A regular meeting of, the Planning C:c";li,ssion was, called to order by Acting Chairman
Reg Kroskiin, at 7-435 p.m, in the Conaacil Chambers of the Public 'Works Building on
Wednesday a May 1.7, 1972.

Palmer Xvalness appeared on behalf of the Petitioner requesting a GW COMRATION
subdivision variance to divide a parcel, of 3.9 acres located at
the Northeast corner of Lancaster mane and 10th Avenue into 2 par- Subdivision Va-iance
cels,, i.e., Parcel. "A"" of 2.1 acres- to the North and Parcel "B" of
1.8 acres to the South,, Serving, as the primary boundary between the
2 parcels would be a spur line- of the Chicago Northwestern Railroad.
Mr. Kvalness explained that they, purchased proposed Parcel B from
the railroad for the ,industrial site previously approved by the
Planninj, Gom.i.ssion and Council; however, the tmc records still
show one parcel of record. Parcel B is still the same size parcel
as previously reviewed with the s=ite plan. The Petitioner also owns
the 1 acre Parcel to the Ulest of Parcel. B. the railroad i, retain -
Ing Parcel. A, and road ea=sement is through the property to the east
adjacent to the frontage road of Cotunty Road 1 which they also own.
Egress to Panel. B would be directly from 10th Avenue. Commissioner
Aoth stated he felt at should be ou'r responsibility to deteamine
that the property to the east is in .fact owned by the Taalroad .so
that an unnecessary - burden is not placed on the owner of Parcel A by
landlocking it.
Motion, made by Commissioner Keeley, second by Commissioner Roth, MclTION TO RECON REND
to recommend approval of the subdivision variance~ to divide the APPROVAL
subject proptrty into Parcels A and. B as shown on the sketch dated
5-12-72 known as A-392 subject to the following two conditions:
l) that it be determined that the owner of Parcel A is the same
as the owner of all property immediately East of and adjacent to
the fxontag;s road on County Road 18 and (2) that the easement
granted to Mannix Construction Company be vacated. Motion, passed,

Arch l ect Donald Green appeared on. behalf of the Petitioner along QU- Ca PANY
with Mr. Green requesting site plan approval .and a Conditional Use
Permit to construct a 33,000 square foot building for sheet metal Site plan; Approval
fabrication in a planned industrial district located: at the South- Conditional Use
east corner of Niagara Lane and 23rd Avenue. Permit
Planner 'Overhiser pointed out that the 71 parking spaces shavn on
the site plan is 16 spaces less than the required number but that
it is the staff's recon nendataan that a. variance be granted for
these lE spaces because they are not needed.
Mr. Green explained that all loading would be done inside with the
possibility of an outside loading dock being added sometime in the
future. He painted out that there is ample room to expand parking
to the rear of the building if it becomes necessary.
Commissioner Roth questioned the 2 different iddths of driveways
shorn, and it was determined that there is no standard for width
of driveway cuts in the Village
Motion made by Commissioner Keeley, second by Commissioner Hagen, MOTION TO RECM4W
to recommend approval: of the site plan and Conditional Use Permit APPROVAL
granting a variance of 16parking spaces. Motion passed 5-0;

The Council requested. that the site plans be approvred prior to Apartment Project
considering 'the final. plat. The Coimr fission was asked to revi w Site Plan Approval
the site plan fpr the apartment project only at this meeting.
Planner Overhiser indicated the Council has decided not to order
a publivc storm sewer project for this area and has directed the
staff to work with the developers in this area. (Schiebe, Super
Valu and Continental. Contractors) for these 3 developments to
provide their own storm sewer pipe to the Pane Tree Pond and share
the cost of the project. Commissioner Kroskin questioned why
the water, runoff was being taken into the lake and not being
handled in a facility on their oxn land. Planner Overhiser indi-
cad ed this had been discussed, but the staff felt there would be
legal problems involved requiring the dev°elcpeti; to store then
own water runoff,
Commissioner Keeley stated he did not like to sea the people who
are already living inthe area subjected to the recreational
noises;. He felt the recreation area should be swallowed up in
the project rather than on 13th Avenue. Planner Overhiser ind-

