Vice Chairman Kreskin, Comissioners,Roth, Hagen, and Chapman MEMBERS ABSENT: Chairman Wahl, Commissioners Thr.einen and Keeley STAFF PRESENT: Martin Overhi ser, Georgia R'ehbei r Willow Ponds -- CUP for Temua o ry Sales Office A-_595 LUNDGREN BROTHERS Planner Overhi ser explained that this petition had been dealt with at the non -quorum meeting of December 20, 1972, and woal{d C)JP allow for one of the fi rs:t lots of Willow Ponds off Dunkirk for Sales to be used as a temporary sales offic, the development. Office Motion was made by Commissioner Roth, seconded by Commissioner MOTION TO Chapman, that the request of Lundgren Brothers Construction RECOMMEND Company to .occupy a,temporary sales office in the Willow Ponds APPROVAL development_ be recommended for approval subject to the developer complying with the usual restrictions and occupying this dwelling only until such time as the development is 85% completed, Motion carried with four ayes. CARRIED A-259 Jerome P. Begin _ Landfill (A-259 J.P. BEGIN Planner Overhiser briefed. the Commission with respect to Renewal of CUP` events concerning this request since the Commission had for Landfill reviewed it on November 1, 1972: He stated that in late November a Staff meeting was ;h.eld with Mr. Begin, repre-sen- tatives of the PCA and the County Environmental Section of the Public Works Department, the Village Engineer and himself. At this meeting, Mr. Begin agreed to take action to:, 1) Revise the February 7, 1967topographic survey their drawing #67-121, 8L-1-11) and put over the original topography the area and grades of the existing fill and the proposed final grades of the entire site; 2) Prepare an application and file for a ;perwit with the Pollut on Control Agency and include with the application .a target date for completion of filling the site, results of a test hole in the lowest area to determine the elevation of the water table, and all other necessary documentation with the application•, Planning Commission Minutes nuary 3, 1973 3) Prepare a brief letter to the County Board of Commissioners requesting ,a license from the County this letter would have enclosed with it the complete PCA application) 4) Send to the Village copies of above Items 1, 2 and 3.- A'rt-er this Staff meeting, and Communication cf DraLe-tuber 1, Planner Overhis er statedthat Mr. Begin contacted him on December 12 and stated that he did not wish to submit to. County or State for permits but wishes to come before the Village for only a renewal of his Conditional Use Permit under the 'Village Zoning Ordinance. Commissioner Roth questioned why Mr. Begin did' not wish to obtain the peri i is and what he had been dumping in his landfill Planner Overhiser answered that Mr. Begin wa,z concerned' about the cost of surveys as well as with the fees involved in obtaining County and State permits and that he had only been dumping trees and con- struction materials in his landfill, Occasionally trash is dumped and the Village has used the site for spring cleanup. Planner Overhiser added that the purpose of handling this matter at the present meeting was to poll the. Commi sdion as to w"bother or not PCA and County Permits should be obtained before the Planning Commission will consider this matter again, The Planning Commission concluded that they wanted Mr. Begin to obtain a County License and a Permit from the PCA before further consideration is given the request for renewal of the Conditional' Use Permit, A-445 Ronald L. Libby - Subdivision r -A-4451 RONALD L. LIBBY Planner Overhiser explained that the petitioner is asking Subdivision to subdivide the long strip. of band along Hemlock Lane. fie added. that in reviewing this variance to the Ordinance,, the Staff recommends that the Village require 27 additional feet of °right of way along the north and south sides of County Road 10, a public walkway easement along the al keshore 40 feet wide, and removal of the five cabins on the south parcel. before the lot is divided, Planner Overhiser stated that the Village views the five cabins as sub -standard and a non -conforming situation with five cabins on orae parcel. However, at the last .meeting, Paul Bakke, Attorney for Elroy Libby, asked that one cabin be left as, it was the home of his client. Commissioner Hagen questioned if requiring' a 40 foot walkway ease- ment was going to become standard procedure, and cited that this 0 had not been done in previous cases. Commissioner Chapman objected to the omission of Condition #2 requiring the 40 foot walkway easement,, stating that he did' not believe the request out n: f line. Commissioner Chapman moved that MOTION/ the motion be amended to include Condition 2. Motion was seconded FAILED by Vice Chairman Kros%i:n .and failed by a 1--3-0 vote (Commissione,- Chapman in favor; The original motion carried, 3-1-0, with Commissioner Chapman MAJOR MOTION/ opposed. C'hurch, CUP & Subdivision A-3 7 P'LYh10UTH BAPTIST Motion was, made by Commissioner Hagen, seconded by CHURCH Commissioner Roth, to recommend approval of the Conditional iise Permit which would allow °for two temporary trailer CUP for classrooms for a period of one and one-half years or Classrooms until July 1, 1974, MOTION TO Motion carried, four ayes. RECOMMEND APPROVAL/ With regard to the petitioner's request for a subdivision CARRIED variance to consolidate parcels :2030 and '2045 of Plat 445$ Subject to the dedication of a 60 foot parcel along the we * -,---L-. side of the property for street purposes, Pastor Terrey stated C{ubdivision that the Church had already dedicated 40 feet and that 20 additional feet would hit the car port and cut cuff one entrarnce to the lower parking lot. He requested that the Commission table this matter, until he had time to consider the effects of this requirement Motion was, made by Vice Chairman Kroskin, seconded by MOTION TO DEFER Commissioner Hagen, to defer this request until the January 17, 1973 Planning Commission meeting. Motion carried with four ayes. CARRIED A-434 55 Company - Rezoning from R -O to I--2 A-434 55 COi4PANY Planner Overhi ser indicated that this proposal involves two Rezoning R -O to basic concerns I-2 l) There should be a preliminary plat of the area in question so there is a clear definition of future parcels 2) Traffic circulation; would the proposed street be a public street? (Staff would suggest that it be a public street that would go north and east to tie in with the proposed Soo Line area..) Planner Over'hi ser explained further that the land slopes up to the north and the renOdential area sout.)i of 55 would have to view the site, Mr, $ergorson, t'he petitioner, indicated that the Bergerson-Caswell property will never be more than one piece of land and that if the land is ever sold he would make this a condition of the sale. He added also that he owned .several acres of land behind the property in question and in the future hopes to build townhouses on this piece_.. oConsequently, he stated that it would be unwise to operate any business that would devalue the property to the: north of the propised site. Planning Commission Minutes -6- January 3, 1973' Vice Chairman f.roskin stated that if this area is extended, he would like to see that i t. remain an 1-1 area, Motion was made by Commissioner Hagen, seconded by Commissioner MOTION TO Chapman, to d-fer action on, this 'rezoning request until after DEFFR the Public ,Hearings on the Land Use Guide Plan - tentatively rescheduling the next review for 'February 21, 1973. Motion carried unanimously.
