Wahl at 1,30 p.m* in the Council Char6ers of the Public Works Building on Wednesday, November 3, 197t. ROVING S.W corners PRELIMSMARX PIAT Pleiiaer Overhiser explained that the petitioner was submitting a DISCUSSION second preliminary `plat because he does not want to proceed with the first one presented. Motion made by Commissioner Neils, second by Commissioner Keeley,, MOTIOR to continue the public hearing until such time as further infornra; tion. is provided regardi:f g :the possible subdivision,of lots and the problem of access to them and the psrk problem is resolved. USE PERMIT Highway 55 Planner Gverhise: stated: that at the October 6, 1971 meeting the Plann- Ing Plann- ingCommission recommended that a public hearing be held on this peti- tion and that property owners, iii the area be notified., Tbere -was a general discussion regarding the following, DISCUSSION 1, Tha access drive into the range --rhe Commission agreed that from a ;safety standpoint,, this driveway should be moved as far south from. Highway 55 as possible, 2. Protective fencing --some type of protection should, be provided .dor the greenhouses to the south and Highway SS, to the north. Mr. Leonard Busch, owner of the p;,operty to the south on which tbe; green- houses are located, stated he was concerned about possible damage to his greenhouses. He would like to see a fence between the driving range and the greenhouses. Mr. Hughes described the baffles he would be constructing on etch side of every tee to prevent balls from slicing. Notion made by Commissioner Keeley; iecond by commissioner Neils, to MOTION approve the pet:iti oner's request subject to two conditions; 1. That the driveway access be where the existing driveway for the residency: is now located, 2, That Mr.. Hughes and Mr,. Busch reach an agreement regard- ing proper baffling to. protect the greenhouses and liability* for damage to the greenhouses. District require site plan approval by the Planning Commission and Council. There was a general discussion regarding aesthetics and the height of the structure. Motion made by Commissioner Seeley, second by Commissioner Kroskia, MOTION to approve the site plan for the sawdust bin, but that no building I permit be issued prior to evidence of approval for the intended use sy :the Pollution Control. Agency. Motion passed 4-0 with Commissioner Roth abstaining. commissioner Roth abstained vainly because he wanted sone direction regarding aesthetics from Oe Council as to requests of this type, A-224 Subdivision Waiver - ,Zata Properties and Hasty Property Mrsch BrotherA Site flan - Steve Lisle Rezoning also involved) Planner Overhiser gave a brief explanation of the request for the sub- A-.24 division waiver for property located at 17210 County Road G into two SUBDIVISION WAIVER parcels: Ho stated; further that the Hirsch Brothers site plan which IATA PROPERTIES has been approved for the entire site Mould have to be revised and HASTY PROPERTY submitted for approval before any development could begin. Mr. and lairs. Merrill Hasty, 1310 Highway 101, Wayzata, have contacted the: Village and are in favor of having the property divided as they earn :the house on Parcel.A and wish to retain ownership of that Parcel. Attorney Lefler was contacted regarding this matter and he is rec- ommending that it be approved. Approval of this request would auto- matically void the Hirsch Brothers, site plan 'because the site plata was contingent upon the house being removed. There was much dis- cussion, regarding the following: 1, The legality of granting the subdivision waiver and re- zoning Parcel Aback to R-1 from R-4. 2. The, legality of granting the subdivision waiver and re- zoning both Parcels A and B back to R-1 from R-4. Motion made by Commissioner Neils, second by Commissioner Keeley, that the Planning Commission recommend :to the Council that the Conditional: Use Permit and General Development Plan approval for Parcels A and B in the Dame of Hirsch Brothers for a Community Unit Project be rescinded.. 'Motion.passed 5-0. MOTION RE KIRSCH BROTHERS SITE PLAN Motion made by Commissioner Neils, second by Commissioner Keeley, MOTION RE SUBDIVISI that the Planning,Commission defer action on the subdivision waiver. 14AIVER - TO DEFER until the Village Attorney gives the Planning Commission advice as ACTION to whether we can legally recommend having.the rezoning revert to; R-1 from R-4 on Parcels A. and/or B, Motion passed 5-0. W Planning Commission Minutes -4- November 3 1971 The Planning Commission also requested that they be giverx complote back round information, on; the rezoning, site plan,: subdivision waiver and any other pertinent information related to thit petition before their next meeting on, this petition. Shaughnessy -.Preliminary-Plat Wood Creek Addition; Planner Overhiser reported that the Council, at their November 1, 1971 4-305 meeting referred the preliminary plat back: to the `Planning Commission S'14AUGHNESSY as they wanted to see only one access. to East Medicine Bake Blvd, dere 1?R - LIMINARY PLA`. also: recommending that. the Village pick up right to the shoreline on WOOD CREEK ADDITION' the Lake znr*diately and lease the required space Zor a dock to Mr. Shaughnessy, and they did not feel that pedestrian wallmays through the plat we; e :necessary. Th;are was mich discussion regarding the relative merits of the DISCUSSED two alternative plans submitted and the original plan which had been referred to the Council. Motion mmade by Commis woner Keeley,,' second by Commissioner Xroskin: MOTION to send back to the Council the original preliminary plat as approved by the Planning Commission on October 20, 1971 and subject to the condttious listed at that time. Motion passed 5..0., Chairman Wahl btated that of the proposals shown to the Planning PUNNING COMISSI0i Commission, the Planning Commission prefers the preliminaty plat .as PREFERS ORIGUAL originally submitted to the Council.. Planner Overhisor requested PLAN that Mr. Shaughnessy submit copies of the two proposals for the Council to review. thoroughfare Guide Plan Planner Overhiser 's memo of November .2, 1971 on the Thoroughf gre THOROUGHFARE Guide Plan was ,passed out to the Commissioner's. Af ter .ditscus.sing the memo, it was the corse-a4us of the Cotrpission that they would like to meet with the, State, County, Consultants oad Staff regarding the recommendations for two interchanges on State Highway 55 awost of I-494.
