A regular meting of the Planili ng Commission was called to ordor
by Acting C;naiirmanol.locic at 't 5µp.m. on October 21 1970 in
the Plymouth Public Works Rxilding.

The first itont of business was a public hearing on petition of Rh John R. John 1. Boyer and Dale 11, Kennedy to change the zoning from Boyer & Dake R. R-1 to R-2 on lots G and Ii R.L.S. No. 743, gerwrally Located Kennedy Rezoninginthevicinity, of lath Avenue and Rosewood Avenue.
Ille public hearing was opened at 8:00 p.m. C.ha r&xa Egan read
the legal notice from the paper. Planner ldrgly pointed out
the location of the proposal. Ile said Lha:t the site n,;as east'
of Rosewnod Avenge and he stated that the proposal is for two
double bungalos to be buil:. qtr. Kennedys was tIv.-n asked to
speak representing this rezoning. Mr. Kennedy showed. the
C'ommissiOn the new petition which was signed by the people in
the neighborhood showing that they no longer were opposed to
zoning and the construction oftwo ioutnle bungalos., Ile
stated that all, the families sa:gnoc this petition that had
previously opposed the rezoning with one exception.
Commissioner Neils asked if they had any specific buildingPlansdrawn. There were no spe,7ific plans. Commissioner
ProkRer questioned the drainage go!-,ag throli,gh the area. Planner
ergl.y explained that about halfway track there is a catch basin
which controls the level of 'tire pond located immediately south
of the catc1i basun. Ile also said that the house would be placed iinfrontofthis. ComUssioner 14afaer asked if sewer Was
availabl- and this vas answered by Mr. Kennedy to be yes it is
available:_
Mai ritain ,ligan then" asked for any more questions by people in
favor of the proposal and then for any questions by people a-
gainst this proposal. ` Questions were then asRed by the members
of the Comr ussioxn.
Corinissioner Neils asked if there would be any redavision of the
lots. It was explained that a variance could be applied for as
lot '#,Ifs is 100 feet wide, (10 feet less than the minimum, re - i quirement)

The next item of business was the new site plan for the
location of the garages in the .Fox Meadows area. Air. T
Teigen was at the mo;eting to represent Belmar Builders.
It was explained that the special committee which was formed
at the October 21., 1970 meeting of the Planning Cviinission
met to discuss this; subject. Each item was discussed item
by itemm and recommendations were made as following:
1, All the long garages have been split, providing :a.six
foot walking space between each pair. These wallavays
are .acceptable if they are lighted, This opinion was
confirmed by Chief Hawkinson.
2. A garage has been relocated to the front ;rard and
enlarged whish is acceptable, but, it must be moved
south for better access to 13uilding #7 and it must
be .adequately screened.
3. Thi: elimination of drives along the west side of the
garages is not acceptable and must be reinstated.
4. The elimination of garages along the north property lane
is not acceptable and should be reinstated to compensate
for the loss of .garages at the southern boundary (due to
the presence of a utility easement which was over looked
by the architect in the first puns,)
5. The el.ininatiDn of the open landscaped spaces along the
north property line and at the south end of the southeast
building is not acceptable p.d must be reinstated.
6, parking spaces along all circulation and access drives is
undesirable ,and should be eliminated at least at the two
principle access points.
7. The parking in fro=nt of the central budding h&s been re-
located to within 20' of the building, and tino circular
drive and open space at the main entrance have been Te -
placed by additional parking and a garbage stall. NeWier
of these changes is acceptable to the committee and it is
recommended that the former sit€ plan be adhered to.
Furthermore, your committee feels that gs.rbvge stalls are
not acceptable anywhere in the front yard.
8, Parking should be eliminated along south boundary :and all
garages in that area shifted south to provide at least 20
feet of yard space next to Building #2.

was stated that the item which brought this issue before the:
Planning Commission was the moving of the small garage to the
north end tothe interior of the front of the development rend
it being replaced by open parking.
Commissioner Neils felt that the parking they had per unit
Eas too much, and if any moving of the parking has to be
done that they should not cJlange the original parking plan but that

