A regular meeting of the Planning Commission was called to odder by Acting Chairman
Reg i roski.n at 7.40 p.m, in the Council Cax6ers of the Public Works Building on
Wednesday, May 3, 1977.

A Public Hearing was held to consider the rezoning request of PLAM-RUSE U11PANY
Delos B. Taylor P-r:d the Playhouse Company. The Petitioners
propose to rezone an area of approximately 131 acres Southwest Rezoning from R -O
of I- ighway SS anti Vicksburg- Lane from R-0 to 1-1 to the Nt-rth, to R-1, R- R-
R-1 to the }kst ' oini g Mapledell and R-3 and R-4 for tho,
remaining area to ifte East along Vicksburg.
The Public Hearing was opened at 7,40 pm. PUBLIC HEARING
Planner Overhiser explained that the Planning Commission has
denied the Petatior , l s rezoning on this property on previous
occasions, the last being in December of 1971. Following this
denial, they were given iui.dance to the effect that I-1 should
be limited to the area North of the proposed *,diva. Road: and
that the over-all density of the residential area should not
exceed 4 units per acre with 2 units/acre density West of the
creels, 4 units/acre dengit r to the East near Vicksburg Lane and
6 units/acre density to tlae earth near a Road.Ie pointed
out that the pres.(°nt propos*l, has an over-all density of 6 units
per acre.
The staff recommendation was to approve the R-1 area zoning but
not necessarily according to the platting shown on the plan
They recommended that the 1-1 area be limited to the area North
of proposed. Medina. Road, and they recommended that no action be
taken on the multiple residents at this time with the suggestion
that the Petitioners reduce the density 'to 365 units in this area.

Architect Harold Birkeland presented the Petitioners plans to PROPONMTS
the Commission. He stated he felt the R--1 area was laid out
according to the Zoning Ordinance and should be acceptable. He
pointed out that the density in the miltiple residential area
also does not exceed the regulations of the Zoning Ordinance ir-
regardless of the Planning Com.,i ssion and Council reconmendati.ons.
He explained that they have triad to align the project to the
natural topography of the land.
Timothy Bunn appeared representing the Mapledell residents, Be OPPONPNrS
said itwas his impression that the Council had not finalized
the place,imt of Medina Road He pointed out that the present
plan shows more units than the previous plans which were rejected.
This plan does not provide the necessary transition from Shenan-
doah because this density is higher than Shenandoah. He felt
Vicksburg is a natural barrier for industry to be limited to the
Bast. With all of the open space available in Plymouth, he felt
itis not necessary to place industry and apartments in this area;
and the placement of the industry and apartments are such that
they will look down on Mapledell. He does not agree with the
xecomnendations of the Planning Commission ani Council and felt
the additional traffic from the R-1 area into Mapledell will both
cause traffic problems and lower prcperty values.
Al Sjoberg, 16500 29th Avenue North, told the Comini,ssion that as
late as 1:969 there was an official pamphlet of the Village which
specifically stated that Vicksburg Sane would be the dividing
line. Ile stated three points of concern: (1) they moved to
Plymouth to get away from factories and apartment buildings; (2)
traffic problems will be created by the street layout as none of
the streets exit onto a thoroughfare street; and C3) A'tapl.edell's
property values will drop, He pointed out that of multiple
residence is approved in this area it would be natural, for the area
to the South also to be zoned multiple which would isolate Maple -
dell.
Planner Ovverhiser informed the Commission that the density of
Shenandoah was between 10 and 12 units/acre.

A Public Hearing was held to consider the Preliminary Plat rf ROGER L. JgINSON
Roger L. Johnson who proposes to subdivide a parcel of approxi-
40 mately 8 acres into 15 individual lots for single family homes. Pteliminary Plat

The Public Nearing was opened at 8.22 p.m, PUBLIC AHMING
Planner Overhiser located the plat for tl,-, Comission and pointed
out that it would connect in with the flughos Addition and that the
property is zoned R-1.
The Petitioner was present and explained the Plat to the Commis
sloe. There was discussion regarding the existing house and its
location with reference to the increased right-of-way for Ha.ghway
101
Planner Ovexhiser explained that the Council did approve a temp
orary lift station for the area and that a preliminary engineering
report should be ready ithin a fear weeks.
There being no other proponents or opponents: to the preliminary
plat,, the Public f-Iearing was closed at 8:30. PUBLIC IMARZNG CLOSED
A IMotion for Action was made by Commissioner Neeley, second by MOTION FOR ACTION
Commissioner Chapman. Motion, passed. 5-0.
Motion made by Commissioner Keeley, second by Commissioner MOTION TO REMMND
Threinen, to recommend approval of the Preliminary Plat subject APPROVAL
to the provisions that (1) an additional 20 feet of right-of-way
be dedicated on, the West side of Highway 101, (2) the property line
North of the existing house be relocated to provide the mininnnn
1S" foot setback required by Ordinance, (3) a variance be granted
to allow the existing house's improper setback from Highway 101
to exist, and (4) it would be preferrable that ac telopment should
be held,up until such time as sewer is available 'to tzarsite.
Motion passed 5-0.

acre parcel owned by 4'T. Koop contingent on Village approval, of F, PATRICK IYEIIS

7,1,978 square feet) . Access to the rear lot would be via a Subdivision Variance
private driveway running on a North-South aligrmrent intersecting
County Road 24 to the North Mr. Pat WbIls was present represent-
ing the Petitioners.
Planner Overhiser andric ted it was the staff xeconinendation that
the ;subdivision variance be approved subject to S conditions.

Chapman, to postpone action on the subject until we have: had a

Cotnanissioner Keeley stated the 978 foot high water marl- established
by the engineer v ss -not accurate as the water level is higher than:

as a result of this. Mr. Pratt said he did not feel this was a
relevant argument for reducing density as the Zoning Ordinank,
does not set out provisions for parcels which are partially ender

There followed discussion regarding which was the front and rear
yards and if variances were necessary for setbacks. pix. Pratt
explained that the road would be under joint ownership of the
residents,, not a homeoumers association.
Carl Steinnagel asked to speak representing the homea lnners in the
area and referred to the petition presented at the :public Hearing
on April 5, 1972 and the conditions they asked by included one of

also asked that a condition be made that the owners could not alter
the natural condition of the west bank of the pond. It was agreed
that it was unreasonable to place this restriction on a private
land oim.er.
Motion by Commissioner Keeley, second by Connuissioner Roth, to MOTION. TO RECWBM
reconnlend denial of the xezonixng request subject to a now plan DENIAL
showing no more than 5 units encompassed in 2 buildings. Motion
passed 342 with Conudssioners Chapman and Kroskin voting against.

Threipen, that a commnication be sent to the Council indicating
that his intent was improperly stated in the minutes recording
hi.s motion, which was seconded by Commissioner Threinen recom-
mending approval, of the Preliminary- Plat for .Belmar's Plymouth
Industrial. Park Condition, f4 (page 6 of the: minutes) was
intended to require a 30 foot roadway easemmentrather than a
driveway entrance on the North edge of Lot 1, Block 1. Motion
passed 3`a with Commissioners Chapman and Kroskin abstaining
