HomeMy WebLinkAboutPlanning Commission Minutes 11-01-1972i PLANNING COMMISSION' VIUAGE OF PLYPIOOTBI MINNESOTA November 1, 197 A regular, meeting of the Planning Commission. was called to order by Chairman Wahl at 7;21 p.m, in the Council Chambers of the Public Works Building on Wednesday, November 1. 1972 MEKBERS PRESENT: Chairman Jim Wahl, Commissioners Jim Threinen, Fran Hagen, and John Roth, MEMBERS ABSENT: Commissioners Warren Chapman and Rey Kroskin STAFFPRESENT: Martin Overhiser, Gecrgia. Planner Overhiser introduced the petitions stating that ML-Wws Staff" recommends that the Planning Commission recommend OFFT(,r.- =LDG Council approval subject to these conditions. 1) Petitioner relocate proposed building to maintain a 75 -foot setback consistent with Ordi.nazyce require- Site Plan rents Review 2) Petitioner provide the Village Engineer with a complete drainage plan showing site plan with 2 -foot intervals of topography; 3) Petitioner indicate size and location of identi ficat3on sign, 4) Two additional fire hydrants be provided; 5) The trash durrpster be housed in a stvucture attached to the huil,ding . Mr. John ;Belga,rde, the pe t,tioner indicated that. he would agree to conditions one, two, and three but believed one fire hydrant (condition four) would be sufficient Mr. Belgarde stated he would like to discuss this matter with the Village Fire Chief. As for condition five; Mr.. Eel.garde stated that if a masonry type structure to house the dumpster were provided, it would necessitate providing underground footings also. Chairman Wahl asked Planner Overhiser if this provision. by Staff was intended to follow an ordinance or if it was an aesthetic suggestion. Planner Ovorhiser. cited Page 80 of the Ordinance which calls for complete plans for waste and garbage storage areas in every site plan review. He added further that he believed Council intent was, to provide for something other than a dumpster setting in a parkil,g area - a poor view for second -story office workers: and ethers. Planner Overhiser also 'indicated that regulations in Planning Commission Minutes --2- November 11, 1972 all R-4 areas had been tightened to provide for one trash chute per every 60 units., Mr, telgarde indicated that he was ipilling to build a structure for the trashout of somet,ni,ng other than brick because of the footings., Chairman Wahl stated that lie believed - if camouflagingthedumsuercouldberegardedanadvantage ' , a ge t o the tenant the Petitioner should consider the request from the standpoint of his ability to rent the budding, adding that this was not really a land use consideration. Comm%ssio,er ;Hagen made a motion, seconded by Commissioner MOTION. TO Threinen, to a. prove the propos-al subject to the five RECOMMEND conditions as outlined by Staff. APPROVAL Chairman Wahl queried if Staff was assured that drainage would be accomplished before any part of the building was allowed to be built. Planner Overhiser an-,wered in the affirmative. Motion to approve with conditions carriled, all. ayes, MOTION CARRIED A =-2, 5- 90 J eroni; P Begin A- Z 5 JEROME P Big IN Planner Overhiser' stated that the petitioner wishes to renew .his permit to operate a Landfill. H„ stated that CUP for Staff has asked the Pollution Control. Agency and the Landfill County to make comments which will be forwarded to the Council upon receipt,, Chairman Wahl questioned if there had been any fixes in this area during the last year. Commissioner Threine stated that he knew the landfill had been ablaze at leash once during the past year but added. that these fires never really jeopardized anything, and at most were smelly and a: nuisance. Chairman Wahl wondered if there would be fires if' the stipulation for nightly covering were followed. Commissioner Threinen stated that he did not believe this stipulation, is. followed as there is never a bulldozer in the area. He added, however, that the area is screened beautifully by hills. and the only part of the landfill that t.*aiw be seen is the entrance, Commissioner Threinen stated that he believed this operation could be a violation of Objective S Criteria i of GOALS, OBJECTIVES, AND CRITERIA which specifies: "Provide adequav zoning to preventtheexistenceofanyindustrialorcommercial; endeavor which will through its operation create a hazard to the environment.." Planning Coammissioa Minutes November 1, 1972 Commissioner Fia en stt ted that he felt it a s theg „ , w h duty of the County or the Pollution Control Agency to regulate this tyre of operation. Planner. Ov:exhiser stated that the Begin operation has never had a permit from the County and that is the 'reason Staff has asked the County for comments;. He added that he believed neither the County nor the pollution Control Agency have jurisdiction over a, landfill that its not classified as a "san.itary landfill" and that perhaps the Staff will obtain copies of the State definition of "sanitary landfill.." Commissioner Thre;inen mado a motion, .seconded by Commissioner MOTION TO Roth, to defer action until such time as it is found that this DEFER landfill, by either County or Pollution Control Agency definition, falls under the classification of "sanitary landfill" and whether or not the Villarre Fire Department has record of fixes that could hake this operation a potential hazard in which case, Goal C, Objective 5, Criteria 7 would apply: 117. Require that any sanitary landfill meet all Pollution Control Agency and Hennepin County requirements and he located in an area which will not jeopardize future development of the Village." Commissioner Rothquestioned an occurence six to eight months ago on the site of this operation oil drums were leaking and the Pollution Control Agency was checking into the matter. Chairman Wahl stated that one of the conditions of the initial. Conditional Use Permit had been that there be no toxic wastes or, solvents involved; he added that he believed the Commission should have a report from Staff regarding violations of the initial conditions for the Permit and the conditions for this renewal 1) No garbage 5) Nightly covering with 2) No burning 61of "appropriate soil: 3) Attendant during open hours 6) Yearly permit 4) No toxic wastes or solvents Motion to defer action on the proposal at this meeting carried, MOTION all ayes CARRIED A-320 Chelsea Woods A-320 CHELSEA WOODS Planner Overhiser staged That the Final Plat for CHELSEA Final Plat WOODS was in conformance wi Planning Commission Minutes -4- November 1, 1972: Motion was made by Commissioner Threinen, seconded by 10-18--72.
