A Public Hearing was 'hold to consider approval of a Preliminary WSaIAN INVESDT NT, CO.
Flat for Hussman Investment Company. The proposal is a replat
of Lot 28 and the north half of Lot 79 of Paracers Lakeside Preliminary flat
Acres ,Addition located ori the oast side of Ranchvieut Lane be-
t:veen 7th Avenue and 9th Avenue extending east past Quantico
L.ae. Tho proposal would create seven building lots for single
family detached dwellings.
The Public Hearing was opened at 7:45 p. , PU .LIC IMARING OPENED
Planner Overhiser presented the proposed plat to the Coninis-
si.oaers and explained that four logs would face R chvieiq Lane
and the other three on a cul -do -sac at the end of Quantico Lane.
He explained that there was a 30 root street easement along the
south side of proposed lets 4 Pad 5 and :hat the staff was -
recom-mending, this not be :used for street purp4 ae- but retained by the
Village as a utility case?nent
Jim Connor appeared on behalf of the .petitioners.
Paul Fox, 710 Ranchvim, Lane, appeared and expressed concern re-
garding the 30 foot easement urhich runs along, his property line.
He concurred with the staff recommendation,

dente) to R-3 (NIU .tipie ,pat; ly Residence --Townhouse) for 4,8 Rezoning R-1 to R-3
acres of land located on the north side of County Road 15 west
of Pineview Drive and east of Vinewood Laney
The Public Hearing was opened at 8.02 p.m. PUBLIC HEMUNG OP,! lWEl
Planner Overhiser indicated the proposal 7,tas for 20 townhouse
units to. be constructed on approximatcOy 3..2 acres of buildable
land, (about l.6 acres of the total. 4.8 acre, site is p;,r;d) for a
density of 6.3 units per acre on the buildable portion and 4.

Appearing on behalf of the Petitioners was Jim Hirsch, repre-
senting Roy Busse, and Bob Leslie, who prepared the site plan,
Mr. Hirsch expl :hied that there would be private ownership of the
tow houses with common ownership of the surroutndizng land. Ile
felt the conn or4nership of the Lakeshore would be an edvarn-
tage as it would preserve it in its natural state. lie explained
the units would all be either one or two bedroom clmAlings in the
30,000 to $32,000 price, range .which he felt would direct f1e,
marl et toward the type of people who would be a credit to; the
COMMMity.
W. Leslie explained their main concern was to develop the, entire
area totally because of the difficult topography of the parcel
and their concern over preserving the lake shore in its present
state. Ile 'explained the drop from the building Level to the late
shore level is 30 feet at the maxzmun and that they would change
the topography very little in the building area but would make
no changes in the lake shore area,
Bill Snyder, 405 h. Pireview Sane opposed this spot zoning in a MONEWS
single family area. He ,felt there is ample R-3 land available in
the Village so that it is unnecessary to rezone P-1 Land to con-
struct towrolouses
Mr. and Mrs. Dale Berndt told the Conani;'sioners they have just
bought a parcel act j acent to this property and plan to build a
home: in the Spring. They felt the project would devalue their
property and that tl,e development would be at the expense of
the other homeowners 1r, the area.
Dale Hagen, 225 Pi,nevi:ew- Lane; J. J. Cavanaugh, who owns the
property to the west of the project; and Iliggo 1, Dietz, 216
Pinevview Lane, all expressed their desire: to see the area re-
main zoned single family.
Mr. TUrsch cited examples to the Commissioners of other con- REBUITAL

Connissioner Hagen sited the Village guide plan which calls ROY BUSSE MARRY SEN
for ,medium density developments such as, this to be placed be-
tweQn areas of Fingl,e family dwellings and areas of more intense
use:. This. proposal is in the midst of a single family area
Towffl ouses maxed in with single family dwellings ars possible
in. planned unit developments but is not in Roeping tilth the
present neighborhood,
CoiTmisslone°r Threi.nen said he felt County Roed 15 was not the
kind of road conducive to heavier density usage,
Commissioner Roth stated he felt tliss was simply, a case of spot
zoning.