Bill Villi'eAls of 18135 13th Avenue North said lie has just build
a horse and when he built this he thoughtthat this area would
remain residential and he ;feels =that this would detract from
his home very muchand from those of othors. would 'like to see
the plan voted against or denied,
Mfrs Dale Oberg of 17610 13th Avenue Forth was concerned about
the amount of traffic that would be brought into the neighborhood
and she said that it is a peaceful neigliborhood and that she
would like to see it stay that way. Definitely not in favor o
this ,
W. Ken Welistrid said he would like to see this area remain
residential and see it closed as far as commercial goes
John Palmer of 1350 Rainier Lane INtorth felt that these was
a responsibility of other land owners to keep this area 'residential. Ile said he did not oklect- to the town houses or apartments, but
axe felt that Plain C would not fit into this area. Said he would
like to see Plan A.
Cobert Pearson of 17725 13th Avenue North supported the feeling
that -vie should have more green. space instead of blacktop and lie
was very concerned about the traTWO roblem; especially if the
residential streets were opened south.
Dave Johnson of 14000 Highway 101 said that he agrees with, what
has been said and he mould def .hely like to see this shoppiaxgcenterdenied.
Pearl 11asty said she was :also concerned about the traffic; that
this shopping center would cause
ChaiTman..Egan said wo should try and tie our thoughts together
so that. the .Commission can come up with a decision of what to do
with this.,
Dave Johnson said that they were very ma ch concerned about the
traffic and he said that the County does not have any plans for
upgrading the roads.
Mr. Hasty said he would Eike to see the residential left residential,
Curt Helber said he would like to urge the Planning Commission to
stick with Plan n, if the property has to be developed other than
siaigle family residential and he feels that Elan A is the most
desirable of the three plans. He also kod if all the existingshoppingcentershavebeentakenintoaccountarsthemarketsurveys
and this was answered to be yes.
Commissioner Hafner explained to the people the situation that
the Petitioner's ; were in and that. they 14-mted to make some use

of thelr laxnd which would pay for the price they had to pay for
it,, lie said any person would feel this same way.
Chairman, ligan asked for any more questions and Mr, Dougherty
said that as far as the traffic goes the roads will follow the I
need. He stated that if tine need arises that the money will be
there and the roads will be built,
Commi.ssio:ner Kroskan stated that this proposes has changed
considerably and there have been subsequent su-rvaysr that have
si1owed the needfor the shopping cdnterr. He asked approximately
how big an area does the shopping center talo:. ;fit was arimfered
to be 'b,etwoen 5 and to .acres. He also asked if the guide plan
of the Village was taken into consideration on this area.. He
asked if Planner Berg'ly had access to the actual market survey
made. The answer to this was no.
Commission Neils asked if fJiis plan accorits for the same
width of right of way as 101 considered nog to of this section.
JAsk:ed if the intention of the developers was to develop the R-
and n-5 under a community unit plan. He said that this would be
to Keep control of the project !and that would make it acceptable,
Caen ssioner Prekker asked where the lowest point of the land
nvas and asked if it would be possible to put into here a ponding
area to hold back some of the water.
Mr. Williams asked who paid for the survey and it was answered
that the developer does this himself.
Me public hearing was closed at 9;30 p.m.
Chairman Egan asked the members for quick comments on what type
of action should be taken. Commissioner June felt that there
are really -no Lincs shown as to where we want to tone for the
various categories. Commissioner Neils was concerned about
two things. l.. That the Ilerfurth property between the pond
and the townhouse area would become landlocked and 2 That
the community unit project provides at least 20%, local open -
pace and IM open -space available to the public. Wonald like
to see this clarified by the Village Attorney before we procede

It was answered to be rural agricultural which became R-0'
Commissioner .Kroskin said that after the ;first public hearing
on this site that the Commission decided that there was three
possible plans, and after they were developed, it was decided
that ,Phan A best fits the area.
Commissioner flafner said that the cbjection to Plan C is mainly
the amount of traffic. it was stated that the plans would

Chaam'm Egan stated that 101 and 6 have to be upgraded and also

Chairman pian asked the members of the Commission if they wanted

to take some action on this or if they Wished to study thissomemore. Commissioner Ifner said that the plan that the
developer brought in, does not satisfy overt Plan C and he moved
that; they recol«nend deniel of the rezonxnng. The motion, was
seconded by Conna ssioner Prekker. Chairman Egan said that
we r= xst think about the people who appeared tna opposition to
this andtheirconcern of what a shopping center would do
to this area. Comissioner June questioned whether we really
know enough about this to honestly vote against. it. Commissioner
Prekker also pointed out 'that they must be concerned about the
triangular piece of land next co the nom: a which would be
affected by the proposed developmeznt Also that the intersection
is ,a factor. The notion was voted upon and four were in favor
of the motion, two were against and tido abstained. The motion
was carried.
The neat item of business was a public hearing on petition of RF. Rezoning
the Village of Plymouth to change the zoning faint R-0 Open of Seven Ponds
Residence District'to - R-1 Single Family Residence district for to R-1,
all lots in the"Soven Ponds" -ubaivisson Located; south of
Cottzty Road 24 and ,rest of Dunkirk Lane. The public hearing
was opened at 10:05 p.m.
Planner Bergly explained thtwt this is soutiz of Cotmty Road
24, lie made tare point that the R -Q permits agricultural uses
that are .not: permitted in L'7 R-1 District. _ People may bpy
or may, have bought with the understanding that It is R,-0
and that certain things are permitted, ju that area. Ile
stated that they would like to hear what the people who are
involved in this area have to say.
John. Campbeil of C owity Roach 24 asked what is the advantage
of the Village to do this.Chairman Egan .sa.id than:. this is an
area, that is changing and what to do iswearetrying prevent
these people in the R,-1 from the problems of certain agricultural
uses,,

