A regular meeting of the ;Planning Commission was called to order by Chair --
man Wahl at 7-,,,;4 p. -,n, in the Council. Chambers of the Public Works Building
on. Wednesday, July 5, IV 2,

The Public Hearing was opened at 7:54 p.m. COACEMAN CORPORATION
Pl;anne i Overhiser explained this is a rezoning request Rezoning R-0 to B -s
to B-$ Service Business for a parcel located at the
Southwest corner of Fernbrook Lane and Highway 55 lying PUBLIC HEARING
between the proposed service 'road and Highway 55. They
propose to build a 170 unit :note', service station,
restaurant and two other buildings as yet undetermined,
Lawrence Zamor, Excelsior, explained they are an Omaha PROPONENTS'
based operation and that this is their first venture into—
building. ntobuilding. The motel will either be a Best Western or a
franchise.
Tom Anderson, architect, explained th•:i>dilding will be
two stories with a swimming and recreation area enclosed
but rest of the interior area open;,
Duane 'Temple, engineer, stated they have discussed the;
Future plans for th,e Highway 55 and Fernbrook intersection
with the Highway Department and that it will be upgraded
at some time in the: future but plans are as yet indefinite.,
Mrs. Betty Anderson, 2505 Fernbrook Lane,, who owns proper-
ty adjacent to this parcel asked if this developnient mould
in any way affect her property. Gary Freund explained that
Circle Star Boulevard will be developed between Fernbrook
Lane and Niagara Lane and that she could possibly be
assessed for this street: but that the developer would be
required to put it in as part of the development.
The Public Hearing was closed at 5:10 p.m.
There being no motion for action, the subject was referred
to the Committee of the Whole Toi further discussion,

Gary Freund explainQd they have had discussions with Mr.
Osterby of the State Highway Department and that the
intersection of Fernbrook and Highway 55 will: be signalized
at some time n the future along with the intersection of
1-494 and Highway 55. For this reasoiZ they requested the
deceleration sane: ant ingress drive from Highway 55 to
lighten the load on the ferebrook intersection. He in-
dicated the Highway Department will allow this at the
present time but that future plans are ixdefinite,,

Planner Overhiser explained the petitioner is asking CA_RLKO COMPANY, INC.
for a rezoning of a residential lot to B--2, this lot
being located at the, Southwest corner of Highway 55 Rezoning R-1 to B-2
and Cottonwood Lane, The lot lies directly west of
an existing B--2 district and would extend the commer- PUBLIC HEARING
cial zoning across Cottonwood Lane. The proposed use
is for an office for the sale of school furniture with
some display
Commissioner Threinen pointed out the proposed Guide
Plan sets this area out as LA -3
Donald Carlson, 6400 Barrie Road, partner in the busi- PROPONENTS
ness, explained that 95 percent of their business is
sales to schools. They do not encourage people to come
to their, offices. He pointed out that the present use
for the house is as a. two family residence. He felt
their business would creat* less: of a parking; problem
than the present use does, and he pointed out they ham?`
no intention of changing the outside appearance of the
house other than painting.
Commissioner Keeley pointed: out that -there is quite a
bit of office space available in the Village plus com-
bination, office --warehouse complexes and asked if they

had: considered such a location. Mr. Carlson stated
it was not the type of atposphere they were looking
for and that it would be too expensive for them,
John E. Kohout, 2016 West list Street, the other owner of
the business, explained they* do not get into warehousing
but that the factory ships orders directly to the buyer.

the neighbors.
Van. Kardashian, 1015 Ives Lane, stated he was concerned OPPONENTS
that as the: business prospered they would make improve --
meats to the building which would change the outward
appearance of the house. He also was concerned that
if the land was zoned commercial it could be sold at
some future time to another conct rn who would have
different ideas than the current petitioners.
Al Hohbein 1020 Ives Lane, pointed out there are plenty
of areas of commercial property in Plymouth at the
present time, and he feaved zoning this lot commercial
would encourage additional rezoning west of Cottonwood.
Georgiana Friedman, 1010 Ives Lane, stated she wouldn't
object to the rezoning if it was limited to this prop-
erty but also feared further rezoning of the residential
areas surrounding this lot.
Harvey Schiebe, 1215 Goldenrod Lane, stated he wase not
opposed to the rezoning but was concerned about taxes
He owns property to the west and felt all this land along
the highway would probably be zoned commercial at some
time in the Future as it would be undesirable to build
a home next to a highway.
Bud Risberg, 710 Cottonwood Lane, stated there is plenty
of room east of Cottonwood Lane for this type of use and
felt this would harm, thein houses on Cottonwood Lane
The Public Hearing was closed at 800 p,m.
Motion for Action made by Commissioner Kceley, seconded
by Commissioner Threinen. Motion passed 4--0.
Motion made by Commissioner Keeley, seconded by Commis- ACTION
signer Threinen, to recommend denial, of the rezoning
request for the following reasons MOTION TO RECOMMEND
DENIAL
1. Further stretching of the commercial district
to the East of this property would create
additional traffic congestion and would encourage

other property owners along the highway to
petition for .zoning changes which would create

2. The proposed change is not compatible with es-
tablished land use patterns inasmuch as single
family homes adjoin the petitioners' site on
the Wast and South.
8. The change would be a deterrent to the improve-
ment of development of adjacent property with
single fam*"ly homaQ.1gners often reluctant to
live next to busin:e;s uses.
4. The property can be used in accordance with
existing zoning regulations
5. There are. adequate sites for the pro,osed use
in other disIvicts in the Village permitting
such uses.
Motion to recommend denial passed 4-0.