Richard Dindborg, Vice .President of Bel -Mar Builders explained t,onditional U e Pei t

Commissioner Roth asked if there was a time schedule on the
ex[XaSion phases. Mr. Pirsch :indicated that if market pro
gcti.ons are correct they will be expanding to phase II within

Conmissioner Keeley questioned what would happen in the event
the Jure l deadline was not met,,, Mr. Pirsch indicated the dead-
line was actually June 26 and that they had the alternative of
extending the lease at their present site in New 136pe ars a viontli
to month basis. however,, it was most important to them pro-
duction schedule to be in operation by this date.
Conmissioner Keeley questioned if the .land behind this site would
be buildable.- Mr. Schoening of the Eberhart Company explained
that a 60 foot strip has been Feld out on the south side of this
proraerty by M. I.P. so that they can extend the frontage road if -
des fired.
ti_.1 Montgomery explained that there were tvo parcels of laud
involved. Phase I would be built on the first parcel, and
Phase II and. 111 on the second. The first -floor will be approxi-
mately 3 feet below 1enlum Lane because of the. cut and fill expense
problem. The basic construction materialwKi.11 be masonery with
curtain wall across the off -ice section.
There followed discussion regarding the parking requirements and
parking within the set -back areas. It was determined this would
not require a variance in this case. Planner Over}riser explained
that the parking requirements for Phase I are for 252 stalls which
Latton feels is more t ion, they will need.
Motion made by Commissioner Hagen, seconded by Commissioner NX)TION' TO RE -M&M
to recommend. approval: of the Conditional Use Permit and final

site plan, this approval to include a variance on the number of APPROVAL
parking stalls they would have to have now to allow for more
landscaping in front of the building. It was agreed parking
could be reduced by 50 stalls.. Motion passed 4-0 Commis-
sioner Aroskin abstained on this subject.

access is provided.

Roth, to recommend approval of the subdivision variance as sub- APPROVAL
mitted subject to three conditions
1. 'Fiat 27 feet along Mate highway 101 be deeded to the
Village for street right-of-gray.
That the owner deed to the Village their right of access
to Highway 101 which shall continue until other public
access is provided to the two now bots..
i. That neje dwellings be connected to public sewer and
stater at the ownc4r's expense.
Motion passed. 5-0

It was determined that Mrs. Broman would be the only operator,
and she did not feel that there would be any parking problems
p=ause of the fact that her business Mould be on an appointment
basis and it"was unlikely there would be more than one or two
cars at a given time,

r Planner Overhiser reviewed the minutes of the 12-1-71. meeting SUPER VALU SPORES,
INC. and the 8 recommendations made by the Planning Comtiission
to the Petitioner. )Me indicated the Petitioner had complied with Final Site .Plan
Approval all items except for #1 - "no access to `Merrimac Lane from
the commercial
center". Commissioner Keeley called to th4 Planning Coimnission'
satten- tion condition #5 regarding sanitary sewer, water and
storm sewer plans. Ile indicated the storm run-off would run into

lines to ,store storm run-off, I* said he would like to see no
building roemits granted until the stonn sewer is available or
in the process. Planner O+erhiser indicated a public hearing

Commissioner Hagen fidesToned if we could legally tie up develop-
amnt in this manner. it was the consensus of the Commissioners
that it was far the public's protection,
Commissioner Keeley asked why the left turn lane requested by
the Planning Commission on 1201071 did not appear on the site
plan.: Planner Overhiser indicated, a street improvement project
has leen proposed at highway 101 and County Road 6 tvhicln wouxd
widen the h ghways to four Lanes each.
Commissioner Keeley read to the Commissioners a letter received
from. R. W Johnson, President of the Oakwood ITomeow ers Associ-
ation expressing their opposition totthe proposed construction
in this. area. (See Exhibit A, on file) Commissioner Keeley
asked fir. Johnson if they were referring to 5chi,ebe Is Oaku,,00d in
addition, to tine Super Valu and Continental Contractors projects.
Mr,, Johnson replied `'yes".
Comm ssicaer Keeley stated his recommcndatioa would be that the
access to Merrimac Lane, be closed and that the berm shown: on the
Continental Contractors plan be extended down into the Super Valu
site. Mr. Loomis stated they felt this access was necessary for
the convenience and safety of their customers so that they would
not be required to make a left turn- off of Highway 101. It was
the feeling of the Coxfmussi,oners that it wo:ald be impossible to
stop trucks from using this access and that it should be closed.

Commissioner flagen pointed out that this area was zoned commercial
when these homes were built. Cotmnissioner Kroskin added that the

dential districts should be protected from such traffic
