance onto Merrimac. (condition Motion carried unanimoxisly; Land Use Guide Plan_Map And Text_- FINAL RECOMMENDATION To Village Council The Planning Commission reviewed the March 2 Consolidated & ist LAND USE of .Recommended Guide Plan Changes; discussion produced the PLAN following changes to that Memo: MAP Planning Commission Minutes 1 , March 2 Memo) ; Soo Line Area March 7, 1973 MOTION was made by Vice Chairman Kroskin, seconded by Commissioner MOTION Johnson, to amend this recommendation to readt, "The area north of Soo Line the proposed industrial area be shown in an LA -2 category and the Area, area east of the West line of Section 8 extended to County Road 9 be changed from. IP Planned Industrial to LA -2 Low Medium Density Resi dential . 11 Motion carried unanimously. CARRIED 1,0, Aay-ch 2 Memo); Area of County Roads 10 and 18 KOTION was made by Commissioner Ericksonseconded by Commissioner MOTION Johnson, to amend this recommendation to read: "That the County Roads neighborhood shopping centerr be located on the north side near 10 & 18) the proposed trail, LA -2 shown up to County Road 10 southeast of County Road, 10 and Zachary, that the highway service be shown northwest of 10 and 1.8, that the limited business area be shown on the western side of the neighborhood shopping area proposed north of County Road 10, that the former neighborhood shopping area and limited business area be shown as LA -3 and that the trails be altered as noted on the work map," Motion carried unanimously. Planner Overhiser Peviewed action of previous meetings with regard, to the Guide Plan Text and outlined changes made at the Council meeting of June 29, 1972 with emphasis on significant changes relati,veto density calcula-,.ions, provision for open space and preservation of natural areas; designation of floodplains and trail and walkway systems, and limitation of development in are -as not served by public sewer. Following further discussion, MOTION was made by Commissioner Hagen, seconded by Vice Chairman Kroskin, and unanimously approved, that the following RESOLUTION be adopted; RESOLUTION CARRIED LAND USE PLAN TEXT WHEREAS, The Plymouth Village Planning Commission FINAL RECCOMMEN DAT ION has been duly created by Ordinance in accordance with Chapter 287 of the Laws of Minnesota to plan for the future guiding of deve'lopment of land within the Village of.Plymouth, an,d WHEREAS, The Plymouth Village Planning Commission has prepared and reviewed a proposed Comprehensive, Land Use Guide Plan for guJding the future development of the Village of Plymouth, and Planning Commission Minutes. 6- Parch 7, 1973 WHEREAS, duly advertised public hearings were held by said Planning Commission on danua.ry 1.0 and 24 of 1973 to consider comments and suggestions concerning the proposed Comprehensive Land Use Guide Flan, and WHEREAS,,this Commission is satisfied that the attzched recofantended Comprehensive Lind Use Guide Plan represents the views and judgment of this Commission relating to the matters involved, t,1OW, THERE.rORC, BE 7T RESOLVED that said proposed Co;mp7-,e',Pnsive Land Use Guide Plan for the Village of Plymouth consisting of a Report and Maps titled Comprehensive Land Use Guide Plan, Plymouth Village, Minnesota and dated March 7, 1973 be and is hereby adopted as the final recommendation of this Commission to the Plymouth Village Council it) regard to a Comprehensive Land Use Guide Plan" for the Village of Plymouth i attached hereto as Exhibit A. NOTE: Attached hereto as Exhibit B is a list of the 13 recommended changes and a map graphically showing the changes which the Planning Commission is recommending be made in the Map that was published for the January public hearings, General Comments 1) Commissioner Hagen stated he believed the Medicine Lake Bus Garage on 36th Avenue and Kilmer Lane should be checked for coupliance with the provi siotts for a non -conforming use. He indicated that a non -conforming use allows only a certain amount of expansion, bot this garage stores old buses. and junk outside, using every available inch of parking space, Planner Overhiser stated that Staff would contact Mie owner of the garage and added that the Village does have legal control if a non -conforming use is k-ing expanded 2:) Planter Overhiser reviewed Council actions at February and March meetings on proposals that had been reviewed by the Planning Commission. 03) Planner Overhiser outlined development in the Village - actual and potential 4) April ll 1973 was tentatively set as the date for the Planning Commission Special Meeting to review the new Zoning Ordinance. Planning Commission -7- March 7, 1973 MOTION was made by Commissioner Ericson, seconded by Vice.