Planner Overhiser explainedthe petitioner's proposal J. BERNARD HELLER
is to subdivide his existing parcel into two parcelst Subdivision V ari anee
Parcel 1" of approximately 73,600 square: feet and
Parcel.. 21' of approximately 21,700 square feet. The
petitioner dishes to sell "Parcel l" and retain "Par-
cel 2," site of his existing house;
Commissioner Chapman questioned whether or not the
petitioner could: get a building permit for Parcel
as he felt it would qualify as a flood plain. Planner
Overhiser stated the Department of Natural Resources
did not look at this parcel as being part of the Lake
Commissioner Keeley stated he felt it was foolish to
have contiguous land on two sides of a. street and that
the subdivision should be granted,
The petitioner explained than "Parcel 1" had been
filled in by dredging the lake with a permit from the
Department of Natural Resources. The present elevation
at shore line is 890 feet,
Motion made by Commissioner Threinen, seconded by
Commissioner Chapman, to recommend approval of the

Commissioner .'hapman stated the station is not kept
up now, and: he felt the use should not be enlarged,
Chairman Wahl palled the Commissioners if they would
object to a facility where traffic would drive in aix d
bac: gut the same: front entrance.. All agreed they
would not object to this type of operation.
John Dygstra stated they 'had landscap wg plans for
the near of the btiAlding which would grt..tly improve
the appearance of the station. Commissit er Chapman
pointed out that the.e, e proposal was. maci when the
station was built, but that: the landscaping; was not
done and the grounds are not kt'-pt up. Mr. Dygstra
stated the rear entrance would allow them ,*o stack up
to 12 cars at a given time and eliminate tnaffi.c con-
gesticn in the front of the building. '"ilairman Wahl
stated he felt this would oontribil+p .o the noise
problems of the neighbors.
Motion to recommend denial passed 4--0.

multi-purpose athletic field house (community service
building) which would seat approximately 900 people. Conditional Use

Commissioner : ,:ley asked what would happen to the
two existing hockey rinks. Mr. Gavarae indicated one
would be relocated on the high school property -end
the other moved to Birchwood School.
Commissioner Chapman questioned the exterior finish of
the building, They indicated the hockey association
was proposing a metal building but that the school
board was thinking in line of concrete h1-)ck.

Commissioner Chapman stated he objected to the con;-

stated he did not feel the Village could prohibit a
metal building if the State Building Code allows it.
He also stated he did not think some metal buildings
were objectionable.

Proposed Amendment: to the Zoning Ordinance PROPOSED AMENDMENTS
TO2Ohi1NNG ORDINANCE
The Village Council at their June 19, 1972 meeting
did direct the staff to p,epard a solution to the Parking in 1-1 Dist.
interpretation problems involved in this: section of
the ordinance and to teen discuss the proposed solution
with the Planning Commission prior to further consider-
ation by the Council.. TI -e staff's proposal would
prohibit parking in any front required setback area
lying between the side lot lines. This Mould allow
parking between the required setback line and the
building itself if the building" were set back further
than tae ordinance requires,
Commissioner Cha,pm> a stated he felt it was appealing
to see a building with Ao parking in the front of the
building. Commissioner Tbreinen stated he d d not
find parking in front of a buildin. g objectionable if
the required setback area was a green area.
Chairman Wahl polled the Comissioners as to -their
interpretation .of front ;hard. All agreed they inter- nterpretedpretedfrontiyardaslyingbetweenthelotlines.
Planner Overhiser pointed out that the ordinance
defines front yard as being between the side yard lines
only and not between the side lot line and that is part
of the confusion.
Chairman Wahl stated, he felt the problem could be
sol..ed by changing the definitions of front, side and
rear yards to conform to the front yard following the
front line of the building from lot line to lot line.
Planner Cverhiser felt thi- might create, problems in
other sections of the ordinance. Commissioner Keeley

stated he felt it would be easier to make ametdments to
this 1-1 section rather than changing the definitions,
Conmissioner Keeley stated he agreed ,that no parking
should be allowed in equired front yards but felt some
allowance should be made for v'isitcv parking in, that
area possibly on a ratio basis to the size of the
building.. He also felt by prohibiting parking in estab-
lished front yards (between 'the street and the building)
the Village would be forcing developers to increase the
size of their lots.
Motion; rade by Commissioner Threinent second by Chair- MOTION TO DEFFR
man Wahl to defer action on this matter and refer it
to the Committee of the Whole for further discussion.
Motion passed 3.-1 with Commissioner Keeler opposed.

Cates the petitioner has met all of the conditions Site Plan approval
set forth by the Planning Commission at their June
7,j 1972 meeting.
Commissioner Chapma:.'1 asked Planner Overhi er if he
felt this area woul: be defined as a flood plain
area. lir. Overhiser stated that the Bassett Creek
Flood Control Commission has set up a management
area along„ both the Plymouth and: Bassett Creeks but
that this area is not called out as past of this
management area.
Commissions Chapraan pointed out that the entire area
to the South of =this property and East of Sunset Hill
School drains into this property. Commissioner Keeley
pointed out that the Village has criteria which states
that nothing can be built on a flood plain.
Motion made by Commissioner Keeley, seconded by MOTION TO RECOMMEND
Commissioner Chaprnan ta recommend apiaroval of the APPROVAL
site plan as resubmitted but express to the Village
Council the Planning Commission's concern about the
suitability of the land in question rulative to its
existence adjacent to or possibly as a part of a flood
plain. Approval is also Conditioned on th6, dedication
of 17 feet of right -cif -way Lo the Vil.lagi and the
provision of the required park donation prior* to a
building permit being issued, Votion passed 4--0,