Gated there is a request before the Park Commission regarding the
park dedication requirement on this project, and. there is some;
discussion to having .a parlmy along Lhe pond. Comni:ssioner
Kroskin stated he did not Feel it was a disadvantage having open
area adjacent to the existing residential rather than a row of
build -Ings,
Mere followed discussion regarding the Council's request that the
buildings be moved back 17S feet from the southern property line.
The site plan shows buildings set b«-*% only 135 feet.
Ake. Stenquist, stated it was still their intention to proceed in
3 ph ses. Mien questioried regarding the timetable for the con-
struction of the amenities, he indicated the cost would have to
be a ortized over the entire project. Asked for clarification, he
stated the first phase would probably include the recreational
building and the swi.m=- g pool but that they Goold not definitely
state this: would be so at this time. her. Stenquist stated he had
no objections to switching the location of the pool and recreational
building around,
Commissioner Threinen asked if the condition previously placed on the
3 developments in the area that a solution to the storm sewer, problem
be fomd prior to any building permits being issued could be con-
sidered satisfied by the plan discussed earlier. Planner Cverhiser
stated he felt the Council considered this to be an acceptable solu-
tion. Commissioner Roth asked what engineori.ng had berm done rem
garding the drainage into Pane Tree Fond.. Planner Qverhiser
explained that the only report available is the preliminary report
for the entire storm seer area.
Comissioner Kroskin asked what the significant differences between
the General Development Plan and the present site plan were. Planner,
Overhiser state) there is some reorientation of the buildings but the
number of units (320) is still the sane.
Commissioner Keeley stated he felt the planting key should indicate
exactly what size trees were proposed to be planted and that as mmeh
of the hedge row on the west side of the property should be retained
as possible.
Mr. Stenquist showed the garage plans to the Commissioners and indi-

spaces but that it will possibly be increased to 116 spaces as the
cost is approximately the same
Cornnissioner Keeley questioned the placement of the putting greens on
the right-of-way .strip leading to the property to the west.. Planner
Overiuser indicated there has to be an easement and: than it would not
be used for street until such time as the property to the Fest needed
it F1a also indicated that all the right-of-way is shown on the final
plat mld that there wall probably be a street improvement project in
the future which the staff is working on at the present time but
that no Council action has been taken on the subject.

The site plan for 'the Murphy Oil Company as revised following the INURPHX OIL CUNTANY
April 19, 1972 .meeting was reviewed. The plan showed one driveway e
on :Onium lane 100 feet South of Highway 55 vnd 2 driveways off the Subdivision Veri,ance
proposed access road along the South side of the property. Tie el Conditionfsl 6,;e
Easterly drive on the South side of the property is less than the Permit
S0 foot minimum setback from another street; however, Planner
Overhiser explained the staff felt this variance was acceptable be-
cause the petitioner has agreed that the driveway on Xenum Lane
could be considered as temporary and eliminated at a future date
when the traffic volume warrants.
It was pointed out that the parking on the West side of the property
was closer than 50 feet from the street and that the corner of the
building on that side was only 13 feet from the street. The canopy
over, the pumps was also closer than 50 feet to, the street.. Clarence
Dillma;A representing Murphy Oil. indicated 'these changes would be
made to conform to the Ordinance,
Commissioner Kroskin Questioned Planner Overhiser why the variance
for the location of the Easterly driveway on the South side wars
acceptable to .staff. 1 -4 --explained that they felt service stati,oiis
do not create a high volume of traffic and that it Was acceptable
because of the agreement to abandon the driveway to Xenium. Com-
missioner Keeley started he felt that When the driveway was closed
the other two driveways should be marked ars one being an exit and
the other the entrance. NIT. Dillman explained that the exterior of
the building would be brick on concrete block and that although i.t
did not appear on the site plan they usually enclose their trash in
a brick enclosure behind the building.

