Commissioner Chapman said that he talked with ahief ilawkinson, and

it would appear from the committee report. that they are ready for a
motion with several things attached to them. fie asked. the Commission
if they fetal that they should restrict the 100 feet and even with
100 feet that their only method of construction would be with a
slope.. Mfr. McCombs said that the developers plan to work to the
west, so this would be the last biailding which would be built.
Coxnrnissioner Chapman said that the llighway Department has not
drawn, up a plan, for the interchalige in the Village yet, and that
is the reason he would be in favor of the 300 feet.,
planner Bergly said that the iiighiay Department is working on
some type of final interchange plans in that area and maybe with-
in a year they will have some firm reconmendations for that
area. Comissioner June a.s?-,ed the developers if they would lie
opposed to having them restrict the building. Chairman lagan:
Mated that basically Bance we rezone the area that the Contmi.ssion
is adopting this site plan.
Commissioner hroskin. asked if all the items were taken care of
which were denied in Ilay. Commissioner Chapman: telt with this
new plan and the recoimnendations which would be placed 'upon it
all the points would be taken care of
Planner Bergly brought uta the idea `that a collector street could
be dedicated to tie the areas together; arid: Commissioner Prekker
said. that he was not in favor of this.
Commissioner prekker made a: motion to move recommendation for . MION
approval. of :the zoning subject to the stdpuiation of Planner
DQ,rgly oil the site plana and the stipulation that the accesses
as proposed, by followed. This 'was seconded by Commissioner
lune. The last item in Planner Bergly's recommendations was
amended to make the recommendations read as follows:

The first item of business wa.5 the committee report which 1xaS Imo; Comittee
referred to the zoning comrittee for report at the last meeting Report or.

Commissioner Chapman reported that it was wtq possible to drive
through the parkiiTg lots and that the accesses on 111ghvay SS

that they get a service drive up to County Road ''.i and the
Village initiate some action to have the State put up a signal.
It was explained that a signal would take at least a year to
put in. Ile said that as far as the site plan goes that every-
thing was on it and the developer feels that they would like to
got the zoning wi,tl. a preliminary site plan and it was the
Comittee's feeling that their site plana are such that they
would be acceptable with the application for building permits;
CoTtut issioner Frekl+er Said that they have looked at different
ways to let the traffic go between County Road ##15 and CotmtyRoad #6 sand they felt that none of these could be clone until
Highway #t55 would be upgraded. Planner Bergly said that he
has reviewed the site plan with conformance of the ordinance ,
and it meets all requirements, The plan is very much like what
t7aey want to develop and at this time it is not encu because
they mast do some study but this is basically the layout that
they w ald like to accomplish. He said that they have reserved
a triangular piece of Viand parallel to highway 55 for interchange
purposes if needed.
Commissioner dune asked if they are out far enough and. Planner
Bergly said that this is loth' but this is built into the very
bottom of a, slope and they could see some problems possibly dc -
pending upon the construction that would take place,
Co=ussionex Prekker said that the Highway llcpaxtarent said the
100 feet was adequate for normal slope easements_, Commissioner
Chapman said ghat they have a site plan which is what they
wanted and if something should happen, he felt that this plan

