The reason for denial was that it REASON FOR DENIAL was felt tris did not fit the definition of ''home occupation" as stated in the Zoning Ordl4iance. Planner Oyerhisera Gave a brie£ descriptim of the area involved.; lie also stated that all staff reports were not in because of the relationship of the proposed plat involved to the surrounding area._ Prank Burgs Caswell-rngineering, gave the presentation for the petitioner: There are approximately 100 acres involved in the plat, and they are proposing to plat 200 residential lots for the area. Consultant Bergly Gave a brief description of thee area involved and stated that the proponent for this guide plan change fi was the Village of Plymouth. The Central Area Guide Plain as it r ow e sts was adopted by the Village Council in June, 1969 xa l was revised in January, 1970. The reasoiis for amending and tx— i:fying the present plan are: I. The Village had several re(riests before the Planning Commission for rezoning which weren't consistent with the best use of the land as it exists today, t, A.study of the topography was made. The basic factor in the guiding was a very steep slope ranging from a. 110 ft. high to a low down by 1-494, 3. The heavy traffic on 1-494 and County road . Mr. Pilgrim's major port was that he didn't feel the proposed single family guide plan for that area was suitable. Majer'reasons stated were: 1. Noise pollution 2. Odor pollution 3. High traffic volume on 1-494 4. Thigh transmission pines S., Types of industry already in the. area Mr.. pilgrim also pointed out that the residential guided for this area would be the only one along a four -mile stretdi of free- way, and he .could not see the reasoning behind at. Ile also felt thzit #,he permanent opel space which would buffer the industrial between f-494 and' the proposed residential area was unjustified, This was too large an area to make it "permanent." There also was no buffer proposed in the area immediately south of the fijan's property. His contention is that single family resi- dential around the areas of the open space- and single family below the open, space would make single'£amily residential develop-- meat very costly. Open space is a natural barrier, Would like to see single family changed to either industrial or high density. Original guide plan was for decision mank g by people ingesting in, property, and the people have to be able to rely on it to a certain extent. Open space --stated it was designated as permanent and necessary, at the present time, but questions whether it should - be permanent. Feeling is very strong that what is planned for the area is not right. kVhatever zoning is planned should be carried through to the bottom part which is owned by his clients. Zelti.n's property has never beeTt on a purehase agreement --it_ was a firm p`k.rchase. Roth property is on option.,Also checked the diamond interchange proposed for 49th .Avenue North and 1-494 ons found the State highway .Departat =nt has no plans -for the tuture for this interchange. ltjre is a questionas to whether this intersection is oven a safe orae --in particular in regards to distance from the one on County Road 9. Understands the logic behind the reason for changing the Guide Flan, but what was published is what was given to the general public. This plan shot}s most of the area as being guided. The proposed changes are inconsistent with ;the coimwnity goals. Doesn't know of anyone who 'has opposed the plan as it was first guided. Fels that the circulation plan does not 'take into oon- sideration the property Lines and cuts off several comers of property. :If it is guided residential, then we will not see the ,area ieveloped. Developers will not speculate on any area where there is noise or odor pollution. Mr. Dcwden read a portion from lReport, #4 on the industrial stud*, Chairman; Wahlls Pointed out, that this is not a rezoning hearing, but only a, hearing on,a guide plan. The Village will continue to prowte indus trial dev6xopments and business in the Village. Com. Keeley Reason this comer ,came up was because of tw;o rezoning applica- tions before. They did several things when the petition was circulated --his letter, was looked at and people were asked whether they',were in favor or opposed. They were looking for proponents and opponents. Tile density they woad propose for the area would be roughly 3-4 units per acro.
