MEMBERS PRESENT- Vice -Chairman Krosk n, Commissioners Roth, Hagen Th ei'nenx Chapman, mana and Keeley MEMBERS ABSENT: Chairman Stahl STAFr PRESENT, Planner Martin Overhiser A-44 Electric Repair and Construction, Inc A-444 8 LECTRI C REPAIR Vice -Chairman Kroskin opened the Public bearing for the AND GONSTRUCTICN rezoning request, of Electric Repair and Construction Com Rezoning R -O to pany, Inc,, ai, 7.35 p.m, I-2 Panner Overhiser explained that the petitioner is requesting Public Hearing rezoning of 7.3 acres from R -O to I-2,- the property being l ocat..ed at the Northwest corner of Trunk Highway 101 and Medina Road. Donald Cole, President of Electrical :Repair and Construction Company, stated that he had ; a purchase agreement on the property that was contingent upon rezoning. Commissioner Roth questioned if the Staff had explained to the petitioner what the plans for this area are as the petitioner had indicated in one of bit comments that he ha.d. followed the Village procedure to the letter and that he therefore thought the request should be approved. Jean Barrett of Christy Realty, representing the landowner, stated that she had discussed the matter with the Staff and that they had indicated to her that this was not an industrial area; however, in talking to. home builders, they had told her that land was not suit- able for residential development There: being no further comments from the audience, the shearing was MOTION_ closed.. Taylor and ,PLAYHOUSE; Playhouse Company, Inc;. to rezone fY om R-0 to R-1, R-3, R-4, and I-1 based upon a Genera; Development Plan, Rezoning: R -O toR-1 Vitae -Chaff man Kroskin opened the ,public Hearing at 7,40 p..m. R-3, R-4 $ Delos Taylor, the petitioner, stated that he had purchased the property three years ago and had sold the northern portion Public Hearin of the property to the Playhouse Company. He indicated that if the property were rezoned that a new Playhouse Company building would be st4rted in 1973 and that the single family area would be started. He also stated that he believed that there would be more Mapledel l traffic going east through his property to get to Vicksburg Lane than there would be traffic from the R--3 area going west through Mapledell to get to Dunkirk, HaroldBirkeland, architect for tho petitioner, briefly reviewed the revised General Development Plan and stated that he had worked with the Village Staff in preparing the street alignments. Floyd 01 son of 28th Avenue Norte; stated that he had talked to the developers wbo own undeveloped lots in Mapled'ell and they were not oppose; to the proposed General Development Plan of Taylor and Playhouse Company. He stated that he has: been observing fvr some time the plans for the Taylor propert± and believes that the current request is acceptable with some minor ch-ange,s which the Planning Commission might want to make.. r,ed Rafferty of 2611 Black Oaks Lane stal"ed` that he was concerned a`x gut the traffic pattern and the, fact t,iat some of the multiple esidents might be going through Maplede`tl He felt that the traffic patterns should, be closely examined Timothy Bunn, 2951 Comstock Lane, questioned the street connections between. Vicksburg Lane and Dunkirk Lane by way of 29th Avenue. He stated that when Vicksburg Lara is closed from having access to Highway $5, and if Medina Road is not constructed between Dunkirk and Vicksburg, then there vroold_ be a large amount of traffic using Planning Commission Minutes December 6, 1972 Napledell streets in order to get over to Dunkirk Lane and up to County Road ZA in order to get onto Highway 55. Mr. Bunii also questioned- the access to Medina Road. Glenn Booker, 28,41 Comstock Lane, stated, that Otto Bo-nestroo, at a previous Council meeting, had stated that the Vicksburg overpasswouldbeconstructedwithinfi'veyears. Planner Overhiser stated that he, did not remember this statement being, made and that the State Highway Department has at this time no plans for building aVicksburgoverpassatHighway55, Commissioner, flagen questioned Planner Overhist„r as to some of the Staff reasons for having the streets connect between the Taylor property and the Mapledell. development Pla.o,ner Overhiser stated that the Staff had discussed the proposal with the Fire Chief and a representative of Fire Underwriters Insurance Service, and they both felt that we should have east -west circulation in thie', area between Vicksburg and Dunkirk Lane in order to maintain alternate Means of access to the residential area. Plannar Overhiser stated that it also was the Staffs' belief that east -west access should be provided through this area and then again through tha Wor-khous,: Property or the Village would end up with almost a mile and one-half long area between proposed Medina Road and 18th Avenue in Chelsea Woods without having any east -west connection for local circulation, between Vicksburg and, Dunkirk. By providing two or three alternative means of getting into or out of a neighborhood, it will be ensured that excessive amounts of traffic do not build up on any one of the local neighborhood residential streets. Commissioner Hagen stated that he believed that the northern east - west connection could, be closed off. Vice -Chairman Kroskin closed the Public Hearing and it was moved MOTION TO by Commissioner Keeley, supported by Commissioner Thr-einen, to ACT/ act on this request. at the present meeting,., Motion carried 5-1, CARRIED with Commissioner Roth voting naye.. Commissiorer Threinen questioned the park area as shown nnd asked that it be explained, Planner Overhiser stated that approximately 13 acres are required for a park donation. or cash in 111ou, of the 13 acres. It is the Staff's recommendation that the Village should accept the 8.6 acre park,, the 1.6 acre trail, and the 9.4 acre drainage and ponding are-a--k-TrDtal - 19.6 acres) as satisfaction of