second Public Hearing on the propos,; ,* Ordinanc winnding the
Zoning Ordinance with particular reference to multiple dwelling
units because of the fact that several developerssere out of
torn at this: time: of tJie first Hearing on January 26, 1972.
The Public Hearing was opened at 7:40 p.m. PUBLIC HEARING OPENED
The only individual appearing to speak on the subject was Jay
Carpenter of Tian Con, Inc. His points of concern urere set
forth in a letter dated April 3, 1972 to the Village, and his
presentation at the Public Hearing was from this letter. This
letter is marked E G IBIT A and incorporated as a part of the
minutes of this April 5, 1972 meeting.

Tree Fond. west of Schiebe"s, Oakwood Addition. Planner Over Rezoning from R-i to R-3
hi.ser explained that the petitioner is proposing a 10 tuut pro-
ject to be built an the IA acres of the parcel which is above
the sigh eater level,

M Roger Freeburg of Tines Architects presented the Site Plan .for PROPOM
the proposal. lie ea .Rained that it is a difficult building site
but that this propos dl would leave the site in as natural a
state as possible. Access would be from Peony and, lazwlerley Lane.
The, parcel, would be divided into lQ Lotss with no c(rmcon, owned
land.

dents of the area along with If. i -i.. Williams, 181.35 lath Avenue,
Kurt I-Iellberg, 1420 Ranier Lane and I,yron, Christopherson., 1.245
Peony Lane. Mr. Steinnagel, presented a petition signed by 27
residents. This Petition is marked. EXHIBIT B and attached as a
pa.rt of the minutes of this April S, 1972 meeting. They stated,
they were opposed to the density of the project and would like
to see it reduced to no more than. 5 units.
Mr. Freeburg stated lie felt that 16,000 square feet per unit is. REBUI1AL
a very lour density for the area and. brought to the Commission's
attention that there would'be a ZOO foot strip of open land
adjacent to the property on the east

A Motion for Action was made by, Commissioner Roth, second by MOTIM FOR ACTION

Builders, Inc.) and R. F. Kroskin for app'roximatel.y 9 acres of
land located at the northeast corner of the intersection of
Fernbrook Lane and County Road 6 Belmar Builders has an option
on all but approximately 2 1/2 acres at the southeva end o:E the
property. The remainderwill be included in the Belmar Indus-
trial Park (see next Public Tearing)

Planner Overhiser explained that the Central ,Area Guide Plan
called for high density for this property.

Lthaca Lane, stated they had nothing to object to -regarding the
rezoning but were concerned over what would be developed on the
so-rthern -:nd. of the property. Cottrdssioner Hagen pointed out
some of the protecti re requirements of the L-1 district. Mfr
t% stated he couldn't, guaxantee hoer long the house located
on the property would remain,. but that hiss long-range intent
is to have something compatible with both the residential. and
I-1 area.,

A Motion for Action was made by Comadssioner Igen, second by MOTION FOR ACrI(XN
Conn ssloner Roth. Motion passed 3-0 ivith Corm assigner Chapimn
abstaining.

A Public Hearing was held to consider approval of a Preliminary BF AR WILDERS, LNC.
Plat for Belmar Builders, Ihr for a planned industrial park
of Lppro)dmately 30.5 acres located on the east side of Fern- Preliminary Plat
b ook Lane north of county Road 6.
The Public i*ari-ng was opened at 8:57 p.m. PUBLIC HEAR.LNG OPENED
Plamier,Overhiser pointed out that Pernbrook bane is a major
h(iroughfare, and the intent of the staff recommendations is
to limit the access points to this street.
George Mastny presented the Preliminary Plat to the Comm3:ssion
ar.a showed them the 4 proposed buildings at the northern end
of the property. He indi.catf>' the remainder of the property
would be developed in much t~- same iamy.
There followed much discussion regarding the access points to
rernbrook and th : alternate I-) an proposed Ly the staff which
would limit the: access points to 2 onto Fernbrook witli, a north -
south street running through the cep.ter of the property. There
was concern over access into the Sevey property inview of the
razvp proposed for the 1-494/County Road 6 intersection. Richard,
Anderson of Delmar Mated he felt it would not be economically
feasible to consider any other plan but that which they presented.
The Public Hearing was closed at 9:25 p.m. PUBLIC FMARZG CLOS

Roth, to ~recommend denial of the rezoning beciT se any- type
multiple development should. have its access onto a major or ACTION
minor thoroughfare and not a neighborhood street, the density
of the project is not in keeping with the surrounding area,
and viewed from, the: north. or south. end of tea pond the viewer
would see about 450 feet of solid wall.. ,4ich is poor planning.
Comzissioner Keeley pointecl out that because of the nature of
the land about 5 single family homes could bo constructed on
the: site. He felt it wotild be: fetter to grouT these units on
as little land as pons-ibl:e to preserve trees Ile- stated, he was
in favor of the proposal; as revised by -the petition of the area
homeowners.
Cott ssioner Chan stated ,e felt this was a very good area
of single fancily homes and shotad be left as such. Commis-
sioner Reith pointed out that the transition area between the
nxtltiple and single family area 'had been accomplished in, the
Schi.ebe development and lie felt there should not be a multiple
development here. Planner Qverhiser stated he fe:i.t the concept
of transferrable density was a favorable idea and should be
considered here.

silos were mc)ved further back ;from the residential lots and
screened by a rmber of trees. They discussed the possibilityity
of moving the silos to the other side of the building and pump-
ing the materials. Mr. Roby indicated he would be interested in
this alternative and would ibzvestigate and report back to the
cc-vassionJ

recoimtendations made at the March 10 Planning Cm fission meet-- .Revised General Develop-
ing had been met with the exception of one unix': which: was only ment Plan.

of condominiums in the 4th .Addition which would be presented, to
the Planning Cotmission on a Preliminary Plat at a, latex date.
Ile advised them that the: "Village Brigineer had requested that the

W. Hagen also -requested Preliminary Plat approial for the 30 unit
condominium project west of the creek in Block 12. He explained
the plans for the 5 six -unit buildings.

Yxoskin, to recoviwnd approval of the Preliminary Plat for
Chelsea. Woods Condominium 1st Addition (30 units west of the
creek and: north of 18th Avenue) subject to staff review and. Condominium lst Addition
approval. Motion passed 3-1 with Commissioner Kroskin opposing.
A-333 Metro Development Corporation-Mburon'' L—A-
Jim Parker presented the Final Plat to the Planning Camnission. MMO DMLOP1mwr CORP.
He explained that the changes had been made as recommended by
the Council and the number of units reduced from 273 to 215.
Ail, agreed that if the Council does approve the Preliminary
Plat on April 17, the Final Plat will be on A e Planning Coni
mission agenda for the 19th.

Richard Cox of M.I.P. presented the site plan to the Coriols- M SOF
sioners and explained that because the petitioner was required
to move from his present site because of the new General Hospi-
tal,, they were most =ious to get site plan approval and start
construction as, soon as possible. The site location had just
been changed, and,*,. Cox presented the alternate site plan.