Pollowing the provision of Subdivision 6 & 8, Section 10 a.ild
further.
1. Specific locations of buildings determined by:
topography
b. soil boring
c, tree locations
d. relationship to homes to south
2. Detailed landscaping plan related to above items
3. Coordination of District 5, Highway Depwrtimat plans
for improvement of 55
4. The Village passing resolution requesting; the Highway
Department to study Highway SS regarding signalization
at Comity Road o considering; the impact of this project
t,nd M.I.P. "Plymouth Heights," chaiinelization, turn,
Innes, stacking space, service droves, etc.
S. Ponding areas be provided in areas where appropriate
to be shaven on detailed site plan
Via., `lliat no building permits be issued for the westerly
300 feet unit it has been conclusively_indicated by
the Village and Highway Department tbat an interchange
will not be neoded or constructed in the area indicated
or the central guide plan as adopted. After 12 months
the developer may petition to the Planning Commission
and Council icor a waiver of this provision.
IMP motion was voted upon. and Com issiorer KrosYln opposed while
the rest voted. in ;Favor of the motion, The motion was carried.
The next item of business ivas a subdivision va.i.vear for Allen RE: Subdivision
S :ensrud. Planner Bergly said that he wanted 2 acres "or building Waiver for
a house) and that is what he wanted, to do. The Cor=;,'ssion discussed Allen
tiis and Planner Bergly showed how this area of 4.8 acres could be Stensrud
laid out to get the ultimate use of this lot,
Commissioner Prekkcr moved that we recommend approval of the U)TIO
ubdivision waiver per Planner Bergly'5 recommendation and
subject to proper location of the home. Commissioner Chapman
seconded the motion, The motion was voted upon and Commissioner ,
Tune opposed the motion while the rest: voted ;n favor of the
Lotion, The motion vias carried.
The next item of business was a subdivision waiver for "fr. U., Subdivision
Cradzen's on property located at 5950 Dunkirk Lane and County Waiver for
Road 47. Plannor Bergly said that there were 3 1/2 acres kir. Gradzens
involvee and the owner proposed to divide it into 3 lots,
This has been to the Council and sent back to the Planning
Coaanis.don for recommendation and relationship to future
subdivision patterns. Commissioner June asked what the reason
rtes fox- dividing it this way, and it was explained because
w of the slope. It was stated: that he would be selling mots
C and A. Planner Bergly said that they are one acre lots and
in the, future they will likely want to divide the lots.
Mai.rman Egan said that this subdivision would not be grawced
unless there was a way to make these half acre lots,

Commissioner Pollock made a motion moving that the Village Planner VON
relay to the applicant to resubmit a proposed prelim"nary plat
at a scale sufficient (V -- 11) to determine if the lot it
division is feeszbl.e« 11xis should corse bark to the Planning
Commission before it goes onto the Council- 1110 motion was
seconded by Commissioner Chapman. .x.11 were in favor of the
motion. The motion was carried.,
Tho next item of business was to study tAe ordinance relative RE., Study
to Single family residential garages. It was e ?lamed that Ordix=ce
some people Were opposed because they feel that this wasn't Regardingcompatiblefortheresidentailarea, Commissioner June Single gamily
felt that they should look into this glove. Ile said that ReS• Garages
they would have to recommend that the building code would
be changed.
Comissi.oner Pollock stated that no conditional use permit
could be used for this type of request, and that the only way
he felt that this }could be controlled would be with a, variance
to come before the Planning Commission, Ile also suggested
that they could: bring it funder some type. of conditional use
procedure for a peri

Commissioner Roth asked about the 2 acres maximum. :Ft was stated
that there is distinction betweenquitea the retail neighboa.4aad
store and a shopping center, Commissioner Pollock said that at
different times developers harm Wanted small shopping centers
but they did not permit them in a B-3 or B-4 because these
districts allow too many other undesirable uses, planner Bergly
suggested haat they have a conditional: use to allow small
convenience center of less than 5 acres in the 13--2 and 13--3
districts.
C.omnxissioner Pollock made a motion to move_ that we ask the ,„ .. MTION
Village attorney to draft an amendment to the zoning ordinance
allowing as condi.ti.onal uses in the B-3 zoning off -sale
liquor stores and convenience food stores being less than
2,500 square feet in floor area. The motion was seconded by
Commissioner Prqkker. Six voted an favor of the motion

ordinance should be held at the January 6th meeting, seconded
by Commissioner Pollock. AIII in favor of the motion
Commissioner Polloc moved to direct the Planner to suggest
some working to ame;id the B-2 shopping center business
district to allow ratail facilities on less t`1an 5 acres as
a conditional, use and furthermore, that criteria be suggested
for+king these determinations when those situations arise.
1jxe are going to have to have some criteria or guide lines as

will be coming in and asking for the less than S acres. Ne