the 13 acre park requirement. Planner Over''Iser stated, that the Park and Recreation Advisory Commission would be reviewing 'the proposed park and open space area at their,-,,,,!,eetin9 of 12-7-72. Commissioner Thre-Inen also questioned the elimination of access to Vicksburg Lane from the R-4 area, Planner Overhiser stated that if the access to Vicksburg from the R-4 area is eliminated as Staff has recommended, then the General Development Plan for the R-4 area would have to be revised showing all access from Medina Road., Commissioner Keeley questioned Mr. Tavlor if lie would be the major developer Of the Property. Mr;,Jaylor, stated he would not be. CARRIED Mi.. - fid) honing ordinance Amendments AG -1 Y—) ZONING ORDINANCE Vice -Chairman Kroskin opened the Public Hearing with regard AMENDMENTS to ,,,ie following proposed amendments to the Zoning Ordinance: Public Hearing l) Section 17, Subdivision 1, Paragraph 6-a Advertising Signs 2} Section 17 Subdivision 3, Paragraph g; New Site Flan Feeof $25 S} Section 19, Subdivision 3 Zoning Variance Fee of $L5 4) Section 20, Subdivision 2 - Cond-itional Use Permit Fee of X25 5) Section 22, Subdivision 1 - Ordinance Amendment of Map or Text Fee of $100 There Being no one present wishing to be heard on these proposed amendments., the hearing was closed, Planner Overhiser stated that the Village Staff is reviewing all Fees fees within the Village Code and that in the latter part of December or the first part of January, a proposed set of new fees will be presented to the Village Council. The Village Attorney has recommended that we consider a new Section to the Village Code that would. set forth all Village license and permit fees. Therefore, the actual amendment to the Zoning Ordinance could make reference to fees as established by the Village Council it a certain Section of the Village Code, eFollowing further discussion, it was moved by Commissioner Chapman MOTION Planning Commission Minutes 5 and supported. b Commissioner Keeley,, tPpYY • Council that the following fees be est -a Attorneyy draft appropriate language for would not specify :the fee Mamount in the reference December 6, 1972 nd to the Villa5e and that the Village nq Orth nonce whi c zoning or_o_i_ x aqe Code., Site Plan - $2 Zoning Variance - $25 Conditional Use Permit - $25 Ordinance Amendment of Map or Text - $100 Motion carried unanimously, CARRIED Vice -Chairman 'Kroskin then opened the meeting for discussion of the proposed amendment to Section 17, Subdivision 1 Paragraph Signs 6-a "Advertising Signs" 4) No advertising sign or structure shall be located closer than two hundred (200) feet from the bona 'ary of any R-1, R-2, R-3, or R-4 district, park, playground, school or church ON THE SAME SIDE OF THE STREET OR INTERSECTION OF STREETS or two .hundred 200 feet from any structure located within an R -O district l-ocated on the same side of the street or inter- section of streets. .k* XXX _^ Proposed Amendment Commissioner Keeley stated tMa.t when the Planning Commission had previously discussed the amendments to the Sign Ordinance, it was the intent then that advertising signs would be set back 200 feet from a residential district boundary whether it happened to be the center line of a street or adjacent to a proposed advertising sign. Fo loviing further discussion, it was moat -ed by Commissioner MOTION TO Keeley, seconded by Commissioner Chapman, to recommend to the RECOMMENDVillaeCouncilthattheabove -proposed amendment to the MjU STATUS QUO Ordinance not be adopted and that the Ordinance be left as it now reads because of the following reasons 1) The intent of the original Ordinance was to figure the setback for advertising signs from the center line which would be the zoning' boundary; 2) Signs are not the same as a building and therefore should not be set as close to a residential district as a building might be; 5} If the proposed amendment were adopted, an advertising sign could be located within 166 feet of a residential structure figuring two 50 foot setbacks f v a 66 foot street). APPROVAL/ CARRIED It was suggested that the Staff prepare a more comprehensive form for persons td fill out who are requesting Conditional Use. Permits for home occupations, Commissioner Chapman suggested that the Village Staff review with the developers of the Tiburon Project the proposed parking areas for guest, and for overflow parking for residents of the Project. He stated that he thinks the guest and overflow parking for the Project is going to be inadequate and that parking would occur on the public streets, Commissioners Hagen and Chapman, in reviewing with the Planning Commission the matters which were discussed at the }-Homeowners Joint Council meeting of November 29, stated that they felt the Trail System would be of most interest to home owners, and should be very carefully explained at the public hearings, Commissioner Threinen stated that the Trail Committee has done an extensive amount of research and study on how the Trail System would be used and that he felt that private groups would be seeking trail easements for a motorized trail. (for snovimobiles) and might be requesting that the Village assume any liability for such a Trail System. i Planning Commission Minutes -7- December 6, 1972. Planner Overhiser noted that representatives o the. Trail Committee would be meeting with the Village Council on December 11, 1972 to discuss certain aspects of the TrailSystem and that Planning 'Commission members would certainly be welcome at that meeting. Commissioner rhreinen then gave a brief review of what the Village Tra.11 Committee has accomplished to date and stated that the Committee s working on detailed criteria as to how the Trail System would be used. Motion was made by Commissioner Keeley, seconded by Commissioner 11-15-72 Chapman, to approve the Planning Commission Minutes of 11-15-72.
