The. Peetitioner is requesting that the tract of Land north of QUALITY T MES, INC.
County Road 9 and East of Zachary mane that was bought and de

for the Sagainore Apartment project be ncr4 divided into Subdivis on Variance
Tracts A, B, C, D and E. Tract A would be used for a to;qhouse
development for which the Preliminary Plat has been submitted.
Tract 8 would consist of the Sagamore .Apartment project which
Prudential Insurance: has purchased. Tract C would be deeded to
Fred Mengelkoch for access to the street (Tract E)Tract Il
would be reserved. for County Road 18 right of way to be taken
at some future date. Tract F is the street that is platted
around the Sagamore Apartment project and on the north side
ivov,1,1 extend to the west along the school property and connect
wa Mary Vane. Jim Parker _appeared on behalf of the Peti-
tion, and explained 'that their primary reason for this request
was for tax purposes
Atr. Parker was questioned regarding the northerly botmdary line
of Tract E. He explained that, it.did not extend to the property ,
line because at the time of platting it was undecided where the
road would extend. He also explained that a triangular piece of
land in the northwesterly corner of Tract 13 had been retained by
tality Homes because of the park dedication requirements. It
was the recommendation of tape staff that this matter to left to
the Council and Managev.

The Petitioner is requesting that his piece of property on the WIREXE J. IALlBERTh
south side or 2Sth Avenue between West Medichle Lake Drive and
Nklddicine Lake be divided :into two tracts. Tract A contains his Subdivision Variance
residence (25,89S square feet) and Tract 1 ww10 ')e a long, nay'-
rw strip not containing any buildings (35,864 square i' -et). Wry
LaLiberte explained. that his reason for subdividing the land was
for the future selling of Tract B and also tai, purposes bec.,iuse
of the long frontage on the street.
Planner Overhiser indicated that it was the canceru of the staff
that Tract B not be a buildable lot until some additional land
is purchased.
Tlie Commissioners discussed the possible consequences of recon
mending that no building be permitted on Tract B until the Village
Attorney has reviet md the matter. The Planner was ins eructed to
have the Village Attorney review this request prior to the Plan-
ning Commission recommendation.

of Ban Con, Inc. Chairman Kahl explained that at the Committee
meting of March S, 1972 they had reviewed this plan and had re-
cormnennded approval of same subject to certain. conditions.. The
Camidssioners wished to see 35 foot setbacks of the major struc-
tures from the north -south collector street and 100 ;Foot setbacks
of the major structures north of the new Cokrity Road 6 right of
way maintained. Mr. liagen, indicated this could probably be ac-
complishedshed with little ds.fficulty. The Commissioners desired
that the driveways on the west side of the collector for the pati
homes be grouped so that three units use one driveway. Mr. 0a en

There followed discussion regarding the b lots on the north side
of Mapledel,l, which would be track to hack on streets if 315t
Avenue eras: left as it presently is platted. It was agreed: that
these, lots should be protected idth :some sort of buffer to the
north. Mr. Hagen indicated he would prefer to move 31st Avenue
to the. north of the church because of the nature of the soil and
stated that they were in a position to dedicate good green space
to the east of the church so that a Use other than single family
could be developed for resat of the lard.
Tiny .Vann and Glen Booker irho live in Mapledell appeared and re-
lated a statement made by Rev, aas that he would. prefer to be on
Dunkirk and. Medina Road and expressed concern that 'INledina Road

It was agreed that the General Development Plan should be as close
to what the Planning Commission desires to see as possible before

Village, and it is incumbent upon the Village to solve the prob-

Planner Overhiser reviewed the recommiendati,ons of the Village
Attorney relative to the proposed amendments to the sign regu-
lations, previously, sppwved by the Planning Commission, and the
following action was taken:
Motion by Commissioner Kroskin second by Commissioner Keeley,
to <unond Sectioxx 17, Subdivision 1., paragraph 1-a, by striking
unless attractively grouped with other directional signs".

amend Section 4 by redefining the. term "Si.gnv Temporary'' asfollows,, "A sign .erected or placed on private property for a

Motion by Commissioner Keeley, second by Commissioner Hagen, to
mend Section 19, Subdivision 2, paragraph 1-b to -read. "Sign
Regulations. Provided that no such variance may be granted contrarytothe, provisions and requirements of the lfinnesota Outdoor `4,ver-

granted to permit signs' in districts or locations uhere such signs

It was also agreed that the problem of an amortization period for
the ;removal of non -conforming signs should be referred to the
Village Attorney for an opinion as to the length of time.