issue a Conditional Use Permit for the petitioner subject to the
foll,owti.ng conditions
The building be IS feet removed from the West property line
andthe canopy and main structure be a minintaun of 50 Feet
off the right-of-way line for Xenium Lane and the proposed
street.
2. The plot plan. be expanded to include the trash handling
f aci,lity .
3. Parking 'be elhninated within S0 feet of the right-of-way
line on the 2 above mentioned streets.
4. "i:rectional signs be indicated on the Southwest exit as
being an "exit".
S. Village receive adequate assurance that the driveway on
Xeniu,m Lane will be closed when the traffic volume Warnrants.
Commissioner Threinen asked for clarification of condition #S.
Planner Overhiser indicated a traffic engineer from Bonestroots
office w.1-11 study the prohlm and an agreement will be made before
the petition goes to the Council.
Commissioner Moth asXed what action had been taken by the Cowrnclon
the nterciiange, and Planner Overh4ser indicated they had taken no
action because of lack of comm ttment by the State.
Commissioner Kroskin stated he had reservations about the number of
gas stations and their trying to tit onto a piece of ground unsu-it-
able for a service :statim.
Motion to recommend approval passed 4-2 with Com.,issioners Rooth and
Yxoskin opposing.:

felt the Planning Commission had made their position quite clear
previously; however, Commissioner Roth pointed out that this recom
mandation was contingent upon Nedina Load being linked 4q th 32nd
Avenue, but, the 11noroughfare WWe Plan adopted; by the Council
shows Medina Road linked with 31st Avenue
The staff recommended the following rezoning:
1., 1-1 zoning Horth of Medina Road (according to Thoroughfare'
Gide Plan alignment
2 R4 zoning east of h apledell Addition, west of drainageway
and south of quarter section lane of Section 20. Density
of 2 units/acre

Com" i ssioner Keeley said he agreed with recommendations 1 and: 2 butfelt #3 should be R rather than R-4. Commissioner Roth stated
he felt this size industrial, building with the number of semi -tracks
this business draws, belongs in an industrial park and should not be
ercroached upon a residential area. He quoted the Goals, Objectives
and Eriteriawhieh .stated that tha best away to cut off industrial isbyamajortho'roughfar, and therefore the industrial zoning shouldnotbeallowedtoexpandfurtherwestthan. Vicksburg. There followed discussion regarding whether they were referring to: the Comprehensive Man for the entire Village or the specific areainvolved. Comn%ssioner Threinen stated he wanted to see the plyfortheentireVillage. Chairman Wahl, stat,d he felt that if the

prior to the. Comprehensive Plwi as all Land around this area is

It was agreed that the pred= direction given by the Planning
t nn ssion must be revised because, of the rea.,lign6nt of lWina
Road. There followed discussion regarding the 1969 pamphlet referred
to by,,'apledell residents at the public hearing which stated Vicks-
bvTg would be the dividtag line between industrial and residential.
Carf issioners Haryand xoskin stated the7 cckdd not recall such a
publication or direction from,, the Village, and there was no, docu-
mentation of the existance of such a publication,.
Commissioner Roth seated; he does not feel the Village is in a
position at the present time where it must encroach upon residential
areas with industrial development. There is ample industrial area
in the Village, and ttvre belhg planned.

Lake was set out as IA -2. Planner Overhi.ser indicated this is an
isolated; area and they kanted to give the developers as much lee-
vay as possible. The Commission ers felt; this was out of context
with the surrounding uses.
Thee followed discussion regarding coordinating water distribution:
plans, sani.tarr sewer plans, storm suer plans, etc. with the
Comprehensive Plan.

on the lakes, and the Commissioners were in agreement with this

Chairman Wahl, reported he has submitted his resignation from the
Planning Commission because of his new position with B, -,DL -..r Builders,
Inc., I* stated the Mayor has requested him to remain on the Plan
nand Commission until the Comprehensive plan is finish: and asked
if any of the Commissioners had any objections to this. All. Com-
missioners present expressed: agreement with the Mayor's request.