landscaping of the South side building facing the proposed apartment

rgly said that this would be taken care of because before the
occupant can get a certificate of occupancy be must be in compliance
with the ordinance. lie said that one problem was ,hog they were
going to handle the division of the lots directly to the west.,
Le,s mer said that ttie,, need a boundary division on Lots 4 & 10.
Chairman Egan asked about the additional landscaping of the building.
Gary Freund said haat the site will be ready for construction
within the next month: or so..
Wmn ssioner Pollock suggested that we, hale this off until the
next meettag so that they can present their landscaping plans for
approval,
Commissioner Prekker moved, Conmdssioi.er June seconded, to MOTIM
recommend approval., of the site plan subject to landscaping pl.<ns
to follow at the next meeting .of the Planning Commission and
subject to items x through 3 in planner Borgly's October 21st
report. Commissioner Kroski,n askeua when Ul e xnplotion date
was and this was answered to be about the middle of May or June
of 1971. The motion carried unananously.
Ilie next item, of business was a request for a height variance RE: Circle
for an office building in a - ` Service Business Area on Highway Star Business
55 near the Gauntry Kitchen. A variance is requested for the office Variance
third; floor of the building because only two floors are per-
mitted b a B-3 zone,
commissioner Nails moved, seconded by Commissioner ,Tune to MOTION
recommend a height variance as requested. The motion was
voted upon and 7 were in favor while Commissioner June
abstained. Ile motion was carried.

store and Tox Thum superette also located on Highway, 55 near the Store and Tam
Country Kitchen. 7iais aas requested for a p-3 zone. Thain
Planner Botgly said that these uses were not :lasted as permitted
uses by conditional use permit in a B-3 zone,

Chaim an. Egan asked if the members of' the Planning Commission saw
anything wrong with this olid said that our recoranr..ndation could be
tbht , it should be rezoned to B-4.
Commissioner Neils stated that he was wondering if this should be
rezoned or recommend that this use be put into a B_3 gone.
Chainwin Egan asked the members if they felt the proposed use
was satisfactory., Commissioner Pollock said we should have a
3-2 classification that would allow planned development o
retail structures on ;less than S acres,
Chairman Egan moved, Seconded by Commissioner Prekker to give MOTION
tenati:ve ,approval to the use that is proposed and since this does
not satisfy a 13-3 gone,, we recamnend that the property, be rezoizedtoB -Z and that the 5 acres bn waived. The motion was voted upon

Commissioner Pollock moved, seconded by Comniss~goner YrosRin, that

motion was carried by an all Ia favor vote.
The next item of business was a.site plan approval for relocating TM Relocatingagarageinthe "Fox Meadows" apartment ctmiplex located west of of garage in
pernbrook 11,ane and North of State Highway 53. Fox, Meadows
Mir, Tom ` a gei.i was at the meeting, to represent Balmar Builders,
lie said that they need 312 garages and garbage stalls, lie told
the Commission that they could not build where proposed because
of the water and storm sewer lines which interfere with the
building of these garages. Ile said that they must have the lines
placed: dere in order to extend over to the Cavanaugh Addition.
lie said that they must (incl a place toput the 20 stall garage. Ile
also said that some other changes were made in the plans because
of the ,great amount of peat which they ran into,
Commissioner Prekker stated that the parking was over the ordinance
requ-Jurenients and that instead of putting in more parking that
they should build less. buildings.

chance to meet with the projects engineers and discuss this further.

The next item of business was to discuss the thoroughfare plan for RR: Thoroughfare
the Joint Planning Commission - Council meeting :nn November 9th. Plan

to consider the following at the meeting. The first thing he
mentioned was,that there was much concern about County- Road 15
with the intersection of 494 and would like to point out that
we are having a safety problem, right .now as it travels west to
Wayzata. Second, the traffic travels alrng this too fast now and
ho children are not safe, there are too many cars going along
this road for a residential area. Ile suggested a solution to
this problem by relocating County Road 15 to the south of :its
present location.
Commisrioher Hainer stated that if we want any changes on this
road that ue will hwie to go through Zhe County.
Another man stated that he has called the County several, times
and they will give him no satisfactory answer as to what they
iiiI I do to County Road 15 He asked if they would widen this
and if they do he said that this would only cause the traffic
to M(,Ve faster.
Chairmn; lagan said that: this would be brought up for discussion
at the Council meeting; and: that all these factors would be
considered in the relocating of County Road 15,
The next item of business was to discuss the proposed revisions RR: "Plymouth
in the former "Plymouth heights" apartment proposal. by M.I.P. heights"Revision
located north of Highway 55 and west of Pineview Danes.
Ray Kirkman and Bruce Carlson sial that the donsity ibr the
south area is the same as before. They showed the plan to th
Commission and said they felt that this plan woul4 work out
very well.
Chairman Egan stated his concern about what can be dole T -r 1111 -
